Item No. 3: To decide on the proposals received for ap~roval of fees structure for the courses started durina Academic Year 2013-14:

: To consider and decide on ~roposals where there are no discrepancies.

The Samiti considered the proposals of the following Colleges/Institutes for finalization of fee structure for the students who joined the course started during Academic Year 2013-14. After deliberations, The Samiti decides to approve the final fee structure of the following Colleges/Institutes for the students who joined the course started during Academic Year 2013-14, subject to final approval/affiliation/permissions from respective Authorities. Figures are arrived at after considering the calculations drawn in the worksheet - calculation sheets of the respective colleges/institutes prepared by a Chartered Accountant. The students admitted in Academic Year 2013-14 and there after continuing their studies will pay an enhanced fee of 8% each successive year as per the norms for 2013-14 till completion of the course. For example if the fee approved is Rs. 1,00,000/- then from 11"~ years onward till corr~pletion of the course i.e. say 11, I11 and IV year the fees will be Rs. 1,08,000/- per @. I n case the students take vth years for completing the course then he shall pay the fee approved in that year. I n case a student joins the course direct in second year, then he shall be required to pay Rs. 1,08,000/-. Worksheet - Calculation sheets are available in the office.

As per our resolution notice were given to the students of various colleges they are dated 3/07/2013 for Engineering college and for 2 others dated 4/07/2013. 1 student in case of Engineering was present. Similarly 2 students of each college were also present. They are heard.

1) EN4191: Central India College of Engineering &Technology S.No. 2511, 2513, Khasra No. 24, Lonara, Tal. Lonara, Dist. Nagpur.

Heard.

Auditors Report 2012-13,

I n case of Engineering college the fee approved for the courses started during 2011-12 was Rs. 48,520. This year for 2012-13 it was approved as Rs. 18,680/-. It is pointed out that there were errors on the part of the college in submitting the accounts. It is also stated that minimum fee required is Rs. 48,000/-. The letter to that effect is also given. Similarly a letter is given by the student accepting the said fee and further stating that fee paid over and above may be refunded. We approve the fee of Rs. 48,000/- and also direct the institute either to refund excess of Rs. 48,000/- collected or to adjust it in the next year's fees. Office to declare it.

2) MB4129: Central India College of Business Management & Studies, S.No. 24, Ph. No. 12-A, Mouza Lonara, Tah. Nagpur Rural, Nagpur- 441111.

Heard.

The fee approved for the course started during 2011-12 was Rs. 56,5201-. This year for 2012-13 it was approved as Rs. 45,000/-. It is pointed out that there were errors on the part of the college in submitting the accounts. It is also stated that minimum fee required is Rs. 48,000/-. A letter to that effect is also given. Similarly letter is given by the students accepting the said fee and stating that fee paid above may be refunded. We approve the fee of Rs. 54,000/- and also direct the institute either to refund excess of Rs. 54,000/- collected or to adjust it in the next year's fees. Ofllice to declare it.


3) D4240 : Central India Institute of Polytechnic, Near Godhani Rly., Godhani, Nagpur- 441111.

Heard.

I n case of Polytechnic the fee approved for the course started during 2011-12 was Rs. 30,800/-. This year for 2012-13 it was approved as Rs. 20,000/-. It is pointed out that there were errors on the part of the college in submitting the accounts. It is also stated that minimum fee required is Rs. 30,000/-. A letter to that effect is also given. Similarly a letter is given by the students accepting the said fee and further stating that fee paid over and above may be refunded. We approve the fee of Rs. 30,000/- and also direct the institute either to refund excess of Rs. 30,000/- collected or to adjust it in the next year's fees. Office to declare it.

4) D4266: Central India Institute of Pharmacy, Mauje Zingabai Takli, Godani Road, Nagpur- 44111 1.

Samiti heard the aforesaid College/Institute.

The college has only written a letter dated 23/11/2012 praying that the fee may be revised. It is now sated on behalf of the college that they would like to withdraw the same.

Allowed to withdraw.

Item No. 5: To consider the followins letters/representations:-

(a) Letter dated 25/06/2013 received from Tatvasaheb Kore Institute of Ensineerins and Technoloav resardins finalisation of fees for the Academic vear 2013-14 (Meetins dated 20/06/2013 Asenda item 3(a) Dase No. 13).

Considered the letter dated 25/06/2013 from the institute aloug with the letter from the Shivaji University, Kolhapur dated 14/06/2013 addressed to the Institute. From the letter of the University it is clear that the affiliation is granted temporary from June 2013 - 2014 (for 1 year ). Therefore the fee for the 0. Engineering and M. Engineering courses to be declared for one year and it can be for further years only, if the affiliation is renewed. Office to communicate this and also to declare the fee of Rs. 78,0001- for course starting 2013-14. Office to declare it.

(b) Letter dated 1/7/2013 received from Mr. Ashav M. Mahaian. Advocate in respect of refund, the excess fees chamed from Shri. Nikhil Saniivkumar Nandaaonkar (client) & other students.

Considered the notice of the Advocate dated 24/06/2013 issued on behalf of Shri. Nikhil Sanjivkumar Nandgaonkar. On behalf of the same student a complaint was made by Mr. Ramesh R. Gophne about the excess fee collected from the students for Academic year 2006 onwards. Shri. Nikhil Sanjivkumar Nandgaonkar was admitted in the college for the course started during2007-08. I n ordinary course he must have conipleted the course during 2010-11. Now this letter is sent. Our answer to this would be the same as Resolution in Item No. 5(a) of the meeting held on 6/2/2013.


9ldmittedly Mr. Gofne who has made this complaint was not the students of the Walchand Institute of Technology, Solapur. He was a student of Shri Vi'thal Education and Research Institute's College of Engineering/ Pandharpur. In fact he joined the College /it Academic Year 2005-06 and completed the aurse lit Academic Year 2008-09. He filed suit against the said College in Civil Court, P andharpur bearing No. 18 of 201 1 alleging that excess fee was charge and it is pendhg. It is also pointed out now the complainant has given notice to the College through Advocate and College has given reply thmugh Advocate. It is also pointed out that The Institute has pointed out in i& reply filed before the Samiti on 11/12/2012 that the Association of the Management of Private Unaided Technical Institutes in Maharashtra being Writ Petition No. 4469 of 2009 in the High Court of Bombay/ Bench at Aurangabad. This Institute is a member of the said Association and it has challenged various decisions of the Samiti before High Court. The complainant has not even explained the delay in making this complains so late which creates suspicion about his motive.

When the hearing was going on Mr. Nikhil Nandgaonkar pointed out that he made complaint on 11/07/2012 to the Samiti regarding charging of excess fee. He joined this allege during the Academic Year 2006-07 and passed out during Academic Year 2010-11 and perusal of his application shows that he was claiming excess fees. Now he stated he paid much fee /it excess in all the four years. He has also not explained the delay /it amhg to this Samiti after getting though the course.

Considering the various aspects and for more, that one reason/ we reject the amplain&'<

(c) Letter dated 25/06/2013 received from Institute Of Manaqement & Research for fixation of fee structure for the new courses in Institute.

Considered the letter dated 25/06/2013 received from the Khandesh College Education Society's Institute Of Management & Research. The Adhoc fee for 2013-14 approved for Dual degree course in MCA (BCA +MU) is Rs. 55,000/- for part time MCA Rs. 45,000/- and incase of Dual degree course in Management(B1Y +MAM) Rs. 50,000. Office to declare it.

(dl Commissioner of Labour, Mumbai for non pavment of dearness allowance in favour of Chetna's Ramprasad Khandelwal Institute of Manaqement and Research (MB3102).

Considered the letter dated 28/06/2013 from Assistant Commissioner of Labour, Mumbai regarding a complaint made by Bhartiya Kamgar Sena dated 23/01/2013 for non payment of dearness allowance to the staff members of Chetna's Ramprasad Khandelwal Institute of Management and Research (MB 3102) Bandra. This subject doesn't fall within the purview of this Samiti. Office to communicate.

(e) Letter dated 29/06/2013 received from Jamia Islamia Ishaatul Uloom requestins for exemptina submissions of fees approval proposal Academic year 2013-14.


Considered the letter dated 29/06/2013 from the Institute for getting exemption

for filing proposals for its 5 institution for 2013-14. It is stated that they would charge

only the same fees which were charged for 2012-13. It is not possible for the Samiti to

grant such exemption. Office to communicate.

(9 Letter dated 20/06/2013 received from Collese of Ensineerins & Technolosv in respect of recovery of fees from students those are not completins their course within a stipulated period.

Considered the letter received on 2/07/2013 from the Institute. Infact decision

was already taken in such cases in the meeting held on 6/11/2013. That it was included

and mentioned as there were norms for 2013-14. It is mentioned in the norms 4 (d).

The norms as under:

"'Considered the letter date 2gh September 2012 received front Ramrao Adik Institute of Technology and also letter dated ldh September 2012 from Maharashtra Nava Nirman Sena regarding some complaint made by the students dated ldh September 2010. It is necessary to note that in case of engineering college the Samiti approves the fee for a period of fbur years Le. fbr the entire course and the student is required to pay than fee for that entire course. But in case for any reason the student is muired to take fifth year Le. additional year than the fee approved fbr that year is required to be paid. It is only required to be clarified that in case if a student is muired to appear for a few subjects then the college can only charge proporfionately and the student could not be asked to pay the full fee approved fbr the course starfed in that year. For example: if there are 10 subje- and fee approved is Rs. 1, 00,000/- fbr the !ifh year. If the student has to appear for 3 subjects only fbr gh year then the college can charge only Rs. 30,000/-. It is necessary to note that after a period of 4 years many changes take place. There is a lot of increase in salaries of staffs, electricity charges and arficles or the instruments required. The student uses it in the gh year. This muires to be set off by collecfing the fee. This is already cleared in the norms prepared by the Samiti and are available on the website of the Samiti';

Item No. 7 : Anv other matter with the permission of the chair .

Item No. 7[a): Considered to G.R. dated 5/07/2013 for Higher and Technical Education Department Government of Maharashtra bearing No. m?. 0 P i/n .5. P d 31 P?. d%-?. and also considered the letter dated 6/07/2013 from the Karmaveer Kakasaheb Wagh Education Society, Nashik. I n view of Interim Order passed by the Division Bench of the High Court (Bench at Nagpur) dated 29/11/2011 in Writ Petition No. 2911/2010 (Shri. Saibaba Gramin Vikas Sansthan), the Samiti posseses no authority or jurisdiction to approve fee of B.Ed/ M.Ed courses. It is only possessed by the new committee. To approve how would amount to Contempt of Court. Instead of inviting Contempt of Court by the State Government and this Samiti, it is better to move the High Court and get the said order modified for the Interim period or to get it vacated or to get Writ petition decided. I n the alternative the fresh committee constituted in the said G.R. dated 5/7/2013, can starts functioning. It can get guidance from the norms settled by this Samiti for the year 2013-14 and can approve the fees. Office to seek clarification from the said Government.

Item No. 7(b): The time to file proposal is extended by 1 month i.e. upto 31/08/2013 subject to payment of Rs. 10,000/- per proposal /per course as late fee.

Item No. 7(c): Considered the letter dated 22/6/2013 from Dr. Principal Vishwanath D. Karad, Executive President and Managing Trustee Maeer's Maharashtra Institute of Technology Group of Institutions, Pune, India.

This subject does not fall within the purview of the Sarr~iti and it is for the State Government to provide the 3 tier system as contemplated by the said letter.

1) Students from Maharashtra. 2) Students from outside IYaharashtra or from Management Quota. 3) NRI students .

Such three tier fee str~~cture can only be decided by the State Government, by making law (enactment). It can provide for the ratio in which fee shall be payable by the students of those 3 tiers. Office to communicate.
