STATUTORY INS T R U M E N T S

. The Universities and Other Tertiary Institutions (Modified Provisions of the Universities and Other Tertiary

Institutions Act applicable to Uganda Management Institute) Instrument, 2006.

[Under section 82C of the Universities and Other Tertiary Institutions Act, 2001, Act No. 7 of2001 (“principal Act”) as inserted by section 13

of the Universities and Other Tertiary Institutions (Amendment) Act, 2006, Act 3 of2006 (“amending Act”)].

Whereas section 82C of the principal Act, as inserted by section 13 of the amending Act, provides that the provisions of the principal Act specified in the Schedule to the amending Act shall apply to any Other Degree Awarding Institution established under the amending Act, subject to such modifications, qualifications, reservations and other changes as the Minister may, on the recommendation of the National Council, by statutory instrument specify;

And whereas by virtue of section 19 of the amending Act, the Uganda Management Institute shall be deemed to have been established as a public Tertiary Institution having the status of an Other Degree Awarding Institution;

And whereas the National Council has recommended that the provisions of the principal Act specified in the Schedule to the amending Act should be modified in relation to, or as they apply to, the Uganda Management Institute;

Now, therefore, in exercise of the powers conferred on the Minister by section 82C of the principal Act, and on the recommendations of the National Council, this Instrument is made this 1 Oth day of May, 2006.

Interpretation.

Modified provisions of principal Act applicable to Uganda Management Institute.

1. This Instrument may be cited as the Universities and Other Tertiary Institutions (Modified Provisions of the Universities and Other Tertiary Institutions Act applicable to Uganda Management Institute) Instrument, 2006.

2. Any word, term or expression used in this Instrument and which has been defined in the Universities and Other Institutions Act, 2001, shall have lhe meaning assigned to it by the Act.

3. The provisions of the principal Act specified in column 1 of the Schedule to this Instrument shall, in their application to Uganda Management Institute, be read with necessary changes and arc modified in the manner specified in column 2 of the Schedule.

Section 31 (providing for the Vice Chancellor of Public University)

(i) There shall be a Director General for the Uganda Management Institute to bcJ appointed by the Chancellor of the Institute on the recommendation of the Institute Council and on such terms and conditions as the Council may determine.

(ii) Without prejudice to the generality of paragraph (i) the Director General shall be offered five year renewable contracts.

Section 32 (providing for theDeputy Vice Chancellors)

There shall be Directors appointed by the Institute Council who shall deputise the Director General. The number, other functions and terms and conditions of service of the Directors shall be determined by the Institute Council.

Sections 33, 34, 35, 36 and 37 (providing for (he appointment of University Secretary, Academic Registrar, etc)

Without prejudice to sections 33, 34, 35, 36 and 37, the Council of the Uganda Management Institute shall appoint such other officers and staff as may be necessary for the proper and efficient discharge of the Institute’s functions.

Section 38 (1) (providing for University Council for Public University)

The provisions of section 38(1) of the principal Act arc modified as follows:-

(a) by substituting “Institute Council” for “University Council" wherever it appears in section 38(1);

(b) in paragraphs (h) and (i) by substituting “one member” for "two members” respectively;

(c) by deleting paragraphs (j) and (k) and substituting “(k) one member of nonacademic staff’, and re-numbering paragraphs (1) to (q) accordingly;

(d) by substituting for paragraph (in) the words “(m) two members appointed by the Minister”; and

(c) by substituting for paragraph (n) the words "(n) two members appointed by the Institute Council”.

The Chaipersons of the Governing Council and the Academic Board respectively of any affiliated and constituent colleges or schools shall also be members of the Council of the Uganda Management Institute.

Section 44(1) (providing for University Senate) Substitute "two persons” for "three persons” in paragraph (1)

Section 50 (providing for Appointments Board) Substitute "a minimum of five members and a maximum of nine members” for "nine members” in subsection (2)

Section 59 (providing for funding of the Public University)

Substitute "Institute Council” for "University Council” in sections 59(i) (c) and 59(5).
