TCF then contacted multiple references, documented and evaluated the results. TCF did not contact the Contractor directly to verify whether they were comfortable and confident with their bid after having had time to review it following the bid opening. TCF Architecture has worked with Bayley Construction on one prior project (2008-10) and also contacted several past Owner’s Representatives. Based on the reference checks we have made, it appears that the Contractor is qualified and capable to perform the work. They received generally positive references from five of the seven individuals contacted with one somewhat neutral and one very negative. Please review the attached information for more details on the Contractor’s references. As such, we see no reason that would indicate Bayley Construction should not be awarded the work for the Seattle World School at T.T. Minor Modernization Project. Seattle World School at T.T. Minor Modernization Project Contractor References Summary by TCF Architecture PLLC Dear Paul: This letter is being provided to inform the Seattle Public Schools of our findings from reference checks on the apparent low bidder, Bayley Construction. the project due to concrete issues. Concrete had to be totally covered with an epoxy topping. Mediation just lasted two days and a deal was struck. They originally asked for $200K and settled at $80K

their reputation. They were very civic minded and participated in fund raising for Ingraham and when ESPN said they would pay for a new BB court, Bailey volunteered their time to install. Both of the above noted projects were WSSP and Cedarpark was also landmarked.

QUESTIONS:

Superintendent tried to do his job well, but with each step up the ladder the culture of thefirm got worse. The Senior Project Manager was very difficult to work with.

4. Did the Contractor complete the project on schedule, and if not, why? There were someweather issues that extended time, but the Contractor also tried to claim additional timethat was denied. Owner/CA team felt that they had to watch very closely to ensure thattime was not claimed improperly.

5. How did the Contractor manage the schedule during the course of the project? (ie.: did they stayon track throughout the project?) There were many disagreements about scheduling.

6. Were the Contractor’s cost proposals on Change Orders reasonable? No, they were usuallymagnified by at least 3 and sometimes as much as 10 times what the Owner and Architectbelieved they should be.

7. Did the Contractor perform the required paperwork in a timely and appropriate manner, and ifnot, what were their problems? They had to be prodded to keep paperwork up to date.

8. Did the Contractor manage their subcontractors in an appropriate and effective manner, and ifnot, what were the problems?

9. Please assess the quality of construction work completed by the Contractor. The actual projectturned out well. The gym floor had some initial problems and the concrete had to be tornout and re-done.

10. Did the Contractor make any claims on the project, and is so, for what? Yes, many of the COPscould not be agreed upon so they ended up combined into a +/-$4M claim at the end of theproject. Outside auditors determined that the actual amount should have been between$300-$400M. The claim was settled for far less than the original claim.

11. Please assess the Contractor’s overall performance. This contractor was difficult to work with and did not try to be a team player. The quality of construction was good overall.

12. Would you work with this Contractor again, and would you recommend them to others? Would not work with this contractor again if given the choice and would not recommend them to others.

13. Additional info offered: James noted that in his 25 years of CA experience this was by far the most difficult contractor he has worked with.

2. Were the Contractor’s cost proposals on Change Orders reasonable? Yes, their change order proposals are good for the most part. They check on their subs COPs prior to issuing and try to keep them to a minimum.

3. Additional info offered: Bob thinks highly of Bailey and is happy to work on projects with them. He believes they are in the top 10% of contractors with whom he’s worked.

complete but mostly on schedule – see notes 8 below. 5. How did the Contractor manage the schedule during the course of the project? (ie.: did they

stay on track throughout the project?) They are staying on course; monitored weekly at meetings.

6. Were the Contractor’s cost proposals on Change Orders reasonable? yes 7. Did the Contractor perform the required paperwork in a timely and appropriate manner, and if

not, what were their problems? yes 8. Did the Contractor manage their subcontractors in an appropriate and effective manner, and if

not, what were the problems? They have had some problems with the landscape sub. Lee did not want to give names, but suggests that landscape should be punched at least a month prior to substantial completion.

complete but no claims are expected 11. Please assess the Contractor’s overall performance. Top Quality 12. Would you work with this Contractor again, and would you recommend them to others? yes 13. Additional info offered: Lee has worked with both Jim Levin and Denny Wilson. He

highly recommends both. He suggests that the architect and owner must make effort to keep Jim engaged as he will only be on site 1-2 times per month. He will work several projects so it is important that you be assertive and let him know that you consider him an important part of the project. Lee noted that Denny is really growing into his job as Superintendent and will take ownership and provide good leadership.
