He planned for the future, work- ing with the city’s movers and shakers to create and remake Rochester as it transitioned from a mid-sized community, to a more urban environment. Han- son also valued the everyman, giving each perspective his full attention and talking to high school students and boy scouts during nearly every council meeting. The Rochester community joined Hanson’s family and friends in mourning his unex- pected passing due to a brain aneurysm at age 57. “You can’t say Denny Hanson without smiling,” said Rochester Area Chamber of Commerce president John Wade. “He will be sorely missed.” A tireless champion of his hometown, Hanson reveled in his role as a civic leader and was a colorful character during community events. He was a steady proponent of growth and development who presided over Rochester city government dur- ing a time of expansion despite national economic downturn. Hanson was particularly inter- ested in improving the down- town area and led the charge on several game-changing develop- ments in this area during his nearly eight years as council president, including the addi- tion of a University of Minne- sota campus and the adoption of the Downtown Master Plan and its accompanying develop- ments. Those who have lived, worked, and visited the down- town area in the last few years have undoubtedly witnessed a marked change. Most recently, President Han- son had been passionate about promoting the expansion of the Mayo Civic Center and exten- sion of the city sales tax. Hanson presided over coun- cil meetings with remarkable wit and skill. He allowed every one wishing to comment on an issue the opportunity to do so, listened to each point of view, and offered solutions to situa- tions that his colleagues on the council often followed. “Denny was a friend, col- league, mentor and just a great person to be around. You could always count on something fun happening if Denny was there,” said Randy Staver, fifth ward city council member and inter- im council president. Mayor Brede shared that Han- son came to his style of openly welcoming all those wishing to comment by way of his distaste of the way a past council presi- dent, not immediately preceding him, would shut down hearings quickly. “That really bothered him and it explains why he prob- ably went overboard in the other direction,” said Brede. “We were all thinking ‘come on, we’ve heard the same thing ten times already’, but Denny wouldn’t have it any other way. Hanson would also take ques- tions on his weekly radio show, and offer up solutions and pro- vided insider information on a wide variety of issues. Hanson was first elected to the council in 1998 to represent the first ward. He was subsequently re-elected and in 2004 made a successful bid for the position of council president, which is a position elected by all Rochester residents. Hanson was re-elected in 2008 and had filed for re- election this November. One of four Mayo High School graduates on the city council, Hanson graduated in 1973 and spent his adult life in Rochester. He worked at Mills Fleet Farm and later at Kruse Lumber before taking on his current job as vice-president of business development at Carpet One. The city council chose fifth ward council member Randy Staver to assume the role of council president on a temporary basis until a permanent replace- ment is elected and takes office in January. Staver was selected because of many years of experi- ence leading state, county, and city meetings, most recently the city planning and zoning com- mission. “It’s a hollow victory. ilene Mildred Anderson Ilene Mildred Anderson, 89, of Chatfield, died Tuesday, July 3, 2012, at Saint Marys Hospital in Rochester. Ilene Mildred Soiney was born May 16, 1923, in Harmony, to Lawrence Soiney and Matilda (Jacobson) Soiney. She attended Harmony and Whalan Schools. She married Ervin O. Anderson in 1943 in Whalan. Ervin passed away in 1968. Ilene was a nurses aide at the Lanesboro and Preston Care Centers. She worked at Saint Marys Hospital as a housekeep-er and dietary aide, and cleaned houses for Doctors in Rochester for many years. Ilene was a member of Whalan Lutheran Church and the Erickson-Rose Legion Auxiliary Post 637. She enjoyed spending time with her family, making mission quilts and day trips with friends. She is survived by four daugh-ters, Carole Johnson of Chatfield, Linda (Larry) Wrolstad of Kenyon, Donna (Francis) Novotny of Chatfield and Cindy (Ole) Bothun of Chatfield; 12 grandchildren; 17 great-grandchildren; seven great-great-grandchildren; and one sister, Bette (Milton) Eide of Rushford. She was preceded in death by her husband, Ervin, a daughter, Sharon, three brothers and three sisters. Funeral services were held Sat-urday, July 7, 2012, at the Whalan Lutheran Church, in Whalan, with Rev. Patricia Hinkie officiating. Burial was in the Whalan Cem-etery. Everyone who came in contact with Ilene loved her. She has left a legacy of wonderful memories for

her family and friends. Riley Funeral Home in Chatfield was in charge of arrangements.

John Owen Edstrom John Owen Edstrom, 65, of Winona died from lung cancer, unrelated to smoking, on Sunday, June 24, 2012. He died peace-fully at his home, surrounded by his family. He was born August 31, 1946, in Winona to Harold Edstrom and Josephine Kjelland Edstrom. He received his primary and second-ary education in Winona Public Schools. He began his bachelor’s degree at Lawrence University, then left to explore big-city life and study at Columbia University. After hav-ing had his fill of New York, he returned to Winona and met the love of his life when they both had parts in a play at the College of Saint Teresa. John earned his bachelor’s degree at Lawrence, and he and Frances Muraine Bowler married on August 16, 1969. He began his career as an English teacher at Winona Junior High, and left after a year to pur-sue postgraduate studies at the University of Washington. Again unable to ignore the call of the Hiawatha River Valley, he returned to Winona and found his life’s work when he and his wife began the Winona Shopper in 1971. After sur-viving the first few very lean years, the publication grew into what is known today as the Winona Post, a thriving newspaper that has won many state and national awards for journalism and art, including many for John’s editorial writing. John is survived by his wife, Frances; his daughters, Cassidy (Angie Ause) and their son Harold, and Morgan (Dan Gish) and their

daughters Peyton and Andalucia; his mother, Josephine; his siblings, Lee (Kathy), Tom (Roxanne Per-gola), Nancy (Steve Bachler), and Nick (Lori); his aunt, Mary; his many cousins, including Winona cousins Steve, Patty, KRS, Kate, and Kim; nieces, Megan, Katie and Jenny; nephews, Luke and Jason; in-laws, John Bowler, Susan Bowler and Mary Ann Bowler; and Omaha family, especially Kay and Paul Bashus, and Mary Borowiak.He is preceded in death by his son, John Harold (Jake); his father, Harold; his in-laws, John Bowler and Margaret Bowler; Terri Bowler; Michael Bowler; and favorite uncles, Ev Edstrom and Roy Stark. His memorial service was Sun-day, July 1, 2012, at First Congre-gational Church in Winona, with Tom Schoen and Pastor Timothy Forester presiding.

inga Emma (Johnson) Frey Inga Emma Frey, 100, died on Friday morning, June 15, 2012, at Field Crest Care Center in Hay-field, MN. Inga Emma Hollevoet was born on September 19, 1911, the daugh-ter of Joseph and Helena (Knutson) Hollevoet in Fertile, MN. She was united in marriage to Sverre John-son in 1932, and he died in 1985. In 1987, she married John R. Frey. Inga lived in Bemidji from 1969 until 2003, when she moved to Hayfield. Inga is survived by her hus-band, John R. Frey, Manti, UT; children, Dale (Teresa) Johnson, Rosemont, MN; Joyce Lacy-Gould (Dave), Salt Lake City, UT; Shir-ley (Don) Comeau, Seneca, SC; Deanna (Darrell) Denisen, Eleva, WI; Sandy Johnson, Rochester, MN; and Steve (Kathy) Johnson,

Rochert, MN. Also surviving are 23 grand children, several great and great-great grandchildren. She was preceded in death by her first husband, Sverre Johnson; daughter and son-in-law, Marlis (Merwin) White; sons-in-law, Gene Hartson and Randy V. Johnson; great granddaughter, Roberta Lee Faulhaber; great grandsons, Daniel Paul Mesich; Carson Randy Braun; and 10 brothers and sisters. The family prefers memorials to your favorite charity in lieu of flow-ers. Blessed be her memory. The funeral service for Inga Emma Frey was Wednesday, June 20, 2012, at Trinity Lutheran Church in Hayfield with Reverend Paul Hauschild officiating. Inter-ment was in the Waltham Town-ship Cemetery in rural Waltham.

William McFarland William Archie McFarland, age 81, died peacefully at his home, surrounded by family, on the farm Tuesday, June 26, 2012, near Elgin, Minnesota. William (Bill), born May 4, 1931, near Potsdam, Farmington Township, to Archie and Verna (Kuhlmann) McFarland, gradu-ated from Elgin High School, class of 1949. He served in the U.S. Army during the Korean War, from March 1954 to March 1956, sta-tioned at Fort Richardson, Alaska. Bill married Kathleen Culbertson on April 17, 1971, at Immanuel Lutheran Church in Potsdam. Bill was actively engaged in farming and milking cows his entire life. The family farm name is “Macland Holsteins.” A funeral service was held at Immanuel Lutheran Church in Potsdam.

Joshua Ottman Joshua Paul Ottman, age 36, of Oronoco passed away unexpectedly June 30, 2012, from complications of Type 1 Dia-betes. Joshua was born Septem-ber 7, 1975, in Rochester to John and Mary (Walker) Ott-man. Joshua worked with his brother at Ottman Excavating, Inc. He loved to be outdoors, hunting morel mushrooms in the spring, fishing and hunting, and enjoyed riding and racing ATVs. He was a true kid at heart and enjoyed having fun. His smile would brighten even the worst of days. He took life as it came to him with a positive attitude and a bright smile. He was a hard worker and was always there to help. He loved animals- especially his longtime canine companion Frisbee who was usually at his side. He lived his short life to the full-est, always caring for others with kindness in a true spirit of happi-ness. Joshua is survived by his father, John Ottman of Rochester; his mother, Mary Ottman of Oronoco; his brother, Jason (Sara) Ottman of Rochester; his sister, Jennifer (Brad) Murphy of St. Charles; his three nephews, Jack, Jonah, and Westin; and as well as both grandmothers, Wilma Walker of Rochester and Jeanne Bergan of Wabasha. He was preceded in death by his grandfa-thers. A Funeral Mass was held Tues-day, July 3, 2012, at Pax Christi Catholic Church. Burial followed in Oronoco Cemetery.

By Nate Langworthy Confusion regarding notice for a public input meeting prompted the city council to continue a hearing on adopting the Imagine Slatterly vision plan into the city’s compre-hensive land use plan until fall by a 6-0 vote. This vision plan is a long-range development plan that puts for-ward a guideline that addresses land use and neighborhood mobil-ity. In 2008 the Rochester Area Foundation received $1.6 mil-lion from the city to alleviate the effects of disproportionately high rates of foreclosures in Rochester’s core neighborhoods. The founda-tion’s First Homes project began rehabbing and reselling distressed homes that had been a blight in the neighborhood. Imagine Kutzky’s vision plan was adopted by the city in 2004, and the foundation

began working with residents of other core neighborhoods, includ-ing Slatterly Park, through a simi-lar process of identifying aspects of their neighborhood that could be improved upon and making design support from staff with architectural expertise available in order to render plans to do so. Wayne Flock, president of Slat-terly Park Neighbors, stated that the process has been transparent, and that neighbors had been noti-fied through a postcard mailed out to each home in Slatterly Park, in addition to newspaper advertising, emails, and the association’s web site. He addressed the long-term nature of the plan, and clarified that each individual project would be addressed separately at some point in the future. “Either we take advantage of the growth of downtown and become a part of that or we let hodgepodge

A lot of it would look much different.” Timothy Macken and Loring Stead spoke in support of the vision plan. Three neighborhood residents stated that they did not receive notice for the final public input meeting held in September of 2011, and took issue with components of the comprehensive neighborhood vision plan. Doris Amundson, who has lived on 6th Street southeast for 43 years, was opposed to a motor vehicle bridge connecting the street with Broadway. She preferred a bridge that would accommodate only bicycles and pedestrians. Amund-son stated that she did not receive notice of the September meeting. Neighborhood resident Dana Inman also stated that he did not receive notice and objected to the plan. “I’m going to have a drag strip through there (a block from his home) and I’m not happy with that. I don’t belong to the neigh-borhood association and I didn’t know anything about this. I’m not in favor of any of this,” he said. Council member Ed Hruska clarified that adopting the vision

plan did not mean adopting any individual components that it con-tains. “There could be a lot cleared up, a lot of misconceptions a lot of con-cerns,” said council member Mark Bilderback, who lives in the Slat-terly Park neighborhood, regarding his support for another neighbor-hood meeting. “Our neighborhood has come a long way but I think it’s important that we do have clear communication.” “We want to be sure that the disagreements are based on facts,” said council member Bruce Snyder. “Nothing’s going to change in the next six months anyway.”

“Nothing really good happens without a vision,” council mem-ber Michael Wojcik said, express-ing his support for neighborhood visioning efforts. Wojcik recounted Flock’s efforts about a decade ago to form the Rochester Downtown Alliance and Thursdays on First. “There wasn’t much happening the first few years, it wasn’t well attended and it didn’t go anywhere. But there was a vision there and I think the results are pretty well in on that one. “When I see plans like this, I’m reminded that it’s a lot easier to tear something down than to build something up,” he said. Imagine Slatterly will hold another public input meeting on a date to be announced in early fall.

By Al Schumann The city of Eyota has received a Grant of $344,000 from the Minn. Dept. of transportation to create safe routes to School for their students. The City will add sidewalks and Bike paths. H a v i n g developed a major part of the city, I won-

dered about the need. Eyota has one of the best streets in the area for both auto and bike paths. When we were developing, we were required to put in paved roads for the use of the autos and bikes. Sidewalks are placed on one side of any heavily traveled streets. We did not place sidewalks in the strictly residential streets for a very good reason. The streets are always plowed first in the winter and sidewalks are the homeowner’s problem. Many older people find it impossible to shovel

ings. The Federal government, which borrows over 40 percent of its money abroad, is giving Min-nesota over $16,850,000 under this program. Minnesota has about two percent of the nation’s population, and if the rest of the nation gets the same proportion of free money, it becomes mind-boggling. Let’s also remember there is no such thing as free money. Anyone selling a home after this year will have to pay 3.8 percent of the sale price to the Federal government. Your electricity has already gone up because the tax has already been applied. And you are going to have

to pay taxes on your gas, autos, crutches, wheelchairs---everything is going to be taxed to pay for an edict from Washington that says that people should walk more and ride their bicycles to school. They can do it now without spending one dollar of our tax money. One of the greatest problems that face any legislator is being able to say “No”…there are always people who want more from their government. My family grew up during the depression years when Mother said “No” quite often. We

their walks, and in most families both parents have to go to work before they have a chance to shovel their sidewalks. If you have a side-walk and don’t get it shoveled, you could be sued or penalized. As far as I know, there have been no acci-dents that would indicate that we have unsafe streets in Eyota. But the article goes on to indi-cate that the grant is a federally-funded program for transporta-tion enhancement. The article also points out that Winona got $600,000 to rehab owner-occupied homes and Lanesboro got $449,000 for housing and commercial build-

By Yvonne Nyenhuis In my twenties, I worked as an Embroidery Designer in Philadel-phia. My dear friend and mentor, Ronald Levy, and I frequently had lunch together in Fairmont Park. One day we were sitting in the sun enjoying our corned beef sandwich-es and pickles, when a flock of birds settled in front of us pecking at chunks of dry rolls that had been thrown on the ground. Out of nowhere a witch-like figure, scrawny and bent over, covered in black, emerged. She pulled a crumpled brown paper bag from the folds of her garments, scooped the rolls into her bag, and swiftly disappeared. No one should have to take dry chunks of bread from the birds in order to survive! Fast-forward to nineteen-sixty-seven. I’m married, living in an

apartment in Minneapolis with my husband, Glenn, and our eighteen-month-old son, Gordon. Once a week I’d pile our laundry into the stroller and taking Gordon’s hand, walk to the Laundromat on Hen-nepin Avenue. One morning we walked over the Hennepin Bridge. I found myself looking down to the railroad tracks below where there was a large cement platform. I wondered at first what all the people were doing. They huddled in twos and threes. Some walked aimlessly in the area. They were shabbily dressed, with slumped shoulders looking down at the ground. Then it hit me. These people are homeless! The awful reality swept over me. When you don’t have a job there is no place to go. When night comes, where do you sleep? What do you eat? For forty years the middle class has been losing ground and pov-erty has increased. The “poor” did not cause the “recession,” yet Republicans in Congress tell us that “entitlements” are the prob-

lem. We must cut food stamps, school lunches, Head Start and Planned Parenthood. Meanwhile they insist we should continue sub-sidies to Corporations and tax cuts for the rich. It is not “Big Government” we need to fear. Corporations have taken over our lives! The drive to “repeal Obama Care” has been care-fully orchestrated by Health Insur-ance companies. The Media is fed by a spring of lies and misinfor-mation. Health Care is a business motivated by profit. Drug compa-nies’ main objective is not “healing the sick,” it is selling drugs! Mon-santo and Cargill engineer our food for “appearance and durability.” We are left to wonder how much nutri-tion is in the food we eat. Corporations put profit ahead of the health and welfare of work-ers and desecrate the environment. (We must get rid of the E.P.A. All those silly regulations are cutting into our profits. We must defund OSHA. Safety of workers? Not our responsibility!) They have money and influence but we have “the vote.” Presently sinister forces are at

work to suppress the vote, threaten-ing the survival of our Democracy! In the pursuit of “smaller govern-ment,” Republicans have made huge cuts in money allocated to States to pay salaries for public workers. We NEED police, firefighters and teachers. If they are hired, they will be able to afford to buy houses and cars. They will increase the need for goods and services in the private sector. Banks will lend to new busi-nesses because a market is created. They will pay taxes, increasing gov-ernment revenues, which will allow us to start paying off the deficit. When we provide upward mobility for the poor and the middle class, we all benefit, including the rich! On a trip to England I stood with a friend on the shore of a harbor looking over the town of Wivenhoe. I was surprised that there was no water. The boats were sitting moored to the muddy bot-tom. It was explained to me that twice a day there was a tide of water pouring in from the North Sea: that “The Rising Tide Raised All Boats!”

simply understood that if we wanted something, we had to work for it. Grants are not free, someone has to pay. Should some faceless indi-vidual in far off Washington decide that the people of Eyota need to shovel their walks, or use the bicycle instead of the car to go to work? I should be free to choose what I want or need. Let the Federal Government take care of national defense, the interstate roads and other things that cross state lines. Let the states take care of their own people with needs, education etc. Let our local communities decide how many sidewalks we need. This thing is just an election ploy that will end when the election is over. I’m ashamed to think that some people will fall for it. It did not work in the ‘30s and it won’t work now.

Community members remember Denny Hanson “Denny and I had a great rela-tionship, working closely together for 13 years. It was just a slap in the face to lose him in such a sudden way. He had this unique ability to facilitate discussion and keep mat-ters on an even keel. Sometimes I’d get impatient when he’d take so much time to hear someone out but that just goes to show that he did genuinely care about what everyone had to say. on June 21 was no exception. The masses were a-grinning. Hands were full of toddler leashes, beer and iced tea, fish tacos and ice cream sandwiches. Dessa took the mic and made a telling disclaimer about how she was going to save her “agro” style

music for the second set (at first I thought “agro” meant she was going to rap lustily about agri-culture. I was later informed she meant “aggressive.”) But Dessa dialed it in just about right for the crowd, which she learned from Twitter held a good many Moms in attendance. She rocked the slow jams with sultry sizzle and interspersed the most lickety-

splitting-spitlicks I’ve ever heard. The Sporty Spice look-alike lady emcee issues a heady rap. Lis-tening close to the lyrics you may detect allusions to Roman Mythology, articulate commen-taries on issues of social justice, broken political systems, or other intriguing syntheses of philosoph-ical esoterica and pop culture. Rumor has it Dessa used to

host a pub quiz in the Twin Cit-ies, and that she has been asked to get the pub quiz scene started in Rochester, a smart city that likes its entertainment on the intellec-tual side. Though Dessa preaches about giving artists, historical figures, and all other human beings “char-itable interpretation,” Dessa needs about as much charity as the city

of Rochester— two scenes which appear to be on the rise.

By Nate Langworthy Before Lake Shady can undergo a transformation into a wetland recreational area, a web of poten-tial property rights claims to the lake bed needs to be untangled. Senior assistant county attorney Tom Canan is working to sort out the claims, but because of the complicated nature of the situ-ation, he asked for and received permission from the county board of commissioners to pursue con-demnation on the lakebed proper-ties. After the flood in the fall of 2010 destroyed the dam, the board decided not to replace it and instead repurpose the area. Olmsted County would like to begin removing remnants of the dam in January, and an ease-

ment should allow this to happen without complications. The area near the dam is planned to be the launching point for canoers and kayakers. With deeds to many areas of the lakebed overlapping one another and many of the property own-ers no longer living, clarifying claims to the lakebed has been a confusing process. The state of Minnesota has a claim to the entire lakebed, though the Allis family appears to have property rights to a substantial portion of the lakebed as well. A handful of other property owners have claims to the lakebed adjacent to their property. The city of Oronoco and Olmsted County also appear to have some property rights on the lakebed.

Condemnation an option for Shady lakebed Canan said that some offers have been made, based on figures from the county assessors office, to living property owners with a claim to the lakebed in order to avoid condemnation of their property. The county has reached agreement with three property owners, but “Its going to require sorting out in court,” said Canan. “We’re going to continue to negotiate with property owners to the extent that they exist.” Appraisals will be sent out to property owners 60 days before condemnation proceedings begin. Once the condemnation pro-ceedings begin, property owners will have 90 days to respond and negotiate for what they feel the property is worth. If they do not respond, an amount determined by the county appraiser’s office will be deposited with the court. Funds to pay for the land pur-chase will come from DNR money dedicated to renovating the area.

The city’s charter calls for election for a special election to take place at the soonest possible date in the event of a vacancy in the council president’s position. However the soonest possible date happens to be November 6th, the date of the general election. State election law was changed last year, preventing nonpartisan candidates for local offices to be removed from the ballot, or to have a special fil-

ing period for new candidates to enter. This means that Han-son’s name needs to remain on the ballot and the only other name on the ballot will be chal-lenger Jan Throndson. The city’s charter commission is propos-ing an amendment to the city charter, making the special elec-tion unnecessary in this event, meaning Rochester voters will not receive two ballots if the amendment clears the city coun-cil. By Iris Clark Neumann When building a new house, the most impor-tant landscap-ing element to plant is a tree. S h r u b b e r y l a n d s c a p e d and mulched f o u n d a t i o n plantings are fine, but they will never add as much value to your home or protection as a tree will. I have a maple with dark green leaves in my front yard. Because I live in a cul-de-sac, the pie-shaped nature of the lot allows only enough space for this single tree in the front yard. The backyard is another story. (It is a jungle of pines, spruces, crab apples, white poplar and a willow.) My maple has never rewarded me with beautiful fall color. The leaves stay green until late in the color season. Then they suddenly turn brownish and then fall off into big piles. However, after our long lingering fall last year they turned a yellowish hue. I love this tree. It provides shade in the front of my house and it

has grown to a substantial size in a decade in a half, so that it nearly covers the front of my house. Unlike most other homeown-ers, I use part of my front yard as a living space. There is a curved foot and a half foot high planter that borders a patio area, which is adjoined by a front yard deck. My husband and I enjoy sitting on this deck in the evenings. He especially loves this space on a Fri-day, his favorite night of the week. The tree shelters the view of our outdoor living space from the out-side world and gives the feeling of separation from the wide expanse of asphalt in our cul-de-sac. But there is streetlight located on the far corner of our driveway. This beacon has been an irritation for years in the otherwise joyous time relaxing on our front deck in the dark. We have discussed how some day a branch from the tree might cover the light and we’d visually measure how long it could take. In the mean time, he would threaten sabotaging the light. This summer a branch finally reached out far enough to filter the light’s intruding rays. Yes! It is tempting when choosing a tree for one’s front yard to choose

something cutesy like a cluster of white or river birches or a varie-gated or purple maple. Personally, I would never choose such a tree. For one reason, birches have a shorter life span than an elm, a linden, an oak or a thornless honeysuckle tree. Choose something that will grow on and on and become a strong force in your front yard. Consider planting a Kentucky coffeetree—it grows slowly at first, but in the end becomes a very grand tree. I remember the two beautiful Ohio buckeyes that were planted in my grandparents’ front yard. There’s an older two-story house in my town that is framed by grand tow-ering black walnut trees. Although I have a maple, if I was choosing today I would stay away from a maple as in recent years, they have not proven to be a tree with longevity. Too many maples have been planted and they form a heavy percentage of trees planted in towns. Some trees should never be planted in a front yard or as bou-levard trees. Pines, spruces and weeping willows do not belong in the limited space of a city front yard. I miss the beauty of the grand elms arching over streets and shad-ing both the asphalt and those walking underneath on sidewalks. Once I had a summer job where I mapped and counted all the elms on the Minneapolis campus of the University of Minnesota. The planning department expected

Dutch elm disease to be eminent in the early 1970s and wanted to be prepared. Many towns suffered from the loss of these trees and sometimes in desperation quick-growing trees like cottonwoods or silver maples were planted instead. Years later, these trees give landscape trees

a bad rap with their aggressive roots and branches falling during storms. Currently, there is another threat to our tree population as the green ash was planted in mass to compensate for the dying elms.

Rochester City Lines’ legal challenge failsBy Nate Langworthy A legal challenge posed by Roch-ester City Lines (RCL) in an attempt to stop First Transit from beginning service as the city’s public bus transit provider, failed in district court, as Olmsted District Court Judge Joseph Chase determined that the routes and schedules were not proprietary information and that the bidding process was not so flawed as to invali-date First Transit as the contract recipient. “I am not persuaded of any like-lihood that RCL has been denied Due Process in the City’s actions,” Olmsted District Court Judge Joseph Chase wrote. “I find nothing improper about the City’s handling of the situation RCL characterizes as an ‘organizational conflict of inter-est’.” RCL, which for 46 years had oper-ated buses run by the city and typi-cally planned routes and schedules in coordination with city public works

staff, failed to procure a competitive bid this past winter. The bid was made necessary by the Federal Tran-sit Administration condition that the transit operator be vetted through a bid process in order for the city to continue to receive Federal subsidies for bus transit. State and Federal sub-sidies cover the vast majority of the cost to operate the city’s bus transit. “City Lines never had a leg to stand on and the judge ruled that they didn’t have a leg to stand on,” said city council member Michael Wojcik, who had been individu-ally named in a defamation lawsuit brought by RCL, stemming from statements made on his blog and through social media. “I hope we’re getting to the end of this, the taxpayers are losing a for-tune on this baseless case,” he said. Judge Chase did agree with RCL on one point; that they should be allowed to keep the schedule that they had been running. RCL for-feited rights to this when they did not run a fleet of buses and eventu-ally suspended operations on July 2nd. City Lines general manager Dan Holter blamed the city for the company’s inability to continue to operate. “We have been hobbled and disad-vantaged by the city. We will operate to the best of our ability, limited by the loss of pass-through federal and

state subsidies and the raiding of our workforce,” Holter said in a state-ment. In addition, Holter maintains that the city raided tickets, passes, and schedules during an audit. Holter indicated that the suspen-sion of service was temporary in a later statement. Rochester City Lines continues to operate intercity com-muter buses and coach buses through its affiliate, Heartland Tours. Meanwhile, the transition to Roch-ester Public Transit, operated by First Transit, went forward with minimal confusion. Most of the bus drivers and mechanics had been employed by Rochester City Lines. Rochester Public Transit general manager Randy Huston, who had been operations manager at RCL up until this winter, said that the buses were operating as planned through-out the first week. “We had a few new facility hic-cups on Monday, but other than that everything is going very smoothly. We will continue to offer improved bus service.” Rochester Public Transit will honor transfers from commuter buses at least until the end of the year. teach us about pruning elms. Trees are said to add 15 percent to a home’s value. Underground tree roots are like a sponge and can protect a home from storm water. In a time when we are more con-cerned about harm from the sun’s rays, shade from trees protects us. Trees are like outdoor air condi-

tioners, cooling and filtering pol-lutants from the air. Homes with trees protecting them from the sun on the east, south and west find their indoor air conditioning bills much lower. A shaded asphalt roadway or driveway lasts longer. Thus I wonder why more don’t invest in at least a single tree for
