COUNCIL BILL 2021 RESOLUTION

A RESOLUTION

DECLARING an intent to initiate annexation into the City of Springfield of approximately 1 5.11 acres of Missouri Department of Transportation right-of-way, generally 2 located along the 5900 through 6200 blocks of West State Highway 3 266/Chestnut Expressway, immediately west of North Airport Boulevard. (Staff 4 recommends approval.) 5

WHEREAS, the proposed right-of-way to be annexed abuts the north side of 8 SGF Sports, LLC’s, proposed private athletic facility located just west of Deer Lake Golf 9 Course; and 10

11 WHEREAS, per the development agreement between the City and SGF Sports, 12

LLC, approved by City Council on March 8, 2021, by Special Ordinance 27472, the City 13 will fund up to $2.1 million in public improvements and interest expenses associated 14 with the proposed facility, including public sidewalks on the subject right-of-way, and will 15 be reimbursed for these costs by establishing a community improvement district (“CID”) 16 over the facility that will impose a 1-cent sales and use tax; and 17

18 WHEREAS, in order for the CID to reimburse the City for the costs of the public 19

sidewalks, the sidewalks must be located inside the CID, and the CID boundaries must 20 be entirely located inside the City limits in order for the City to establish the CID; and 21

22 WHEREAS, the proposed right-of-way annexation is necessary to ensure that 23

the CID boundaries are entirely located inside City limits, and thus ensure that the CID 24 can be properly established to entirely reimburse the City the costs of the public 25 improvements it has agreed to fund in association with the proposed private athletic 26 facility; and 27

28 WHEREAS, the proposed public right-of-way to be annexed is currently a 29

Missouri Department of Transportation (“MoDOT”) maintained roadway named West 30 State Highway 266/Chestnut Expressway; and 31

32 WHEREAS, the proposed right-of-way to be annexed is within the Urban Service 33

Area and is immediately adjacent to the City of Springfield; and 34 35

WHEREAS, the City is required to announce its intention to initiate annexation 36

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 39 SPRINGFIELD, MISSOURI, as follows, that: 40

41 Section 1 – City Council hereby announces its intention to initiate annexation of 42

approximately 5.11 acres of MoDOT right-of-way, generally located along the 5900 43 through 6200 blocks of West State Highway 266/Chestnut Expressway, immediately 44 west of North Airport Boulevard and described in “Exhibit A,” which is attached hereto 45 and incorporated herein by this reference, into the City of Springfield. 46

47 Section 2 – The City Manager, or designee, is hereby authorized to do all things 48

necessary and convenient to carry out the intent of this Resolution. 49 50

Section 3 – This Resolution shall be in effect immediately upon adoption. 51 52

PURPOSE: To initiate an annexation of approximately 5.11 acres of MoDOT right-of-way into the City of Springfield, generally located along the 5900 through 6200 blocks of West State Highway 266 (Chestnut Expressway), immediately west of North Airport Boulevard (A-3-2021).

BACKGROUND INFORMATION:

The City requests to annex approximately 5.11 acres (2,200 linear feet) of MoDOT right-of-way generally located along the 5900 through 6200 blocks of West State Highway 266 (Chestnut Expressway), immediately west of North Airport Boulevard. The proposed right-of-way to be annexed is contiguous to the City limits and abuts the north side of SGF Sports, LLC’s proposed private athletic facility located just west of Deer Lake Golf Course. The purpose of this annexation is to ensure that a community improvement district (“CID”) can be properly established to entirely reimburse the City the costs of the public improvements it has agreed to fund in association with proposed private athletic facility.

Per the development agreement between the City and SGF Sports, LLC, which was approved on March 8, 2021 by Special Ordinance 27472, the City will fund up to $2.1 million in public improvements and interest expenses associated with the proposed facility, including public sidewalks on the subject right-of-way. The City will be reimbursed for these costs by establishing a CID over the facility that will impose a 1-cent sales and use tax. In order for the CID to reimburse the City for the costs of the public sidewalks, the sidewalks must be located inside the CID, and the CID boundaries need to be entirely located inside the City limits in order for the City to establish the CID.

This Resolution only initiates the proposed annexation and does not annex the right-of-way. Public hearings, and review and approval by the City Council are required before the annexation of this right-of-way can be executed.

REMARKS:

Staff recommends the initiation of the annexation of this right-of-way.
