1.1 PROVISION OF LOAN FOR SALARY, PENSION & MANDATORY CONTINGENCIES AT LORALAI CANTT.

Reference/Authority: HQ ML&C letter No.200/23/P&MA/ML&C/CV/2020-Pt-I dated 03.06.2020 & DML&C Karachi Region letter No.3/769/DKR/ Vol:I/CB Loan/04 dated 12.06.2020.

To consider the directions contained in HQ ML&C letter No.200/23/P&MA/ML&C/CV/2020-Pt-I, dated 03-06-2020 received through RHQ Karachi letter No.3/769/DKR/Vol:I/CB Loan/04 dated 12-06-2020 for payment of Rs.1.00 million as loan (refundable) to Cantt Board Loralai for disbursement of salary, pension & mandatory contingencies.

It is apprised that HQ ML&C vide letter under reference has directed to Cantt Board Clifton to pay an amount of Rs.1.00 million as loan (refundable) to Cantt Board Loralai for disbursement of salary, pension & mandatory contingencies.

As the above said amount of loan was not included in the current year Budget Estimates 2019-2020, therefore, the sanction of the Competent Authority is required to meet the expenditure out of the Closing balance for the Budget Estimates 2019-20.

Resolution Considered and the Board unanimously approved to grant loan amounting to Rs.1.00 million to Cantonment Board Loralai out of Closing Balance for the Budget Estimates 2019-20 in the light of HQ ML&C Deptt letter No.200/23/P&MA/ML&C/CV/2020-Pt-I, dated 03-06-2020. The case be forwarded to Competent Financial Authority for necessary sanction.

Rule 21 (a) of the Cantonments Accounts Code, 1955 states that:

1.4. GRANT OF ASSISTANCE PACKAGE FOR DECEASED EMPLOYEES OF CBC.

Reference/Authority: Govt. of Pakistan Estb. Division Islamabad O.M No.8/10/2013-E-2(Pt) dated 4.12.2015 and ML&C Deptt letter No.73/137/ADG/(Est)/ ML&C/2007 dated 19-11-2008.

To consider an application dated NIL submitted by Mst. Hina Iqbal widow of Mr. Muhammad Sajid s/o Abdul Aziz, Ex-Driver CBC requesting therein for financial assistance as per Govt. of Pakistan Estb. Division Islamabad O.M No.8/10/2013-E-2(Pt) dated: 04.12.2015.

In this connection, it is apprised that the above named employee of CBC was expired on 05-05-2020 due to Natural death and struck off from the strength of CBC with effect from the same date. Payment is admissible to the bereaved family as per said Assistance Package as the matter regarding grant of Assistance Package to the families of the Cantonment Board’s deceased officials was discussed in the Director’s Conference held on 13-10-2008 in ML&C Deptt under the chairmanship of DGML&C wherein the matter was decided vide Item No.13 of the minutes of the Conference circulated vide ML&C Deptt letter under reference. The decision is reproduced as under:-

“DGML&C decided that each Cantt Board is competent to decide whether the package may be applied or not. Such cases may be decided through a CBR and these cases may not be referred to DML&C or HQML&C for permission. In case of transferable category the different Cantt Boards will share the burden proportionately where the official has served as is practice in pension cases.”

The Board further unanimously resolved to approach Press Information Department (PID) to publish the notices/advertisements only in the newspapers as required by the Cantonment Board Clifton and no change whatsoever in number or newspaper be made in the best interest of office administration. The Board unanimously decided that if the request of the Board is not acceded to by the PID the Board shall have no other option but to get publish its notices / advertisements directly from newspapers instead of PID.

2.2. REDRESSAL OF GRIEVANCES & SETTLEMENT OF DISPUTE COMMITTEE.

Reference/Authority: Rule 48 of the PPRA Rules, 2004.

To consider constitution of a committee for redressal of Grievances & Settlement of Disputes as required under Rule - 48 of the Public Procurement Rules, 2004, according to which the procuring agency shall constitute a committee comprising of odd number of persons, with proper powers and authorizations, to address the complaints of bidders that may occur prior to the entry into force of the procurement contract.

Rules 48 of the PPRA Rules 2004 is reproduced hereunder for perusal of the Board:-

48. Redressal of grievances by the procuring agency:-

(1) The procuring agency shall constitute a Committee comprising of odd number of persons, with proper powers and authorizations, to address the complaints of bidders that may occur prior to the entry into force of the procurement contract.

(2) Any bidder feeling aggrieved by any act of the procuring agency after the submission of his bid may lodge a written complaint concerning his grievances not later than fifteen days after the announcement of the bid evaluation report under rule 35.

(3) The Committee shall investigate and decide upon the complaint within fifteen days of the receipt of the complaint.

(4) Mere fact of lodging of a complaint shall not warrant suspension of the procurement process.

(5) Any bidder not satisfied with the decision of the Committee of the procuring agency may lodge an appeal in the relevant Court of jurisdiction.

2.3. BAN ON ILLEGAL / UN-AUTHORIZED WALL CHALKING IN CBC AREA

Reference/Authority: Section 118 (1) (a) (x, xi, & xii) of the Cantonments Act, 1924 and proposal floated by Vice President.

To consider the proposal received from Vice President regarding imposition of ban / restriction on wall chalking / wall advertisement etc being done by the various national / multinational companies / political parties / Aamils within the limits of Clifton Cantt.

It is apprised that various companies / political parties / Aamils are in habit of carrying out wall chalking within the limits of Clifton Cantt, which give ugly look and damage the natural beauty and cultural diversity of the area and the same is being done in violation of Sub Section (x, xi, & xii) of Section 118 (1) (a) of the Cantonments Act, 1924. It is also observed that the wall chalking is also causing tension and conflicts among the communities and with other institutes. Therefore, it is proposed to impose permanent ban on illegal / un-authorized wall chalking within the limits of Cantt. area. In this regard it is proposed to impose fine upon violators.

Resolution Considered and the Board unanimously approved to impose ban on wall chalking / wall advertisement etc being done by the various national / multinational companies / political parties / Aamils within the limits of Clifton Cantt. The Board further unanimously approved that in case of violation, warning letter to be served upon all concerned. In case of non-compliance penalty of Rs.5000/- be imposed upon the violators and in case of a continuing contravention, with an additional fine of Rs.10000/- upon every occurrence.

Resolution Considered and the Board unanimously approved to refer the cases as mentioned on agenda side to the Assessment Committee for inquiring / investigating and fixation of ARVs in the light of Section 68 (2) and (3) of the Cantonments Act, 1924. 4.2. ISSUANCE OF CHALLANS ON ACCOUNT OF RENEWAL FEE OF ARCHITECTS, STRUCTURE ENGINEERS, VETTING ENGINEERS & GEO-TECH ENGINEERS ON PANEL OF CBC.

Reference/Authority: Building Bye-laws No.1 (2) (ix), 1 (2) (Lii), 1 (2) (Liii) and advertisement published in daily Dawn dated 11-02-2012 and Daily Jung dated 11-02-2012.

To consider the matter regarding issuance of challans on account of renewal fee of subject professionals already registered with PEC & PCATP & registered on panel of CBC through Building Committee & Board. In this connection, it is apprised that at present as per existing practice these challans are being issued before approval of these renewals by the Board.

Now the engineering branch vide report dated 15-06-2020 has requested that these challans may kindly be issued to the concerned professionals annually after recommendations of the Building Committee in order to expedite the process. However the recommendations of the Building Committee shall be got confirmed in forthcoming meeting of the Board.

4.5. SINGLE STAGE TWO ENVELOPE BIDDING PROCEDURE

Reference/Authority: Proposal floated by Vice President and rule 36 (b) of PPRA Rules, 2004.

To consider the proposal floated by Vice President regarding adoption of “Single Stage Two envelope bidding procedure” for future tenders as per Rule-36 (b) for all type of procurements / works. The bids shall comprise a single package consisting of two separate envelopes, containing separately the financial and technical proposals as per tender:-

i. The envelopes shall be marked as “FINANCIAL PROPOSAL” AND “TECHNICAL PROPOSAL” in bold and legible letters to avoid confusion.

ii. Initially, only the envelope marked as “TECHNICAL PROPOSAL” shall be opened in the presence of contractors / firms or their authorized agents / representatives.

iii. The envelope marked as “FINANCIAL PROPOSAL” shall be retained in the custody of the procuring agency without being opened.

iv. The procuring agency shall evaluate the technical proposal by a Committee to be constituted by the Board comprising (technical officials of engineering Branch and elected members) in a manner prescribed in advance (Evaluation criteria circulated by PEC) without reference to the price and reject any proposal which does not conform to the specified requirements.

v. During the technical evaluation no amendments in the technical proposal shall be permitted.

vi. The financial proposals of bids shall be opened publically at a time, date and venue announced and communicated to the bidders in advance.

vii. After the evaluation and approval of the technical proposal the procuring agency shall at a time within the bid validity period, publically open the financial proposals of the technically accepted bids only by the Committee as mentioned above. The financial proposals of bids found technically non responsive shall be returned un-opened to the respective bidders and the bid found to be the most advantageous bid (lowest evaluated bid) shall be accepted.

Cantonment Board Clifton being procuring entity reserves the right to accept or reject any tender on technical / administrative grounds under Rule 33(1) of PPRA Rules, 2004.

Furthermore the said case was placed before the Board and the Board vide CBR No.3.4, dated 13-04-2020 approved the same erroneously as the tender notice could not be uploaded on PPRA website which is a clear violation of Rule 12 of PPRA Rules 2004 which tantamount to mis-procurement in terms of Rule 50 of the PPRA Rules 2004.

To consider a letter dated 22-06-2020 received from Mr. Muhammad Jamil, Elected member, CBC requesting therein to approach at appropriate level to refrain DHA vigilance to stop un-necessary interference during minor repair & maintenance works being executed by CBC officials.

In this regard, the elected member in his above referred letter has highlighted that DHA vigilance used to ask for DHA’s permission from CBC staff whenever they start M&R works of emergent nature like leakage of sewerage / water supply lines etc. They also used to stop the CBC staff from doing their work and at times confiscate the material as well.

Cantonment Board Clifton being procuring entity reserves the right to accept or reject any tender on technical / administrative grounds under Rule 33(1) of PPRA Rules, 2004.

Resolution Considered and the Board unanimously approved to reject the lowest rates under Rule 33 (1) of the PPRA Rules 2004 as the procurement process is in violation of Rule 12 of the PPRA Rules 2004. The Board further unanimously approved to recall the tenders / bids under rule 34 of the Rules ibid.

From the above mentioned quoted rates it reveals that the lowest quoted rates are not reasonable in consideration of prevailing rates of local market as reported by the concerned Branch on behalf of the Board being procuring agency. 4.12. CONSTITUTION OF PROCUREMENT / PURCHASE COMMITTEE.

Reference/Authority: Rule-19 of Pakistan Cantonments Account 1955, Rule-11 of PPRA Rules-2004 (as amended), CBR No.12 dated 25-08-2015, Office Order No.843 dated 17-12-2015 and No.967 dated 19-12-2019.

To consider the constitution of procurement / purchase Committee pursuant to Rule-19 of Pakistan Cantonments Account Code 1955, Rule-11 of PPRA Rules-2004 (as amended) wherein the Board is procuring entity and CBR No.12 dated 25-08-2015.

The TOR/Mandate of the procurement / purchase Committee will be as under:-

i. The Committee shall observe the principals / procedures of procurement as required under PPRA Rules-2004 (as amended) and Pakistan Cantonments Account Code, 1955 and operate within the ambit as defined in rule 19 of the Pakistan Cantonments Account Code, 1955 on behalf of the Board being procuring entity.

ii. The Committee shall carry out the opening and evaluation of bids as required under Rule 28, 29, 30, 31, 35, 36 and 37 of PPRA Rules 2004 (as amended) on behalf of the Board being procuring agency/entity.

iii. The Committee shall carry out the scrutiny of the proposals, bids, tenders, quotations etc of procurements/works.

iv. The Committee shall carry out rate analysis keeping in view of the specifications of goods/items to be procured.

v. All cases pertaining to procurements / works alongwith recommendations of the Committee shall be placed before the Board for consideration/approval being procuring entity in the light of rule 19 of the Pakistan Cantonments Account Code, 1955 and rule 11 of the PPRA Rules, 2004.
