SUBJECT: REVISED RULES AND REGULATIONS ON THE REQUIREMENTSOF LIFE SAVING APPLIANCES UNDER CHAPTER IX OF THEPHILIPPINE MERCHANT MARINE RULES AND REGULATIONS(PMMRR) 1997

Pursuant to the provisions of Presidential Decree No. 474 and Executive OrdersNo. 125, as amended, R.A 9295 and its IRR, as amended, SOLAS 1974, LSACode, as amended and in order to foster rationalized implementation ofChapter IX of the Philippine Merchant Marine Rules and Regulations (PMMRR)1997, as amended, the following are hereby prescribed:

I. OBJECTIVE:

To ensure the effective implementation of the rules on LSAlE (Life-Saving Appliances and Equipment) required of ships operating in thedomestic trade.

11. COVERAGE:

All Philippine-registered ships regardless of hull construction operating inthe Philippine waters, including fishing vessels temporarily operating ininternational waters.

Ill. DEFINITIONS

For purposes of this Circular, the following terms as used in this Circular shallmean the following:

1. Administration refers to the Maritime Industry Authority (MARINA):

2. Accredited Supplier/Servicing Entity refers to a privateindividual or entity authorized by the Administration to engage inmanufacturing, servicing and supplying ship's appliances and equipment:

3. Buoyant Apparatus refers to a life raft, or any craft or floating device,as provided for this MC, as a means for a person/s to be in an afloatcondition in the event of abandonment of the ship;

4. Safety Certificate refers to a certificate issued, after inspection andsurvey by the Administration or its deputized agent, to ships operatingin Philippine waters upon compliance with the provisions of the PMMRR1997, as amended.

5. Coastwise Voyage refers to a voyage limited to open sea or greatercoastal waters subject to the jurisdiction of the Philippines.

6. Company refers to the Owner of the ship or any otherorganization or person such as the Manager, or the Bareboat Charterer,who has assumed the responsibility for operation of the ship from theShip owner and who, on assuming such responsibility, has agreed totake over all the duties and responsibilities in the operation of the ship;

7. Life-Saving Appliances and Equipment refers to theappliances and equipment required of each type of ship inChapters IX of the PMMRR 1997, as amended, and other relevantprovisions of national and international safety rules and regulations andcodes;

8. Coastal Water refers to a body of water that covers navigable area morethan three (3) nautical miles from the nearest land.

9. Protected Water refers to a body of water that covers navigable areawithin three (3) nautical miles from the nearest land.

10. Safety Rules and Regulations refers to provisions of the PMMRR1997, as amended, and other relevant national and international safetyrules, regulations and Codes;

11. Survival Craft refers to a craft provided for accommodatingpersons on board a ship in the event of abandonment of the ship andincludes lifeboats, life raft (inflatable or rigid) and any other craft asapproved by the Administration, suitable for the protection andpreservation of persons in such circumstances;

12. Open Sea - refers to a body of water that is not classified as protectedand coastal water but still within the area /jurisdiction of the Philippines.

13. Type-Approved UJe-Saving Appliances and Equipment (LSA/E) refersto life saving appliances and equipment approved and certified by theAdministration, and organization recognized/authorized by theAdministration and other maritime administration.

Other terms used in this Circular and its Annex shall be as defined ininternational conventions/codes and/or other issuances of thisAuthority.

c IV.> GEZNERAL POLICY GUIDELINES:

1. Life-saving appliances and equipment for each type, class andcategory as listed in Section V of this Circular shall serve as equivalentsto those prescribed in PMMRR 1997, as amended;

2. Life-saving appliances and equipment shall be of the approved typeand shall be acquired from an accredited manufacturer/supplier orserviced by an accredited servicing entity. Life-saving appliances andequipment on board ships acquired from abroad must also be type-approved and proof thereof to be checked and certified by theAdministration.

3. The basis for the approval of the design and manufacture ofequivalent ship appliances and equipment shall be based on the result ofactual testing.

3.1. In areas where the approval of the Administration is impracticable, asurveyor from the Administration shall conduct actual testing ofthe rigid life raft, buoyant apparatus and life jacket. The surveyorshall provide a description of the appliances and equipment andthe testing made indicating there in the observations and findingsresulting from the testing conducted.

3.2. The company shall provide a log book for purposes of recordingactual testing conducted. The Master and the attendingAdministration surveyor shall affix therein their signatures in thelogbook after the sampling tests are made. In cases where thedeputized agency undertakes the testing, the surveyor shallprovide its serial number and detachment/station/district affiliation.

3.3 The sampling test shall be made during survey in connection withthe issuance of SSC.

3.4 The company shall present the aforecited logbook every time asurvey and testing was done for issuance of a SSC is made.

5. The Administration may, if it considers that the sheltered nature andconditions of the voyage are such as to render the application of anyspecific requirements of this Circular unreasonable or unnecessary.Approved alternative specifications that are considered equally effectiveunder circumstances. An Exemption Certificate shall be issued.

V. RATIONALIZED SAFETY REQUIREMENTS:

1. Lifeboats, liferafts, lifefloats, lifebuoy, buoyant apparatus and lifepreservers shall be readily available in case of emergency and shall be

kept in good working order and ready for immediate use at all times whenthe ship is being navigated, or in so far as reasonable andpracticable w.hen the ship is, not being navigated.

2. Lifejackets shall be provided in each and every passenger accommodation,as applicable. In common areas, or accommodation, a separate locker forlifejacket shall be provided for every 20 person in the accommodation. Nolifejacket locker/cabinet shall be permanently locked during voyage. Thenumber of lifejacket in every locker/cabinet shall be clearly indicated.

The decks on which lifeboats, liferafts, lifefloats, buoyant apparatus and lifepreservers are carried shall be kept clear of cargo or any otherobstructions which would interfere with the immediate launching ofthe life-saving appliances.

3. Sufficient ladders as applicable shall be provided to facilitateembarkation into the lifeboats and liferafts when waterborne;

4. Lifeboats, liferafts, Iifefl oats buoyant apparatus, life preservers andlifebuoys shall be clearly marked with the name of the ship as well as theapproved maximum number of persons for each applicable life'-savingappliances.

5. Lifeboats, liferafts, lifefloats, buoyant apparatus and preservers shall bestored in such a manner that:

5.1 They are capable of being launched in the shortest possible time;

5.2 They shall not impede the launching or handling of other life savingappliances;

5.3 They shall not impede the marshalling of persons at the embarkationstations or their embarkation; and

5.4 They shall be capable of being put in the water safely and rapidlyeven under unfavorable condition of list and trim.

5.5. Lifejackets shall be provided in every passenger accommodation, asapplicable.

5.6 In common areas, or accommodation, a separate locker for lifejacketshall be provideC: for every 20 person scattered in different location.

5.7 No lifejacket locker/cabinet shall be permanently locked during voyage.The number of lifejacket in every locker/cabinet shall be clearlyindicated.

5.8 Lifejacket for infants shall be distributed during embarkation andcollected upon arrival.

6. The required number of LSA/E are hereby provided in Annex A whichshall form as, integral part of this Circular.

VI. PENAL PROVISION:

For violations or non-compliance with the rationalized requirementsprescribed in this Circular, the following fines and penalties shall beimposed, after due process:

All companies shall comply with this Circular not later than six (6) monthsfrom the effectivity of this Circular or on the next drydocking, whichevercomes earlier.

VIII. REPEALING CLAUSE:

MARINA Circular No. 197 and its annex are hereby repealed.

IX. EFFECTIVITY:

This MARINA Circular shall take effect fifteen (15) days after its publicationonce in a newspaper of general circulation.

lifejackets of not less than 25% of the total number of persons onboard for personnel on watch at work station shall be provided.

d. Distress Flares:• Every ship shall carry at least two (2) rocket parachute flares.
