1. DELEGATIONS

1.1. Tim Grouette and Wes Startup, Lower Columbia Initiatives Corporation - 2019 Fourth Quarter Report

Wes Startup, Board Chair and Tim Grouette, Economic Development Officer with the Lower Columbia Initiatives Corporation (LCIC) were present at the meeting to provide an update on the LCIC's activities. Mr. Startup introduced Mr. Grouette as the new Economic Development Officer with the organization.

Mr. Grouette provided an overview of his new role and the projects and initiatives that will be the focus in the coming months. Mr. Startup indicated there will be a strong focus on the sustainability of Metal Tech Alley, which has been widely recognized as a rural success story.

Chair Pasin thanked Mr. Startup and Mr. Grouette for their presentation.

Councillor Jones left the meeting.

1.2. Doug Jones and Erika Krest, Trail & District Chamber of Commerce - Our Role in the Community

Doug Jones, President and Erika Krest, Executive Director of the Trail & District Chamber of Commerce, were present at the meeting to provide an update on the Chamber's activities.

Ms. Krest provided information relating to the Chamber's "Our Role in the Community" initiative which seeks to support new, growing and long term businesses in the community.

Mayor Pasin thanked Ms. Krest and Mr. Jones for the presentation.

1.3. Samantha Murphy, Jeff Jones and Joanne Beetstra, Trail & District Public Library - 2019 Fourth Quarter Report

Jeff Jones, Chair, Joanne Beetstra, Vice Chair and Samantha Murphy, the Library Director were present at the meeting to provide Council with an update on the library's operations.

Ms. Murphy provided an overview of the services and programs offered at the library in the fourth quarter of 2019. She spoke about the library's goals and objectives for 2020 and provided information on some of the projects that are planned for this year.

Mayor Pasin thanked the library representatives for their presentation.

2. PUBLIC WORKS

2.1. Cambridge Creek and Violin Lake Dam Decommissioning

The Committee considered the report dated February 13, 2020 from the Engineering Department with respect to a shared Contribution Agreement with the British Columbia Wildlife Federation (BCWF) for the Cambridge Creek and Violin Lake Decommissioning Project.

That the City enter into a shared Contribution Agreement with the BCWF for the purpose of the planning and implementation of the Cambridge Creek and Violin Lake Decommissioning Project in the amount of $141,000; and that the City endorse the Rossland Streamkeepers production of a 3D model in the form of a letter of support that can be used for public involvement, notification and potential funding support.

3.2. JL Crowe Graduating Committee - Request for Rental Waiver

The Chief Administrative Officer indicated that an email had been received advising that the JL Crowe 2020 Graduating Committee had withdrawn their application requesting a waiver of the rental fees associated with their use of the Trail Memorial Centre gymnasium for a fundraising event on February 1, 2020 and the Safe Grad event on June 19, 2020 because the graduates are unable to assist with clean-up at Silver City Days this year.

3.3. Lower Columbia Community Development Team Society - Request for Sponsorship

Mayor Pasin called the Public Hearing to order.

2. INTRODUCTION OF BYLAW PURPOSE

The Deputy Corporate Administrator reviewed the purpose of the proposed bylaw. She advised that notice of the Public Hearing had been provided by mailing twelve statutory notices to property owners and occupants within 50 metres of the subject property and by advertising in the Trail Times.

3. REPRESENTATIONS

Mayor Pasin called for representations to the Public Hearing.

3.1. Written Submission - Jennifer and Jeff Kuhn - 3890 Carnation Drive

The Deputy Corporate Administrator referenced correspondence received from Jennifer and Jeff Kuhn of 3890 Carnation Drive indicating they do not object to a secondary suite in the premise but were in favour of the zoning being changed to R1/SS (Single Family Residential R1/Secondary Suite) as is the practice in the Village of Warfield as opposed to Single Family and Two Family Residential – R2.

3.2. Written Submission - Garth and Staci Johnson - 3891 Carnation Drive

The Deputy Corporate Administrator referenced correspondence received from Garth and Staci Johnson of 3891 Carnation Drive indicating they agree with the position of Mr. and Mrs. Kuhn.

3.4. Written Submission - Don Norman - 3894 Carnation Drive

The Deputy Corporate Administrator referenced correspondence received from Don Norman of 3894 Carnation Drive providing his support for the proposed re-zoning due to the shortage of rental accommodations in the area.

3.5. Written Submission - Ken and Christine Kryski - 3860 Carnation Drive

The Deputy Corporate Administrator referenced correspondence received from Ken and Christine Kryski of 3860 Carnation Drive indicating they are opposed to the rezoning and agree with the position of Mr. and Mrs. Kuhn.

3.6. Sandy Norman - 3894 Carnation Drive

Sandy Norman, the property owner at 3894 Carnation Drive, addressed the Public Hearing with respect to the application. She expressed her support for the proposed re-zoning and indicated there is a dire need in the community for rental accommodations. Ms. Norman indicated she did not foresee any impact to parking in the area, noting that other areas of Carnation Drive are far more congested than the area in question.

Chair Santori presided in the Chair.

1. DELEGATIONS

1.1. Bill MacPherson, Mercer Celgar - Growth and Innovation in the Kootenays

Bill MacPherson, Managing Director of Mercer Celgar, was present at the meeting to provide an overview of the operations at the mill. Mr. MacPherson noted that Mercer Celgar is one of the largest employers in the West Kootenay, employing over 400 full time employees. He provided information relating to the "Celgar 550 Project" that aims to lower Co2 emissions, reduce the risk of forest fires and utilize fibre that is left in wood as waste. He provided information relating to Phase 2 and 3 of the project that involves the installation of an industrial scale gasifier that would use bio-mass as a replacement to natural gas. Mr. MacPherson noted that Mercer Celgar is working to transform its business from a pulp-primary, commodity business into a multi-product bio-refinery business that is a global leader in innovative, environmentally friendly, bio-based products.

Chair Santori thanked Mr. MacPherson for his presentation.

2. OPERATIONAL REPORTS

2.1. Parks and Recreation Department

Trisha Davison, the Director of Parks and Recreation, was present at the meeting to update Council on the department's operations.

Ms. Davison reported on a variety of projects and initiatives the department has been working on. She summarized programs and services being offered and reviewed maintenance activities and capital projects underway.

4.2. United Way of Trail and District - Request for Sponsorship

The Committee considered the application dated February 26, 2020 from the United Way of Trail and District requesting a cash grant in support of the annual "Storm the Stairs" event planned for September 26, 2020.

SUBJECT: ZONING BYLAW AMENDMENT BYLAW 2880, 2020 - SECONDARY SUITES

1.0 PURPOSE

1.1. The purpose of this report is to advance an amendment to the City’s Zoning Bylaw No. 2503, 2002 to make allowance for secondary suites under certain zones and to create a particular process to facilitate this type of application.

2.0 RECOMMENDATION

2.1. That Zoning Bylaw Amendment Bylaw No. 2880, 2020 receive its first and second readings.

3.0 BACKGROUND

3.1. Council recently had an opportunity to consider an application to rezone the property at 3878 Carnation Drive in order to allow for a self-contained secondary suite to exist in the basement of the dwelling. At the time of Council’s consideration, it was suggested that the property be rezoned from Single Family Residential Zone R1 to Single Family and Two Family Residential Zone R2 as two family dwellings are permitted in the R2 zone.

3.2. During the Public Hearing phase of the noted rezoning application, concerns were brought forward from an adjacent property owner that the R2 zoning was too broad and could result in a secondary building being placed on the property, or a larger building being constructed which fits the description of a two family building, such as a duplex.

4.0 ANALYSIS

4.1. The information provided by the adjacent property owner and dispersed amongst the neighbourhood was in part incorrect in that the R2 zone would not permit the construction of a secondary building as not more than one principal building is permitted in the R2 zone. Additionally, a two family dwelling is defined in the Zoning Bylaw as a dwelling containing two dwelling units, but does not include two detached single family dwellings on the same lot.

4.2. However, the concerns raised regarding future construction of a duplex are valid although clearly not the intention of this particular applicant. Rezoning this parcel from R1 to R2 could result in the construction of a duplex on the property at a future date.

4.3. The City of Trail Zoning Bylaw 2503, 2002 currently does not specifically address secondary suites.

4.4. It is therefore being suggested that the General Provisions of the City of Trail Zoning Bylaw No. 2503, 2002 be amended to allow secondary suites under certain zones and to create an approval process to facilitate this type of application.

4.5. Council will be familiar with the provisions of the Zoning Bylaw, which permit short-term rental accommodations in the R1, R2 and R3 zones. This process involves an application for rezoning followed by a Public Hearing. If the request is approved, the subject property is designated by bylaw as R1a, R2a or R3a depending on its current zoning. The Zoning Bylaw is structured in this way so that any request to establish a short-term rental accommodation can be considered by Council on an individual basis. This allows Council to ensure the proposed location of the short-term rental accommodation does not create conflict with the neighbouring residential area and that adjacent property owners have an opportunity to express any concerns they may have through the public hearing process.

4.6. It is being recommended that a similar approach be adopted for secondary suites; however only in the Single Family Residential R1 and Single Family and Two Family Residential R2 zones whereby if the request is approved, the subject property would be designated by bylaw to be Single Family Residential Zone R1s or Single Family and Two Family Residential Zone R2s;

4.7. It is being recommended that the Hillside Single Family Residential R3 zone be excluded from the amendment due to the housing density and lack of off-street parking in this area.

4.8. It is being proposed that the definition of a secondary suite be incorporated in the Zoning Bylaw, Part I as follows: 4.8.1. “secondarysuite”meansaself‐containeddwellingunitlocatedwithina

4.9. It is further proposed that Part III, General Provisions of the Zoning Bylaw be amended to include the zones in which a secondary suite will be allowed, a process to establish a secondary suite, as well as regulations.

4.9.1. The BCBuildingCode recently removed the limitation to floor space or percentage distribution of a secondary suite to the habitable space of the building; however, the City can still regulate this within the provisions of the Zoning Bylaw. It is being suggested that a secondary suite be limited to a maximum floor area not to exceed 40% of the total floor area of the principal building. This limitation is suggested as secondary suites by their nature are intended to be ancillary to one’s principal dwelling.

4.9.2. The amendment includes the provision that any secondary suite constructed within the R1 and R2 zones shall comply with all relevant City Bylaws and the BCBuildingCode.

4.9.3. It is being recommended that bed and breakfast accommodations not be permitted to operate within a secondary suite or be located on a parcel that also has a secondary suite.

4.10. Based on the public input collected as part of the engagement process for the on-going OCP review, the provision of a variety of housing options and more affordable housing options in Trail is one of the emerging themes. Amending the Zoning Bylaw to make provisions for secondary suites in the R1 and R2 zones seeks to achieve these goals.

4.11. Council may decide that the risk that a duplex could be constructed at 3878 Carnation Drive at a future date is low and therefore a comprehensive amendment to the Zoning Bylaw to accommodate secondary suites is not required.

5.0 OPTIONS

5.1. Proceed with Third Reading and adoption of Zoning Bylaw Amendment Bylaw No. 2879, 2020 rezoning the property located at 3878 Carnation Drive to Single Family and Two Family Residential Zone R2.

5.2. Proceed with first and second reading of Zoning Bylaw Amendment Bylaw No. 2880, 2020 to allow secondary suites under certain zones and to create a particular approval process to facilitate this type of application. 5.2.1. Direct staff to amend Bylaw 2879 to reflect a zoning designation of R1s

before giving third reading. 5.2.2. If Council provides this direction, the holding of a second public hearing in

regards to the amendment could be held at the discretion of Council. Given the amendment is in line with the input received at the first public hearing held with regard to Zoning Bylaw Amendment Bylaw 2879, it is staff’s view that this is not required.

6.0 POLICYANDLEGALCONSIDERATIONS

6.1. Section 464 of the LocalGovernmentAct requires that a public hearing be held prior to the adoption of an official community plan or zoning bylaw for the purpose of allowing the public to make representations to Council respecting matters contained in the proposed bylaw. 6.1.1. If Council proceeds with first and second readings of Zoning Bylaw

Amendment Bylaw No. 2880, 2020, staff will take necessary action to provide public notice of the public hearing in accordance with section 466 of the LocalGovernmentAct.

6.1.2. The public hearing will be scheduled for Tuesday, April 14, 2020 at 6:00 pm immediately preceding the Regular Council Meeting.

concerns that were brought forward during the public hearing process when Council

considered Bylaw 2879. The creation of a subzone R1s provides a more comprehensive

approach as part of dealing with any future applications that may come forward and was

developed in consultation with the planning consultants who are working on the City’s

OCP. As noted, should Council proceed with the amendment now being proposed and

should the bylaw be adopted, Bylaw 2879 would subsequently be amended to remove the

R2 designation and include the R1s designation before the bylaw is adopted. Staff do not

believe a second public hearing is required for Bylaw 2879 on the assumption that Bylaw

2880 is finally adopted and a public hearing will need to be held to seek input in response

to the amendment contained in Bylaw 2880. Should members of the public raise concern

in response to Bylaw 2880, the City may have to consider what other options might be

available to provide a reasonable approach to densification in established residential

neigbourhoods.

Council should proceed as recommended.

Bylaw No. 2880, 2020: Zoning Bylaw Amendment Bylaw To set provisions to allow secondary suites in R1 and R2 properties

THE CITY OF TRAIL BYLAW NO. 2880 A BYLAW TO AMEND ZONING BYLAW NO. 2503, 2002 WHEREAS Council of the City of Trail deems it expedient to amend Zoning Bylaw No. 2503, 2002; AND WHEREAS the regulation on land use may include a prohibition of a use or uses in any zone, AND WHEREAS Council deems it to be in the best interest of the municipality that secondary residential suites be regulated, NOW THEREFORE, Council of the City of Trail, in open meeting assembled, ENACTS AS FOLLOWS:

1. That this bylaw may be cited as “Zoning Bylaw Amendment Bylaw No. 2880 , 2020”.

2. That PART 1, Section 1(2) of Zoning Bylaw No. 2503, 2002 be amended by adding the following definition:

“Secondary Suite” means a self-contained dwelling unit located within a building or portion of a building: (1) completely separated from other parts of the building by a vertical fire separation that has a fire-resistance rating of not less than 1 hour and extends from the ground or lowermost assembly continuously through or adjacent to all storeys and spaces including service spaces of the separated portions; (2) of only residential occupancy that contains only one other dwelling unit and common spaces; and (3) where both dwelling units constitute a single real estate entity. 3. That PART III, GENERAL PROVISIONS of Zoning Bylaw No. 2503, 2002 be amended by

adding the following Section:

3(17) Secondary Suites

(a) A secondary suite will be permitted in the following Zones: Single Family Residential Zone R1 Single and Two Family Residential Zone R2

(b) Requests to establish a secondary suite shall be submitted to Council as an

application for rezoning. If the request is approved, the subject property will be designated by bylaw as Single Family Residential Zone R1s or Single and Two Family Residential Zone R2s as applicable, pursuant to section 903 of the Local Government Act.

(c) The following regulations will apply to secondary suites:

i. A secondary suite shall only be permitted on a lot with a single family or two family dwelling and no other dwelling units.

ii. The maximum floor area of a secondary suite shall not exceed 40% of the total floor area of the principal building.

iii. Off-street parking shall be in conformance with the regulations of this

Bylaw as replaced or amended.

iv. Secondary suites shall comply with all relevant City Bylaws, and the British Columbia Building Code as replaced or amended.

1.0 PURPOSE

1.1. BF Roofing Ltd. is applying to rezone the property legally described as Lot A, Plan NEP65521, Township 7A, K.D. (PID 024-617-181) (hereafter referred to as Lot A, Highway 3B) to allow for a contractor’s office and yard on the property.

1.2. The purpose of this report is to advance the rezoning application and proposed bylaw to Council for consideration.

2.0 RECOMMENDATION

2.1. That Council consider giving Zoning Bylaw Amendment Bylaw No. 2881, 2020 its first and second readings.

3.0 BACKGROUND

3.1. This undeveloped lot is off of Highway 3B near the intersection of Marcolin Drive and is presently listed for sale. The property is currently zoned Single Family Residential R1 which allows for it to be developed as a single family dwelling.

3.2. BF Roofing Ltd. is proposing to purchase the property in order to develop a shop and storefront for its operations. 3.2.1. Rezoning of the property for commercial use is a condition of the sale

proceeding. 3.3. It is being requested that the Zoning Bylaw be amended to designate the property at

Lot A, Highway 3B as Service Commercial Zone C7, to which the proposed development can meet the requirements.

3.4. Zoning Bylaw Amendment Bylaw No. 2881 has been drafted accordingly and is presented to Council for first and second readings.

4.0 ANALYSIS

4.1. The property is located in the Waneta Junction neighbourhood that has a mix of commercial uses amongst single family residential properties. The commercial uses in the area include a large building supply store, an automobile dealership, a restaurant and regional commercial “big box” stores ie. Walmart and Canadian Tire.

4.2. The City’s Official Community Plan supports commercial, single family residential and parks and recreation land uses within Waneta Junction and seeks to attract appropriate commercial uses to the area.

4.3. The property in question is located between two developed single family residential properties and backs onto three developed single family residential properties (see attached mapping).

4.4. The applicant is proposing to construct a 4,000 square foot shop in order to have office space and to store roofing materials and supplies. The structure is proposed to be 16” in height and have a flat roof. As indicated in the attached sketch, the applicant had proposed to have the structure placed near the rear of the property and that the remainder of the property would be used for parking for the commercial business. The structure as proposed by the applicant is contrary to the minimum side and rear yard setbacks contained within the C7 zone.

4.5. Engineering reviewed the development and provided the maximum building size and siting options available. The applicant has indicated a desire to work within the provisions of the C7 zoning in terms of the construction and siting of the building, if the change of zoning designation is approved.

4.6. There are several provisions contained within the C7 zoning that addresses the requirements when a commercial use abuts a residential zone. 4.6.1. The minimum interior side yard is increased from 14.8 feet to 29.5; 4.6.2. Fencing is required of 4.9 feet to 5.9 feet in height and a landscape screen

for interior side yards and for rear yards where no developed rear lane exists.

4.7. Other provisions required include: 4.7.1. All portions of the lot, except those used for buildings, structures, parking,

loading, driveway, outdoor storage, and display purposes, shall be landscaped and maintained in good condition.

4.7.2. Off street parking shall be provided in accordance with the bylaw. Although “contractor’s offices and yards” is not defined in Part VII, it could be compared to “building supply”. In terms of the development proposed and if applied in this manner, the applicant would be required to provide 7 off street parking spaces (1 per 50 m2 gross floor area) to which there is ample space.

4.7.3. Surfacing of the off-street parking area is required to be a permanent surface of asphalt, concrete or similar pavement so as to provide a surface that is durable and dust free for the purposes intended and so that all water is contained on site or directed to an approved drainage system.

4.7.4. The applicant has indicated he plans to eventually pave the parking area. There are concerns from the City’s perspective that if this is not done in a timely manner, there would be impacts on the neighbouring properties ie. dust.

4.8. The proposed zoning change to allow for a contractor’s office and yard on the property may have additional impacts on neighbouring properties when considering the residential nature of the adjacent properties. Increased traffic, noise and potential depreciation of property values might be expected, which could create some inconvenience and/or conflict for the residentially developed properties nearby.

5.0 POLICYANDLEGALCONSIDERATIONS

5.1. Section 464 of the LocalGovernmentAct requires that a public hearing be held prior to the adoption of an official community plan or zoning bylaw for the purpose of allowing the public to make representations to Council respecting matters contained in the proposed bylaw. 5.1.1. Following first and second readings of the amending bylaw, staff will take

necessary action to publish notice of the public hearing in accordance with section 466 of the LocalGovernmentAct.

5.1.2. The public hearing could be scheduled for Tuesday, April 14, 2020 at 6:00 p.m. immediately preceding the Regular Council Meeting.

5.2. Because the subject property is located within 800 metres of a Controlled Access Highway (Highway 3B), section 52 of the TransportationAct requires that the bylaw be advanced to the Ministry of Transportation for approval prior to the bylaw’s adoption. The bylaw will be referred to the Ministry following first and second readings, if given.

CAOCOMMENTS:The proposed rezoning is consistent with the mixed use in the area. The highest and best

use for property fronting a highway is commercial and the zoning requested would

facilitate the proposed use.

Should Council agree to proceed, a public hearing would be required and at that time,

Council can assess the public feedback in terms of impacts and any concerns that come

forward before proceeding with the adoption of the bylaw.

The construction of a commercial building is seen to be positive in that it will be an

addition to the City’s property tax base and there likely would be other positive economic

spinoffs. These considerations do need to be balanced against the planning considerations

and the current mixed uses. A building of this nature is likely used for storage and

loading/reloading of supplies and material whereby the impacts to the neighbours should

not be significant given that fencing and screening is a requirement.

Council should proceed with two readings of the bylaw.

CITY OF TRAILREVENUE POLICY

PURPOSE

The purpose of the City’s Revenue Policy is to ensure compliance with legislativerequirements. The policy is intended to further enhance municipal public accountability bydisclosing objectives and policies relating to core municipal revenue sources includingmunicipal taxation, which is included within the City of Trail’s Financial Plan.

SCOPE

Specific objectives and policies pertaining to municipal revenues are included as follows:

• the proportion of total revenue that comes from each of the funding sourcesdescribed in Section 165(7) of the Community Charter;

• the distribution of property taxes amongst the property classes; and• the use of permissive tax exemptions (including revitalization tax exemptions)

POLICY

A. Revenue categories — Section 165(7) of the Community Charter indicates that fundingsources must be separately disclosed for certain categories. The City recognizes thatdiversification of revenue sources is preferred but there are legislative and otherbarriers that reduce the opportunity to introduce new, sustainable revenue sources.Therefore, property taxes remain as the City’s primary revenue source.

The following summarizes the City’s current approach as it pertains to funding sourcesthat are utilized in the operation of the City:

I. Property value taxes — Property taxes are the City’s primary revenue source.It is recognized that revenue diversification is desirable where sustainablerevenue sources outside of property taxation become available and providefor a reduction in the overall municipal property tax burden, which couldmake the City more competitive.

II. Parcel/Residential Flat taxes — The City utilizes parcel and flat taxes wherefunding can be linked directly to specific services as well as the benefitingproperties who either use or derive direct benefit. These taxes are used torepay funds to the City’s Local Improvement Fund (specified area tax), tofund ongoing infrastructure replacement and upgrading or to pay directlyfor general municipal services.

The City’s Local Improvement Policy outlines conditions under whichspecific projects can be advanced as part of a petition process where themajority of benefitting properties agree to fund a share of costs as specified

within the policy. Parcel or frontage taxes will be approved and levied inaccordance with these policy guidelines.

Residential property taxes also include a specified Flat Tax as part ofdistributing general service costs more equitability across the residential taxbased when considering the considerable variance in assessments levels andchanges in assessments on an annual basis. The 2020 flat tax is establishedat $260 per residential property.

III. Fees — The City levies fees for services that provide benefit to specificservice users. It is the City’s general goal or policy to minimize the need tosubsidize these services with property taxes. It is recognized that for certainservices it would not be possible to levy fees that would completelyeliminate the need for an ongoing property tax subsidy. In these instances,full cost recovery would require that fees be increased to a point that wouldnegatively impact use and would therefore jeopardize the provision of thespecific service, which is seen to provide a greater community benefit.

The following provides a general summary of fees levied as well as theCity’s intended policy direction with respect to cost recovery:

A. Utilities (water/sewer/garbage) — The annual utility levies areestablished to offset the budgeted operating costs associated with theprovision of these services after taking into account revenue fromother sources. Capital projects may be funded by utility basedrevenue and may utilize other funding sources depending on thenature of the capital project.

B. Cemetery — The City charges fees for cemetery services with themain sources of revenue coming from burial fees and the sale ofplots. User fees are reviewed intermittently and will considerchanges in direct costs. The net operating costs for the operation ofthe cemetery is provided by the regional district in the form of aconditional operating grant that recognizes the regional benefit ofthe service provided as part of a regional function. Any changes inthe City’s user fees must be included in a municipal bylaw andapproved directly by the Province.

C. User Fees — Recreation — User fees for recreation services areintended to offset the service cost and the final property tax subsidythat is required to fully fund the recreation services. User fees arereviewed annually and will consider revenue recovery, operatingcosts and the associated subsidy for each service area as well ascomparable rates charged by similar sized municipalities. Rateslevels must also be set so use is not discouraged with the goal ofproviding access to municipal facilities and services by all ofresidents in the City through the establishment of an acceptable split

between user fee recovery and the net property tax subsidy that isrequired to operate each facility or provide the specific service orprogram.

User fees will be set at levels that differentiate between users in theregion who directly subsidize recreation cost through propertytaxation. Users who live in the Greater Trail and outlying areas whouse facilities on an ongoing basis but do not contribute to the costsof facilities through property taxes or by purchasing a residencycard” will pay a higher user fee in order to create and promote rateequity and fairness as part of the Trail Resident Program (TRP).TRP rates will be reviewed in order to ensure that rates are notdiscriminatory but are appropriate in recognition of the significantproperty tax subsidy required to operate the recreation facilities.

When facilities are used or rented for special events, the City willendevour to recover all costs wherever possible but also recognizethat certain events provide a broader community benefit oradvantage such that full cost recovery may not be possible.

D. Airport — The City will set fees in accordance with industrystandards as part of a revenue generation strategy that will result inthe offset of the majority of operating costs and therefore minimizethe net subsidy for operations coming from property taxation. TheCity owns and operates an airport terminal building and fees arecharged to the commercial carrier who uses the facility. In addition,airport revenue includes lease fees for the building use, parking feesand advertising fees.

IV. Other sources — Based on the City’s stated goal of reducing property taxdependency, revenue from other sources will be reviewed annually andwhen the City levies specific charges, they will be adjusted so they remainreasonable and where revenue is maximized. The City will continue toexplore opportunities to identify other sustainable revenue sources that mayoffset specific cost areas or can be used in the general operations of the City.This may involve the inclusion of new revenue streams further to thelegalization of cannabis.

V. Proceeds from borrowing — Proceeds from borrowing are utilized to ftindspecific capital projects. The need to utilize borrowing will be reviewedannually as part of Council’s approval of the Five Year Capital Plan. TheCity’s current goal is limit borrowing as part of funding ongoing capitalprojects from revenue. Proceeds from borrowing will be utilized dependingon the nature of the project and the funding available and will fully considerthe future implications of the annual cost of carrying the debt including therevenue implications associated with increasing property taxes or user feesto make future debt payments. B. Distribution of Property Taxes amongst property classes — The City’s approach toproperty tax distribution will be based on the following:

Class I — Residential — This property tax Class is effectively used as a “balancing”Class when consideration is given to the policy direction referenced below as itpertains to the other property tax classes. As part of the annual budget process,residential property taxes are reviewed and compared to other neighbouringmunicipalities and similar sized jurisdictions in the Province. This ensures that themunicipal property tax rate for this Class is reasonable and comparable to othercommunities when consideration is given to services provided and other differencesthat may exist between the different communities.

Class 2 — Utilities — Property taxes that can be levied against this Class are cappedby Provincial Regulation. The current maximum that can be levied against Class 2Property is the greater of $40 for each $1,000 of assessed value, and 2.5 times therate applicable to Class 6 property for general municipal purposes in themunicipality for the same taxation year.

As a property tax policy, the City will continue to levy the maximum rate allowedunder the Provincial Regulation.

Class 4 — Major Industry — The City is fortunate to have substantial Class 4assessments in its jurisdiction. It is recognized that dependency on one propertytax class can expose the remaining property tax classes to significant increases ifconditions change or municipal services could be at risk if a significant reductionin this class was ever required or legislated. Property taxation should balance thenet burden on the Class and overall dependence so as to reduce revenue and serviceloss reduction exposure where practical.

The Major Industrial property tax levy will be reviewed on an annual basis; usingthe previous year’s levy as the base. The net increase in the annual property tax

levy to be applied to this Class will maintain the total proportion of taxes previouslylevied against this class, which is currently 6 1.33% of the total municipal tax levy.Variables such as shifis in municipal assessments. community economic impacts,extra costs the City may incur as a result of the industrial operations residing in theCity and any other factors that may impact the City directly or indirectly wherebyCouncil may feel that some form of adjustment to the level of property taxes paidby this class is appropriate. The apportionment to major industry should be fair andjustifiable when considering the factors noted above as well as the historicalcontext.

Class 5 — Light Industry — The City’s light industrial property tax rate has been setat a rate that is less than the Provincial rural property tax rate and has been adjusted.Recognizing the very small assessment base and minimal revenue generatingcapacity, the rate may encourage future development in this class if land can bemade available.

Class 6 — Business/other — In order to remain competitive in the context ofsustaining and attracting investment in business, the City will distribute propertytaxes to Class 6 where the ratio between Class 1 and CLass 6 will closelyapproximate 2 to I with the ratio to be adjusted in recognition of ongoing changesin assessments. The net ratio is impacted by the residential flat rate and thereforerevenue from the flat tax will make the ratio appear higher. Rates are reviewedannually and will also consider assessment growth in Class 1 and Class 6 as part ofmaking any adjustments to maintain a reasonable apportionment amongst the rateclasses.

The municipal property tax distribution for 2020 will be as follows and may besubject to change depending on any change in total assessments.

C. Permissive Tax Exemptions - Tax exemptions are currently limited as part ofCouncil’s goal to promote transparency and accountability. Current policydirection is to limit the use of annual permissive tax exemptions and if applicableconsider the provision of a cash grant on an annual basis to qualifying organizationto offset municipal property taxation.

RE: FortisBC Inland Gas Upgrade Project Update

As a follow up to previous correspondence FortisBC would like to notify you of an upgrade project that will beoccurring in the City of Trail.

We are planning to upgrade 29 natural gas lines in communities across the interior region of B.C as a part of ourInland Gas Upgrade (IGU) Project. Some of this work will require us to upgrade lines to remove bends and smallparts that could block inspection equipment. In some cases, this work will require us to replace gas lines. Inother cases, we will regulate the pressure in sections of our system. Additionally, the vast majority of this workwill take place within our existing utility right-of-ways. The IGU Project forms part of our ongoing systemintegrity program, ensuring continued safe and reliable service for our customers.

In fall of 2018 we applied for a Certificate of Public Convenience and Necessity for this project through ourregulator, the BC Utilities Commission (BCUC). This application was approved early this year. The project willnow move forward into its next phase, with construction scheduled to take place between 2020-2024.

While some project work will begin in 2020, we are not planning to carry out construction activities in the City ofTrail this year. In the months ahead, we will continue to provide you with updated timelines and more specificproject details as they become available.

We would like to share with you the exciting results of the BC Farmers’ Market Nutrition Coupon Programat Trails IncrEDIBLE Farmers’ Market for 2019. The BC Association of Farmers’ Markets delivers this provincialprogram and is extremely proud of its deep impact on both people and farms across BC.

Over the last year, this valued program connected with 78 communities making fresh local foods moreaccessible to over 15,862 British Columbians. In 2019, a total of $7,560 was invested directly in the Trailcommunity through the Farmers’ Market Nutrition Coupon Program.

Our partner in your community, the Trail United Church Food Bank provided lower-income pregnant women,families and seniors with coupons to purchase fresh fruits, vegetables, cheese, eggs, nuts, fish, meat and herbs atyour local farmers’ market.

As a result, program participants from Trail ate more local foods, learned about healthy eating, and feltconnected to their community. At the same time, the local food system was strengthened with farmers in yourcommunity benefitting from additional revenue to sustain their farms.

We have received many messages of thanks throughout the year but this one stood out to us, as best expressingthe value of the Program to participants ‘The security of knowing we will have some fresh and healthy food eachweek. Also, the pleasure of knowing and seeing our farmers each week. The good feelings that come from beinga part of the market community each week, seeing everyone there, smiling.”
