TBAC Meeting was called to order in the Gateway Plaza Conference Room located on the 3rd floor of METRO headquarters at One Gateway Plaza in Los Angeles, California at 9:40am.

IV. Chair's Report - Lucia Tam

Lucia Tam wished a happy Lunar New Year to all. The Meet the Primes event was very successful, with between 600 and 700 attendees. Ms. Tam reminded all to be persistent in contacting the Prime Contractors with whom they made contact. Elias Cortez complimented the work of Metro staff and requested that they distribute the lists of interviews back to the Primes along with a letter urging the Primes to contact the subcontractors with whom they spoke. Keith Compton responded that that work is already underway. Mr. Compton stated that 27 tables were set for Primes, but that there were more Primes than tables. Elias Cortez recommended that Metro's Public Infonnation Officer write a follow-up article about the event as a means of attracting more attendees. Carlos Morgner wished to thank personally all who attended, which included Richard Katz, Mark Ridley-Thomas, Linda Wright and Michelle Caldwell.

Parking: Ms. Tam stated that TBAC attendees do not have parking validation privileges.

V. TBAC Speakers

Borja Leon. Associate Director of Surface Transportation for the Mavor of Los Angeles: Report on Measure R and Mayor's 30/10 Initiative. The 30110 Plan would accelerate funding and construction of twelve Measure R projects to ten years instead of the thirty years specified in Measure R. Mayor Villaraigosa was in Washington D.C. in January to advocate for the plan, and the Mayor's office is developing new strategies to gain the favor of incoming House leadership.

In response to a question from Rod Garcia, Mr. Leon said that some private sector investors have expressed interest in the 30/10 plan, and private investment is being considered. However

currently public-sector financing appears to be financially more favorable. Some mix of public and private funding is possible.

In response to a question from Lia Reyes, Mr. Leon stated that Public-Private Partnerships are being considered for some of the upcoming projects, including the Crenshaw Line.

Robert Guzman questioned whether DBE and SBE goals would be maintained under 30/10. Mr. Leon agreed that the work must be distributed fairly, and stated that he was open to input from

TBAC members on how to improve the outlook for SBEIDBE fmns.

Ali Altaha expressed frustration with Good Faith Efforts in contracting, and recommended elimination of GFE's. He spoke in favor of a high mandatory DBE goal similar to the one being used by the New York Transit Authority. Mr. Leon promised to send Mr. Altaha his contact information via email, and requested that Mr. Altaha provide information regarding the New York plan.

Elias Cortez asked what the Mayor would do to ensure independent verification that there is appropriate outreach being performed on Measure R Projects, and in particular that the outreach process is being handled properly. Mr. Leon stated that this would be a challenging task and stated that Metro Staff and the incoming Metro Inspector General would provide stepped-up scrutiny on Measure R contracts

Larissa Ordaz requested that a liaison be established between TBAC and the Mayor's Office. Carlos Morgner made a further suggestion that TBAC create a 30/10 Committee to work with the Mayor's office on 3011 0 issues. Mr. Leon welcomed the idea and stated that the committee could also serve to advocate for the program in Washington.

Timothy Jones suggested that this work would best be carried out by a subcommittee of the Legislative Affairs Committee rather than by an independent committee.

Rudy Garza suggested that the track records of Primes in the hiring and treatment of DBE and SBE subcontractors be recorded and made available.

Robert Guzman requested that the Mayor's office consider changing the scoring system for Measure R work to favor contractors who bring new companies onto their teams.

Rubina Cbaudhery requested that agencies be open to DBE joint ventures acting as prime contractors. She also asked if the Mayor would consider review the current city policy of not permitting MlWBE primes to count themselves as contributing to the participation goal. She stated that eliminating that restriction would encourage small businesses to grow. Mr. Leon said that he was not directly involved in City contracting but would forward the request to MBOC.

Rod Garcia recommended that agencies build upon the start made by Metro in the creation of a bench program aimed specifically at SBE's.

Presented contract look-aheads and current solicitations. Drew attention to several upcoming projects, including design-build solicitation for Division 3 Maintenance Buildings. There are no projects under $100,000 to report.

There is currently no Award Tracker Report. The first 2011 Repot will be provided at the March TBAC meeting.

VII. Committee reports:

Legislative Affairs - Ali Altaha Per the discussion with Bolja Leon (see above) it was moved that a subcommittee be fonned to work with Mayor Villaraigosa's office regarding the 3011 0 program.

Motion: 30110 Subcommittee fonned as a liaison with the Mayor's office to be chaired by Larissa Ordaz.

Ad Hoc Committees - Rod Garcia, EHas Cortez

Disparity Study Committee: Rod Garcia requested a further follow-up session to discuss results of the Disparity Study, stating that this session was agreed upon at the previous meeting with BBC. Both Michelle Caldwell and Tashai Smith expressed some confusion over the request. Mr. Garcia said he would review his notes and send the information to them. Michelle Caldwell stated that the Metro Board had approved $200,000 to fund a follow-up to the disparity study for the years 2007-2010. This follow-up will provide data from three additional years of race-neutral contracting. Elias Cortez requested that the Scope of Work for the follow-up study be presented at the next TBAC meeting. Tashai Smith responded that the Scope of Work would not be ready by the next meeting, but it would be presented to TBAC at the earliest opportunity. In the meantime the scope of work for the previous study will be transmitted to Lucia Tam.

Ali Altaha requested that Arab-Americans be included in the Disparity Study.

Assessment Committee: No report; will meet later in the day.

Commodities - Ezekiel Patten Reported progress on credit card payment issue, which would allow Metro to use credit cards to make purchases on some items below a given limit.

Professional Services. Construction - Carlos Morgner Three RFP's under the bench program potentially coming in February: two for Project Management and one for Hydraulics Design. Anticipating potential CM contract for Expo 2 plus three additional CM contracts for soundwalls. SBE goals for CM projects are expected to be at least as high as at the previous soundwall RFP's, approximately 40%. Pointed out that large firms will be aggressively pursuing projects.

Regarding Construction, anticipating CM Support RFP's for projects in Glendale in March, Westlake, Calabasas and Agoura Hills. The RFP's will be released by the municipalities with assistance from Metro.

Membership- Juan Manuel Chavez Jr. Will be emailing requests to organizations that are still missing renewal paperwork. American Indian Chamber of Commerce is still missing bylaws and questionnaire, and needs to provide the name of one alternate. BBA, COMTO and WTS also need to submit an additional alternate, and WCOE needs to submit bylaws, minutes, and questionnaire.

Proposed networking meeting between Bench Contract firms and Metro Project Managers: still pending. Doug Failing will discuss with Michelle Caldwell regarding timing of the meeting given the fact that some task orders will be solicited soon.

Meeting between Metro Board and TBAC Board regarding TBAC's concerns over the PLA's: Meeting pending this month.

Metro to Provide Report regarding Contracting Practices of Individual prime contractors to allow SBEIDBE Firms to see which primes were more open to hiring - Metro is exploring legal avenues to provide this information.

Larissa Ordaz requested that anyone interested in joining the City of Los Angeles liaison committee should contact her.

x. Public Comments

Linda Wright stated that DEOD will be moving to the 8th floor and will be out of communication for a few days.

Robert Guzman drew attention to a complaint against the CHSRA filed with the Justice Department, and an article in the Los Angeles Business Journal critical of the Agency.

Jackie Nutting encouraged member organizations to contact Metro to state their opposition to PLA's.

Tashai Smith announced that DOT has issued its approval of the change proposed by Metro in DBE certification rules increasing the maximum personal net worth of owners to $1.3 million effective Feb 28, 2011. Similar changes are expected to be implemented for the SBE program in the near future.

Lucia Tam announced CACP's upcoming Lunar New Year celebration on Feb. II.
