    We spoke with Warren CountyMiddle School Principal Alan Foxas the seemingly hectic nal weeko preparation or the opening othe 010-11 school year in a newmiddle school location progressedat a locomotives pace.

    We eature the move o WCMSrom its West 15th Street loca-tion to Luray Avenue and the or-

    mer Warren County High Schoolbuilding or our back to school010 issue (see related interviewwith another WCHS alumni, LCWPresident Max Clatterbuck, or ad-

    ditional ino on the transormationo the now 70-year-old buildinginto the new, state-o-art WCMS).Both Fox (class o 84) and Clatter-buck (class o 77) are WCHS alum-ni.

    We apologized to Fox or takinghim away rom his obviously ullplate o nal week preparationsand then plowed ahead like thepushy media we sometimes are. So, hows it going, Alan?

    Well, we still had to close down

    the middle school and when youve been in one school or years youve got a lot o memories(not to mention classroom accou-trements), Fox began o an experi-

    ence he was sharing with his sta.In act Foxs ties to the old WCMSrun deep. He began his teachingcareer there in the 1988-89 aca-demic year, moving rom In-SchoolSuspension to English, Math andUS History beore taking on ad-ministrative unctions in 1996,culminating with appointment tohis current position in 003-04.

    And while the memories tiedto the old building may be many,

    what now surrounds him is mak-ing the transition an exciting stepinto the uture.

    Now to come here and have ev-erything new the architectureis spectacular; the opportunity isspectacular. Our kids will be verypleased and so will our parents,Fox hazarded a guess at the initial

    reaction o those or whom thiswork was done.

    And speaking o seamless, Foxpointed out the way building ren-ovation/construction contractorLCW ( Lantz Construction o Win-chester) had connected the existing

    hallways to the new ones as part othe architectural marvel aroundus. As we ventured toward the oldmain entrance down the east wing,Fox pointed to fooring, walls andeven a new enclosed courtyard thatwill serve educational unctions, inaddition to aesthetical ones.

    As I said, what youll see is that

    the architecture is spectacular tothe point o being award winning.Te Virginia School Board Asso-ciation has dierent awards or ar-chitecture and I think they shouldbe nominated, in particular or this

    main hallway, Fox said gesturingaround us as we headed east, andto the media center which youllsee as we make the circuit aroundthe old section and back into thenew one.

    As we stopped to really take inour surroundings or the rst timesince arriving to seek out our inter-

    view, we were truly impressed. Teold artists rendering we eaturedlast year when the contract wasauthorized didnt really prepare usor the scope o this addition to theschools physical ootprint.

    When it is ready or public view-ing at the above-cited dates, just goto the old eastside gym entranceand youll be there! And let metell you, Fox is not exaggerating.Even ull o workers, boxes and theteachers belonging to those boxesull o books and classroom ma-terials, this main entranceway is a

    jaw dropper.And Fox pointed out that the ar-

    chitects ocused on maintaining avisual theme centered on the mag-nicent and amiliar old columnedentrance looming on the hillside

    On Aug. 17 the Warren CountyBoard o Supervisors accepted thelow bid on construction o a newcounty public saety building. Te a-cility has been long sought by SheriDaniel McEathron to house his ownincreasingly cramped administra-tive oces now located on JacksonStreet. Te new building with a con-crete base price tag o $10.55 millionwill also house the county emergencyservices administrative oces andpotentially a joint county-town lawenorcement 911 communicationsand dispatch center, though the sher-i remains skeptical about that latterchange in existing dispatch opera-tions (see our Late July edition).I appreciate the decision to moveorward its going to be a greatacility or Warren County, McEa-thron told the supervisors ollowingthe unanimous roll call vote o ap-proval.Te acility will be located acrossSkyline Vista Drive rom SkylineHigh School, caddy cornered be-tween Route 340 South and CriserRoad just northeast o the school.Te project is being unded through acombination o already issued capitalimprovement bond unds, set-asidespecial project reserves, and a por-tion o the so-called twice-a-year tax

    billing windall. Te latter amounto nearly $7 million (see below -nancing box) is county real estateand personal property tax revenues

    received six months earlier than nor-mal in the initial year o the new Juneand December tax collection system.

    While the total amount o availableunds cited above are considerablymore than the base construction bido $10.5 million, County Adminis-trator Doug Stanley explained thatother project costs are anticipatedto reduce the unused amount oavailable unds to less than $300,000($66,850). Any surpluses can simplybe re-directed to other needed proj-ects or payments that the supervisorsapprove.

    Te accepted bid on the projectcame rom Harrisonburg-basedNielsen Builders Inc. Reerences orNielsen submitted as part o the bidproposal packet included a Public-Private Educational Facilities and

    Inrastructure Act (PPEA) project inRockingham County on what is de-scribed as a state-o-the-art bio-re-search acility. Tat acility, partner-ing Rockingham County, Nielsen anda amiliar name SRI International(ormerly Stanord Research Insti-tute o Menlo Park, Cali.), will houseSRIs primary Mid-Atlantic researchacility targeting bio-deense andneglected d iseases.

    County sta noted that all but oneo 13 received bids came in within$1.35 million o each other, withNielsens $10.549 million at the lowend and $11.901 million at the highend. Te one exception was a $16.1million bid impacted by a second

    phase bid about $4.3 million abovethe other average bids on that aspecto the project.

    County sta noted the majority obids compared avorably to projectconsultant Moseley Architects pre-bid cost estimate o $10.81 million.

    She said all the right things andshe didnt laugh.

    A ew years later she called meup and told me that her dad, localbuilding legend Sonny Whitting-ton said it was his avorite paper. Iremember when you told me youwere going to start a newspaper,she said. I thought, well ... so you

    are going to just start a newspaper.Just like that, she recalled. I guess

    you did.Tat call meant more to me than

    she will ever know.I had been planning dierent

    layout designs and chatting withother publishers to get ideas andgure out how to get things rollingor a couple o years when in 006,Roger Bianchini became suddenlyavailable.

    I was red, he would clariy.You are always so diplomatic, Dan I got canned philosophical di-erences, he elaborated.

    Roger sent me an e-mail askingi I knew o any writing jobs that

    might be available. I hired him inmy reply.

    Tus began the project that hasgone rom little-known communi-ty tabloid to a newspaper that hasbeen quoted around the world andbeen praised by some o the topwriters at Fox News Channel, TeWashington Post, Politico and TeWashington Examiner. Roger and Ihave appeared on national televi-sion and I even played the dubiousrole o unwitting evil print report-

    er in the last episode o Te RealHousewives o Washington, DC. (Imust admit I wasnt watching and

    didnt know I was on the show untiltwo colleagues e-mailed me to say Iwas on that night. Ten my phoneblew up as the texts and messagesrolled in.) But thats how it works.Once, our oce landlord om Es-helman told me he had seen me in-terviewed on the local Fox stationin Las Vegas the previous night.Tat was the rst I had heard aboutit.

    I had interviewed with the DCstations many times but I remem-ber how scared I was when I did aninterview on Good Morning Amer-ica. Tey taped me or ten minutesand I was shaking or hours ater-

    ward, worried I would look like anidiot. Ten it came on and I wasthere or 1 seconds and lookedne all that worry or nothing.

    Once I was asked to do a bit orGreta Van Sustern o Fox NewsChannel. I didnt have time andwanted to get Roger to do it. Hehad never done V beore and Imust admit that I orgot to men-tion that it was or a national net-work. Roger was interviewed byGri Jenkins or Fox and I thoughtit was unny that Roger, a sel-de-scribed 60s radical was havingsuch a pleasant interview with FoxNews. Gri later complementedRogers perormance. Again, I was

    worried or nothing.But as I look back on our beginningdays, there was cause or concern right away.

    Warren County Reports printedition was originally going to bea magazine on newsprint. It wouldbe monthly and cost $.50. Tatwas my plan.

    Big mistake! But it was xed threedays later.

    We all got together and decidedto change the cover price to 50cents Rogers rst I told youso. Tis was a huge problem sincemany stores had programmed ourbarcode to $.50 and we wouldhave to get with each o them to

    reset our paper to the new price.But I had a brilliant idea or that!

    I went to Staples and bought somelittle round stickers. I chose yel-low since it would stand out. Andwe literally went to every place andput a little yellow sticker that said50 cents over the old price andbar code.

    On the next issue I printed theprice in a yellow circle to be consis-tent. We kept it when we eventu-ally went ree.

    So that is the reason there is a bigyellow FREE on the paper. It was allbecause o those little yellow 50-

    cent stickers that allowed our curi-ous 000 rst readers to see whatwas going on.

    As I write this, I am looking at various covers we have printedover the years. All o the issues areon our website. Each one bringsback memories.

    I remember debating catchyheadline ideas or the story o thenSen. George Allens use o the wordmacaca to describe a young man

    videotaping one o his speeches. Icame up with Macaca happens.We got beat up a little on that one,but not as bad as it turned out asthe senator himsel did.

    Ten the town decided to createa misdemeanor charge or peoplewho dont sort their trash correctly.(We still think that is a stupid idea.)ony Elar, who now owns YellowCab, drew up a hysterical op-edcartoon showing a town trash truckhauling people to jail. I put that onthe cover.

    One o the prettiest covers wehad showed a housing develop-ment. Te article was about Del.Clay Atheys bill to oer incentivesto steer home construction to landadjacent to already developed townand city property, instead o chop-ping up all the arm land in Virginiauntil there isnt any let.

    Max Clatterbuck, a 1977 gradu-ate o Warren County High School,came back home to lead the con-struction project which has trans-ormed the old school into the Lu-

    ray Avenue Middle School.Now the president o Lantz Con-

    struction Company o Winchester,Inc. (LCW), he talked about howit elt to return to the scene o hishigh school days.

    I think its neat, it brings backa lot o memories. Its hard to

    walk back to the old auditorium,because you remember somethings. When I was in Key Club,we had a womanless beauty con-test. I remember being on stage init and it was not a pretty sight, helaughed.

    Te school, however, is a prettysight.

    Richmond-based Consultantswith Ballou Justice Upton Archi-tects were necessary to smoothly

    connect 60,000 square eet o newconstruction to the 100,000 squareeet o historical renovation. Wallswere demolished, new walls anddoorways shored up with tempo-

Te old library hasbeen transormed into a gleamingmedia center. Above it is a balconywhich looks out on both the mediacenter below and the mountains

    outside. We kept two o the exist-ing walls and built everything elsenew, said Clatterbuck.

    Students will be happy to ndout that theres air conditioningeverywhere in the building includ-ing the auditorium which also hasa new/old look. Te layout is thesame, but all old seats and fooringwere taken out and replaced. Te

    ceiling has been redone with newlights. A new sprinkler system hasbeen installed which wasnt re-quired in the old building when itwas built in 1943.

    But the old building was part oClatterbucks history.

    He was born and raised in War-ren County, and his ather stilllives here. Ater high school heattended Virginia ech, gradu-ated in 198 with a degree in civiland structural engineering, thenworked in Washington D.C. or 15

    years and got his Proessional En-gineering license. Hes been with

    LCW or 15 years, six as its presi-dent and lives in Frederick Countywith his wie Mary and daughtersKatie and Jesse.

    But he still has a hand in help-ing out in his birthplace. LCWand he continue to support lo-cal causes and recently partneredwith Rotarys Mike South, a localcitizen who is involved with Proj-ect Lead the Way. Te organiza-tion gives high school studentsexposure to dierent careers, with

    knew I had to at least make goodgrades, he said.

    He also remembered Yates Hall,basketball coach and gym teacher,as being a great support. I hadtremendous respect or him hesaid. Hall was instrumental in get-ting Clattterbuck involved in KeyClub in high school. Lookingback, he said, I appreciate peoplewho pointed me in that direction,it was a great experience, now Imin Kiwanis which also helps peo-

    ple. And his company, he said, hastried to give back to the commu-nity by being an annual sponsor othe Front Royal Rotary Club, andthe Warren County EducationalEndowment Fund. Tey are cur-

    rently a sponsor o Shagging onthe Shenandoah which is a benetto help rebuild a school in Haiti.Friends also helped to orm hischaracter.

    Once I got to high school, hesaid, I was very ortunate to besurrounded by good people whoonce again set the example. RickLeonard, Roy Boyles and MikeSilek were all a year ahead o me inschool. We were all in the Key Clubtogether and played sports. Rick

    Leonard excelled in everythinghe did and he is now Superinten-dent o Schools in Winchester.Roy Boyles was an excellent oot-ball player and is now chairmano the Warren County School

    Board. Mike Silek was presidento the Key Club and he is now anextremely successul business per-son.

    And as the middle school projectwound down, Pamela McInnes,Warren Countys Superintendento Schools, became an ally.

    Pam McInnes has been a realteam player in working with us.When we get close to the end o aproject, many people get anxiousto get it nished, but shes been

    very supportive and helpul. Ipeople can get together as a team,it goes so much better, and i not itmakes it so much more dicult,

    McClosky suit against DSS, King headed to tRuling sends $600k civil suit orward on wrongul termination count o

    On July 15, 6th Judicial CircuitCourt Judge Dennis L. Hupp ruledthat the $600,000 civil suit o JudithMcClosky against both the WarrenCounty Department o Social Ser-vices and its director, Ron King mayproceed but along much narrowerparameters than originally led.

    In ruling on deense motions orsummary judgments to dismiss thecase, Hupp said the case may pro-ceed on one aspect o three in Countwo o the original ling. Te casewill proceed solely on McCloskysallegation she was wrongully termi-nated in retaliation or attempting tocarry out her prescribed duties as apart-time welare raud investigator.

    Te judge also ruled that Mc-

    Closky may sue King individually,as the supervisor who she allegeswrongully terminated her. Te latterruling came despite Hupps acknowl-edgement that the deense was cor-rect in asserting that King was notMcCloskys employer, so cannot besued as such, but rather or allegedactions in his personal role as her su-pervisor.

    Te judge also noted that the de-ense ling regarding Count One oMcCloskys original complaint hadbeen rendered moot by the deenseswithdrawal o that aspect o thecase led under the Virginia FraudAgainst axpayers Act. Te plain-ti had led a 54-count justicationo incorporating the Fraud Againstaxpayer Act citing discrimina-tory practices by her employer. Teplainti was asking double amounts

    o monetary damages claimed basedon that raud against taxpayers stat-ute. Hupp observed that the deensehad acknowledged a precedent setby the case o Ligon vs. the Countyo Goochland in withdrawing CountOne rom the suit.

    Between the deenses own actiono withdrawing the Count One l-ing, and Hupp ruling in the deensesavor on two o three exceptions toVirginias employment at will doc-trine in Count wo, the case hasbeen narrowly ocused on two es-sential claims.

    Going to trial

    What will be heard at trial is evi-dence surrounding McCloskys claimher April 6, 007 termination wasin retaliation or her attempt to doher job as described by state statute.

    Hupp actually gave a split rulingon the deenses request or dismiss-al according to ype 1 exceptions toVirginias employment at will doc-trine. He ruled that McCloskys casedid not qualiy under her claim shewas red because she insisted onreporting instances o welare raudto the Commonwealths Attorney.

    However, he ruled that the case didqualiy or such a ype 1 exceptionon the plaintis claim she was hin-dered in her investigations o raudcases, and in cooperating with the

    Commonwealths Attorney in theprosecution o such cases. Hupp cit-ed McCloskys claim her terminationwas due in part to Kings disgruntle-ment over her testimony beoreWarren County Grand Juries abouther workplace allegations regardingthose cases.

    McClosky, as a raud investiga-

    tor, had an obligation to investigateraud cases and to assist the Com-monwealths Attorney in the pros-ecution o those cases, Hupp wrotein his ruling. She would also havehad an obligation to testiy beorethe grand jury i subpoenaed to doso as provided under Virginia Code19.-01 or Virginia Code 19.-08.o the extent that McClosky allegesthat her termination resulted romher carrying out these obligations, Ibelieve she makes out a claim under

    this ype 1 exception ment at will doctrine,

    It seems to have been a case withno winners, only losers.

    On Aug. 3, local property owner,businesswoman and relocated Mas-sachusetts Yankee not quite in KingArthurs Court Patricia Callahan lost

    her appeal o our lower court misde-meanor convictions o brandishing arearm at neighbors renting a garagenear her home property at SouthRoyal Avenue. Consequently Calla-han will pay $100 o $500 nes im-posed on each conviction, along withcourt costs.

    Calling the incident a behavioralaberration by the deendant, who hadno previous criminal record, JudgeDennis L. Hupp suspended $400on each ne and declined imposingany jail time that had hovered overCallahans head since her lower courtsentencing. Hupp granted Callahansrequest to be given three months topay a total o $873 in nes and courtcosts.

    But i the 6-year-old Callahan,who has practiced law in Washing-ton D.C., now has a criminal recordand is a little lighter in the pocket,the people with whom she had anongoing neighborhood dispute lead-ing to the Aug. 1, 009, brandishingincident no longer have the down-town garage where they used to re-pair cars, including one said, a amilyhobby, short-track race car.

    According to testimony and outo court conversations with some o

    those neighbors, since the August009 incident leading to Callahansmisdemeanor brandishing convic-

    tions they have lost that garagerental largely it would appear due toincreased zoning scrutiny by townocials. Callahan long alleged theMoore amilys work on vehiclesat the garage constituted an illegalcommercial garage operation. TeMoores said they worked only onpersonal vehicles o theirs or riends.

    Te dispute led to a long, some-times verbally bitter clash with notonly the Moore amily and riendswho gathered to socialize and con-tribute or simply observe the repairwork going on at the garage, but alsotown ocials she believed were atbest ailing to uphold town codes.

    I Callahan believed her neighborswere operating an illegal commercialgarage operation in the downtownHistorical District, those neighborsappeared to believe Callahan wascreating her own Hysterical Dis-trict based on personal prejudicesand dislikes o their blue-collar lie-style and physical appearance.

    Callahan has contended rom herarrest on Aug. 1, 009, that all shedid was point a cell phone at herneighbors as she had done on many

    occasions beore in an attempt todocument what she alleged was anillegal commercial garage operation.However no photos were producedrom that incident, which occurredaround 8 p.m. and dusk because itwas too dark, Callahan said.

    No weapon was ever ound by au-thorities on her person or propertythat day and Callahan testied shehad never owned a gun and did nothave one that day. However, a com-bination o actors led Circuit Court

    A second actor weighed heavily inthe judges decision, he said. Tat ac-tor was a recorded call to FRPD dis-patch that day in which an obviouslyexcited Callahan threatened to get agun and take matters into her ownhands due to her dissatisaction withthe way the town police had thus ardealt with her complaints.

    In explaining his verdict Hupp saidthose alleging the brandishing couldnot have known o Callahans com-ments to FRPD dispatch that day.So why on that same day, would the

    complainants decide to suddenlyabricate a weapons story rom a be-havior that Callahan had repeatedlyengaged in with them that o point-ing a cell phone camera at them?

    However deense attorney John Bellargued that his clients comments todispatch indicated a plan to get a gunshe did not yet have. He pointed outthat the time rame between that callto FRPD and the incident was onlyabout a hal hour. Could Callahanhave gone out and purchased a pistoland returned within that timerame,Bell asked the court.

    However Assistant Common-wealths Attorney Michael Flemingargued that Callahan had, had timeto dispose o a weapon within her

    South Royal Avenue property, whichincluded some locked rental ocespaces Callahan claimed she had nokeys to. Tose locked oce spaceswere never searched by police try-ing to locate a weapon that evening,Fleming pointed out.

    Fleming also questioned the be-havior o a woman who claimed to bearaid and intimidated by her neigh-bors deciding to walk alone pastthose very neighbors alone at dusk.Callahan testied she believed po-lice would soon be responding to hercomplaint call when she went intothe alley armed, she said, only withher cell phone.

    Called as a character witness orthe deense, Js Gourmet-Elements-Apartment G owner David Ged-ney told the court he believed hisneighbor Callahan to be honest and acrusader or causes she embraced as

    Matt and Joe saw a needand lled it. When Blockbust-er and Video World abandonedtheir customers in the videorental market in Front Royal, theGochenour brothers, Matt, 19and Joe, 1, decided to step upand open Shenandoah Video in

    the ormer Blockbuster space inthe Royal Plaza Shopping Center.

    We thought it was a great op-portunity with the other twostores going out o business, andbusiness has been very good.Since we opened, 1300 patronshave joined and the numbergrows about 0-30 every day,they said in the rst weeks o op-eration.

    video providers.Matt said, We have thousands

    Weve learned how our atherhas done it and taken bits andpieces and incorporated theminto our own. Our pricing is thesame as his and weve decided todo pretty much the same way hedid since his methods work, saysMatt.

    Identical twins Michelle Phillipsand Melissa Ramsey had enougho traveling distances or great bar-gains at consignment stores.

    We both love to shop at con-signment stores and had to go toWinchester. We thought this areaneeded one, they said.

    Gently used, but new to you isthe slogan o the newest shop inthe Royal Plaza shopping center,their consignment store which isaptly named New You.

    Savannah donates her fowing locks to cancer resea

    en-year-old Savannah Long oFront Royal decided more thanour years ago to allow her lovely,red hair to grow to her waist.

    Last week, it got to be where

    she wanted it and in a visit toHair Spa on Shenandoah Av-enue - it was scissored o romthe shoulders down missionaccomplished.

    A young lady who rom an earlyage has looked out or others,Savannah sent her tresses to the

    American Cancer Society - spon-sored Locks o Love where itwill be used or wig making orthose cancer patients who su-er hair loss in radiation and/orchemo therapy.

    And Savannah, who lives withher grandmother, Ginger Higgs, a

    longtime Front Royal realtor cur-rently at Brown & Rutherord re-

    alty company, i snt stopping now.She says shell grow it long againas she enters Warren CountyMiddle School. When it reachesher waist, shell make another do-nation to Locks o Love.

    Rescued dog-cat team fourishing in Darr househ

    It didnt take the 010 mayoralelection to rst rocket im andammy Darr into the headlines othe Warren County Report.

    Tey publicly distinguished them-selves a year earlier by adopting Otisand Milo, the odd couple o rescuedanimals at the Julia Wagner animalshelter, whose terrible plight hadbeen reported in these pages in July

    009.It was just last month that Otis, a

    dog, and Milo, a cat, completed theirrst year with the Darr amily thatalready included Simon, a dog, andSnowball, a cat.

    Otis, a black poodle, was the vic-tim o one o the worst cruelty andabandonment cases o 009 at theanimal shelter. Milo was his sel-ap-pointed care-giver and companion.Teir rescue by the Warren CountySheris Department animal control

    and subsequent lie-saving treat-ment by shelter volunteer veterinar-ian, Dr. Kent Smith, caught the eyeso the Darrs, who immediately wentto the shelter o o Happy CreekRoad to see how they could help.

    It was a month-long wait whileOtis, always with Milo at his side,recovered rom the surgical repair owhat could have been a stab wound.Ater the injury, the dog was aban-doned by its owners at a rental prop-erty and was literally, when ound,bleeding to death. For whatever rea-son, Milo stood guard and comortedhis doggie pal beore animal controlound them. Tey were ultimatelyadopted as a pair to the Darrs.
