RANM’s Board of Direc-tors held their annual meet-ing Thursday, September 12. Meeting highlights included:

• Approval of the revised 2014 RANM Budget which includes no increase in member dues.• Denial of a request by the New Mexico MLS to discon-tinue royalty payments to RANM.• Approval of appointment of Julie Greenwood, Gretch-en Koether, and Eddy Gibson to the RANM Credentials Committee.• Approval to hold a special membership meeting in con-

junction with RANM January meetings. The purpose of this meeting will be to consider bylaw amendments changing the make-up of the RANM Board of Direc-tors.• Approval to spend up to $35,000 from Growth and Enhancement Funds for technology enhancements to RANM communications, website, etc.• Election of 2014 RANM Officers.• Election of NM MLS Direc-tors and Stanley H. What a busy year.

Instanet, our new forms delivery platform, was rolled out on August 29th. The reviews have been very good and we hope the transition will continue to be smooth. The Bylaws Committee, chaired by Pat Fell, has worked tirelessly this year to make sure our governing documents are in order. It seems to be a never-ending job, but please

fered seven amendments to RANM’s Bylaws; all were approved during our annual meeting.

The Forms Committee, chaired by Beverly Hilton, has also been hard at work all year. I’ve had the pleasure of attending several of their meetings and still haven’t decided if I want to ever serve on Forms! It was quite a challenge keeping up with new forms that were needed for HOA and PID legislation.

The Technology PAG, chaired by Todd Clarke, is in the process of bringing RANM up to speed - revamping the website, increasing participation in social media, incorporating video into the plan, creating the Millennium Project, and more.

RANM made a donation of $1,000 to the Arizona Foundation Relief Fund for the 19 fire fighters that were so tragically killed. This hotshot crew had been in New Mexico the week before their death fighting the Thompson Ridge Fire near Jemez so we felt a connec-tion to these brave men and wanted to help their families.

On a happier note, RANM hosted an AE Training Seminar in August in Santa Fe. It was a huge success and I received many thank you e-mails from those who attended.

Thanks to everyone who helped make our conference a BIG success. Congratulations to the new officers, and Pat Pipkin, 2013 REALTOR® of the Year, and Todd Clarke, Peggy Comeau Leadership Award recipient.

The NAR Annual Convention is November 8-11, 2013 in San Francisco. I have scheduled RANM Night Out on November 9 at Scala’s Bistro in Union Square. I hope to see many of you at this Convention and at our Night Out dinner.

We are still working hard to accomplish our goals and the last quarter of 2013 prom-ises to be a busy one. Please contact me with any questions or suggestions you have. It’s

DEFINITIONS

Real Estate Contracts The new Liquid Waste Regulations that took effect September 1, 1013 clarify that it is the BUYER in a real-estate contract (REC) transaction that becomes responsible to the New Mexico Environmental Department (NMED) for any violations of the Liquid Waste Regulations (regulations).

As previously written, the regulations were ambiguous on two important ques-tions regarding RECs: is the seller required to have an inspection performed prior to equitable-title transfer and who is responsible to the NMED in the event a liquid waste system (system) fails after equitable-title transfer?

In the past, the NMED has taken the position that the seller should conduct an inspection prior to selling a property on an REC, but the regulations did not specify whether it was required prior to equitable or legal title transfer. The term “transfer” is now defined under the regulations as the “transfer of equitable or legal title to a property.” The regulations now contain a definition of REC, as well.

In addition, in the past, the NMED had taken the position that if a system failed after the property was sold on a REC, the NMED would hold both the buyer and the seller responsible for remedying the failed system.

Under the amended definition of the term “owner” in the new regulations, the NMED has clarified that “in the case of a property sold on a real estate contract, the “owner” of the property is the buyer”. In other words, in an REC transaction, the NMED will no longer hold the seller responsible for correcting any deficiencies in the system. That is not to say that a seller may not be contractually liable to the buyer (depending on the terms of any agreement between the parties), but liability to the NMED and liability based on the contract are two separate issues and the NMED will not be concerned about who is responsible under the contract. Furthermore, a seller’s failure to conduct an inspection as required by the regulations will not shift the burden to remedy the failed system to the seller. Again, while NMED may find the seller in violation for not having conducted the inspection prior to transfer, the NMED will still look to the buyer to remedy any problems with the system.

Systems Located on Common Property This issue of ownership of the system arises most commonly in condominium situa-tions. The new definition of owner also clarifies that “if the property sold or purchased is owned collectively by multiple owners, the “owner” of the common property is the entity or governing body specifically designed in governance documents for the common property.”

Bedrooms The definition of “bedroom” has been amended to “mean any room within a building that is designated as a sleeping room on drawings submitted to the responsible build-ing permitting authority, manufactured housing authority or in the case of unpermitted systems, to the NMED.”

AMENDMENTS TO THEREQUIREMENTS AT TIMEOF TRANSFER

Previously the NMED used the term “inspector” when referring to who must evaluate or inspect a system prior to trans-fer. The amended regulations now require that an “evaluator evaluate” the system. The term ”evaluator” and “third-party evaluator” are defined in the regulations as someone who has the following qualifica-tions:

• a valid and appropriate classification of licensure by the construction indus-tries division of RLD;• licensure as a professional engineer;• accreditation in on-site wastewater inspection by the National Sanitation Foundation;• certification by the National Envi-ronmental Health Association as an installer of onsite wastewater treatment systems;• certification as a Registered Environ-mental Health Specialist or a Regis-tered Sanitarian; or • demonstration of a similar accredita-tion or certification or a combination of training and experience as approved by the NMED.

erty transfer evaluation for an existing system has been done within 180 days of the transfer, a property transfer inspection is NOT required. The regulations now specify that “in the event, property with an existing permitted on-site system is transferred prior to the remediation of a failed system, the transferee (also known as, “the buyer”) becomes responsible under the regulations for remedying the failed system.”

Permitted Systems The NMED has added an entirely new subsection to the requirements at time of transfer for permitted conventional systems which specifically lists what the evaluator must determine that:

• the treatment unit is watertight and functioning properly;• the existing tank has a liquid capacity within one tank size of the capacity required by the regulations;• the disposal system appears to be functioning properly;• the system appears to meet setbacks and clearances;• the system meets lot size requirements in effect at time of initial installation, or at time of most recent permitted modification; and• the system does not constitute a public health or safety hazard.

Permitted advanced treatment systems must meet the above-requirements in addition to the requirements that were already set forth in the regulations.

Unpermitted Systems and Installer Specialists Unpermitted conventional systems installed or modified prior to February 1, 2002 may be issued a certificate of registration for continued operation if, after evaluation by the NMED or by an installer specialist it is determined that the system has met the same criteria as set forth above for permitted systems and the appropriate permit fee has been paid for the system installed.

If any of the above conditions are not met, a certificate of registration cannot be issued and an application for modification must be submitted to the NMED.

An installer specialist is a new classification of installer; the qualifications therefore are set forth in the amended regulations.

For unpermitted conventional systems installed on or after February 1, 2002, the NMED may issue a permit if after inspection by the NMED, the NMED determines that all construction and material requirements are met, that all of the above-criteria for permitted systems are met and that the appropriate fee has been paid.

Evaluations The amended regulations dictate a new process for submitting evaluations. As has been the case, evaluations (formerly referred to as “inspections”) must be recorded on forms approved by the NMED. However, the NMED has issued a new standard form.

Also, as has been standard, evaluators must submit to the NMED copies of all evaluation reports, whether completed or not, within 15

days of the evaluation. A permit or variance application must still be submitted within 15 days of the evaluation to correct any deficiencies or permit violations identified by the

evaluation, but now the regulation requires that the permit or variance application be submitted “by the party who is or will be the owner of the property on the 15th day following the evaluation.” This means that in some case, depending on closing dates, the seller will be required to request the permit or variance, and in other cir-cumstances, the buyer will be required to make the request.

ADDITIONAL RELEVANT AMENDMENTS

Lot Size While a conventional treatment system is still not permitted on a lot sized smaller than 0.75 acre where there is not an estab-lished system, under the new regulations, the NMED may issue a permit for such an installation in cases where the NMED has identified and mapped where ground-water is not at risk from nitrogen loading from onsite systems.

The new amendments set forth the factors to be considered in determining if ground-water is at risk. Also under the amendments, the lot size is now determined by the total area of the lot plus or minus the area of any liquid waste disposal easements; roadway easements are no longer deducted in determining the size of the lot.

Multiple Systems on One Lot and Setbacks The new amendments allow for multiple systems to be located on a single lot, provided that the systems are set back a minimum distance from each other in accordance with a formula set forth in the regulations. The amendments also establish a protocol to be used when the NMED discovers that a private drinking water well has been drilled at a loca-tion that is not set back from a pre-existing system by the distance required.

Permitting Process The process for requesting and canceling a permits and changing contractors has been amended. Only the permittee who is defined as any owner of a permitted on-site system may request that the NMED cancel a permit; the request must be made in writing. An installer whose CID license number is on a permit may, upon written notice to the per-mittee and to NMED withdraw from the permit. A permitee may amend the permit to change the installer without installer withdrawal, provided the permitee provides written notice to the installer.

Upon installer withdrawal, permit approval shall be suspended until the permittee amends the permit either to include another licensed installer or to reflect approval as a qualified homeowner. A “qualified homeowner” is defined as a person who is the owner residing at the property who has been provided homeowner installation training materials and who has passed an exam administered by the NMED.

If a contractor withdraws after construction has commenced, construction of the system cannot proceed until the permit amendment is approved by NMED and the owner must eliminate any public safety hazards posed by open treatment systems, excavations or other conditions related to unfinished construction.

Access Risers and Effluent Filters The regulations now require that an approved effluent filter and access risers be installed over the tank inlet and outlet access openings whenever a modification to any part of a system is conducted and all tanks must include an effluent filter installed on the outlet of the tank before final discharge with a access riser installed to grade and with a handle that extends to the top of the riser.

Advanced Treatment Systems There are new maintenance and moni-toring requirements for advanced treat-ment systems and effluent sampling is now required for on-site systems that do not conform to manufacturer’s guidelines for field parameters or where the manu-facturer has not established guidelines for field parameters or for systems that the NMED has determined are not operating properly.

Tertiary treatment and disinfection is required for any reduction in setback distance between 50-99 feet from a private drinking water well located on the prop-erty and a variance, tertiary treatment and disinfection are required for any reduction in setback distance less than 50 feet when the well is either not located on the sub-ject property or is a public drinking well.

The following provisions were also amended:

• determination for a groundwater discharge permit versus a liquid waste permit;• drainage sizing and calculations for sidewall credit;• drain field product credits;• pumps and alternative disposal sys- tem requirements;• design of pump systems;• installation of soil replacement systems;• low pressure pipe systems;• split-flow systems;• sand-lined trenches and bottomless sand filters.

Many of the rule changes adopted by the Real Estate Commission at a September 16 rule hearing are clean ups of existing rules.

The changes are:

• A new definition of “owner or property owner” that would include property owned by any legally-recognized entity in which the owner has an interest of ten (10) percent or more.• New definitions of “military service member” and “recent veteran” to comply with a new law requiring expedited processing of license applications from these catego-ries of applicants.• An amendment to the fingerprinting rule restoring a provision that fingerprint cards cannot be submitted to the Department of Public Safety (DPS) any earlier than six months prior to an initial license or license renewal application.• An amendment to the License Suspension and Revocation rule clarifying the requirements for the surrender of associate broker and qualifying broker licenses that have been suspended or revoked by Commission order.• An amendment to the Qualifying Broker rule permitting a qualifying broker to pay commissions to the surviving spouse of a deceased broker.• An amendment restoring the requirement that designations of brokers-in-charge be made in writing to the Commission.• An amendment to the Associate Broker rule requiring associate brokers to main-tain errors and omissions insurance and provide their qualifying broker of documen-tation of such coverage.• An amendment to the Broker Duties rule requiring written disclosure of potential conflicts of interest to their client or customer and other brokers involved in the transaction.• An amendment to the Trust Accounts rule clarifying that revenues derived from the management of a broker’s own property or property owned by any legally-recognized entity in which a broker has a ten (10) percent or more interest are to be segregated from the funds of others.• Another amendment to the Trust Accounts rule restoring a provision that a bro-ker can deposit their own funds in a trust account only after written approval by the

Commission and full disclosure to the property owner.• An amendment to the Prop-erty Management rule restoring the requirement that Property Man-agement Trust Accounts be clearly labeled as such.• Another amendment to the Prop-erty Management rule clarifying that a property manager does not have to provide owners with documents that they are prohibited by law or contract from providing, such as criminal background checks and credit reports.• Repeal of the Foreign Broker rule to coincide with the repeal of the Foreign Broker provision of the Real Estate License Law.

The Commission will file the rules with the State Records Center and Archives in time for a January 1, 2014 effective date.

Clarke Named Leadership Award Recipient

Pipkin Receives RANM’s Highest Honor Patricia Pipkin, from Santa Fe, was named RANM’s 2013 REALTOR® of the Year during the Celebration Luncheon at Fall Conference.

Pat’s real estate career began in California, where she served on her local board in numerous com-mittee and officer positions (including President), and as a director for the California Association of REALTORS®.

She relocated to Santa Fe in the early 2000s and almost immediately jumped into volunteer service for both the Santa Fe and New Mexico REALTOR® associations. She served as Santa Fe Associa-tion president in 2007 and as RANM’s president in 2008. She has represented New Mexico as a Director of the NATIONAL ASSOCIATION OF REALTORS®, served on several NAR Com-

mittees, and is currently the Regional Vice President for NAR’s Rocky Mountain Region XI.

Pat has also served her local community in activities ranging from Junior League community projects to delivering meals for Santa Fe’s Kitchen Angels. She has even served as president of three Home-owners’ Associations.

Pat Pipkin will be honored with other state REALTORS® of the Year during NAR’s Annual Convention.

Todd Clarke, Albuquerque, was honored as recipient of the Peggy Comeau Leadership Award during RANM’s Fall Conference.

The Peggy Comeau Leadership Award was established in honor of former RANM Executive Vice President Peggy Comeau. It is given to a member who has never served as RANM President or been honored as RANM REAL-TOR® of the Year, to recognize his/her loyalty and selfless contributions to the REALTORS® Association of New Mexico.

The Qualifying Broker at NM Apartment Advisors, Inc. in Albuquerque, Todd earned his real estate salesperson license in 1989 and his broker’s license in 1996.

Todd is a CCIM instructor, former CCIM ambassador to Eastern Europe, and is currently serving a three year term as a Director of the National CCIM Organization. In 1995 he founded CARNM – the Commercial Association of REALTORS® New Mexico – and served as their president in 1995 and 1996.

Todd Clarke is currently serving the REALTORS® Association of New Mexico as chair of the 2013 Technology Presidential Advisory Group.

RPAC-NM held their annual meeting during RANM Fall Conference. Activi-ties and amounts raised for 2013 were reviewed.

New Trustees ratified (3-year terms begin November 1, 2013): * Cathy Colvin, Tim MacEachen, Diane Stearley – Central District * Victoria Murphy – NE District * Bill Davis and Richard Randals – SE District * Tom Whatley and Kim Clark – SW District * Lela Holmes fills the NW District unexpired term of Kim Wall.

Working with the expert consultants in NAR’s Campaign Services division, SFAR found a way to have a significant effect on local elections in general; not just the upcom-ing mayoral race, but in preparing a cadre of candidates to run for all sorts of elected offices down the road.

NAR conducted its Candidate Training program in Santa Fe on August 10, free of charge, for SFAR members and other would-be can-didates who support property rights. The day-long program included a general introduction to the nuts-and-bolts of running for office, covering topics from reasons for running, to planning and budgeting, to fund-raising, to online efforts and volunteers.

Santa Fe’s Homebuilders Association and Chamber of Commerce joined SFAR in reaching out to potential candidates to participate; there were nearly 20 attendees at the training session.

Contributions are not deductible for income tax purposes. Contributions to RPAC are voluntary and are used for political purposes. You may refuse to contribute without reprisal and the National Association of REALTORS® or any of its state associations or local boards will not favor or disfavor any member because of the amount contributed. 70% of each contribution is used by your state PAC to support state and local political candidates. Until your state PAC reaches its RPAC goal 30% is sent to National RPAC to support federal candidates and is charged against your limits under 2 U.S.C. 441a; after the state PAC reaches its RPAC goal it may elect to retain your entire contribution for use in supporting state and local candidates.

SFAR uses REALTOR® Party Resources to Conduct Candidate Training

New Mexico REALTORS® meet with Representative Michelle Lujan Grisham to discuss federal real estate issues.

David Oakeley has been named Government Affairs Direc-tor for the REALTORS® Association of New Mexico, Steven Anaya, Chief Executive Officer, announced.

Oakeley will help lobby on behalf of RANM and assist in the development of strategies to achieve the Association’s leg-islative goals. He also will monitor and track State and Fed-eral legislative issues and help keep the membership informed.

“David has a broad knowledge of the political and public affairs process in New Mexico,” Anaya said. “He also has excellent communication skills and is a solid addition to the RANM staff.”

New Officers in-clude Tom Whatley – Chair,; Bill Davis – Vice Chair; and Kim Clark – Secre-tary/Treasurer.

The Taos native has lived and worked in Las Cruces, Albuquerque and Santa Fe. He most recently worked at New Mexico Magazine. He previously worked for the Pueblo of Pojoaque and New Mexico State University.

He began his career in Las Cruces as a radio and television news reporter and has had several positions in public relations, media and marketing. He worked as a legislative analyst for RANM during the 2011 New Mexico Legislature.

Oakeley is a graduate of New Mexico State University. He currently lives in Santa Fe.
