I could only give you advance warning in our previous issue about school changes in the NEW School year. Junior schools open at 8.30am and will close at 2pm suiting families where one of the parents is not working in the afternoon. Jávea Townhall April meeting

After declaring themeeting open, the Mayor ledCouncillors through theAgenda.Point 1 approved the Minutesof the monthly meetings heldon 26th November, 19thDecember 2013 and 20th and27th February 2014. Jose Luis(PP) said the Minutes mighthave been approved sooner,had they not been distributedto Councillors in a format thatsent Minutes to the ‘Spam’folder. Approval wasunanimous.Point 2 unanimouslyapproved whatever decisionsthe Mayor had made -undelegated powers - since25th March.Point 3 took into accountletters the Townhall hadreceived from Belen Quiroga,the new NUEVA JAVEACouncillor.Point 4 gave the opportunityfor the Mayor to suggest howresponsibilities andmembership of TownhallCommittees might be changednow that Belen Guiriga hadbeen recognised as aCouncillor.

Having explored some ofthe options he can now goaway, consult with others andmake his recommendation atthe Pleno at the end of May.Point 5 proposed that whenthe Townhall needed chairs,marquees and the like, havingreviewed overall costs,Carpes i Cadires S.L. beconsidered,Point 6 Councillors agreedon the 5th price increase withCespa S.A. to cover increasedcosts between 1st December2012 and 30th November2013, which apply to beachcleaning, maintenance andrubbish ollection. Unanimous.Point 7 Councillors approvedpayment under referenceF/2014/22 in the amount of8,851€.Point 8 allowed Councillorsto discuss the procedure forloans and grants and it wasagreed to increase the grant toClub Sportiu Xabia, and to

cancel the grant previouslyplanned for the Karate/JudoClub.Point 9 Vicente referred tothe availability of a largeinvestment to benefit the localeconomy and asked to beinformed where there wasneed. The amount was notmentioned.

Mayor Chulvi said it wasTownhall policy to meet localexpenditure using localbusinesses, unless the job wastoo big for a local supplier.

Oscar said expenditure onsports events and the like, wasput out for tender, and most ofthe awards are to localcompanies.Point 9 referred to actionunder Tax Law 217 andCouncillors approved that thedecision of the Alicante Courtof Contentious Administration.Point 10 gave the additionalauthority for gas providerEndesa Gas to createadditional pipework to conveygas from existing pipeworkon the edge of ruralconstruction, to individualdwellings in the Pueblo, Portand Arenal. Phase 1, willbring natural gas to theWestern outskirts of themunicipality, at Silvasol.Piped gas availablethroughout the municipality,including the Pueblo, Port andArenal may take as long as 4years. The Townhall will beresponsible for inspection ofthe pipework, with nopipework taking place inSemana Santa and theSummer months. Councillorsapproved the project butinsisted the Town Plannermust pre-approve all work. Atthis stage only the project isauthorised, NOT the grantingof a Licence, and a Guaranteewill have to be provided. Point 11 Councillorsapproved a payment of353,32€ in respect of damageto the vehicle of Juan MarinIglesias. Point 12 Jose RoselloCaballero approved apayment for damage to his

vehicle for 375€ with partpayment by the Townhall andtheir insurers.Point 13 Cansalades 10 PlanParcial complied with allconditions, but no morebuilding licences will begranted.Point 14 Public participation isbeing sought for the PlanGeneral. Terms and conditionsfor submissions can beobtained from the Townhallregistry in the Advice Centreabove CLOT Parking.

Belen questioned how thepublic would know theirparticipation was wanted, and itwas agreed that a publicitycampaign should be organised.Point 15 Councillors renewedthe existing contract with theGeneralitat for disposal ofwaste material from buildingwork, Point 16 unanimously agreedto revoke the APA Port Schoolamount which had not beenspent.

Points 17 and 18 referred tosimililar decisions in respectof the AMPA music schooland the APA Port School.

The largest portion of thebudget (1.2 million euros) is intendedfor asphalting works, and will focus onstreets in a deteriorated condition andomitted from the last asphaltingcampaign. Other investments willprovide for urban development andlandscaping of the central part ofAvenida Augusta (695,000 euros), theexpropriation of a farm in ruins inPrimer Montañar known as Villa Sarita(500,000 euros) together with itsdemolition and subsequentdevelopment of calle Vicenza to openit up towards the sea (293,000 euros). New proposals for Port developmentThe Valencian Government has putforward new proposals for thedevelopment of the Port. In contrast toprevious plans, this involves re-organisation of the existing port areaand not port expansion. The project isbudgeted at €8 million with aminimum annual fee for Valencia of€50,000. There will be concessions forthe ramp, crane, public moorings andcurrent mooring at the Levante jetty.The Town Hall has 30 days to file itsfeedback and would be calling a public

Tourism department expands range of guided toursJávea’s tourism department hasexpanded its range of guided tours toinclude a "Gastronomía" route - andseveral routes based on the richness oflocal vegetation and its use by differentcultures.

There will be five routes: Cap Primand its microreserve of flora; XàbiaRomana which discovers the marks leftby the Romans; Cala Tangó and themarine reserve; Santa Llúcia and theconquest chapels; and the windmills ofthe natural park of Montgó. Theseroutes will also offer the chance to tastelocal products.

Five oil wells possible in the Gulf of ValenciaA study commissioned by the SpanishAssociation of Research Companies,Exploration, Production ofHydrocarbons and Underground Storage(Aciep) notes that it is expected to finddeposits for five oil wells in the Gulf ofValencia containing about 70 millionbarrels of oil. The most promising areaof Spain is actually the Canary Islands,where a volume of 1.200 million barrelsis expected. Dear Readers,We would like to take this opportunityto inform you that a Regulation waspassed in 2012 (REGULATION (EU)No 650/2012), allowing EU citizens toleave their Spanish property accordingto their own national law, instead of thelaw of their country of residence. It isrequired to make a Spanish Will inwhich you state that you wish to leaveyour property according to UK law andthat the Will only applies to yourSpanish assets.This law will come into being in Spainin 2015, so all non-Spanish owners ofproperties in Spain (residents or nonresidents), should make a Spanish WillASAP. In fact, having a property inSpain without making a Will can be avery risky and ultimately a costlydecision for you and your legal heirs. Why?Firstly, because without a Will,inheritance expenses can beprohibitively high (in Probate or Grantof letters of Administration’s costs, plusswore translations and compulsorylegalization of documents, legal fees,etc).Secondly, beneficiaries will face alengthy and stressful Spanish legalprocess to claim their Spanishinheritance, whilst a standardinheritance procedure can just takearound 3 months where the testator hasmade a Spanish Will.Thirdly, because if someone dieswithout making his or her wishes clearin a Spanish Will, there is a possibilitythat the Spanish rules on intestacy mightapply. Spanish intestate Law differsgreatly from UK Inheritance Rules.Whereas the UK law permitsindividuals, within reason, to leave theirassets to whom they choose, the Spanishlaw imposes strict rules as to inheritanceby family members.

This is particularly appropriate insituations where there has been morethan one marriage and several childrenfrom different marriages. According tothe Spanish Rules of Intestacy, allchildren (irrespective of the marriage),would have a preferential equalentitlement to claim their own share.Therefore, if you plan to leave yourSpanish property and assets to yourheirs without wishing for them to sufferdelay and escalating costs, you ought tomake a Will in Spain before you passaway.Likewise, remember that when makingseveral Wills in different jurisdictions,you can have for example an UK Willthat might cover a UK interests and

your Spanish Will that will cover onlyyour Spanish interests. However, bear inmind that the Wills must be clear onwhich assets each Will pertains to coveras well as the appointed beneficiaries.Moreover, it is essential to mentionclearly that the scope of the SpanishWill must include any present or futureproperties or assets, located in Spainonly. Otherwise, the Wills could beaccidentally invalidated and as a result,the testator’s actual wishes completelyoverridden. This situation of uncertainty frequentlyleads to a lot of stress and delay, whichfinally results in escalating costs andsignificant inconvenience derived fromhaving to request for a lot of additionalcertificates from the SpanishAuthorities, which sometimes are noteasy to obtain.Subsequently, in order to prevent thisunpleasant situation from happening, itis crucial that you carefully follow thesevery important final instructions verycarefully and in case you might haveany question or doubt, please do nothesitate to contact our Law Firm forfurther clarification or advice:1º.- We strongly recommend that yourSpanish Will is signed shortly after theproperty purchase and that you alsoupdate your Spanish Will, such thatyour current Will might no longerreflect your actual wishes or if yourpersonal situation might have variedsubstantially, like for instance gettingmarried, divorce, having new children,etc. Nevertheless, if you change yourpassport number or your address, youwill not need to change the Will. 2º.- Nevertheless, keep all yourpaperwork in order and let also yourbeneficiaries know where it is kept. The deadline for the Town'sresponse is May 10th.

Arenal's Canal de la Fontanaout to tenderAfter years of delay, the ValenciaGovernment has finally put the contractfor the construction and operation of theCanal de la Fontana out to tender.According to the Official Gazette, thisproject to privatise the management ofthe canal is valued at €5,008,017. Thedeadline for submitting tenders is twocalendar months. The process will be

open and will be awarded to the mostadvantageous proposal. Besides theinvestment of five million euros in theworks, the company will have to pay anannual fee of €65,000 plus VAT to theregional government. The most worryingaspect is what will happen to the 350members of the Aexamar association,who make up 85% of the current users ofthe canal, and which used to be involvedin managing the channel.

Montgó forest fire highlightsvulnerability of housesA forest fire in the Montgó Natural Parknear Jesus Pobre (cause unknown, butbeing investigated), affected 40 hectaresof forest on the Col de Pous and Barrancde l`Huera area. 50 people had to beevacuated from their homes, whilehelicopters and planes doused the firefrom the air. Firefighting went on late intothe night since embers were rekindled bygusts of wind and had to be smotheredonce again. Next morning aerialfirefighting assets cooled and secured theperimeter of the fire. There had been fearsthat flames might spread over the Col dePous onto the Denia side of the mountain,where there are many more houses. Asthings were, there were no hydrants toprotect the houses on the south side of themountain, the closest hydrant being at theMarriott hotel which had insufficientwater pressure. Benidorm aims for a technology parkIn an attempt to solve a long standingdispute over land use with the regionalgovernment, Benidorm has proposed theconstruction of a technology park nextto Terra Mítica. Despite their seemingly hopelesscondition, two of the elder children,Albrecht and Albert, had a dream. Theyboth wanted to pursue their talent for art,but they knew full well that their fatherwould never be financially able to sendeither of them to Nuremberg to study atthe Academy.

After many long discussions at nightin their crowded bed, the two boysfinally worked out a pact. They wouldtoss a coin. The loser would go downinto the nearby mines and, with hisearnings, support his brother while heattended the academy. Then, when thatbrother who won the toss completed hisstudies, in four years, he would supportthe other brother at the academy, eitherwith sales of his artwork or, if necessary,also by labouring in the mines.

They tossed a coin on a Sundaymorning after church. Albrecht Durerwon the toss and went off to Nuremberg.Albert went down into the dangerousmines and, for the next four years,financed his brother, whose work at theacademy was almost an immediatesensation. Albrecht's etchings, hiswoodcuts, and his oils were far betterthan those of most of his professors, andby the time he graduated, he wasbeginning to earn considerable fees forhis commissioned works.

When the young artist returned to hisvillage, the Durer family held a festivedinner on their lawn to celebrateAlbrecht's triumphant homecoming.After a long and memorable meal,punctuated with music and laughter,Albrecht rose from his honouredposition at the head of the table to drinka toast to his beloved brother for theyears of sacrifice that had enabledAlbrecht to fulfil his ambition. Hisclosing words were, "And now, Albert,blessed brother of mine, now it is yourturn. Now you can go to Nuremberg topursue your dream, and I will take careof you."

All heads turned in eager expectationto the far end of the table where Albertsat, tears streaming down his pale face,shaking his lowered head from side toside while he sobbed and repeated, overand over, "No ...no....no ..no."

Finally, Albert rose and wiped thetears from his cheeks. He glanced downthe long table at the faces he loved, andthen, holding his hands close to his rightcheek, he said softly, "No, brother. Icannot go to Nuremberg. It is too latefor me. Look ... Look what four years inthe mines have done to my hands! Thebones in every finger have beensmashed at least once, and lately I havebeen suffering from arthritis so badly inmy right hand that I cannot even hold aglass to return your toast, much lessmake delicate lines on parchment orcanvas with a pen or a brush. No,brother ....for me it is too late."

José reports to his‘Facebook’ friends

MAYOR HOLDS ANNUALMEETING WITH EXPATS

Jávea Mayor, Jose Chulvi seems toregard ‘Facebook’ as a way of selectingBrits whom he thinks are interested inhis activities. Javea Jeard attended themeeting at the Parador in 2013 (and gavehim what we thought was a fair report)but we didn’t get an invite this year.

His meeting had the double purposeof explaning his responsibilities as a‘Diputado’ in Alicante, and answeringthe questions of those present.

High on the list of topics raised bythose present, were IBI and car parking.Attendance was estimated at 100 people,a lot less than in 2013.The Mayor kicked off proceedings byapologising for what he insisted was his"poor English" and joked that he hadn'tslept for a couple of days as aconsequence to which he receivedgenerous and sympathetic applause fromthe floor. He explained that he wanted tomake the presentation because he feltthat it was essential for all residents ofJávea to understand his work in Alicante.There followed a short clip of theMayor's formal inauguration on July16th 2011, after which he explained thepurpose of the 'Diputación de Alicante' -the Provincial Government of Alicante -which is responsible for managing theeconomic and administrative servicesand functions within the Province ofAlicante whose territory stretches fromjust north of Dénia to the border fromMurcia in the south and inland to justbeyond Alcoy and to the border with thehistoric region of Castile-La Mancha.The Diputación was established inJanuary 1822 by a decree of the MadridParliament and currently has 31 MPsrepresenting a population of just under 2million people. Those representatives areselected from the political parties of theelected municipal councillors in theprovince with the Marina Alta regionproviding three, one each from Jávea,Benissa and Ondara. Of the 31representatives, 20 are drawn from thePartido Popular (PP) and 11 from thePartido Socialista Obrero Español(PSOE) of which José Chulvi is a

member. Individual MPs are selectedinternally by the vote of the councillorsbelonging to their political parties intheir respective districts which in thecase of the Mayor was the Marina Alta.José then outlined the principal areas ofresponsibility of the 'Diputación' whichincluded infrastructure and roads,tourism along the Costa Blanca,equality, youth and foreign citizens,promotion and development of theregion, the heritage of the regionincluding the support of the 'MuseoArqueológico Provincial de Alicante(MARQ)', the water cycle, theenvironment and the provision ofservices to municipalities within itsboundaries. Its budget for 2014 isalmost 249 million euros, the majorityof which is funded by CentralGovernment in Madrid.As for his own responsibilities inAlicante, José is a member of theManagement Committee of MARQ, thearchaeological museum in the city, and

he implored those who hadn't yet visitedit to do so (it won the 'EuropeanMuseum of the Year Award' in 2004).He is also a member of the Costa BlancaTourist Board and meets with fellowMPs to decide policies and developmentin the Province of Alicante as well asattending monthly plenary sessions ofthe provincial government. For this, hereceives a salary and it has been well-documented that as a consequence herenounced his right to a salary as Mayorof Jávea, the only mayor to do so,because he strongly felt that in thesedifficult times no public servant shouldreceive two salaries. Such an actionreceived deserved applause from thefloor. He also explained that he bought anew car (on credit) in 2011 - his old onehad "expired" after nine years - and thathe has driven almost 60,000 kilometreson business travelling to Alicante,Valencia and Madrid.José went on to explain the benefits ofhis presence within the provincialgovernment for Jávea which includesbetter access to grants and subsidies forprojects and improvements as well asthe ability to lobby provincialdepartments for funding. He explainedthat in 2007 Jávea received just over4,700 euros in annual subsidies andwhilst this did rise to over 400,000 euros

The Oasis Centre was openedfifteen months ago following threesuicides in the area. We opened theCentre to provide a listening ear toanyone who was going through adifficult time and to generally helpanyone who would accept it. Forexample, as it is now no longer possibleto renew passports by filling in a formand sending it to the UK withsupporting documents. Now it all has tobe done online and many who come tothe Centre are elderly and don't havecomputers. Clive is able to complete theapplication online and then downloadthe form to his computer, so it can besigned by the applicant and forwarded -by courier, overnight - in to Belfast.Often people just come in for a chat,some live alone and are obviouslylonely.

I have been surprised that whenpeople start to open up, especially ifthey have problems, how often theconversation comes round to angels. Ihave also been surprised at how many ofthem, like me, believe that we haveguardian angels that are with us all thetime, and help in times of danger.

About twelve years ago, Cliveand I travelled to Cullera (about halfway from Jávea to Valencia), to spendthe day with Spanish friends Magda andEnrique at their holiday apartment. Afterlunch it was suggested we go to the

The owner (or hisstaff), have never followed me aroundor mysteriously appeared to tidy shelvesbut he is so helpful if I need help to findsomething I can't find. The shop goesback a long way and he is happy to sit athis desk at the door and let hiscustomers roam around for as long asthey want to.

Talking of shops, as many ofour readers know, in the Oasis Centre inthe Port at the back of the dolphinroundabout, we have a large selection ofgreetings cards, all at 1 euro each andduring this past month our selection andquantity of cards has been augmentedby 10,000 more cards. Many come tothe shop with a list of all the birthdaysand anniversaries they have for the nexttwo months and often buy as many as10 - 15 cards at a time. It's well worth avisit.

Have you been‘touched by anangel’?I would like to thank all those readerswho have visited us at the Oasis Centreor phoned to find out how my husbandClive is progressing after his nine daystay in hospital which left him unable towalk. Progress is slow and occasionallyhe has a bad couple of days but he isgetting better. Clive is now able to walkunaided and to help out in the OasisCentre each morning where visitors andcustomers are pleased to see him.

When I go into a shop I hate itwhen an assistant suddenly appearsclose by to tidy shelves, or generallyhang around, obviously to keep an eyeon me in case I am going to stealsomething. I immediately leave the shopbecause it makes me feel uncomfortable.Some of the Chinese shops are

in 2009, a consequence of storm damagewhich necessitated major public worksto repair the Tosalet ravine and the banksof the Gorgos, it changed little until2012 when subsidies climbed to justover 69,000 euros and this year theyhave risen to almost 490,000 euros (upto February 2014). This figure includes393,250 euros for the renovation of theCentral Cinema in the centre of the oldtown and 93,750 euros towards themunicipal plan to improve energyefficiency. The town has also received100% funding for several projectsincluding 176,377 euros for resurfacingand repairs to the Carretera Jesús Pobre,48,422 euros for the resurfacing ofAvenida Colomer, which leads out oftown from the olive tree roundabout,241,395 euros for the roundabout at thejunction of Carretera Cabo de La Naoand Carretera La Guardia - the Saladarjunction - which has looked to bothresolving congestion, especially duringthe busier summer months, and reducingincidents on what had become a majoraccident blackspot. head of the Marine Division of the EUEnvironmental Commission, Jo LienenMEP responsible for oil exploration andfracking issues who promised to followup the issues by visiting Jávea after theEuropean elections in May, and LindaMcAvan MEP, the British coordinator ofthe EU Parliamentary Commission forthe Environment, Public Health andFood Safety. José called for unityagainst oil exploration just severalkilometres off the coast: "Together withthe citizens of Jávea we will make everyeffort to defend our beautiful coastline". Those present were then invited to askquestions and the first came from aDutch resident who asked where theValencian government came into thepicture after all the information aboutAlicante. With the help of GeorgeThomas, president of the PSOE in Jávea,José explained that the position withValencia is quite complicated and notmade any easier by the fact that Jávea isowed a lot of money by the Generalitat.Two main issues are involved: educationand health. With regards to the former,the eight schools in Jávea - 6 elementaryand two high schools - are theresponsibility of the Generalitat,including building repairs although thetown hall has carried out necessarywindow replacements recently. Withregards to health, the town hall has beenpushing for assurances that medicalcover is not reduced over the busiersummer season and has been fighting aproposal by Generalitat to reduce theambulance service. With regards to thelatter, the town hall has agreement withthe Cruz Roja to provide 24 hour coverfor emergencies although it has to find200,000 euros a year to finance thatcover.

The next question concerned the marinawhich, once again, comes under theauthority of Valencia. José explained thatthere are proposals to improve the port -although not to enlarge it - which wouldmean that more boats could use it. Thereare also plans to improve the marina ofthe Fontana canal, also under the wing ofValencia, and an assessment is to bemade to identify requirements.Cleanliness in the Arenal brought up theissue of land ownership andresponsibility. The original questionasked what the town hall could do toensure that the back of the Arenal aroundAvenida Tamarits and Scallops was keptclean, the inquirer pointing out the returnof a funfair as a cause for concern. Josésaid that owners of private propertyacross the municipality were requestedto keep it clean and tidy and if theycomplied to the request then good.However he agreed that cleanliness ofthe town should be ensured due to itsstatus as a tourist destination. The talkinevitably turned to the long-runningsaga of the roundabout at Barclays Bankwhich he admitted was a specialproblem. He explained that there werefour parts that affected the roundabout,two of which have been accepted by thetownhall but the other two belong todevelopers and they should have paid ashare to develop the roundabout but havefailed to do so. He added that the townhall was looking towards a solution. Healso confirmed that the temporaryroundabout at the junction of Avenidadel Pla and Avenida del Arenal wasbeing made permanent this year.The issue of IBI was an inevitable querywith the questioner asking when thosewho overpaid were going to receive

swam on ahead. It was then that Inoticed a strong current below thesurface and it was very hard for me,even though I am a strong swimmer, toswim against it. Finally we arrived atthe beach, the men dropped Clive ontothe sand and I ran over to him to helphim up. As I helped him to his feet, hisfirst words were "We must thank thosemen for saving me." We looked roundthe beach, there was no sign of any wetmen, they had disappeared. I amconvinced God had sent two angels.

When we talked about ourexperiences with Enrique he explainedthat when we went out we had walkedin a semi-circle and of course when weturned back and saw where the lifeguardstation was, we made a direct courseback and unbeknown to us, the strongcurrents had swept away the sand andleft big holes and Clive had walked intoone of the holes when he found he wasout of his depth. When I was thinkingabout our terrible experience during thefollowing days, I knew that I couldn'thave forced Clive's arms away from meand saved myself while watching himdrown, we would have stayed clungtogether until we both drowned.

There is no doubt in my mindthat they were angels. They didn't speaka word, didn't wait to see if he wasalright when they dropped him on thesand, they just did the job God had sentthem to do and disappeared!! But I mustadmit that an experience like that doesmake you do a lot of thinkingafterwards. You go through the "whatif?" questions. What would havehappened to the Church we pastor?What would have happened to all theother work we were involved with?Nobody is indispensable and we realisedall our activities we were involved withwould either have been taken over bysomeone else or ceased. It did give us alot of soul searching over the next fewweeks and caused us to slow down,back off from some of our activities thatothers could do just as well, and spendmore quality time with each other andGod.

On another occasion a fewyears later, Clive was driving alone onthe road from Benitachell to Jávea. Itwas dark and a wild boar crossed theroad, so Clive swerved to miss it andended up going off the road and tearinginto a field until the car stopped. Thefirst I knew about it was when hearrived back home and asked me "Doyou want the good news or the bad?"The good news was that he was stillalive and the bad news was that the carwas probably a write-off. The nextmorning we called for a taxi and went to

beach to swim but I explained to Magdathat Clive couldn't swim and it wouldhave to be a safe beach. "No problem"she said. "There is a very safe beachclose by where you can walk out a longway before the water is up to shoulderheight." So off we went. Enrique stayedon the beach with our clothes near to thelifeguard station while Magda took theopportunity to do some supermarketshopping.

It was lovely in the water, I wasswimming along quite happily and Clivewas plodding beside me, his feet alwayson the ground and we were aware thatwe were quite alone out there. We were along way out before Clive decided wehad walked out far enough as the waterwas now well above his waist. Weturned round and looked at the beach,saw the flags of the lifeguard station andstarted making our way back. I wasswimming ahead of Clive and he waswalking at his own pace behind me.Suddenly he shouted "Anna."

Now when he calls me Anna Iknow there is a problem. I turned roundto see him go down under the water andthen come up again, gasping andcoughing. Down he went again, and upagain. I swam quickly back to himknowing I could put my lifesavingcertificates and medals into practice.This would be the first time I hadactually saved a person drowning, all theother people I had "saved" had wanted tocooperate as they were all confidentswimmers.

What I didn't expect was that assoon as I came close to Clive, instead ofhim waiting for me to turn him over andsave him, he grabbed me with both armsand we both went down. He was sostrong and so heavy I was powerless, wewere both drowning. While we wereunder the water I tried to push hisbottom up so he was floating and easierto manage but he wasn't having any of it,he was like an upright heavy brick.When we surfaced I shouted at him indesperation "Let go of me, you'repanicking," to which he replied, "Ofcourse I'm panicking, I'm drowning!!"

When we surfaced for about thesixth time, I was amazed to see two menswimming quite close to us, I hadn'tnoticed anyone out there, I thought wewere quite alone. In my best Spanish Ishouted to them and said my husbandcouldn't swim and ‘HELP’!!

Within seconds they were withus, each of the men took one of Clive'sarms and he let go of me. They turnedhim on his back and without saying aword, swam back to the beach while I

look for the car. The taxi dropped us offat the point where Clive had come offthe road (close to the entrance toResidencia Lluca) and we could see thebroken bushes where he had left themain road. On the ground was a frontbumper which was lying next to a gulleyand a little further along, a low stonewall. We carried on through theundergrowth and finally found the car inthe middle of a field. We examined thecar and found to our amazement that thefront bumper was still there. The onlydamage to the car was a few scratcheswhere the branches of trees had caught iton iys journey through.

"Try and start the car" I toldClive. He got inside and low and behold,it started first time. The field where thecar was standing was full of bigboulders so we would have to be carefulhow we drove it out. We found the onlyplace we could drive back onto the mainroad without hitting any of theseboulders was close to a tree but thebranches were so low it was impossible.Clive sawed the bottom branches off andwe were ready to drive to the main road.I walked on ahead beating the longundergrowth down to locate the bouldersand pointed a route out to Clive. Heslowly followed me through the thickundergrowth and before you know it wewere back on the main Benitachell road.

When we went back a few dayslater to the point where Clive had comeoff the road, we found that the car hadgone through the hedge, clearing thebunker, bounced over the wall anddriven right into the middle of the fieldwithout hitting any of the hiddenboulders. It was a miracle Clive wasn'tkilled and he is convinced he had angelsguiding his car that day.

These are just two occasionswhen our guardian angels rescued us.rescue. Some of the people we have aconversation with in the Oasis Centreabout angels also have stories to tell. DON’T PLAYWITH FIRE

After the fire which destroyed 40hectares in the Montgo area at thebeginning of this month, I really believethat we have to think about.......

EDUCATION AND AWARENESS and PREVENTING FOREST FIRES Conserving and protecting our forestsmeans conserving and protecting one ofthe most valuable heritages in ourterritory. Its value stems from itsecological function as well as from itssocial function as it is a source ofwealth, work and recreational activities.

This is why the fight against forestfires is fundamental.It is a battle against the most importantthreats faced by our forests.

The fight against forest fires is apriority for the Generalitat (ValenciaRegion Government) and importantefforts are being made to acquire thebest means and resources to confrontthem. Nonetheless the best and mosteffective tool we have in the fightagainst forest fires is to avoid them, thatis to say, prevention.

Only 23 per cent of forest fires in theValencia Region are caused by naturalfactors such as lightning. The rest arecaused by negligence or are setintentionally. Therefore, the mostcoherent message we can send is that itis in our hands. All of us, who either forwork or recreation and leisure activities,use our forests must mitigate and reducethis percentage and the number of forestfires.

Of course, it is difficult to fight thefoolishness of pyromaniacs but asnormal and concerned citizens, weshould keep in mind certain rules andobligations. The basic rules below aremandatory in all circumstances and for

any activity, whenever you're in theforest or within 500 metres of it. You can make fire only in the placesprepared and authorized to that effect.When the level of pre-emergency is 3, itis forbidden to make any type of fire,the permits being in abeyance.

Always put out your cigarette buttsor matches. Never throw them on theground and even less lit, use the existinglitter bins or dispose of them at home.

And, don't forget that a barbecue withfriends does need a lot of care andplease remember that the ashes keeptheir heat for a considerable time!!!

José gave a long explanationabout the situation which saw IBI ratesrise 10% of the value of the propertyevery year after the new rates were set in2006. The Townhall set the wheels inmotion to make claims against the rises,citing 345 properties which proved thatthe rates had been misvalued. It seemsthat the problem was passed from pillarto post until it eventually came back toJávea with the Supreme Court ruling infavour of the townhall although only inthe case of the 345 properties.

After the elections in May 2011, theincoming coalition decided to reducerates for 2012 and in June the SupremeCourt judgement arrived which meantthat the town hall would have 8 millioneuros less in its pot for 2012 and wouldhave to make adjustments. Assessmentshad to be made using a specialist and thetown hall investigated the possibility ofreimbursing any money whilstindividuals set about taking the town hallto court to force a refund of theoverpayment. However judgementsruled in favour of the town hall who hadno obligation to repay. Once again,income had to be adjusted for 2012-2013as rates were set to 2009 levels meaningsome 6 million euros less in the pot. Joséacknowledged it was a long andcomplicated issue. At the end of the day,the money was taken, it was spent andconsequently it cannot be returned.However he said it showed that there hadto be good economic management inorder for the eleven councillor who runthe council to achieve their soleobjective and that is to improve Jávea.To this end, they have also worked tobring in those people who had beenavoiding paying their fair share of IBIcontributions and these residents havehad to pay up to four years of back-datedtax.

A question about the controversial oilexploration project brought a simple butpassionate response from the mayor. Theinquirer asked for a comment on the pro-lobby who said that the explorationproject would actually bring jobs to theregion. José quoted Councillor AntonioMiragall (Tourism) who said: "Xàbia'soil is tourism" before explaining thatstudies have suggested that any suchexploration and subsequent discoverywould provide just 1% of the country'senergy and it wouldn't create jobs inJávea but rather work to destroy them,such as the fishing industry. He said thatthe only benefit would be to thecompany who would sell their findingsfor a profit.

The session concluded with randomquestions on parking meters (the cost ofrunning them was more than theincome) and the issue of responsibilityfor the removal of infected palm trees(which came down to Valencia onceagain) before it was wrapped up withanother request for residents to registerwith the Townhall and get on the'padrón' to help make sure that the towngets the right funding for its services.

It was a very useful session and, as JoséChulvi agreed during a chat afterwards,the importance of getting informationout to everyone in Jávea was paramount.Chats like this serve to prove that theMayor and his councillors are moving inthe right direction.

Spain still has besthealthcare in Europe

claims reportSPAIN’s healthcare system is the best inEurope, claims a new study, and thecountry is ranked fifth best in the world,in the study by Bloomberg whichmeasured efficiency, life expectancy andcost.

The report comes after a number ofstudies showed that Spanish health carehas deteriorated dramatically over recentyears due to national budget cuts.British medical journal ‘The Lancet’recently slammed its quality followingdrastic 30% cuts over the last few years.Despite this, Spain’s efficiency ratingwas 68.3, its life expectancy was 82.3,and the cost of healthcare as apercentage of GDP per capita: 10.4%.

This is compared to the UK’sefficiency rating of 55.7, life expectancyof 80.8, and healthcare cost percentageof 9.4%.

Hong Kong topped the list of the‘most efficient healthcare countries inthe world’, followed by Singapore.Japan and Israel also made the top five,while the UK came 14th, and the USranked 46th.

The results were greatly affected byBloomberg’s decision to take cost intoaccount.

This sent countries with good butvery expensive healthcare – like the US– far down the list.

Page 26 May 2014, Nº 13 Jávea JeardHaving recently looked at buying andselling a property in Spain, here’s thefirst part of a short guide to buying landto build your own home.

Alejandro Giménez Ferrer who is theprincipal of Alejandro GiménezArchitects was asked what prospectivepurchasers of plots should look into, andbe prepared for, in Spain.

“The first thing is find out is whatkind of plot is being offered,” Alejandrosays.

Traditionally, land here is classifiedas urban, urbanisable, or green belt. Thelatest Land Act, passed in 2007, changedthe definitions a little, but, in practice,the only land you can legally build on isan urban plot. This means it must have,at least: vehicle access, power, waterand sewage connections, and streetlighting.

“If the basic infrastructure is not inplace,” Alejandro points out, “therecould be problems.”

Neither green belt (which isprotected, for scenic, historic, scientificor cultural reasons or due toenvironmental risks, public-domainissues, or agricultural or naturalimportance) nor urbanisable land (whichis not protected and could betransformed into urban land, if townplanning and infrastructure aredeveloped) can be built upon.

The next step is to ask the localtownhall for a planning certificate(certificación urbanística) thatdetermines what can be built on the plot.This will confirm the type of land anddetail any requirements, such as:minimum plot size and separationboundaries, maximum built area(expressed as a ratio of plot size andonly including square metres aboveground), floor area (again, a ratio of plotsize), roof height, and any stylerestrictions.

You can request this yourself fromthe townhall or ask an architect toproduce a technical report, for whichthey will be legally liable, detailingwhat will be permitted on the plot in linewith the general town plan (PlanGeneral de Ordenación Urbana).You should also ensure there are nodevelopment restrictions in either thetown plan or the Property Registry(Registro de la Propiedad), due toproximity to the coast, rivers, orhighways, third-party rights (like power,water and drainage connections) andother rights of way. Any of these couldmean a building license will not beissued and, if work begins without one,could result in it being halted,demolition ordered, and fines levied.

Once you’ve confirmed building onthe plot is possible, Alejandro says thebasic things to think about are: thedirection the house would face (south-facing being the best), type andtopography of the soil (if it’s rocky,

unstable, or on a slope, constructioncosts climb), the view, and any existingor potential neighbours.

After all, if you plan on building ahouse in Spain, you don’t want yourdream home turning into a nightmare inthe future.

Having looked at the things you needto know before buying a plot to build onin Spain, the next ´hurdle´is to reviewthe process, and costs, of going fromhaving a piece of land to the plans foryour new home.

The first thing needed to complywith Spanish law is a geotechnicalreport, to determine the correct type offoundations for your build. Specialistgeotechnical engineering companies,which must be registered providers,produce this kind of report. Thisnormally takes a week and costs 1,000-3,000€.

Depending on the plot, you maywant a topographic report to see howyour land lies. Alejandro particularlyrecommends this for plots on a slope orwith difficult terrain. This is done by atopographer, also takes a week, andcosts 300-1,000€, depending on theplot’s size and characteristics.

The next step is to employ anarchitect (arquitecto) who is responsiblefor drawing up your plans, subject to allthe relevant rules and regulations, anddirecting the build: “You should alwayscheck he or she is a member of theprovincial Architects’ Association and isup to date with membership and

insurance payments,” Alejandro says,“Your plans have to be approved by theAssociation (often referred to as theCollegio), too.”

The architect not only designs thebasic plans (proyecto básico) of whatgoes where in your new home, but alsothe installation and structural plans(proyecto de ejecución) that detail how itall works.

While he or she is ultimately incharge of the design, a good architectalways conceives a building in line withthe client’s ideas: “My goal is to make amade-to-measure suit, just like a tailorwould; something that fits perfectly.”You’ll also need a technical architect(aparejador), to manage the build on aday-to-day basis. Your architect willprobably have one, or more, theyregularly work with, who you mayinterview for the job, but you’re free tochoose your own. Bear in mind,however, both professionals will see a lotof each other, and of you, so try to hireone you and your architect get on with.

Architects usually charge 7-10% ofthe projected build cost for their work,while a technical architect normally costsabout 30% of what your architect willcharge.

Once you have the plans and otherdocuments prepared, you can apply for abuilding license (licencia de obra) fromthe local Townhall. You should have acareful look at what’s required in yourtown but, given the paperwork andhassle involved, you’re probably bestadvised to let your architect look afterthis, too.

Getting a license can take 1-3 monthsand the process is overseen by the town’stechnical staff. They may requestchanges, which your architect willhandle, to ensure your plans comply withthe law and planning guidelines but,sooner or later, you should get themapproved (informe favorable.) Costsvary, depending on the town, but areusually 4-5% of the projected buildprice, calculated using standard tables.

Then, unless you plan on getting yourhands really dirty, all you need next is abuilder…
