Process for Developed Properties to Connect to City Services

Recommendation:That Policy C535, Process for Developed Properties that are Currently Unserviced to Connect to City Services, as outlined in Attachment 1 of the June 9, 2008, Planning and Development Department report 2008PDG006, be approved.

Report SummaryThis report provides a new City policy and procedure outlining the process available to Edmonton property owners that want to get their developed properties connected to City services.

Previous Council/Committee ActionAt the May 7, 2008, Executive Committee meeting, the following motion was passed:

1. That Administration prepare a policy on the process for developed properties that are currently unserviced to connect to City services.

2. That Administration, as part of the process, facilitate communications between developers who are actively developing in an area of Edmonton with adjacent property owners that want to connect to City services and who may benefit from the active development.

3. That Administration report to Executive Committee, for

information purposes only, when it decides that a project should go the servicing agreement route instead of through local improvement financing.

Report Administration will assist property owners who wish to connect to City services by directing them through the available options of proceeding either through the servicing agreement process or the local improvement financing process as set out in Attachment 1 of the proposed Policy and Procedure C535. In addition, Administration will facilitate communication between developers who are actively developing in an area of the City and adjacent to existing property owners that want to connect to City services and who may benefit from the development. Properties that are determined to be eligible under existing City policies will follow the process as set out in Attachment 2 of the proposed Policy and Procedure C535 for financing through a local improvement tax. existing City policies may want to enter into a servicing agreement with the City as set out in Attachments 3 and 4 of the proposed Policy and Procedure C535. The servicing agreement would help to facilitate construction of services to their properties. The property owners may wish to form an organization such as a Home Owners’ Association, Residents’ Association, Partnership, Corporation, etc. Financing for such projects is done at the expense of the property owners themselves. Administration will report to Executive Committee for information purposes only, when it decides that a project should go the servicing agreement route instead of through local improvement financing as set out in Attachment 3 of the proposed Policy and Procedure C535.

Public ConsultationThe public consultation was limited and very targeted. Administration has held a number of meetings and has been involved in numerous correspondences with a resident of Donsdale Crescent and with a representative of the Greater Windermere Community Leagues and some members of the Windermere Crescent Home Owners’ Association.

Budget/Financial ImplicationsAdministration will bear the costs associated with the following:1. Preparation of the servicing

agreements.2. Review and approval of detailed

engineering drawings for local improvement projects that do not proceed.

3. Preparation of the cost estimate of a local improvement project that does not proceed.

Legal ImplicationsThe City’s debt limit is set by the Debt Limit Regulation, A.R. 255/2000. Local improvement borrowing is calculated as part of the debt limit. Any borrowing bylaw must be passed prior to the start of any construction of a local improvement project (section 254, Municipal Government Act, R.S.A. 2000, c. M-26).

Justification of RecommendationApproval of this new City Policy and Procedure provides City property owners with a clear process to follow in order to get their developed properties connected to City services.

This Policy provides direction and a process for City Administration and developed property owners that want to connect to City services.

Policy C535 – Procedure

POLICY NUMBER: C535AUTHORITY: City Manager EFFECITVE DATE: XXXXX, 2008

TITLE: Process for Developed Properties that are Currently Unserviced to Connect to City Services

1. DEFINITIONS

1.01 City Administration: shall mean the City of Edmonton administration that is responsible for the City Services being requested.

1.02 City Services: shall mean services that are owned by the City of Edmonton. This shall include water services only if the construction is done in conjunction with sanity services.

1.03 Detailed Engineering Drawings: shall mean drawings that are provided by the Owners at their own expense and approved by the City Administration in accordance with Attachment 4.

1.04 Developed Property: shall mean any residential parcel of land that have existing Improvements (excluding any subdivision occurring as a replot process pursuant to the Municipal Government Act) but have not been previously fully serviced (excluding alley paving).

1.05 Improvements: means

(i) a structure,

(ii) any thing attached or secured to a structure, that would be transferred without special mention by a transfer or sale of the structure, and

(iii) a designated manufactured home.

1.06 Owner : shall mean any property owner whose Developed Property is located in the City of Edmonton.
