The Sacramento Claims Association is half way through the 2014 year and it is time for you to think about how you may get more involved. Both to finish strong with all we have scheduled for this year and as a potential Board Member for 2015. Yes we will be conducting an “election” for Board Members in October of this year. Now is the time to consider if YOU would like to step up and make a greater impact on YOUR SCA. The Board is a critical element to the lifeblood of the Association and works diligently to bring value to the members. We consider the foundation building blocks of the SCA in everything we do with Education being the corner stone. The Board oversees all aspects of the SCA and makes critical “voted” decisions that carry our theme forward in a positive way.

The experience is very gratifying and rewarding. It will help you to understand how to work with others toward a common goal. The aspect of give and take for a greater cause. How to position your thoughts and ideas and to present them in a professional way where others may see them more clearly. Additionally it will give you an opportunity to work with many Leaders within our great industry and be responsible for the strongest Association in the North State….YOUR Sacramento Claims Association.

strong work ethic as there is after hours involved with Board Meetings and a once a Year Summit Meeting that reviews the entire strategy of the SCA for past, present and future focus.

As the representative of the Board you will also be asked to lead a committee. These are very important to the SCA as each committee represents an integral part of the overall success. Each committee recruits members to be a part of that committee and work together on those committee goals for the year. Another way to reach out to individuals in the industry in an effort to involve them in the SCA. This process helps with Leadership and Communication among other attributes that are essential in leading a great and effective committee.

If you are interested in stepping up YOUR involvement with the SCA with either a potential Board Elected Position or a Committee for 2015 please reach out to anyone on the current board for assistance. Or reach out to me personally and I can make sure your request is properly considered.

The SCA welcomed James K. Ward, from Evans, Wieckowski & Ward, to speak at the June 12, 2014 Luncheon Meeting, held at the Lions Gate Hotel.

Mr Ward shared a great deal of information and knowledge on the very complex subject, the Col-lateral Source Rule.

An American case law doc-trine, the Collateral Source Rule prohibits the admission as evi-dence any information that a plaintiff or victim has received compensation from some source other than the damages sought against the defendant. That is to say, attorneys may not bring up any facts expressing whether a plaintiff/victim received any insur-ance or workers’ compensation settlements.

Join the Sacramento Claims Association Thursday, July 10, 2014 for our next luncheon meeting. The SCA is pleased to welcome Steve Einhaus of Einhaus Adjusting Services, as

our guest speaker. Steve, a graduate of the University of Iowa and a multi-line adjuster since 1978, has worked for several insurance companies and has been an independent adjuster since 1991.

He will speak on a model of human personality termed the nine personality types, a system for the evaluation of profes-sional skills and self awareness, and a way of seeing ourselves, our relationships and the world we will in. The types are Re-former, Helper, Achiever, Individualist, Investigator, Loyalist, Enthusiast, Challenger and Peacemaker.

Many people have studied the Myers Briggs Type indicator which has people basically more inner directed (introvert) or outer directed (extrovert), more thinking or feeling oriented, more intuitive or more sensing - or the Strong Campbell Interest model. The nine personality type model Mr. Einhaus believes is equally insightful.

The talk will focus on Mr. Einhaus’s over 30 years of

observations of people within the industry, to include ad-justers, various experts, marketing personnel, even public adjusters, and inclinations toward certain personality types. It will also address a number of well known people, past and present, politicians, entertainers, our State Governor, and each person’s type.

The entertaining, uplifting talk will provide participants the opportunity for light hearted reflection, inspiration and motivation toward their personal and professional goals.

Phantom collisions result in multiple arrests in auto insurance fraud caseSeven insurance companies ripped off for over $314,000

LOS ANGELES – Joel Paredes Saldana, 22, owner of Lightning Auto Body in Riverside County, was arrested June 25, 2014 as Department of Insurance detectives and multiple allied agencies swept up at least 20 co-conspirators associated with an organized insurance fraud crime ring. Those arrested will face multiple felony charges that include grand theft, knowingly filing a fraudulent insurance claim, and conspiracy.

“This orchestrated phantom collision ring contributes to the multi-billion dollar drain on California’s economy due to insurance fraud,” said Commissioner Jones. “This is not a victimless crime. The cost of insurance fraud is borne by consumers who pay for it through higher premiums. Southern California is the auto fraud capitol of the nation. Our detectives and law enforcement partners are dedicated to shutting down these scams and arresting those participating in these complex crime rings.”

Investigators from the Department of Insurance initially received information about the crime ring in 2013, when insurers recognized a pattern to Saldana’s and his co-conspirators’ insurance claims. Investigators allege that Saldana recruited friends and family members to pose as insurance consumers and, for a $500 bounty, file claims for collisions that were either staged or didn’t occur at all. As the ringleader, Saldana allegedly engineered an elaborate crime ring that staged up to 16 false insurance claims to receive a payout of over $314,000 from seven different insurance companies.

dates back to 1854, and is intended to promote justice and to assess remedies for fault against the tort feasor, rather than allowing him to avoid responsibility for setting the losses in motion.

Mr. Ward discussed several case law decisions that have revised the Collat-eral Source Doctrine in recent years. He pointed out that under the new Affordable Care Act, this doctrine may not have the same net impact, though that is yet to be seen. Through time, many insurance or other payment sources that do pay for damages have secured liens, or subrogation interest, in the ul-timate recovery. This means that the injured person must pay back his/her health insurer before collecting anything.

The question of disparity between amounts billed for medical treat-ment versus often negotiated payments can become another factor, as well as whether charges and/or payments made are reasonable.

SCA Past President and current board member, Art Coussoulis, provided some input on the subject, adding clarification. He stated, in part, that “if evidence of the collateral source is admitted and the fact-finder reduces the award to compensate for the already-paid damages, this

can result in under-compensation for the injury, as the lien holder will generally at-tempt to recover the full value of any lien, thus leaving the plaintiff uncompensated for lost earnings, pain, anguish, or other non-economic damages.” This luncheon meeting was reasonably well attended, especially considering that it was held just days after the annual golf tourna-ment, and during a week when many were away at a big annual tradeshow.Good to see longtime friend,
