Robertino Diodoro, the Trainer of fourth place finisher #4 MISS SHAWHAN, lodged an objection against second place finisher #2 SHIMMERING DREAM, ridden by Denny Velazquez, alleging interference on the backstretch. After reviewing the videos and taking testimony from the riders involved, the stewards determined that #4 MISS SHAWHAN did check briefly in tight quarters but the films were inconclusive as to any interference that took place, therefore the objection was disallowed. Hearings TURF PARADISE RULING #19-20TP076
Having been properly noticed for a formal hearing and having appeared on January 6, 2020, Owner/Trainer Rigoberto Guillen (ADG #10890) is hereby fined two thousand five hundred dollars ($2,500.00) plus 5% Race Horse Adoption Fund surcharge for a total of two thousand six hundred twenty five dollars ($2,625.00) and suspended one hundred eighty (180) calendar days (January 11, 2020, through July 9, 2020, inclusive) after receipt of a report from Industrial Laboratories indicating that urine sample #E358433, taken from the horse "MIRACLE", first place finisher in the first (1st) race on November 5, 2019, at Turf Paradise was confirmed positive for the presence of the Class III foreign substance CLENBUTEROL at a concentration of approximately 40.3 pg/mL in urine. In addition, a split sample report was received from Texas A & M Veterinary Medical Diagnostic Laboratory confirming the presence of CLENBUTEROL in urine sample #E358433 taken from the horse "MIRACLE" from the first (1st) race on November 5, 2019, at Turf Paradise. This drug calls for a Category A penalty in Quarter horses as put forth in the Uniform Classification Guidelines for Foreign Substances and Recommended Penalties Model Rule (January, 2019 (V.14.0)). A.A.C. R19-120(C)(1) states that if the stewards determine that a licensee has violated this Section, the stewards shall consult the Uniform Classification Guidelines for Foreign Substances and Recommended Penalties Model Rule, both of which are established by the Association of Racing Commissioners International (ARCI). The penalty guidelines call for a minimum penalty of one (1) year suspension and a ten thousand dollar ($10,000.00) fine absent mitigating circumstances and a maximum penalty of a three (3) year suspension and a twenty five thousand dollar ($25,000.00) with the presence of aggravating factors. After testimony was taken from the licensee the board of stewards determined that an aggravating factor that possibly could be considered in this case is the fact that Mr. Guillen had two (2) CLENBUTEROL medication violations in 2018, however, in 2018 the Category used to determine the penalty for CLENBUTEROL medication violations for Quarter Horses in Arizona was Category B. To conform to the Uniform Classification Guidelines for Foreign Substances and Recommended Penalties Model Rule (January, 2019 (V.14.0)) this case is being referred to the Director of the Arizona Department of Gaming/Racing Division with the recommendation the fine be increased to $10,000.00 and the suspension be increased to one (1) year. The horse, "MIRACLE" shall be placed on the Veterinarian's List for 180 calendar days (retroactive to November 18, 2019, through and inclusive of May 16, 2020, and must pass a commission approved examination before becoming eligible to be entered. The fine set forth above must be satisfied within ten days from the date of this order. If it is not paid by January 17, 2020, all licenses held by the respondent are automatically suspended for one hundred and eighty (180) days beginning January 18, 2020, through and inclusive of July 16, 2020, and this matter is referred to the Director of the Arizona Department of Gaming/Racing Division with the recommendation that all licenses remain suspended until all requirements herein are satisfied. During the term of his suspension Rigoberto Guillen is denied access to all grounds under the jurisdiction of the Arizona Department of Gaming/Racing Division. The horse "MIRACLE", first place finisher of the first (1st) race on November 5, 2019, is hereby disqualified and declared unplaced. TURF PARADISE RULING #19-20TP079 Having been properly noticed for a formal hearing and having appeared on January 6, 2020, Owner/Trainer Rigoberto Guillen (ADG #10890) is hereby fined two thousand five hundred dollars ($2,500.00) plus 5% Race Horse Adoption Fund surcharge for a total of two thousand six hundred twenty five dollars ($2,625.00) and suspended one hundred eighty (180) calendar days (July 7, 2021, through January 3, 2022, inclusive) after receipt of a report from Industrial Laboratories indicating that urine sample #E358628, taken from the horse "TAMURA", second place finisher in the second (2nd) race on December 1, 2019, at Turf Paradise was confirmed positive for the presence of the Class III foreign substance CLENBUTEROL at a concentration of approximately 22.4 pg/mL in urine. In addition, a split sample report was received from Texas A & M Veterinary Medical Diagnostic Laboratory confirming the presence of CLENBUTEROL in urine sample #E358628 taken from the horse "TAMURA" from the second (2nd) race on December 1, 2019, at Turf Paradise. This drug calls for a Category A penalty in Quarter Horses as put forth in the Uniform Classification Guidelines for Foreign Substances and Recommended Penalties Model Rule (January, 2019 (V.14.0)). A.A.C. R19-120(C)(1) states that if the stewards determine that a licensee has violated this Section, the stewards shall consult the Uniform Classification Guidelines for Foreign Substances and Recommended Penalties Model Rule, both of which are established by the Association of Racing Commissioners International (ARCI). This is Rigoberto Guillen's 4th lifetime Category A penalty. The penalty guidelines go up to a 3rd lifetime penalty, however to continue the escalation of the recommended penalty matrix as it is, the 4th lifetime penalty would call for a minimum penalty of seven (7) years suspension and a one hundred thousand dollar ($100,000.00) fine absent mitigating circumstances and a maximum penalty of license revocation with no reapplication for a seven year period and a two hundred thousand dollar ($200,000.00) fine with the presence of aggravating factors. After testimony was taken from the licensee the board of stewards determined that an aggravating factor that possibly could be considered in this case is the fact that Mr. Guillen had two (2) CLENBUTEROL medication violations in 2018, however, in 2018 the Category used to determine the penalty for CLENBUTEROL medication violations for Quarter Horses in Arizona was Category B. To conform to the Uniform Classification Guidelines for Foreign Substances and Recommended Penalties Model Rule (January, 2019 (V.14.0)) this case is being referred to the Director of the Arizona Department of Gaming/Racing Division with the recommendation the fine be increased to $100,000.00 and the suspension be increased to seven (7) years. The horse, "TAMURA" shall be placed on the Veterinarian's List for 180 calendar days (retroactive to December 18, 2019, through and inclusive of June 16, 2020, and must pass a commission approved examination before becoming eligible to be entered. The fine set forth above must be satisfied within ten days from the date of this order. If it is not paid by January 17, 2020, all licenses held by the respondent are automatically suspended for one hundred and eighty (180) days beginning January 18, 2020, through and inclusive of July 16, 2020, and this matter is referred to the Director of the Arizona Department of Gaming/Racing Division with the recommendation that all licenses remain suspended until all requirements herein are satisfied.

Race 5: None Race 6: STEWARDS INQUIRY/POOR START/NO CHANGE: Following the running of the race the stewards posted the inquiry sign due to an incident at the start of the race in which sixth place finisher #8 SHE LOOKS PROUD, ridden by Ryan Barber, broke slowly and trailed the field early. After reviewing the videos and taking testimony from starter Darrin Hall and jockey Ryan Barber, the stewards determined that simultaneously as the starting gate was opening #8 SHE LOOKS PROUD reared up of her own accord as the front doors were opening, however, the starting gate of #8 SHE LOOKS PROUD opened in unison with the rest of the field and the assistant starter released the horse properly. The horse was given the opportunity of a fair start and therefore the stewards did not make any change to the original order of finish. The official order of finish is as follows: 5-6-1-4-7-8-2-3.
