DickielTats:

Thanks so much for helping us to verify a water level in a recently-drilled private domestic well in Kauai. We would like to remeasure the depth to water because the well completion report indicates a water level at -13 ft msl. If possible, can you also take a picture of the well and note whether there's a pump in the well. I have attached a USGS topo map & tax map showing the well location. Also attached is a copy of the completion report. The contact name, address & phone number for the permittee are:

Penny Kuuleialoha Johnson P.O. Box 1213 Kapaa, HI 96746

PH: 808-822-3113

Again, mahalo, and if there are any questions or problems, please call Lenore Nakama at 587-0218.

This follows an August 19, 1999 telephone conversation with your husband regarding the subject permit. Per your husband's request, we are sending you a copy of your validated permit. We have highlighted Condition 7, which outlines the items and documents that should be submitted within sixty (60) days after completion of the work authorized by the permit.

We understand that the well was completed as of April, 1999; therefore, please submit the required items and documents within the next thirty (30) days. Once we receive and accept the information, we will then be able to issue your pump installation permit.

Please be advised that failure to comply with the terms of your permit may result in daily fines of up to $1000 (under Section 174C-15 Haw. Rev. Stat.).

If you have any questions, please contact Lenore Nakama at 587-0218 or toll-free at 274-3141, extension 70218.

o o MEMORANDUM FOR THE RECORD

FROM: Lenore Nakama

SUBJECT: Well No. 1120-28

4/29/99 Steve Goldberg requested identification of drilling contractor for this well. Unfortunately, this application fell through the cracks in that we accepted permit as being fully validated even though the permittee did not obtain a licensed contractor. (As of May 14, 1997, when we received confirmation from DCCA that landowners cannot claim owner-builder exemption for well drilling, we should have been enforcing the licensing requirement.)

Called Kuulei Johnson on 4/29/99 to inquire as to status of well drilling. She said that the well has been completed. Requested that she submit the Well Completion Report, etc. She said she thought she had done that months ago, but will check and submit another copy.

Well Construction / Pump Installation Permit Application for Well No. 1120-28

We acknowledge receipt, on August 13, 1997, of your well construction permit application for the Ka Lae Amana Pt. Well (Well No. lUO-28). You can expect your application to be processed within ninety (90) days from this date.

From an August 28, 1997 telephone conversation with Lenore Nakama of my staff, your application has been amended to indicate that: 1) you are also applying to install a permanent pump in the proposed well, and 2) there are no other pending actions of which you are aware (line item 7).

For your information, the process of constructing a well is normally regulated and permitted in two (2) steps. First, a well construction permit is issued for drilling and testing purposes only. Based upon information provided by you through a Well Completion Report Part 1 (Well Construction), a pump installation permit (upon completed application) may then be issued to authorize pump work. If a pump is installed then a Well Completion Report Part 2 (Pump Installation) is required.

We note that you have not yet selected a licensed contractor to do the work. To expedite the process, we have been accepting applications for processing without the contractor's signature; however, we will require your licensed contractor to sign the permit document prior to beginning any work.

If you have any questions about your permit application, please contact Lenore Nakama of the Commission staff at 587-0218 or toll-free at 274-3141 (Kauai), extension 70218.
