I. Executive Summary

1. The Angat Water Transmission Improvement Project (AWTIP)1 intends to improve the reliability and security of the raw water transmission system through the partial rehabilitation of the transmission system from Ipo to La Mesa as well as the introduction of water safety and risk and asset management plans. It will develop Tunnel 4, a 6.454 km tunnel from Ipo Dam to Bigte and associated intake and outlet works, as the priority scheme for the transmission system. Its completion will pave the way for the rehabilitation of Tunnels 1-3 and AQ-6 Phase II (aqueduct) as well as the whole transmission system. 2. The Project uses a mechanized excavation method with a double blade tunnel boring machine (TBM). The Project has the following components: construction of Tunnel 4 and associated structures, namely, (i) inlet structure; (ii) outlet structure; (iii) tunnelling; (iv) channel connecting Tunnel 4 and existing aqueduct 5; and, construction of support facilities which includes contractor’s working area (CWA) and temporary spoil disposal. The project’s right-of-way (ROW) has a width of 8m and length of 6.454 kms which traverses Barangay San Mateo and Barangay Bigte in Norzagaray, Bulacan. 3. The Executing Agency of the Project is the Metropolitan Waterworks and Sewerage System (MWSS). A Project Management Office- Angat Water Transmission Improvement Project (PMO-AWTIP) manages the day to day activities of the project including implementation of safeguards requirements. 4. The Project is categorized as C in Involuntary Resettlement and B in Indigenous Peoples safeguards. The project will not cause physical and IR impacts as the tunnel is constructed 200-500 me below the ground and B in IP since a portion of CWA and intake is found to be within the land claimed by IP communities. 5. As of December 2018, status of project is as follows (i) final designed approved in October 2018; (ii) TBM Tunnel Excavation Accomplishment is 93.49% and Lining Installation is 93%. 6. Updating of the IPP is ongoing. Updating will be based on the final detailed design and impacts and updating the socio-economic profile of the IPs living in the communities near the project area. Consultation meetings with the IPs have been conducted to agree on the terms of the Memorandum of Agreement (MOA) between the IPs and the MWSS. This was held on 18 December 2018. The MOA includes community development support from MWSS for the IP community as part of the Free-Prior and Informed Consent (FPIC) process. 7. There were no unanticipated IR and IP impacts encountered during the monitoring period. As of December 2018, no grievance has been reported or received on account of the project. 8. For the implementation of the Traffic Management and Transportation Plan, no accidents and complaints have been reported. The traffic management measures are being implemented in coordination with the barangay officials. 9. On the operation of the grievance mechanism, suggestion boxes were installed at Bigte and San Mateo barangay centers and CMC di Ravenna and MWSS have designated a point person to take charge of any complaints received. No complaints have been received during this period.

I. Introduction and Project Overview

1. The Project is located in Norzagaray Municipality, Province of Bulacan, about 50 km north of Manila. Norzagaray has a population of about 150,000 inhabitants and hosts to several important cement industries. It is easily accessible via highway or normal roads. The project site is within the property of the Metropolitan Waterworks and Sewerage System (MWSS) along Bigte, Norzagaray (Outlet Portal) and Ipo Dam, San Mateo, Norzagaray (Inlet).

2. The Project involves the construction of Tunnel 4 and associated structures namely: intake structure; outlet structure; and, channel connecting Tunnel 4 outlet portal to existing aqueduct 5 and construction of support facilities which includes construction work area and temporary soil disposal. The proposed tunnel is 6.454 km. long and 4.2 m in diameter (finished internal diameter), lying within the MWSS ROW and adjacent to Tunnel 1, and running from Ipo reservoir to Bigte. Much of the tunnel is located at depths from 100m to 150m below the ground surface, with a maximum depth of approximately 200m. The tunnel will have a precast concrete lining with steel reinforcement to ensure structural integrity and raw water flows in the long term.

3. Intake structure provides a conduit between the reservoir and the tunnel inlet portal located between the new and old Ipo Dam. Such structure comprises a rectangular box with nominal dimensions of 10m wide and 18m long. A transition structure, approximately 10m long and 4m wide, allows for transition from the rectangular section to the circular profile at the tunnel. The intake structure invert is set at a relative elevation of 95.7m, nearly 5m below the normal reservoir operating level. The top deck is set at relative elevation of 103.5m. The intake structure includes a trash rack to control debris entering the tunnel, stop logs for closure and control or sluice gates to regulate the flow to the tunnel. The inlet works will be located at the depths of approximately 10m.

4. The executing agency of the Project is the Metropolitan Waterworks and Sewerage Water Sewerage System (MWSS). A Project Management Office - Angat Water Transmission Improvement Project (PMO-AWTIP) was created to manage the day-to-day activities of the project including implementation of safeguards requirements. Figure 1 shows the PMO-AWTIP organigram.

II. Status of the Project implementation

5. The Status of AWTIP as of December 2018 are as follows:

(i) The final design was completed in October 2018. (ii) Ongoing construction of Bigte Outlet Portal and is expected to be completed by

May 2019; TBM work up to station 6+300 (see Figure 2) is ongoing and expected to be completed in May 2019.

(iii) Construction of Intake Relocation with road works is on-going and expected to be

completed by May 2020; ongoing works include clearing and grubbing, drainage works and micropile and concrete caps which were started in February 2018 and are expected to be completed by February 2019.

(iv) Ipo Dam slope protection and acceleration works is on-going and expected to be

completed by May 2019. (v) Construction/ rehabilitation of (access) road at Bigte, which started in March 2017

will be completed by January 2020; ongoing works for precast inspection manholes were scheduled from June to September 2018 and completed; road works will resume in March 2019. Please see map below for reference.

The construction contractor, CMC Di Ravenna, submits regular monthly progress report to the project supervision consultant, DOHWA, and upon consolidation, submits to the MWSS-PMO AWTIP. The Social Monitoring Report, which is done semi-annually, is prepared by DOHWA for MWSS submission to ADB in compliance to the reporting requirements. During the reporting period the social safeguard consultant assisted the implementing agency in the implementation of the IPP.2 III. Indigenous Peoples Performance Monitoring

A. Updating of the Indigenous People's Plan (IPP)

7. The Indigenous Peoples’ Plan (IPP)3 is currently being updated. Updating of the IPP is based on the final design of the project and to incorporate changes in impacts and update the socio-economic profile (SEP) of IPs living in proximity with the project area. This will be completed by June 2019. Household survey will be conducted in six sitios of Barangay San Mateo. 8. A household interview questionnaire will be prepared which will include information on culturally appropriate and gender-responsive livelihood and employment; health and safety; education and recreation; environment and sanitation; peace and order, and culture and heritage. Prior to the actual conduct of the household survey, meetings with the representative groups of the IP communities will be conducted by the Social Safeguard Specialist. This will inform them about the conduct of the household survey. 9. Table 1 below provides the status of compliance with the IPP requirements based on the current IPP.

B. Update on Free-Prior and Informed Consent (FPIC) process

10. As part of the FPIC process, NCIP consultations were held on: (i) 4 August 2018 - First Community Assembly which discussed the project information on the Angat Water Improvement Project (AWTIP); (ii) 29 August 2018 - Second community assembly which discussed the change of methodology of tunneling from drill and blast to mechanical excavation using TBM, and, (iii) 18 December 2018 – MOA Negotiation. In the 18 December 2018 consultation, the details of the community development support to be provided by the MWSS as requested by the IP community were discussed. These community development support subject to the approval of the MWSS Board will be included in the MOA between/among the MWSS, NCIP and IP community integral to the FPIC process. Table 2 below provides a summary of the demands or requests during the said consultation meeting.

Additional Demands/Requests Response of MWSS

4 "Kolong-kolongs" or tricycles whose sidecars are made up of tubular metal frames used to transport people and/or materials.

Some units will be given for communities to share but not one for each sitio. Number of units to be given will be deliberated upon.

5 Ambulances The ambulance currently being used by the Contractor (CMC Di Ravenna) will be turned over to the community thru MWSS once construction is completed. An additional unit will also be donated. Meanwhile the existing ambulance and other medical facilities may be used by residents in case of emergencies.

6 Scholarships MWSS will coordinate with DepEd, CHED, LGU and NCIP to further study the granting of educational assistance. Sitios will also clarify and consolidate their educational assistance needs, specifying the number of proposed beneficiaries, how long the scholarships are to be last, and for what specific items will assistance be provided.

7 Motorized boats MWSS will provide only a few boats each with a 16-HP engine. These will be shared among the sitios. The original demand of one boat per sitio will not be provided.

8 Fingerlings Fish fingerlings will be provided but the species of fish will need to be determined.

9 Fishing nets MWSS will donate nets but will first determine the number of fishermen in the different sitios and their needs

10 Vegetable seeds These will be given.

11 Water hoses and water tanks These will be given after MWSS determines if water sources are clean and fit for human use.

12 Toilets These will be provided

13 Scythes (Carets) for clearing vegetation

These will be given (14 pcs).

III. Unanticipated Impacts

A. Update on the Household

10. A household comprising three families had self-relocated to make way for the Ipo Dam site. The man of the house is an employee with the Dam. The household was compensated for the relocation, with three times the estimated compensation amount. MWSS will continue monitoring if there are any grievances from these families and to report on these in future monitoring reports. IV. Employment generated by AWTIP

11. Generally, the Project was able to generate employment and income opportunities for the locals. To date, a total of 445 persons work with the project contractor. Out of this number, a total of 127 persons were from Barangay San Mateo; 64 were from Bigte; and 33 were from other barangays of Norzagaray; and, 43 from other Bulacan municipalities. The Table 3 below provides the details.

V. Status of the Traffic Management and Transportation Plan Implementation

12. The Traffic Management and Transportation Plan (TMTP) was prepared and implemented to address expected increase in traffic volume caused by the delivery of construction materials for the project sites in Barangay Bigte and Barangay San Mateo, as well as the delivery and return of the huge tunnel boring machine from Ipo Dam site during decommissioning. The TMTP describes measures on how to control and minimize impacts within the community of Bigte and San Mateo during transport of heavy equipment and ensure no hazards from increased truck traffic. 13. As observed, minor road obstructions were found along the road traversed by deliveries during project construction. Minor road obstructions include parked vehicles along the road shoulder, pile of construction materials of private houses under construction or repair works and market vendors’ stalls during market days on Fridays and Sundays. 14. To address traffic obstruction, the project implemented the TMTP. Implemented measures include warning of households and community when there are abnormal traffic movements along the road, such as the delivery of the tunnel boring machine (TBM) during decommissioning. Cargo trucks are required to put covers if transporting construction debris and aggregates. Deliveries

are usually done at night. During the reporting period, the deliveries of heavy equipment and materials did not cause any problem to the community related to traffic management and no accidents or complaints were reported. VI. Information Disclosure, Consultation and Participation

15. As earlier mentioned on the FPIC process, NCIP consultations with IPs including community assemblies were conducted in 2018. The consultation meeting held on 18 December 2018 discussed the details of the community development support to be provided by the MWSS as requested by the IP community. These community development support subject to the approval of the MWSS Board will be included in the MOA between/among the MWSS, NCIP and IP community as part of the FPIC process. Minutes of the meetings are found in Appendix 1. VII. Capability Building

16. No capability building on social safeguards aspect was done during the monitoring period. However, the training needs of the IPs has been included in HH survey questionnaire and will be incorporated in the IPP updating. VIII. Grievance Redress Mechanisms

17. During the reporting period, suggestion boxes were already installed at Bigte and San Mateo barangay centers. No grievance or complaint was filed by the IP community. 18. The Grievance Redress Mechanism (GRM) is being followed by the project which provides avenues for resolving the Non-AWTIP and AWTIP issues. For non-AWTIP grievance or complaint, filing is made in writing by the PAH/AP to the Barangay Captain and for AWTIP grievance or complaint, filing in writing is made to MWSS. In both cases, the Barangay Captain and the MWSS who receive the grievance or complaint forward this grievance case to the contractor, CMC Di Ravenna, for screening/validation and informs the PAH/AP whether it is valid or invalid. Only valid AWTIP concerns, will be investigated jointly by the CMC, MWSS, and Barangay for appropriate action to resolve the issue. For the IP, a grievance or complaint may be filed to the tribal council. The filling is done in writing using the grievance form. There are designated focal persons who are responsible for the GRM. Figure 3 shows the GRM Diagram below.

IX. Conclusion

19. This Social Monitoring Report (SMR) for the period of July to December 2018 provided the MWSS progress in implementing the AWTIP IPP in compliance with the social safeguard requirements of the Project. In so far as the FPIC process is concerned, MWSS successfully negotiated with the NCIP and the IP community during this period. The expressed demands of the IP Community will be included in drafting the MOA among MWSS, NCIP and the IP Community.

A. Items to be included in the next monitoring period (January to June 2019) 20. In the next six (6) month monitoring period, the following will be the activities to conducted:

(i) Coordination with the NCIP for the field survey for the ADSDPP to determine the actual boundary of the ancestral domain and overlapped portion of the project area; Obtain updates on Ancestral Domain Strategic Development Plan and geodetic survey of the ancestral domain from the NCIP.

(ii) Coordination with the LGUs and tribal chieftains for detailed socio-economic profiles and impact assessment of AWTIP on barangays, sitios and IP communities.

(iii) Consultation of updated Indigenous People's Plan (IPP) with the IP Community. Activities to be undertaken parallel to the updating of IPP includes: (i) review of the detailed design data and impacts on IP Community; (ii) conduct household interviews in the six sitios of Barangay San Mateo; (iii) final draft IPP for clearance from MWSS and submission to ADB; (iv) consultation of IPs regarding updated IPP.

(iv) Follow up on the issuance of the Certificate of Precondition (CP) from NCIP in line with the completion of FPIC process.

APPENDIX 1

Minutes of the MOA Negotiation Held on 2018 December 2018

At the MWSS Compound, Norzagaray, Bulacan Summary of Proceedings 1. On December 18, 2018, residents from the Sitios living within Ipo and Angat reservoirs met

with representatives from MWSS. Facilitators from the NCIP were present. The whole event was hosted by CMC Di Ravenna who provided food.

2. Of the expected 128 residents, only 44 came. After registration and settling down, all were

gathered into a large room where the chief NCIP started the event by explaining what the activity was all about—that it was the logical next step to the previous activities that they did of information dissemination and the individual sitios being asked their expectations.

3. Previously, the demands of each Sitio were consolidated into a single document for easier

reading. This now was projected in front of the room and every demand/request was read and clarified with some items being changed by the residents/representatives involved.

4. Discussions were formal but unforced. Mutual respect between stakeholders were evident

and no disagreements emerged. 5. Most of the demands and requests were granted albeit some needed some further verification

and quantification: 6. The CMC ambulance now being used will be turned over to the community after the

construction activities are finished. Another unit will be given as well. 7. Each sitio will be given a motorized boat (banca) each of 16 HP motors. A number of motorized

sidecars will also be given for the residents’ use, the number to be determined with some sitios sharing the vehicles since vehicles are not really allowed in the watersheds but will be used by residents on their way to and from the outskirts.

8. Some tribal halls will be rehabilitated and those sitios without a functional hall will be provided

facilities which they can share. 9. For scholarship requests, MWSS will coordinate with the Department of Education. For the

Angat Dam sitios who requested fingerlings, MWSS will coordinate with NPC to find to what are acceptable species and how the process works. Fishing nets will be provided soon as the number of fishermen and their actual needs have been accounted for. Seedlings for vegetable planting are to be provided.

10. Some sitios requested for water hoses for their water supply. For these MWSS will ensure

that their water sources are safe before providing the hoses.

11. The provision of solar panels was categorically granted but the number of sets and how these will be shared among which communities will have to be studied.

12. The requests that were not granted were the demand for service vehicles and the request for

free rice. 13. As for the request for one percent (1%) royalty, the MWSS representative stated that they will

be waiting for the decision of the legal case of Province of Bulacan vs. MWSS regarding the granting royalties.
