PRIVACY AND RIGHTS OF STUDENTS REGARDING THEIR EDUCATION
RECORDS
The Family Education Rights and Privacy Act (FERPA) affords University students certain rights with respect to their
education records. These rights include:
1. The right to inspect and review their own education records within 45 days after the day the University
receives a request for access. A student’s request to review their own education records should be submitted
in writing to the department or office maintaining the record and should identify the record the student
wishes to inspect. The appropriate University official will make arrangements for the student to access the
education record and will notify the student of the time and place where the record can be inspected. If the
record is not maintained in the office or department where the request is submitted, the student will be
directed to the proper record holder in order to resubmit the request.
2. The right to request amendment of the student’s education record if the student believes the record is
inaccurate, misleading or otherwise in violation of the student’s privacy rights under FERPA. A student may
request amendment of their education record by submitting a written request to the department or office
maintaining the record that clearly identifies the part of the record the student wants changed, and the
specific basis for the request. Upon review of the written request, if the University determines that the
education record should not be amended, the student will receive written notice of the decision and
information about the student’s right to request a hearing regarding the amendment. Additional
information regarding the hearing will be provided to the student when notified of the right to a hearing.
3. The right to provide written consent before the University discloses personally identifiable information from
the student’s education record, except to the extent that FERPA authorizes disclosure without consent.
The University discloses education records without a student’s prior written consent under the FERPA
exception for disclosure to University officials with legitimate educational interests. A University official
typically includes a person employed by the University in an administrative, supervisory, academic, research
or support staff position; a person serving on the Board of Trustees; or a student serving on an official
University committee such as a disciplinary committee. A University official may also include a volunteer or
contractor working on behalf of the University who performs an institutional service or function for which
the University would otherwise use its own employees and who is under the direct control of the University
with respect to the use and control of education records, such as an attorney, auditor or collection agency or
a student volunteering to assist another school official in performing their tasks. A University official
typically has a legitimate educational interest if the official needs to review an education record in order to
fulfill his or her professional responsibilities for the University.
The University discloses education records without a student’s prior written consent under the FERPA
exception for disclosure of directory information which includes information that would generally not be
considered harmful or an invasion of privacy if disclosed. The following information is considered “directory
information” by the University:
Student name
Student home and school address
University assigned e-mail address
University assigned student number
Month, day and place of a student’s birth
Major field of study
Participation in officially recognized activities and sports
Weight and height of members of University athletic teams
Dates of attendance
Enrollment status (e.g., undergraduate/graduate, full/part-time)
Classification (e.g., senior, junior, sophomore, freshman)
Degrees, awards and honors (including selection criteria)
Expected graduation date
Dissertation and thesis titles
Most recent school of attendance
Photographs
Students may request that the University not disclose directory information as defined without the student’s
prior written consent by submitting a written request to the University Registrar. A request will be honored
until revoked by the student in writing.
Upon request, the University also discloses education records without consent to officials of another college
or university in which a student seeks or intends to enroll.
4. The right to file a complaint with the U.S. Department of Education concerning alleged failure by the
University to comply with the requirements of FERPA. The name and address of the office that administers
FERPA is:
Family Policy Compliance Office
U.S. Department of Education
400 Maryland Avenue, SW
Washington, DC 20202
FERPA also permits disclosure of personally identifiable information from a student’s education record, without
consent of the student, if the disclosure meets certain conditions found in the relevant Federal regulations. Except for
disclosure to University officials, disclosure related to some judicial orders or lawfully issued subpoenas, disclosure of
directory information, and disclosure to the student, FERPA requires the University to record the disclosure and
students have the right to inspect and review the record of disclosures.
