May 5, 2014

PRESENT: Jim Church, Ed Lukasek, Alli Karrels, Josh Lydon and Kevin Brueggeman (arrived at 5:40)

ABSENT: NoneALSO PRESENT: Todd Fahning, chief Kass, Kevin Riley, Mayor Button, Renae Caldwell, Scott from Wal

Mart, Chad Monty, Kelly Hansen

The first order of business was to elect a chairman. Josh Lydon nominated Jim Church and Alli Karrels

seconded the motion. Josh Lydon motion that the nominations be closed and cast a unanimous ballot

for Jim Church seconded by Alli Karrls. Motion carried 4-0.

Chairman Jim Church called the meeting to order at 5:01 p.m.

A motion was made by Josh Lydon and seconded by Alli Karrels to approve the consent agenda

consisting of the minutes of the April 7, 2014 meeting and the Special Public Safety Meeting on April

16, 2014 and the Police Department's monthly report for March and bills. Motion carried 4-0.

Upon payment of all fees and fines, a motion was made by Alli Karrels and seconded by Josh Lydon toapprove the following new or renewed bartender's licenses. Motion carried 4-0.

Kylee Brooks submitted another bartender application to see if she would be approved. Chief Kass is

recommending denial again based on the fact that last fall she was cited for serving alcoholic beverages

to underage persons. She did not have a license at that time, and our current ordinance states that she

would have to wait a year to get her license. No action was taken at this time.

A bartender application was received by Kelly Hansen and it was recommended by Chief Kass to be

denied. ln the last 5 years, she has been convicted of several crimes and is currently on probation. Kelly

did speak in her behalf and said that she has changed in the last couple of years and is turning her life

around. She has been working for Chad Monty at BP for the past 5 months. A motion was made by

Josh Lydon to approve the bartender license for Kelly Hansen. Motion died for lack of a second. AlliKarrels said she did not second the motion because of other applications not being approved forcitations and there needed to be consistency. She can re-apply in a couple of months if she wishes.

A motion was made by Ed Lukasek and seconded by Josh Lydon to approve the carnival license forButterfest. Motion carried 4-0.

A motion was made by Ed lukasek and seconded by Alli Karrels to approve the Temporary Class "8"license for Sparta Festivals, Motion carried 4-0,

A motion was made by Josh Lydon and seconded by Alli Karrels to approve the new and renewalapplications for Class "A" Beer Licenses, Motion carried 4-0. They are:

Chief Kass brought to the Committee another sample of Revocation and Suspension of Licenses toreview. The Committee would like to put together a program or set some standards as far as approving

licenses or when to suspend, etc. The Committee would like to look over the examples that Chief has

given them so far. losh mentioned that it would be good to have something in black and white so

everyone knows the rules and the penalties. Maybe a meeting can be set up in the future to discuss

what the committee is looking for and decide on what to do. No action was taken on this issue.

Mayor Button wanted the Committee to look at repealing the Cabaret License Ordinance. There is a

similar ordinance that was changed in 2010 in Zoning that already talks about cabarets. Having a

Cabaret License is hard to regulate and is unenforceable. (Kevin Brueggeman arrived here). A motion

was made by Alli Karrels and seconded by Josh Lydon to approve the repealing of the Cabaret License

ordinance. Motion carried 5-0.

An item for future consideration was to change the starting time for the Public Safety Meetings to 5:30

p.m. This time change will take effect at the June, 2014 meetinS.

A motion was made by losh LYdon and seconded by Alli Karrels to adjourn at 5:40 p.m' Motion

carried 5-0.

Activity Report:

During the month of April the Sparta Police Department responded to 1192 calls for service, issued 160 traffic citations, arrested 7 persons for Operating While Under the Influence and made 125 non-traffic related arrests. Overall activity level was similar with the prior year.

Chief’s Report

The Department continues in its effort to hire a police officer to replace Lt. Livingston who accepted a position with the City of Altoona. Only two candidates remain on the current eligibility list and a Conditional Offer of Employment has been made to one of the candidates. The Sergeant's promotional process continues and candidates will take a written exam in May and interview before the Police Commission in June. Nine of the eleven officers eligible for the position applied and are continuing in the process. The Commission is expected to make a selection sometime in June. Training

Officers Johnson & Edwards completed a Mindset Boot camp seminar. Sgt. Pipkin attended Multi-Agency Unified Command Training. Officer Edwards completed a basic SWAT officer’s course. Officers Ambrosius & Erickson completed a course in conducting seated field sobriety tests. Lt. Kuderer & SRO Seubert attended the Juvenile Law Conference. Sgt. Ferguson & Officer Tovar attended the WI Homicide Investigators Training Conference. Sgt. Ames attended the WI Crime Stoppers Training Conference. Lt. Kuderer attended Crisis Management for Executive Officers. Legal update was provided for members of the Department.

1. Licenses to sell alcohol beverages may not be transferred topersons other than the licensee without City Council approval. lf thelicensee, or an applicant for a subsequently granted license, dies,becomes bankrupt or makes an assignment for the benefit of creditorsduring the license year or after filing the application, then under suchcircumstances or others deemed sufficient by the City Council in itsdiscretion, the City Council may, upon application, transfer the license tothe licensee's designee provided such designee complies with alltherequirements under this chapter applicable to original applicants, exceptthat a surviving spouse shall be exempt from payment of the license feefor the year in which the transfer takes place.

2. Upon the happening of any of the events under paragraph (1)above, the personal representative, the surviving spouse, if a personal

representative is not appointed, the trustee, orthe receiver may continueto sell or assign the business.

B. From Place to Place. A license may only be transferred to another placeor premises with the City Council's approval. The City Council may permit one

transfer during the license year provided the licensee proves to the City Council'ssatisfaction the new premises is in full and complete compliance with all stateand city laws, regulations and ordinances; the owner and/or lien holder of theexisting premises consents to the transfer in writing, and that such transfer is notdetrimental to the public interest. Application to transfer shall be filed with theCity Clerk along with payment of a transfer fee in the amount of ten dollars ($t 01.

ln the event the City Council approves the transfer the City Clerk shall promptlynotify the department of all transfers.

(B) CLOSING HOURS. No premises for which an alcohol beverage license hasbeen issued shall remain open for the sale of alcohol beverage:

A. lf a wholesale license, between Spm and Bam, except on Saturday whenthe closing hour shall be 9pm.

lf a retail Class "A" license, between midnight and 8am

lf a retail "Class A" license, between 9pm and Bam.

D. lf a retail CIaSS "B" Or "Class B" liCense, between 2am and 6am onweekdays and between 2:30am and 6am on Saturdays and Sundays. OnJanuary 1, premises operating under a Class B license are not required to closeNo package, container or bottle sales may be made after midnight.

exceed the limitations of Sec.348.15 or 348.16(3), Wis. Stats., pertainingto Class "A" highways or deliveries on Class "8" highways.

(3) RESTRICTION ON PARKING. No vehicle or trailer which is equippedwith pneumatic tires or which exceeds 20 feet in length or has a gross vehicleload weight exceeding 6,000 pounds shall park for longer than 30 minutes on anystreet designated heavy traffic route in (2Xa), except to obtain orders, move ordeliver supplies or commodities to or from a place of business or residencefacing thereon. 7.08 TRAINS NOT TO OBSTRUCT TRAEfle. No railroad train, locomotive or carshall stop upon or across any highway or street crossing within the City or remainstanding upon such crossing longer than 10 minutes, except in cases of accident andany conductor, engineer, brakeman or other person in charge thereof or responsibletherefor who shall violate this section shall be subject to a forfeiture of not less than$25.00.

7.09 SCHOOL BUSES. USE OF FLASHERS. Schoolbus operators shallnot useflashing red waming lights in the City, except where emergenc,y condi{ons create asafety hazard to passengers or pedestrians or where the operator is prevented by trafficconditions from loading and unloading passengers immediately next to a curb. Schoolbus operators are prohibited from using flashing red warning lights when pupils or otherauthorized passengers are loading or unloading directly from or on to the schoolgrounds or that portion of the right of way between the roadway and the school groundsdesignated by "school" warning signs as provided in Section 118.08(1) in which a streetor highway borders the grounds of a school, pursuant to Section 349.21(2) Wis. Stats.,except where emergency conditions create a safety hazard to passengers orpedestrians.

7.10 SNOWMOBILES.

(1) STATE SNOWMOBILE LAWS ADOPTED. Except as otherwisespecifically provided in this chapter, the statutory provisions describing anddefining regulations with respect to snowmobiles in the following enumeratedsections of the Wisconsin statutes are hereby adopted by reference and madepart of this section as if fully set forth herein. Acts required to be performed orprohibited by such statutes are required or prohibited by this section.
