I. EXECUTIVE SUMMARY:
1. This report covers the period from July to December 2019 relating to the progress of the land acquisition, resettlement and compensation of the 10 subprojects; 5 in Louang Namtha Province, and 5 in Bokeo Province.
2. The compensation payments have now been completed in Four out of Five subprojects in Louang Namtha, and Three out of Five subprojects in Bokeo. Compensation payments for two subprojects were made during the reporting period (1) 19 affected households with the compensation payments totaling 39,259,250 LAK for the wastewater management subproject of Houayxai, (2) 38 affected households received compensation totaling 830,427,100 LAK for the wastewater management of Louang Namtha. Construction has now commenced.
3. Compensation payment for the HXY B2 Ecological Park and Recreation Area, Riverside Road, and Walkway was split into two phases. The payment for the 1st phase (LAK 1.27 billion out of 3.42 billion; or 30 out of 42 AHs) was made in January 2020; The 2nd phase (LAK 4.14 billion) is being prepared for payment in the next reporting period.
4. During the reporting period, 6 grievance cases from two subprojects of Louang Namtha province were received by the grievance committee: (1) 4 were cases linked to the urban village upgrading (LNT A1) and (2) 2 cases relating to the urban recreation facility sports hall and park, night market (LNT A3). 4 out of the 6 grievances received were considered valid cases of unanticipated project impacts and additional compensation was agreed to a total of 13,365,200 LAK.

II. INTRODUCTION
A. Background
5. The Government of Lao People’s Democratic Republic (Lao PDR), with assistance from the Asian Development Bank (ADB), is implementing the Second Greater Mekong Sub-region (GMS) Corridor Towns Development Project under ADB Loan 3315-Lao and Loan 8296-Lao.
6. The 2 towns in this project, Houayxai of Bokeo Province and Luangnamtha of Luangnamtha Province, are part of the North-South Economic Corridor (NSEC), which links Lao PDR with People's Republic of China (PRC), Thailand and Myanmar. The 2 towns were chosen due to their economic potential, infrastructure constraints, and commitments to the project.
III. PURPOSE
7. The Project Coordination Unit (PCU) is responsible for internal monitoring. The main aim of the internal monitoring is to monitor the process of the LACP implementation such as the compensation process, grievance mechanism, and effectiveness of the LACP implementation procedure. The data for the internal monitoring related to the LACP implementation processes were collected by the Project Implementing Unit (PIU) with the assistance of a team of resettlement experts and used to assess the progress and results of LACP implementation and to adjust the work program, when necessary.
IV. LAND ACQUISITION AND COMPENSATION IMPLEMENTATION STATUS
A. Institutional Arrangement
8. The Ministry of Public Works and Transport (MPWT), along with its Department of Housing and Urban Planning (DHUP), is the executing agency (EA). The Department of Public Works and Transport (DPWT), through the Project Coordinating Unit (PCU) and the Project Implementation Unit (PIU) of Houayxai and Luangnamtha, are the implementing agencies (IA) and are responsible for the direct supervision and execution of the subprojects.
B. Provincial Resettlement Committee
9. A provincial resettlement committee (PRC) has been established in each province with members from relevant departments, including DPWT, Lao Women’s Union (LWU), and Department of Finance and Investment and Planning. The role of PRC in LACP preparation and implementation include (i) conducting consultation meetings with the AHs; (ii) establishing compensation rates at replacement cost for affected assets; (iii) conducting, reviewing and confirming the DMS data; (v) approving final agreement with the AHs on compensation; (v) managing funds for compensation disbursed by the Provincial Department of Finance; (vi) monitoring all LACP activities; and (vii) acting as a grievance officer. The Village Resettlement Committees (VRC) supports the PRC.

C. Compensation and Rehabilitation
10. During the reporting period the resettlement program was active in 3 subprojects; the Wastewater Management Subproject of Louang Namtha, the Wastewater Management Subproject of Houayxai, and the Ecological Park and Recreation Area, Riverside Road and Walkway
11. Compensation payments were completed in two subprojects during the reporting period. 19 affected households received 39,259,250 LAK for the wastewater management subproject of Houayxai, A further 38 affected households received 830,427,100 LAK for the wastewater management of Louang Namtha, and the construction had started.

D. Disclosure and public consultation
12. Compensation agreements were discussed with each AH during July – December 2019. This was led by the PRC and PIU and included explanation of the inventory of losses with a list of impact confirmed by the AHs, the compensation unit rate and entitlements. During the individual meetings the household was also provided with information on the salient points of the project resettlement policy, including the grievance redress process.
13. When the agreement was reached, others authorized person i.e. the village headman, the representative of PIU and the representative of the RC all signed to acknowledge.
14. Based on the compensation agreements, the compensation plan was prepared. After the plan was approved by the PRC, the PIU requested the Department of Finance to disburse the budget for paying the compensation and allowances of the AHs. The compensation money was remitted to their individual bank accounts in March 2019. Then, the PRC and PIU notified the AHs about the schedule of their monies are remitted to their bank accounts and signatures were gathered to confirm receiving the payment.
E. Grievance Redress Mechanism
15. The GRM was established at the start of the subproject activities during consultations in 2017. There are five consecutive levels to facilitate grievance mediation and resolution, with the lowest level being the Grievance Committee at the village level and the highest level being the People’s Supreme Court at the National level. Nevertheless, affected people are entitled to lodge complaints regarding any aspect of the subproject preparation and implementation, without prejudice to their right to file complaints with the court of law at any point in the process.
16. The grievance forms are available in village offices which is one of the entry points for the GRM.
17. During the reporting period, 6 grievance cases from two subprojects of Louang Namtha province have been lodged to the grievance committee: (1) 4 grievance cases impacted by urban village upgrading (LNT A1) and (2) 2 grievance cases complained of urban recreation facility sports hall and park, night market (LNT A3). All cases were investigated and 4 out of 6 were considered to be related to project impacts and agreed further compensation payments to a total of 13,365,200 LAK. The two cases that were not upheld were related to modification of the existing design of the urban recreation facility sports hall.

F. Compliance Status
Internal monitoring and evaluation will assess the implementation of the LACP according to the following criteria:

During the reporting period, no case was found that the
contractor is invaded in the private properties or
construction activities go over the compensation area. The
contractor is vigilant in ensuring that they are working
inside of permission or inside the compensation area.
Provisions of the loan covenant are met.
The resettlement implementation has completed 9 out of 10
subprojects (5 subprojects in Luang Namtha and 4
Subprojects in Borkeo province), except the Ecological Park of Houayxay the payment compensation and
allowance is delayed for both of phase 1 and phase 2 due to
the budget limitation of local government. The compensation unit rate needs to adjust and compare with
the yearly inflation rate and provide additional
compensation to PAP who will receive late compensation.
G. Capacity building
18. A workshop to strengthen the GRM and review the Safeguard Policy Statement of the GMS2 took place in 10 December 2019. The target audiences were the PIU staff who responsible for the GRM, and the assigned person who responsible for producing monthly report and the project engineer of each contractor. The main objectives were; (1) reviewing related GoL regulations, the requirements in the SPS and the project’s agreements regarding the Grievance Redress Mechanism; (2) getting the feedback of earlier implementation and brainstorming the solutions for better implementation of the GRM; and (3) re-establishing the GRM to cover all aspect of the complaints and having grievances recorded and reported according to the agreed schedule.
H. Follow up Actions, Recommendation and Disclosure
19. It is recommended that the project will be required to produce updated unit rates if compensation is delayed more than one year after the unit rates were issued.
