Introduction

The Philadelphia Water Department (PWD) defines a Private Cost project as any development

project with a scope of work impacting PWD infrastructure. Impact can range from relocating a

fire hydrant to reconstructing public water and sewer systems to accommodate other elements

of the project’s scope. The term “Private Cost” refers to the project’s funding source and is

designated to any work not directly funded through PWD’s capital program. Private Cost

projects require input, guidance, and approval from PWD. Private Cost projects are reviewed

and managed by engineers within the Private Cost group, an ancillary branch of PWD’s Design

Unit.

The PWD may accept and maintain water, sanitary, and stormwater facilities installed within

the public right-of-way by any private developer or agency provided that the facility is designed

and constructed in accordance with PWD standards. A PWD inspector will ensure proper

construction and installation of these facilities, and will issue final approval upon completion of

the work.

The intent of the Private Cost Manual is to:

• Familiarize the Developer and Project Engineer with the procedures and standards

associated with submitting a set of plans that are acceptable to PWD. The plans serve as

construction documents to be adhered to under the supervision of a PWD inspector,

and will be on record as the contract documents associated with the constructed

portion of PWD’s infrastructure.

• Streamline the Private Cost Plan Review and approval process.

• Provide the Project Engineer with PWD standards, including but not limited to design,

drawing, and construction requirements.

• Ensure that PWD and ultimately the citizens of Philadelphia receive infrastructure of the

highest quality with a long and trouble-free service life.

Terms and Abbreviations

The following is a compilation of terms, definitions, and abbreviations used throughout this

manual:

Terms & Definitions Private Cost - Refers to any project where the design and construction of facilities to be

owned and maintained by the Philadelphia Water Department is funded through a non-PWD capital funding source.

Private Cost Group - Group within PWD’s Design Unit responsible for facilitating the proper design of infrastructure built through the Private Cost process.

Private Cost Plan Review - Process by which any party seeking the approval of contract drawings outlining the construction of water, sewer, or stormwater infrastructure will submit to the Private Cost Group for review, comment, and acceptance of the plans.

Design Unit - Branch of PWD’s Planning and Engineering division providing engineering support, a subset of which is dedicated to Private Cost related services.

PWD Engineer - Design Unit engineer assigned to review, comment, and accept the contract drawings and any additional documentation associated with the Private Cost Plan Review.

Project Engineer - Engineer working on the Private Cost component of a project acting on behalf of the Developer.

Developer - The primary catalyst for any project requiring a Private Cost Plan Review, often responsible for managing all moving components of a project.

PWD Inspector - PWD representative present during all construction operations related to PWD infrastructure; assures work performed is of acceptable quality and in compliance with PWD standards, maintains records of completed work, and coordinates with appropriate PWD units throughout construction.

PWD Design Manual - PWD Design Unit’s manual outlining the process and presentation of water & sewer contract drawings. Contains standard formatting for plan presentation.

Philadelphia Water Department Standards

The water and sewer design standards comprise three (3) primary documents:

The objective of the Water and Sewer Design Manual is to promote uniformity in the

presentation of plans by establishing a general format and outlining detailed information

required for the preparation of complete water and sewer contract drawings.

These two documents are referenced throughout the Water and Sewer Design Manual to

supplement the manual with PWD standard details and specifications.

It is the intent of PWD’s design manuals, details, and specifications to give guidance on the

orderly preparation of final documents to be issued for construction as well as communicate

PWD’s own design practices developed over the years. Adhering to the methods, procedures,

language, and examples in these documents promote consistency in the preparation of plans

and supplementary construction documentation.

The Private Cost Manual serves only as a general guideline. Engineers and design professionals

should not rely solely on these guidelines, and must always use professional judgment in the

development of plans and specifications. It remains the responsibility of the design professional

to develop plans based on sound engineering judgment and consistent with all laws and

regulations. Compliance with these guidelines does not guarantee design acceptance by PWD.

The Department will exercise its best professional judgment, on a case-by-case basis, in its

review of each design application.

Lead Service Line Replacement Program

By way of background, the City does not own the water service lines. The full length, from the

City-owned water main to the City-owned water meter, belongs to the customer and is the

responsibility of the customer. When the water mains are replaced, it is prudent to also replace

the customers' water service lines that are in the street to the curb stop. However, in the case

of lead pipes, water service lines are replaced from the curb stop to the meter, which are

located inside the property. This policy is intended to account for any inadvertent impact on the

customer from a partial lead service line replacement (to the curb stop). Additional information

Submission, Review, and Approval Procedures

Private Cost Plan Review – Project Introduction and Plan Submission

Private Cost projects are introduced to the PWD Design Unit from a number of internal and

external sources:

• PWD Stormwater Plan Review – Stormwater Plan Review is a unit within the PWD

responsible for reviewing development projects in the City of Philadelphia to ensure

compliance with the Stormwater Regulations. As part of their Development Review

process, Stormwater Plan Review will forward projects to the Private Cost group to

review and comment on potential impacts to PWD infrastructure. If a Private Cost Plan

Review is required for a project, Stormwater Plan Review will inform the applicant of

this requirement in their review response. For more information on Stormwater Plan

• PWD Projects Control – Projects Control is a review and coordination entity with a

number of important roles in the development process, including coordinating and

distributing private and public project submissions and approvals among multiple PWD

units. Projects Control approves changes to PWD rights-of-way (ROWs) and easements,

including striking, shrinking, and establishing new ROWs. Developers should make their

first submission to PWD Projects Control Unit to be recorded and distributed to the

appropriate units within PWD.

• Philadelphia Streets Department – As part of the Streets Department’s Complete

Streets program, PWD’s Private Cost group is notified of projects in the city that may

impact PWD infrastructure within the public right-of-way or encroaches on drainage or

water main right-of-way.

• Developer – Developers will sometimes reach out to engineers in the Private Cost group

when they know a Private Cost Plan Review is necessary for their project. The

Developer. or Project Engineer acting on behalf of the Developer, is directed to formally

submit through Projects Control to initiate the Private Cost Plan Review process.

• PennDOT – PennDOT will reach out to utility agencies prior to initiating highway or

bridge reconstruction projects. PWD will often be required to relocate a sewer or water

main to accommodate the proposed highway infrastructure.

• PWD GSI Maintenance– GSI Maintenance is a group within PWD that maintains public

Green Stormwater Infrastructure (GSI) throughout the city. If one of these GSI systems is

impacted by development/utility work, the Private Cost process may be necessary to

restore the affected infrastructure.

• PWD Stormwater Billing & Incentives– This group reviews private Stormwater Retrofit

projects and engages in partnership project opportunities between PWD and other

entities. They also administer the Stormwater Management Incentives Program (SMIP)

and Greened Acre Retrofit Program (GARP) programs, which provide funding and

assistance to non-residential PWD customers and contractors. As part of their

stormwater retrofit review, Stormwater Billing & Incentives will forward projects to the

Private Cost group to review and comment on potential impacts to PWD infrastructure.

Also, projects that propose to manage right-of-way runoff on private property will

submit to the Private Cost group for review of the work proposed within the right-of-

way.

Once it is known that a project requires a Private Cost Plan Review it is the responsibility of the

Developer, or the Project Engineer acting on behalf of the Developer, to contact the Private

Cost group for instruction on moving forward with the review process. To initiate the Private

Cost Plan Review process the Developer must submit an electronic copy (on a CD or by email), a

transmittal letter, and three (3) sets of printed plans (upon request) to PWD’s Projects Control

Unit, addressed to:

Design Review and Philadelphia Water Department Internal Approval

The Project Engineer will coordinate with the Private Cost

group engineer assigned to the project (PWD Engineer)

throughout the design review process. The Project Engineer

will submit drawings to the PWD Engineer, who will ensure the

plans meet PWD design and drawing standards. The PWD

Engineer also ensures the proposed work does not encroach

existing ROWs or inhibit the continued operation &

maintenance of existing structures. This iterative process will

continue until the PWD Engineer finds the plans to be

acceptable.

Final approval of the plan set is contingent upon an internal

review by PWD’s Water Conveyance, Collector Systems, and

GSI Design Units, as well as the Philadelphia Fire Department

(review by Water Conveyance required for projects replacing,

abandoning, or impacting existing water main; review by GSI

Design required for projects proposing green infrastructure;

review by the Fire Department is required when fire hydrants

are relocated). Each party will provide their own review

comments, which will be forwarded to the Project Engineer by

the assigned PWD Engineer. Once the comments have been

addressed fully, the PWD Engineer will inform the Project

Engineer of PWD’s acceptance of the design and the project

will move from PWD Design to Projects Control. In Projects

Control, a Developer’s Agreement will be drafted and signed

by the Developer, ensuring the the work will be constructed to

PWD’s standards and insured in the event that the work is

determined unacceptable or incomplete by PWD.

Final Submission

Once all the comments compiled from PWD’s Internal Approval have been addressed and are

reflected on the plans, the Project Engineer must submit to the PWD Engineer:

• One (1) transmittal letter,

• One (1) set of plans printed on mylars, stamped by a Professional Engineer registered in

the Commonwealth of Pennsylvania and signed by the engineer,

• One (1) CD with: an electronic copy (PDF format) of the stamped plans and associated

AutoCAD files, one (1) copy of the “Location Report” generated from GPIS, one (1) copy

of the Paving Restoration Letter, and one (1) copy of the corrosion control report (water

only)

The PWD Engineer will transmit the signed mylars along with a memorandum summarizing the

work and acknowledging PWD Design’s acceptance to PWD Projects Control Unit. At this point,

the project has officially moved from PWD Design to PWD Projects Control, bringing the Private

Cost Plan Review process to a close and initiating Projects Control’s process for private

development.

Developer’s Agreement

PWD’s Projects Control unit will process the plans for signature by the Water Commissioner and

draft a “Developer’s Agreement” to be entered into by the Developer and PWD, ensuring the

work is completed to PWD’s satisfaction. On Private Cost projects, an agreement is drafted,

approved by the City of Philadelphia’s Law Department, and sent to the developer for their

signature and submission of a performance bond, if necessary. When the signed agreement and

performance bond are returned to Projects Control, the Notice To Proceed letter is issued to

the Developer or their agent. At this point, PWD Construction and Water Transport Records

receive a copy of the approved plans and Notice To Proceed letter, and the work may

commence. The Capital Projects office will issue a copy of the signed mylars and Developer’s

Agreement with the necessary signatures to the Developer.

The Developer, upon receipt of the final approval letter, signed plans, and Developer’s

Agreement, must instruct the contractor to contact PWD’s Construction Unit seven (7) days

prior to construction to have a PWD inspector assigned to the project. Prior to accepting newly

installed sewers, PWD must perform a post-construction video inspection on the newly

constructed facilities; water mains must be pressure tested and disinfected before being put

back in service (see “Construction Requirements” section for more information).

Design and Drawing Standards

This section provides a general overview of PWD’s technical design standards, contract drawing

standards, and the supplemental documentation necessary for a complete Private Cost Plan

Review submission to be accepted and approved by PWD. The Water and Sewer Design Manual

provides detailed explanations and examples of PWD standard design practices and drawing

standards along with a catalogue of reference information for designing water and sewer

infrastructure in the City of Philadelphia. For green stormwater infrastructure design guidelines,

the GSI Planning and Design Manual serves the same function.

All plans submitted for Private Cost Plan Review must include the following information:

• Existing and proposed streets, right-of-ways, and property lines;

• Existing and proposed buildings, curb adjustments, i.e. any permanent structures

located in the public or PWD drainage/water main right-of-ways; and

• All existing and proposed utilities, labeling the location, size, and depth of each utility;

water and sewer material information should be included in the labels. Existing utility

information in the project area can be obtained through PA One Call.

• All areas to be maintained by a Homeowners Association or other non-City entity shall

be clearly defined on the plans. All piping and/or drainage structures that are to be

maintained by the owner must be labeled as ‘PRIVATE’.

Cross Section : One cross section per sheet minimum at most critical section Scale: ¼” = 1’

Profile : Not required on water sheets unless otherwise directed by PWD

Title Block : Three signatures must appear in the title block on the first sheet:

• Engineer for the Consultant

• General Manager of PWD Planning & Engineering

• PWD Water Commissioner

Note: All subsequent sheets must have the Engineer’s signature

Water Notes : General Water Main Notes—These notes, located in the appendix of this document, should appear on a dedicated notes sheet or on the first plan sheet in the set.

Standard Water Notes—These notes, located in PWD’s Water and Sewer Design Manual Appendix II.i, should appear on each plan sheet with proposed water main.

PWD Work No. : Issued by PWD. Must appear in the Title Block on all sheets.

Corrosion Control (if applicable)

: Plan and Detail sheets provided by a PWD approved corrosion control Consultant must be included in the full set of plans.

In addition to the symbols, labels, and information required on the plans as stated in the PWD Water and Sewer Design Manual, the following pertinent information unique to Private Cost Plan Review submissions should be shown on the plans:

• Proposed and existing building(s) and surface features,

• Proposed service laterals with labels (service type, size, and pipe material),

• Proposed curb adjustments,

• Meter pits, backflow prevention, valves/curbstops

Projects proposing water main reconstruction will require a corrosion control study to be

performed by a PWD approved corrosion control consultant.

Corrosion Control Requirements

The corrosion control engineering service shall be paid for by the Developer directly to the PWD

approved corrosion control consultant. An electronic copy of the corrosion control report along

with the corrosion control plans (if required) must be provided to the PWD Engineer to receive

final approval.

Once the water main design is found to be substantially complete, the water sheets must be

provided to a PWD approved corrosion control consultant for the design of special corrosion

control measures. The corrosion consultant will perform a field investigation and draft a report

outlining the results and their recommendation for corrosion control measure: either

“standard” corrosion control—sand backfill and coating of joints—or “special” corrosion control

measures, in which case specifications, cost estimates, and/or plans will be provided for

inclusion in the contract documents. All corrosion control materials must be furnished and

installed in accordance with PWD Standard Specification W-23, found in the appendix of PWD’s

Standard Details and Corrosion Control Specifications for Water Mains (1985).

GSI Notes—Found in the appendix of this document, these notes must appear on sheets with proposed work that impacts existing GSI.

In addition to the symbols, labels, and information stated in the PWD Water and Sewer Design Manual, the following information unique to Private Cost Plan Review submissions should be shown on the plans:

• Proposed and existing building(s) and surface features,

• Proposed curb adjustments,

• Proposed service laterals with labels (service type, size, and pipe material),

• Label connections (type, size, and material if applicable),

• Manhole labels (MH #, Rim El., Inv. In El., Inv. Out El., Change in size and/or grade if applicable),

• Prop. Concrete Collars (Inv. El.),

• SMPs: Common Drains, Retention/Detention Basins, Underground Piping, Swales, Seepage Pits,

• Details for manholes, connections, special foundations, or any unique structures not found in PWD’s

Boring Requirements

For new sewer construction, a complete soil investigation shall be performed with borings

taken at least once for every 150 feet of sewer along the proposed alignment. The results will

be evaluated as follows:

• In cases where the standard penetration resistance value (or N-value) is consistently 17 blows

per foot or greater pile supports are not required by the Water Department. Where soil

conditions are poor, the sewer along with the laterals, inlet pipes, inlets and manholes will

require pile supported foundations in their design and construction.

• In areas of moderately poor soils, other means of support may be required. Each case shall be

evaluated on an individual basis.

Auger Boring Specifications may be provided upon request.

Labels

: SMPs must be labeled in conformance to PWD’s standard list of SMP types defined in the GSI Planning and Design Manual. GSI Maintenance will assign unique IDs to components such as inlets, pipes, cleanouts, etc. that must be included on final design plans.

In addition to the symbols, labels, and information stated in the PWD GSI Planning and Design Manual, the following information unique to Private Cost Plan Review submissions should be shown on the plans:

• Proposed and existing building(s) and surface features,

• Proposed curb adjustments,

• Proposed service laterals with labels (service type, size, and pipe material),

• Label connections (type, size, and material if applicable),

• Manhole labels (MH #, Rim El., Inv. In El., Inv. Out El., Change in size and/or grade if applicable),

• Prop. Concrete Collars (Inv. El.),

• SMPs: Common Drains, Retention/Detention Basins, Underground Piping, Swales, Seepage Pits,

Details for manholes, connections, special foundations, or any unique structures not found in PWD’s GSI

Planning and Design Manual

Construction Requirements

Throughout construction of the infrastructure outlined on the Private Cost plans the Developer,

or agent acting on behalf of the Developer throughout construction, must coordinate with

PWD’s Construction Unit via the PWD inspector assigned to the project. The PWD inspector

assures the quality of the means, methods, and materials used by the contractor to construct

the facilities. PWD ownership of the installed facilities is contingent upon the acceptance issued

by the PWD inspector. The PWD inspector is also responsible for coordinating the testing and

inspection of any installed facility.

THE CONTRACTOR PERFORMING THIS WORK IS TO NOTIFY THE PWD CONSTRUCTION DIVISION, 1101

MARKET STREET, 2ND FLOOR, PHONE (215) 685-6345, AT LEAST 7 DAYS IN ADVANCE FOR ASSIGNMENT

OF AN INSPECTOR TO THE JOB. WATER SHUT-OFF TO BE REQUESTED BY THE INSPECTOR ONLY.

A PRE-CONSTRUCTION MEETING WITH PWD CONSTRUCTION REPRESENTATIVES MUST BE HELD AT

LEAST 7 DAYS PRIOR TO STARTING CONSTRUCTION.

The following procedures must be coordinated with the assigned PWD Inspector:

STREET OPENING PERMIT—the Developer, or agent acting on behalf of the Developer throughout construction, is responsible for providing the PWD Inspector with a copy of the Street Opening Permit obtained through GPIS prior to starting construction.

VALVE CLOSURES—coordinate with the PWD Inspector to have the necessary valves closed so the contractor may proceed with construction on the isolated portion of water main.

SUBMITTAL PROCESS—the contractor must submit for review by the PWD Construction Engineer all information required by the contract documents. Shop drawings submitted for review shall bear the contractor’s stamp of approval which shall constitute certification that the contractor has verified all construction criteria, dimensions, materials, and similar information and checked each drawing for completeness, coordination, and compliance with the contract documents.

PRESSURE TESTING & DISINFECTION—before the newly constructed water main comes in contact with potable water, it is the responsibility of the contractor to pressure test and disinfect the water main as outlined in PWD’s Standard Specifications W-22 for Disinfecting Water Mains, which can be provided upon request.

SEWER VIDEO—prior to PWD’s acceptance of any newly constructed sewer, the contractor must coordinate with the PWD Inspector to perform a post-construction video inspection to ensure the quality and integrity of the sewer.

AS BUILTS—coordinate with the assigned PWD inspector to have PWD’s Survey Unit draft the water and sewer as-built drawings. It is necessary to maintain an accurate record of the customary as-built location data for all underground construction for future O&M purposes.

Permit Requirements

The majority of work that is subject to a Private Cost Plan Review also requires certain permits

and ancillary approvals. Work proposed in the public right-of-way will require a Street Opening

permit. Any disturbance of the public right-of-way will also require a Paving Restoration Letter

from the Street Department’s Transportation Unit, which outlines how the excavation of the

proposed work must be restored. If there are service connections, both water and sewer,

proposed on the project, a connection permit will need to be obtained for the project.

The flow chart on the following page demonstrates the permit workflow depending on the type

of work you are doing on your project.

Street Opening Permit PHILADELPHIA STREETS DEPARMENT

A Street Opening permit is obtained through the Streets Department’s Guaranteed Pavement

Information System (GPIS). The Street Opening permit is required by the Philadelphia Code

and/or Streets Department Regulations and issued by the Streets Department to open or

excavate within the City right-of-way. Along with the initial review letter, PWD will provide the

Project Engineer with a notice that explains how to go about accessing the Guaranteed

Information Paving System (GPIS) and the steps to following to obtain a permit. This “GPIS

Notice” should be filled out and returned to the PWD Engineer you are working with as part of

the next submission. The Project Engineer will also provide the completed GPIS notice to the

Streets Dept. when requesting a Paving Restoration Letter. A copy of this notice can be found in

the Appendix of this document.

Paving Restoration Letter PHILADELPHIA STREETS DEPARMENT

Prior to PWD’s final approval of the Private Cost plans, the Project Engineer must provide a

Paving Restoration Letter to the PWD Engineer. To initiate the process of getting a Paving

Restoration Letter, the Project Engineer must send the substantially complete plans, a

transmittal letter, the Developer’s contact information, and completed GPIS notice to:

Connection Permit PHILADELPHIA WATER DEPT. – WATER TRANSPORT RECORDS

The process of obtaining a Connection permit, which is required to get a Plumbing permit,

starts with PWD’s Water Transport Records Unit. Applications for Connection permits are

submitted to:

Once the application is generated and approved by PWD’s Water Transport Records Unit, the

Project Engineer or Developer will be instructed to pick up their “pre-permit” from the service

desk on the 2nd floor of 1101 Market St. They will then take the “pre-permit” to PWD’s

connections permit desk at the Municipal Services Building to obtain a certified Connection

permit. For direction on the processes and approvals require for connections to PWD sewers,

refer to the PWD Sewer Connections and Repair Manual.

PWD will add a reference to their water connections manual upon its release

Discharge Permit(s) PHILADELPHIA WATER DEPT. – INDUSTRIAL WASTE UNIT

Primarily on sewer reconstruction projects, Discharge permits, both groundwater and

wastewater, may be required to facilitate proper construction of the sewer. PWD’s Industrial

Waste Unit issues permits regulating industrial, commercial and non-routine discharges to the

City's sewers and wastewater treatment plants. All permits issued by IWU establish specific

discharge, monitoring and reporting requirements. Failure to obtain the necessary permits or

violation of permit conditions may be punishable by monetary fines.

NECESSARY PRECAUTIONS TO PREVENT TEST PRESSURE FROM ENTERING ADJOINING

DISTRIBUTION SYSTEM. TEST DISTRIBUTION MAINS AT 150 PSI FOR AT LEAST ONE HOUR.

HYDROSTATIC TEST SHALL BE COMPLETED WITH NO MEASURABLE DROP IN PRESSURE. UPON A

DROP IN PRESSURE, DETERMINE THE AMOUNT OF LEAKAGE BY MEASURING THE ADDITIONAL

QUANTITY OF WATER THAT IS PUMPED INTO THE MAIN TO MAINTAIN PRESSURE WITHIN 5 PSI

OF THE SPECIFIED TEST PRESSURE. WHERE THE MEASURED LEAKAGE EXCEEDS THE

ESTABLISHED ALLOWABLE AMOUNTS THEN THE CONTRACTOR SHALL, AT HIS OWN EXPENSE,

LOCATE AND MAKE APPROVED REPAIRS AS NECESSARY UNTIL THE LEAKAGE IS WITHIN THE

SPECIFIED ALLOWANCE. REPAIR ALL VISIBLE LEAKS, REGARDLESS OF THE AMOUNT OF LEAKAGE.

In addition, the following notes may be required if the existing water mains are being relocated and/or

abandoned:

17. THE ABANDONED WATER MAIN VALVE FRAMES AND FIRE HYDRANTS SHALL BE REMOVED AND

ELBOW. FILL THE REMAINING PORTION OF THE STANDPIPE WITH CONCRETE. THE HYDRANT

REMOVED WILL BECOME THE PROPERTY OF THE CONTRACTOR WHO IS RESPONSIBLE FOR ITS

DISPOSAL. BACKFILL THE TRENCH WITH SELECTED GRANULAR MATERIAL - 2RC UP TO

SUBGRADE ELEVATION. COMPACT THE TRENCH, AND RESTORE DISTURBED CONCRETE CURBING

19. CONTRACTOR IS REQUIRED TO UNDERTAKE NECESSARY MEASURES TO PREVENT SEDIMENT

FROM LEAVING THE WORK SITE, TO PREVENT EROSIVE CONDITIONS, AND TO SUPPRESS DUST

ON THE SITE AND SURROUNDING AREAS. CONTRACTOR MUST COVER AND SURROUND

STOCKPILES WITH EROSION CONTROL MEASURES TO ENSURE SEDIMENT DOES NOT MIGRATE

INTO THE PUBLIC ROW OR ENTER THE PUBLIC SEWER. IF CONTRACTOR IS HAND DIGGING OR

EXCAVATING, CONTRACTOR MUST SWEEP WORK SITE AT THE END OF EACH WORK DAY. THE

CITY MAY REQUIRE THE CONTRACTOR / OWNER TO CLEAN CITY-OWNED INLETS AND SYSTEMS

AFFECTED BY NONCOMPLIANT OR FAILED E&S CONTROLS.

20. CONTRACTOR MUST INSTALL INLET PROTECTION MEASURES AT ALL INLETS ADJACENT TO OR

WITHIN THE WORK AREA. INLET PROTECTION MEASURES MUST BE INSPECTED DAILY TO

ENSURE PROPER PLACEMENT, AND MAINTAINED, POSITIONED OR REPLACED AS NEEDED TO

ENSURE PROPER FUNCTION AND TO PREVENT FLOODING. REFER TO PWD GUIDANCE FOR

WATER AND SEWER IMPROVEMENTS

Agreement No.: 032415 This agreement (“Agreement”) is made this day of , 2015 by and between, DEVELOPER (“Developer”) and the City of Philadelphia acting through its Water Department (“City”). WHEREAS, the City, to facilitate the development of property, has agreed to certain changes in the City’s water and sewer system (“Improvements”); and WHEREAS, the Developer, as the owner of a property at ADDRESS, PHILADELPHIA, PA has agreed to construct and/or to pay for the construction of the Improvements; and WHEREAS, the City agrees to assume ownership and maintenance of the Improvements after its successful completion in accordance with City standards and regulations. THEREFORE, in consideration of the foregoing promises and the mutual covenants, terms and conditions set forth herein, the Developer and the City intending to be legally bound agree as follows: 1. Developer, its agents, or contractors shall perform the Improvements in strict accordance with the Plans and Specifications entitled: WORK NO. ##### – PRIVATE COST WATER MAIN AND SEWER CONSTRUCTION – STREET. Said Plans and Specifications were prepared for Developer by ENGINEER NAME & ADDRESS and consists of # sheets, namely Sheets No. W-1 of 1 and S-1 of 1 which was delivered to the City of Philadelphia by cover letter, dated DATE. 2. Developer shall be solely and exclusively responsible for and shall pay all costs for the work required by Paragraph 1 and under no circumstance shall Developer, its agents or contractors make any claim or demand from the City for any portion of these costs. 3. Developer shall comply with all City ordinances, regulations and policies that affect the construction of the Improvements. 4. Developer shall file a bond with the City, in the amount of $###,000, as fixed by the City Law Department, conditioned upon compliance with the Water Department’s regulations and specifications. The City shall release the bond once the City takes ownership of the Improvements. 5. Ownership of the Improvements shall not vest in the City unless and until the following conditions are satisfied:

a) The Improvements have been approved and accepted in writing by the

City’s Water Commissioner or his authorized representative; DRAFT

b) the public streets on which the Improvements are placed are confirmed on

the City Plan; and c) in lieu of placement of City Streets on the City Plan, Improvement right-of-

ways are granted to the City at no cost and with free and clear titles. Such grants shall allow the placement of the right-of-ways on the City Plan.

6. Developer and/or its contractor shall be solely responsible for the costs and for obtaining all permits required from the City of Philadelphia, its boards and agencies, and any permits required by the Commonwealth of Pennsylvania, its departments, or agencies.

7. Developer shall, at a minimum, provide general supervision of the construction of

the Improvements, including the review and periodic inspection of all work performed for and material furnished for the Improvements so as to ascertain and determine, without full-time inspection, whether the contractors and others engaged in the Improvements are properly performing their duties, whether all work is being performed in conformity with the Plans and Specifications and whether proper materials are being used in the construction of water and sewer improvements.

8. Developer shall indemnify, defend and hold harmless the City, its agents,

employees and officers from and against any and all losses, costs, including litigation costs, settlement costs and counsel fees, claims, suits, actions, damages, liability and expenses, including but not limited to, those in connection with the loss of life, bodily and personal injury or damages to property occasioned by Developer’s acts or omissions or the acts or omissions of Developer’s agents, contractors, employees or servants arising from or related to the Improvements, regardless of whether such claim, damage, loss or expense is caused in whole or in part by the negligence of City, its officers, employees, or agents. 9. Throughout the entire period of work on the Improvements, Developer shall, or shall require its contractor(s) to procure and maintain, or cause to be procured and maintained, the types and minimum limits of insurance specified below. All insurance shall be procured from reputable insurers authorized to do direct business in the Commonwealth of Pennsylvania and acceptable to the City. All insurance required herein shall be written on an “occurrence” basis and not a “claims-made” basis. In no event shall work be performed until the required evidence of insurance has been furnished. If Developer or Developer’s contractor(s) fails to obtain or maintain the required insurance, the City shall have the right to treat such failure as a breach of this Agreement and to exercise all appropriate rights and remedies. The insurance shall provide for at least thirty (30) days prior written notice to the City in the event coverage is materially changed, canceled or non-renewed. The City of Philadelphia, its officers, employees and agents are to be named as additional insured on the General Liability Insurance Policy. Also, an endorsement is required stating that the coverage afforded the City and its officers, employees, and agents as additional insured will be primary to any coverage available to them. DRAFT

(a) WORKERS’ COMPENSATION AND EMPLOYERS’ LIABILITY (1) Workers’ Compensation: Statutory Limits (2) Employers’ Liability: $500,000 each Accident-Bodily Injury by Accident;

$500,000 Each Employee – Bodily Injury by Disease; and $500,000 Policy Limit - Bodily Injury by Disease.

(3) Other States coverage and Pennsylvania Endorsement. (b) GENERAL LIABILITY INSURANCE (1) Limit of Liability: $2,000,000 per occurrence combined

single limit for bodily injury (including death) and property damage liability; $1,000,000 personal and advertising injury; $2,000,000 general aggregate; and $1,000,000 aggregate for products and completed operations.

(2) Coverage: Premises operations; blanket contractual liability; personal injury liability (employee exclusion deleted); products

and completed operations; independent contractors; employees and volunteers as additional insurers; cross liability (insured vs. insured); and broad form property (including completed operations).

(c) AUTOMOBILE LIABILITY (1) Limit of liability: $1,000,000 per occurrence combined single limit for bodily injury (including death) and property damage

liability. (2) Coverage: Owned, non-owned and hired vehicles. Certificates of insurance evidencing the required coverage must specifically reference the Agreement Number for which they are being submitted and shall be submitted to the Water Department and the City’s Risk Manager at One Parkway, 1515 Arch Street, Philadelphia, Pennsylvania 19102 at least ten (10) days before work is begun and at least ten (10) days before each renewal date. The ten (10) days requirement for advance documentation of coverage may be waived in situations where such waiver will benefit the City, but under no circumstances shall Developer or Developer’s contractor(s) actually begin work (or continue work in the case of renewal) for the water and sewer modifications without providing evidence of insurance. The City reserves the right to require Developer to furnish certified copies of the original policies of all insurance required under this Agreement at any time upon ten (10) days prior written notice to Developer. The insurance requirements set forth herein are not intended and shall not be construed to modify, limit or reduce the indemnification made in this Agreement by Developer to DRAFT

NOTICE TO DEVELOPER/OWNER GPIS PERMITTED PROJECT TRIGGER

You are receiving this notice because the scope of your project under review by the Philadelphia Water Department requires that it must be entered into the Streets Department Guaranteed Pavement Information System (GPIS) in order to obtain a Street Opening Permit for excavation, installation of the water, sewer, or Green Streets Infrastructure, and to coordinate with other paving, roadway and utility construction projects. As such, you are responsible for the following in GPIS:

Entering your project - You as the developer/owner are responsible for entering the details of your project into GPIS. This includes entering estimated Planning, Design, Permitting, and Construction Phase dates for your project. When you enter your project, it should be entered as a “permitted” external project with a work type of “Private Water Sewer GSI project” for a “Tier2” GPIS Street Opening Permit (Refer to the following link for permit regulations which govern Street Opening Permits: http://bit.ly/2d1DAM4). A GPIS Street Opening Permit will be issued once all requirements have been met, utility clearances completed, construction conflicts resolved, and the project has been approved in GPIS by the Streets Department Right of Way (ROW) unit.

organization. This individual is responsible for entering and updating the information into GPIS for this project. Ensure that the Designated GPIS Project Contact has an active User Account in GPIS. Refer to the “GPIS External Admin Guide” (posted on the Reports screen of the GPIS website) for directions on setting up contacts within an organization.

o After you or your consultant has set up your GPIS Project Contact, please e-mail Joseph McGovern ([email protected]) at the Water Department to have your contact delegated into the “Privately Funded Water and Sewer Infrastructure” organization. All privately funded Water, Sewer, or GSI projects are entered into GPIS under this organization.

o Once your GPIS Project Contact has been delegated into the “Privately Funded Water and Sewer Infrastructure” organization, the GPIS Project Contact can create and enter information in GPIS. Your project information in GPIS should include all locations that have water, sewer, or GSI infrastructure in the public right of way. When creating the new project, select the “Private Water Sewer GSI Project” work type appropriate for a “Tier 2” GPIS Street Opening Permit. Refer to the following link for permit regulations which govern Street Opening Permits: http://bit.ly/2d1DAM4 Refer to the “GPIS External Project Guide” (posted on the Reports screen of the GPIS website) for information on creating locations and entering information into a GPIS project.

o After your GPIS Project Contact has created and entered relevant information for the water, sewer, or GSI infrastructure portion of your development, they must create a “GPIS Location Report” (found on the Reports screen of the GPIS portal). As part of the Philadelphia Water Department plan review approval process, you will be required to submit a printout of the “GPIS Location Report” to show that the project has been entered correctly.

Keeping your project’s information up to date – You as the developer/owner will be responsible for keeping your project information in GPIS up to date. This includes any changes in construction timelines and project locations.

Updating the current phase of your project in GPIS – As your project moves from the Planning Phase to the Design Phase to the Permitting Phase to the Construction Phase, you are responsible for updating GPIS to reflect what stage your project is in. When you update the phase of your project, you are also responsible for entering the actual phase dates of your project. Refer to the “GPIS External Project Guide” (posted on the Reports screen of the GPIS website) for information on maintaining phase dates for your “permitted” external project.

Resolving project conflicts triggered by your project – You are responsible for managing project conflicts triggered by your project in GPIS. This means coordinating your project with other projects or utilities that may be scheduling permitted work or paving in the same locations with an overlapping construction timeline.

Completing the Utility Clearance and Receiving a GPIS Street Opening Permit – You as the developer/owner will be responsible for completing a utility clearance before pulling your GPIS Street Opening Permit from the system. This occurs in the Permitting Phase and you will be required to do the following prior to accessing your GPIS Street Opening Permit:

o Upload your plans and PA One Call tickets; o Enter offsets, cover, and other dimensions for all proposed underground water, sewer, or GSI infrastructure in the

public right of way; o Enter PA One call numbers for the locations; o Submit a utility clearance transmittal to city agencies and right of way users who have facilities near your project; o Obtain approval from all respondents listed in your utility clearance; and o Resolve all project conflicts.

Please be aware that you will need to provide a copy of your GPIS Street Opening Permit when a PWD inspector is assigned to your project.

Closing out your project in GPIS – You as the developer/owner will be responsible for closing the Construction Phase of the project in GPIS. As such, project conflicts with your project must continue to be resolved in GPIS until the Construction Phase is closed. Offsets and dimensions for the final “as-built” infrastructure should be entered and “as-built” plans should be uploaded to the project before closing the Construction Phase. The PWD inspector assigned to your project will require confirmation that you have closed the Construction Phase of your project, this will be done by giving the inspector a copy of the Location Report showing that your project has been closed in GPIS.

You may delegate this responsibility to your consultant handling the PWD Private Cost Plan submission; however, be aware that we expect the project to be updated in GPIS through the Planning, Design, Permitting, and Construction Phases, even if your consultant or contractor changes. The Streets Department, PGW and other utility companies use GPIS to coordinate work in the public right of way so it is important that the construction timeline for your project be accurately reported in the system.

When your contractor applies for Street Closure Permits to perform the work, they will be required to submit an updated copy of the “GPIS Location Report”. This will be the updated version of the report to show that your project has been moved to the Construction Phase in GPIS. The contractor will also be responsible for submitting a copy of the GPIS Street Opening Permit issued by you or your consultants once all construction conflicts have been resolved and the project has been approved in GPIS by the Right of Way Unit. Contractors seeking Street Closure Permits for private cost sewer/water/GSI installations must apply for these permits through the online Street Closure Permitting System (https://stsweb.phila.gov/streetclosure/ ). Paper applications will no longer be accepted.

** Note that GPIS is for obtaining a Street Opening Permit and does not circumvent the need to apply for a Connections Permit through PWD Water Records **
