Crystal Carter, read to the SPBLA Board, the Resolution passed in Memorandum of Mr. James Carl “Jim” Finley.

At the annual Plumbing – Heating - Cooling Contractors Association of Louisiana convention held March 15-16, 2019 in Shreveport, LA, PHCCLA President Gene Martin announced the death of our loyal and esteemed colleague

Mr. James Carl “Jim” Finley

On motion, duly seconded and passed, the Plumbing – Heating - Cooling Contractors Association of Louisiana unanimously approved that the minutes of this meeting reflect our deep sorrow in his death and in his memory adopt the following resolution:

Whereas, Mr. James Carl “Jim” Finley was a long-standing member of the Louisiana plumbing heating cooling community and member and past president of the Plumbing – Heating - Cooling Contractors Association of Louisiana, and

Whereas, He diligently served and supported the initiatives of this association, and brightened many PHCCLA meetings with his presence, his guidance and wisdom, and

Whereas, He served in leadership positions and has been honored by the industry on numerous occasions, through state and national associations, namely the Plumbing-Heating-Cooling Contractors Association, the Louisiana State Plumbing Board, the New Orleans Metro PHCC and many other entities, and

Whereas, He was appointed to numerous boards and commissions of the state which were focused on the contracting and plumbing trade, and

Whereas, He was second-generation president of C.N. Finley Plumbing Company from 1967 to 2016; therefore

Be it resolved that the members of the Plumbing – Heating - Cooling Contractors Association of Louisiana hereby give formal expression of its loss in the death of our loyal friend and colleague Mr. James Carl “Jim” Finley and do hereby note in its records the passing of life of this man who was loved and respected by his associates.

Be it resolved that this Association express to Jim’s family, the sincere regret of each member of his absence, and further that a copy of this resolution be tendered to his wife Lynne and his family as our humble expression of sympathy.

In conclusion, SPBLA Secretary Treasurer, Mr. Rickey Fabra stated he had the greatest opportunity to get on this Board years ago when Don Traylor was the Executive Director. Mr. Fabra stated Mr. Finley always had the Plumbing Industry at heart. Mr. Fabra stated there was

never a time where Mr. Finley was worried about different organizations, it was always about the industry. Mr. Fabra stated this is the first meeting attending without Mr. Finley’s presence here, but in our hearts and in our minds, we know that he is here, and he is going to guide us in faith and making the right choices for the industry. Mr. Fabra stated it is great to hear the acknowledgement from LAPHCC and them drafting the resolution in support of Mr. Finley and his family. Mr. Fabra stated Mr. Finley is going to be missed, but he guarantees that Mr. Finley is here and the decisions we make are for public health and safety.

APPLICATION COMMITTEE

a.) Journeyman Application – Bradley J. James – On February 28, 2019 the State Plumbing Board of Louisiana received a Journeyman Plumber Application from Mr. Bradley J. James. Mr. James submitted his application along with W-2’s and payroll documents after the rule changed for the voucher process. Mr. James was employed with B & D Plumbing since 2012 to 2017. Mr. James is currently employed with M & M Plumbing Company, Inc. Mr. James has over five (5) years of experience. Mr. James is requesting to be eligible to take the Journeyman Plumber Exam through W-2’s and payroll documents and not have to enroll in an Apprenticeship Program.

MOTION: To accept Mr. James’ application based on the required W-2’s and payroll documents provided.

b.) Journeyman Application – Adam Tyler Huff – On February 11, 2019 the State Plumbing Board of Louisiana received a Journeyman Plumber Application and Permit Form from Mr. Adam Tyler Huff. Mr. Huff submitted his application along with payroll documents after the rule changed for the voucher process. Mr. Huff was employed with LaFleur’s Plumbing, LLC from May 2013 to April 2017 and started working back with LaFleur’s Plumbing, LLC since August 2018. Mr. Huff has over eight thousand (8,000) hours of experience. Mr. Huff is requesting to be eligible to take the Journeyman Plumber Exam through payroll documents and not have to enroll in an Apprenticeship Program.

MOTION: To accept Mr. Huff’s application based on the required payroll documents provided.

Mr. McCraney has over five (5) years of experience. Mr. McCraney is requesting to be eligible to take the Journeyman Plumber Exam through W-2’s and not have to enroll in an Apprenticeship Program. Journeyman Application – Paul Darrel Wiltz, Jr. – On March 19, 2019 State Plumbing Board of Louisiana received a Journeyman Plumber Application and Permit Form from Mr. Paul Darrel Wiltz, Jr. Mr. Wiltz submitted his application along with payroll documents after the rule changed for the voucher process. Mr. Wiltz has been employed with Colville Plumbing & Irrigation from 2013-2016 and Gary’s Plumbing Services, LLC from 2016-2019. Mr. Wiltz has over eight thousand (8,000) hours of experience. Mr. Wiltz is requesting to be eligible to take the Journeyman Plumber Exam through payroll documents and not have to enroll in an Apprenticeship Program.

On November 26, 2018, State Plumbing Board of Louisiana Enforcement Officer, Mr. Fred Fontenot, arrived at a construction site located at 151 Feliciana Dr. Pineville, Louisiana. Mr. Fontenot observed a plumbing company truck at a new residential construction site. Mr. Fontenot went inside and observed Mr. Triston Travis securing pex piping in the walls by nailing plastic straps to the studs. Mr. Fontenot then observed Mr. Alex Coleman pulling on other pex piping to ensure the connections and strapping were secure. Mr. Fontenot identified himself as an Enforcement Officer for the State Plumbing Board of Louisiana and asked to see their plumbing licenses. Mr. Coleman had an Apprentice Card and Mr. Travis did not have anything. Mr. Travis advised Mr. Fontenot that he would be in an apprentice school after the first of the year. Mr. Fontenot then asked if anyone else was working with them on this site and they both advised no one else was working at this site. Mr. Fontenot then advised them to contact their supervisor and advise him that they were to stop working until a licensed Journeyman or Master Plumber was with them. Mr. Darrell “DJ” McWaters, Jr. (Owner of the Company), who is the Master Plumber, arrived at the location and showed Mr. Fontenot an email confirming that Mr. Travis was accepted in a school after the first of the year. Mr. McWaters stated to Mr. Fontenot that Mr. Coleman was only supposed to be working on the A/C system and not to touch the plumbing. Mr. Fontenot cited Mr. McWaters for Use of Unlicensed Personnel (x’s 2). Mr. Fontenot cited Mr. Travis and Mr. Coleman for Journeyman Work without a License. Mr. McWaters, Mr. Travis, and Mr. Coleman are requesting an Appeal for their Violations. Mr. McWaters, Mr. Travis, and Mr. Coleman were cited for the same violations in September 2018 and they were paid in full. As of April 25, 2019, Mr. Travis is still not registered as an Apprentice with the SPBLA Office.

MOTION: To reduce the violations for Mr. McWaters, Mr. Travis, and Mr. Coleman to $1,000.00.

Mr. McWaters stated to Mr. Fontenot that Mr. Coleman was only supposed to be working on the A/C system and not to touch the plumbing. Mr. Fontenot cited Mr. McWaters for Use of Unlicensed Personnel (x’s 2). Mr. Fontenot cited Mr. Travis and Mr. Coleman for Journeyman Work without a License. Mr. McWaters, Mr. Travis, and Mr. Coleman are requesting an Appeal for their Violations. Mr. McWaters, Mr. Travis, and Mr. Coleman were cited for the same violations in September 2018 and they were paid in full. d.) Violation Appeal – Karl Sanson – On October 4, 2018, State Plumbing Board of Louisiana Enforcement Officer, Mr. Fred Fontenot, arrived at a residence at 13249 Hwy 28 Deville, Louisiana. Mr. Fontenot met a gentleman, Mr. Jim Miller doing carpenter work at the above location. Mr. Fontenot observed an old bath tub on the carport and an old toilet in the dumpster. Mr. Fontenot identified himself as an Enforcement Officer for the State Plumbing Board of Louisiana. Mr. Fontenot asked Mr. Miller who was doing the plumbing work and Mr. miller stated to Mr. Fontenot that it was a local guy named Mr. Karl Sanson. Mr. Fontenot asked Mr. Miller if he could see the work being done and Mr. Miller gave him permission and brought Mr. Fontenot through the house which was undergoing major renovations. Mr. Fontenot observed a new toilet and bath tub that had been installed and some new pex piping in the wall in the bath room and observed that kitchen piping was removed from the sink area in the kitchen. Mr. Fontenot asked Mr. Miller who installed the fixtures and Mr. Miller advised that Mr. Sanson did. Mr. Fontenot asked Mr. Miller for the information to get in touch with the contractor and Mr. Miller stated the name of the contractor is Sam Scott Miller LLC and gave him his phone number. After multiple attempts to contact the contractor, Mr. Fontenot was unable to get in contact with him. Mr. Fontenot was able to locate Mr. Sanson’s information through the State Plumbing Board of Louisiana’s Database and it showed that Mr. Sanson was a Journeyman Plumber, however; his license was not attached to a company. Mr. Fontenot attempted to contact Mr. Sanson and the number he had for Mr. Sanson was no longer in service. Mr. Fontenot went back to the location and asked Mr. Miller to contact the contractor, Mr. Scott Miller. Mr. Fontenot spoke with Mr. Scott Miller and identified himself and asked Mr. Scott Miller who was doing the plumbing work on this job and Mr. Scott Miller advised that Mr. Karl Sanson, a friend of his from high school. Mr. Fontenot asked Mr. Scott Miller if he had any invoices from Mr. Sanson and Mr. Scott Miller stated he had an invoice at his office and he would send Mr. Fontenot a copy of the invoice as soon as he got back to his office. Mr. Fontenot then advised Mr. Scott Miller that Mr. Sanson was only a Journeyman Plumber and this job was required to be done by a company with a licensed Master Plumber. Mr. Fontenot received a phone call from Mr. Sanson and Mr. Sanson stated to Mr. Fontenot that he was a retired plumber and that he did not do any plumbing. Mr. Fontenot informed Mr. Sanson that the contractor informed him that Mr. Sanson was the plumber on this job and Mr. Sanson then became irate with Mr. Fontenot and denied that he had done any plumbing and refused to give Mr. Fontenot his license number. Mr. Sanson continued to become irate and continued to deny doing any plumbing and stated that all he did was install a flange for the toilet. Mr. Fontenot then received a text message from Mr. Scott Miller stating, “Dear Sir, I’ve check records and email and do not have any invoices from Karl Sanson. I contacted him asking how he would have sent it. He has not sent one since he didn’t intend to be paid for helping out a friend. Sincerely Scott Miller.” We received a letter from Mr. Sanson stating all he did was help a friend out in his spare time. He stated he did not get paid or ask to get paid. Mr. Fontenot cited Mr. Sanson for Master Work without a License and No Sign on Jobsite. Mr. Fontenot cited Mr. Scott Miller for Contractor Using Unlicensed Persons and his citation has been paid in full. Mr. Sanson is requesting an Appeal for his Violations.

e.) Violation Appeal – Shayan Kerai – On August 16, 2018, State Plumbing Board of Louisiana Enforcement Officer, Mr. Glen Gremillion, received a complaint of an unlicensed plumber doing plumbing work at 13916 Hwy 165 Kinder, Louisiana. Mr. Gremillion arrived at the above location and could see that there was plumbing work being done by the concrete being broken up for piping, (water and sewer). Sewer pipe was already installed and covered up but not concreted in. Mr. Gremillion then called the City Inspector, Mr. Rick Harper, to come meet him at the location. Mr. Gremillion introduced himself as an Enforcement Officer for the State Plumbing Board of Louisiana and asked the clerk to speak to the manager. The clerk advised Mr. Gremillion that he was on his way to the store and would be in shortly. The owner/manager, Mr. Shayan Kerai, arrived and Mr. Gremillion asked him who did the plumbing work. Mr. Kerai told Mr. Gremillion that his worker used to be a plumber’s helper in Lake Charles and knew how to do the plumbing. Mr. Harper told Mr. Kerai to uncover the sewer pipe so he could inspect it before any more work could be done. Mr. Harper shut the work down until a licensed plumber could finish the work. Mr. Gremillion cited Mr. Kerai for Operating a Plumbing Business without a License, Master Work without a License, and Contractor Using Unlicensed Person. Mr. Kerai is requesting an Appeal for his Violations.

MOTION: To reduce the violations for Mr. Kerai to $750.00.

f.) Violation Appeal – Kenneth Fa-Kouri – On January 22, 2019, State Plumbing Board of Louisiana Enforcement Officer, Mr. Fred Fontenot, observed a plumbing vehicle truck parked at an unoccupied camp ground (Acorn Hill R V Park) located at 7480 Natchitoches Hwy., Robeline, Louisiana. Mr. Fontenot observed a gentleman working on the piping. Mr. Fontenot identified himself as an Enforcement officer for the State Plumbing Board of Louisiana and asked to see the gentleman’s plumbing license. The gentleman informed Mr. Fontenot that he did not have a plumbing license. The gentleman, (Mr. Ricky Leggett) advised Mr. Fontenot that he was working on the guards for the valve cutoffs at the R V hookups. The guards are attached to the waterlines to protect the cutoffs from breakage and freezing and keep the dirt off the valves. Mr. Fontenot observed all of the hookups that had new waterlines. Violation Appeal – Ricky Leggett – On January 22, 2019, State Plumbing Board of Louisiana Enforcement Officer, Mr. Fred Fontenot, observed a plumbing vehicle truck parked at an unoccupied camp ground (Acorn Hill R V Park) located at 7480 Natchitoches Hwy., Robeline, Louisiana. Mr. Fontenot observed a gentleman working on the piping. Mr. Fontenot identified himself as an Enforcement officer for the State Plumbing Board of Louisiana and asked to see the gentleman’s plumbing license. The gentleman informed Mr. Fontenot that he did not have a plumbing license. The gentleman, (Mr. Ricky Leggett) advised Mr. Fontenot that he was working on the guards for the valve cutoffs at the R V hookups. The guards are attached to the waterlines to protect the cutoffs from breakage and freezing and keep the dirt off the valves. Mr. Fontenot observed all of the hookups that had new waterlines. Louisiana. Mr. York observed two (2) covers lifted off of what appeared to be backflow devices for about thirty (30) minutes. Mr. York approached the location and observed a gentleman who he recognized as Mr. Steven Alexander as he had cited Mr. Alexander in September 2016 for No Sign on Jobsite and Master Plumber Work with an Expired License and identified himself as an Enforcement Officer for the State Plumbing Board of Louisiana. Mr. York asked Mr. Alexander what he was doing, and Mr. Alexander stated he was going to replace this backflow device (which he pointed to the new backflow device in a box in the back of his truck) at this location. Mr. York then asked Mr. Alexander for his Master Plumber License and Mr. Alexander handed Mr. York his Expired Master Plumber License (LMP #4582) and his Louisiana Driver’s License. Mr. York then asked Mr. Alexander if he was certified to install a backflow device and did he have the WSPS Endorsement. Mr. Alexander stated that he did not have the necessary endorsement, but he has installed many of these devices. Mr. York then advised Mr. Alexander that he must renew his Expired Master Plumber’s License before he did any future plumbing and that he could not install a backflow device unless he was certified to do so. Mr. York cited Mr. Alexander for Operating a Plumbing Business without a License, Master Work with an Expired License, WSPS Work without and Endorsement, and No Sign on Jobsite. Mr. Alexander is requesting an Appeal for his Violations. Mr. Alexander sent in a letter stating, “I will not be attending the hearing on the 25th. I am retired from plumbing and have no intention of renewing my plumbing license as I did nothing that would merit a fine, and I trust no further attempts will be made to pursue this matter.”

j.) Violation Appeal – Jerry McMurry – On February 12, 2019, State Plumbing Board of Louisiana Enforcement Officer, Mr. James York, arrived at location 1200 Arlington Avenue, Ruston, Louisiana. Mr. York was sent a building permit from the City of Ruston for plumbing work being done at the above location. Mr. York stated when he arrived at the location there was no jobsite sign posted at the location. Mr. York contacted the contractor listed on the permit, Mr. Cecil Davis, and asked who the plumber was for this location. Mr. Davis stated to Mr. York that the plumber was McMurry Plumbing, Mr. Jerry McMurry. Mr. York contacted SPBLA Staff Member, Ms. Ashleigh W. Cambre who advised Mr. York that Mr. McMurry was not listed on the SPBLA website due to him not renewing his 2019 Master Plumber License as of that day. Ms. Cambre gave Mr. York Mr. McMurry’s contact information. Mr. York was able to contact Mr. McMurry and advise him about him not having a jobsite sign at the location. Mr. McMurry stated to Mr. York that he had not done any plumbing at that location in quite a while. Mr. York stated that he could not tell by observing the location, the time frame at which the plumbing was done. Mr. York cited Mr. McMurry for Working with an Expired Master Plumber License and No Sign on Jobsite. Mr. McMurry is requesting an Appeal for Working with an Expired Master Plumber Violation. Mr. McMurry paid his violation for No Sign on Jobsite.

Mr. Jenkins passed the Journeyman Plumber Exam, but he is no longer in the Apprenticeship Program and was unable to show proof of completion which is required to obtain an Initial License. Mr. Jenkins is here today to show proof that he has been in the plumbing trade for at least five (5) years. Mr. Jenkins is requesting to receive his Initial Journeyman Plumbing License without having to show proof of completing the Apprenticeship Program.

ADVISORY REPORT

Mr. Keith Bienvenu stated the advisory board met this morning and did not have a quorum this morning. Mr. Bienvenu stated we only had four (4) members and we could not have an official meeting. Mr. Bienvenu stated they would like the Board to start allowing vendor presentations to be non-generic and to be more product specific.

ENFORCEMENT OFFICERS’ REPORT

The enforcement officers each gave their individual report.

EXECUTIVE DIRECTOR’S REPORT Executive Director, Mrs. Ashley J. Tullier addressed the board and stated the

staff was cross trained to be able to process all license types to make it more stream lined. Mrs. Tullier stated we found this year that would make the process more stream lined is to have one renewal form for all license types. Mrs. Tullier stated on the front of the form it is basic personal information, who they are working for, their employer, and it goes further to discuss the license holder responsibilities. Mrs. Tullier stated on the back of the form are all of the license fees and we included to let them know these fees include the ten dollar ($10.00) processing fee. Mrs. Tullier stated all they will need to do is pick the license type, enter in the amount that it states, and total it at the bottom. Mrs. Tullier stated not only are we cutting down to one renewal form, we are hopefully making it more stream lined for the licensees. Mrs. Tullier stated she would like to report that the continuing professional education complaint process has been put together administratively and consist of putting something in writing and submit the complaint to our office. Mrs. Tullier stated once the complaint is submitted to our office, she would hold a formal investigation and at the next applicable Board meeting, she will provide that complaint along with what she has found so the Board can take corrective action. Mrs. Tullier stated the State of Louisiana is now requiring our budget to be turned in a lot earlier, in March. Mrs. Tullier stated she has spoken with our CPA and our Secretary Treasurer and the only way to bridge that gap is to have a special board meeting in December specifically for the budget. Mrs. Tullier stated that puts us close enough for us to be able to budget for the next fiscal year and also allows us to meet the state deadline. Mrs. Tullier stated she has legislative updates regarding House Bill 78, by Representative Carmody. Mrs. Tullier stated the bill did require a one hundred dollar ($100.00) fee for contractors that is optional for their educational program and that bill struck out the word optional and the contractors are forced to pay that additional one hundred dollars ($100.00). Mrs. Tullier stated it was defeated in the committee on April 23, 2019, however; they have not released any proceedings yet. Mrs. Tullier stated House Bill 172, by Representative Pierre, provides for a training registration and certification process for prior existent material applicators. Mrs. Tullier stated that is more applicable for the bigger commercials, however; it is important for us to watch that. Mrs. Tullier stated it has been ordered to move to the senate Mrs. Tullier stated House Bill 503, by

Representative Rick Edmonds creates a fresh start act for persons convicted of certain crimes in the workforce. Mrs. Tullier stated this is something that we especially need to watch. Mrs. Tullier stated State Plumbing Board of Louisiana Staff Member, Mrs. Dustine Tullier is no longer employed with us. Mrs. Tullier stated Mrs. Dustine Tullier spent roughly seven and a half years with the Board and we are very sad to see her go, however; we do wish her the best. Mrs. Tullier stated we are hiring for the Master Licensing Division and that is done through Civil Service and that job has to post for an allotted amount of days and close before she can start the interview process. Mrs. Tullier stated our staff has done a phenomenal job even with losing people. Mrs. Tullier stated we signed the contract with NITC to move forward with updating our plumbing exams. Mrs. Tullier stated NITC is working on that end and she is working on re-writing the NASCLA Business Law Book. Mrs. Tullier stated she is taking the Gas Laws and incorporating them into the NASCLA book. Mrs. Tullier stated once she has completed the re-writing, the Board will have a chance to view the book to ensure it is where they want it to be and once we move forward with that, NASCLA will be able to publish it. Mrs. Tullier stated we are probably two months out from that happening. Mrs. Tullier stated there has been a lot of questions regarding Mr. Finley’s position. Mrs. Tullier stated she did speak with Amanda Ames, with the Louisiana Department of Health and she was made aware there are two resumes turned in for his position. Mrs. Tullier stated they are going to submit them to the Board and Commissions this week and we should see that position filled soon. SPBLA Board Member, Mr. Carl N. Bourgeois stated to Mrs. Tullier since we are re-writing the test, will we consider changing our practical at the time. Mrs. Tullier stated it will need to be done and we will need to put together a committee. Mrs. Tullier stated we will probably not roll out the new exam until next year. Mrs. Tullier stated it will behoove us to put together a committee to review the practical and make sure the practical is up to code and if it is not then we can make those adjustments. Mr. Bourgeois stated he was more referring with how it is all out on the street now and they know what they are looking at before they even walk in here and he has been told that by several different people. Mr. Bourgeois stated we change it, so it is not rubber stamped what they are walking in to do. Mrs. Tullier suggest the Board put together a committee to work on that and present it to the Board and that would be our best option to redo those practical exams. Vice-Chairman, Mr. Kelly Craft stated to Mr. Bourgeois if he would like to be a part of that committee, along with SPBLA Board Member, Mr. Terry Smith, Advisory Board Members, Mr. Jay Huckabee and Mr. Michael Eilers. Mr. Craft stated he agrees with Mr. Bourgeois.
