14. ACTION U/S 26 OF CANTT ACT, 2006.

To note the actions taken by the CEO with the prior sanction of PCB U/s 26 of Cantonment Act, 2006.

(1) Sanction dated 18.01.2018 regarding cancellation of mutation and entry in GLR in respect of B.No. 276, Circular Road Meerut Cantt carried out by the Board vide CBR No. 480 dated 17.01.2017 in favour of Shri Deepak Kamra S/o Shri Murlidhar Kamra & Shri Anurag Bansal S/o Shri Ramesh Chand Bansal without any valid title documents/sale deed on the basis of power of attorney/ 03 wills. The legal opinion dated 29.11.2017 has also been obtained from Shri Prashant Mathur, Advocate High Court Allahabad who has opined that mutation in the name of above persons is void and mutation can not be affected in their favour in GLR.

(2) Sanction dated 31.01.2018 regarding refund of deposited amount on account of cancellation of booking by Lt. Col. V Paul (Retd) in R/o of Ashiyana Guest House for 14.02.2018 seeking allotment of 06 suites. Out of total deposit of 13650/- 10% has been deducted as cancellation charges.

(3) Sanction dated 19.01.2018 for Rs.62000/- as cost for purchase of Sweets (Laddoo) for distribution to the children of Cantt Board schools, Cantt General Hospital, Gandhi Bagh, & Cantt Board office on the occasion of Republic Day 2018.

(4) Sanction dated 28.02.2018 regarding approval of payment of GST @ 5% on purchase of uniform for poor students of Cantt Board Schools class 1st to 8th, lowest rates

have already been approved by the Board but due to clerical mistake regarding payment of GST @ 5% could not be mentioned in the agenda but already quoted by the firm.(5) Sanction dated 13.02.2018 regarding approval of payment of GST @ 5% on purchase of summer uniform for male & female employees for the year 2017-18, lowest rates have already been approved by the Board but due to clerical mistake regarding payment of GST @ 5% could not be mentioned in the agenda but already quoted by the firm.

(6) Sanction dated 09.03.2018 regarding arrangement of Tantage for Flower Show 2018 & approval of expenditure of Rs.1,40,000/- to be incurred.

(7) Sanction dated 09.03.2018 regarding arrangement of refreshment/lunch for Guests/Judges/ special invitees for Flower Show 2018 & approval of expenditure of Rs.35,000/- to be incurred.

14. Resolution:Noted and approved except item No. 14 (1).

CEO informed the Board that the issue of cancellation of mutation of B. No. 276, Circular Road, Meerut Cantt should have been referred to the GOC-in-C, CC as the Cantonment Board or the PCB have no jurisdiction to order for cancellation of mutation entry as the Board is competent to amend only Column No. 9 of the GLR, but herein this case the mutation had been carried out without valid title documents and on legal advice it is found that the mutation is void. Therefore, the matter should had been referred to the GOC-in-C, Central Command.

Vice President stated that mutation is time consuming and carried out with rigid procedure on the basis of office report CAC takes decision and Board confirms the same after one year of mutation in GLR such action of cancellation of mutation is not understood.

Shri Anil Jain, Member raised the issue of exercise of power u/s 26 of CA, 2006 by PCB and he was of the view that PCB has wrongly exercised the power in cancelling the mutation.

It is resolved by majority that the matter be referred to the CAC with office report for the review of the case.

15. CONDUCT OF REGULAR MEETINGS OF THE BOARD, CIRCULATION OF MINUTES ETC.

To note the instructions issued by the DG DE regarding conduct of regular meeting of the Board.

Board is informed that the DG DE vide letter No. 29/Business Regulation/C/DE/2012 dated 31.01.2018 has instructed that notices along with agenda for the Board meeting should be sent to the MP/MLA timely without fail.

16. REQUEST FOR INSTALLATION OF TRANSFORMER IN COMPLIANCE OF ORDER DATED 23.01.2018 PASSED BY THE HON’BLE HIGH COURT, ALLAHABAD IN WRIT NO. 918 OF 2018 TITLED AS EXECUTIVE ENGINEER EUDD-II U.P.POWER CORPORATION LTD V/S CANTONMENT BOARD MEERUT AND OTHERS.

To consider the order dated 23.01.2018 passed by the Hon’ble High Court in the subject matter.

Fact of the Case

Board is informed that UPPCL (Uttar Pradesh Power Corporation Ltd) a Stare Govt of UP department erected/installed various transformers/room/office by way of encroachment on Govt land classified as Class B-4 and “C” illegally and unauthorisedly without prior permission/approval of competent authority. The landlord of the said land is Govt. of India, Ministry of Defence under the management of Cantonment Board Meerut Cantt.

Against the said illegal encroachment on Govt. land the technical staff of Cantonment Board Meerut submitted reports in the year 2007-2008 to the Chief Executive Officer, Meerut regarding various encroachments made by the said department without prior approval of competent authority. The matter was referred to the Estate Officer, Meerut for initiate proceedings under the provisions of Public Premises (Eviction of unauthorized occupants) Act, 1971. The Estate Officer Meerut initiate following proceedings under the provisions of PPE Act, 1971 and issued notices accordingly. SR.NO.

The Estate Officer Meerut after hearing both the parties passed final order for removal of above mentioned encroachments vide order dated 24.06.2017. Against the said order of Estate Officer Meerut the Department/UPPCL approached Distt Judge Meerut and filed appeals (18 nos) before the Distt Judge Meerut u/s 9 of PP Act, 1971. The Distt Judge Meerut vide a common order dated 04.08.2017 dismissed all the appeal at the stage of admission. Against the said order the UPPCL filed a writ petition bearing No. 916 of 2018 titled as Executive Engineer EUDD-II, Power Corporation Ltd v/s Cantonment Board Meerut through CEO, Estate Officer Meerut and Union of India, Ministry of Defence through its Secretary against order dated 24.06.2017 passed in case No. 7 of 2008 as mentioned above.

The Hon’ble High Court vide order dated 23.01.2018 disposed of the writ petition giving liberty to UPPCL to file proper application for permission before the Chief Executive Officer, Cantonment Board Meerut for construction of room for the purpose of installation of transformer of electricity within a period of two weeks with direction for passing suitable order on the application within two month in accordance with law. The Court further order that order dated 22.6.2017 (wrongly mentioned as correct dated is 24.06.2017) shall be kept in abeyance till disposal of the application filed by the petitioner and shall be abided by the final order passed by the Chief Executive Officer.

In compliance of order of Hon’ble High Court dated 23.01.2018 the UPPCL/ petitioner has filed an application dated 31.01.2018 with request for regularization of encroachment as mentioned at Serial No. 07 of list above only.

This office vide letter dated 06.02.2018 informed the UPPCL that as per Hon’ble High Court order dated 23.01.2018 it has clearly stated that as per Section 10 of the Indian Telegraph Act, 1885 permission for construction of installation of electricity equipment within limit of Cantonment Board by the Chief Executive Officer is necessary. As such you are required to submit applications for installation/regularization of all transforms against which the Estate Officer has passed final order on 24.06.2017.

The said department was also directed that except of above, various transformers, rooms, office has been installed/constructed by you in the various location of Meerut Cantt without prior approval of competent authority and required to give details of the same with request to regularized as per law. As per GLR survey No. 183/735 the land in question is part of Govt. B-4 Land and the landlord is Govt. of India, Ministry of Defence under the management of Cantonment Board Meerut. As the landlord of the land in question is Govt. of India, Ministry of Defence, the matter be refer to the competent authority through PDDE for issue suitable instruction/direction in the matter in compliance of order of Hon’ble High Court Allahabad as quoted above.

Board is requested to consider and take a decision in the matter

16. Resolution:Considered and resolved that necessary proposal seeking sanction of the

competent authority be forwarded through PD DE, Central Command after calculating the amount of lease rent and premium as may be applicable as per current STR and also recommended that the competent authority should convey its decision at the earliest regarding grant of lease to the UP Power Corporation Limited as per orders of the Hon’ble High Court, Allahabad. So that the Hon’ble Court may be intimated in due course.

17. SURRENDER OF BALANCE AMOUNT OF SPECIAL GRANT OF WATER SUPPLY PROJECT.

To consider and approve surrender of unspent amount of special grant of Water Supply Project for laying of pipe lines, supply & installation of VT Pumps & Motors in Cantt area.

OFFICE REPORT

1. Board is informed that special Grant of Rs.2,19,97,362/- received vide Govt of India, Min. of Def. Directorate General of Defence Estates Delhi Cantt letter No.9/64/Danapur/1/C/DE/2014-15 dated 03.03.2015 for laying of pipe line & installation of VT Pump Motors & bore-wells for water supply in Meerut Cantt which was received in Cantt Fund on 28.03.2015.

2. After completion/ approval of tender proceedings, the work of laying of pipe lines, supply & installation of VT Pumps & Motors in Cantt area was started in 2016-17 and finally completed on 30.06.2017 for which final payment was made on 15.01.2018 for Rs.2,02,78,017/-.

3. Further, JE ( E/M) vide report dt 25.01.18 has reported that an amount of Rs.14,77,353/- has also been incurred on a/c of new Electric Connections for 03 VT Pumps taken from UP Power Corpn Ltd. which may also be booked under Water Supply Project Grant.

4. Board is also informed that in r Annexure 1 in Cantt Account Code 1924, decision of the Ministry of Defence is quoted. The Ministry of Def. has vide letter No. 601//43/C/L&C/83 dt 23.01.1985 has decided that Cantt Boards will refund the unspent balance of Special Grant-in-Aid sanctioned to them for execution of project on completion of project provided that:-(i) The contractual obligations have been completed and work order placed

on the contractor.(ii) In case, the work has been sanctioned to be undertaken departmentally, if

the material required for the project has been purchased / order placed /payment made there from.

(iii) In case of purchase of Stores, eg Vehicles/X-Ray, Plants , furniture and such other items, if tenders/quotations have been accepted and supply order placed but the stores are likely to be delivered after the close of the financial year: and

(iv) In case the work is to be executed by another agency of the Central/State Govt or Public Sector undertaking , if the amount/ part amount has been deposited with that authority.

5. On the report of JE ( E/M), the then CEO has viewed that it appear that the expenditure was not included in the original cost, though, it was essential, this may be referred to Board.

6. In view of the above, Board may approve expenditure on electrification of 03 new Pumps of Rs.14,77,353/- out of unspent Grant of Rs.17,19,345/- and Balance amount of Rs.2,41,992/- may be refunded to CDA ( Army) Meerut through MRO after approval of the Board before end of this Financial year.

17. Resolution:Considered and authorized CEO to look into the case afresh and check whether

the amount can be utilized as per the terms & conditions and if not then to surrender it.

18. SANCTION OF REVISION OF RATE OF DA FROM 4% TO 5% W.E.F.01.07.2017 ON BASIC PAY IN R/O EMPLOYEES OF CANTT BOARD MEERUT.

Reference: Directorate DE HQ CC sanction letter No. 9334//UP/DA/LCP/44 dt 05.01.2018.

To consider & note the sanction for revision of rate of Dearness Allowance from 4% to 5% on Basic pay w.e.f. 01.07.2017 to CB Employees accorded vide Directorate DE CC letter referred above.

OFFICE REPORT:

1. Board is informed that proposal seeking sanction for grant of revised DA 4% to 5% on Basic pay w.e.f. 01.07.2017 to the employees of Cantt Board Meerut at par with employees of UP Govt as per UP Govt GO NO.09/2017/Ve-Aa-1-790/Das-2017-8(M)/2016 dt 12.12.2017 was forwarded to the Directorate DE vide this office letter No.MCB/10020/2017-18/Acctt/Payment/470 dt 15.12.2017 under authority of Cantt Board Resolution No.668 dated 26.08.2002.

2. The sanction of the competent authority under FR 44 read with Rule 19 (b) of Cantt Account Code 1924 to incur the expenditure on a/c of payment of revision of DA from 4% to 5% (01%) w.e.f. from 01.07.2017 in r/o of Cantt Board employees has been received vide Directorate DE HQ CC letter under reference.

3. The Directorate DE vide para 4 of letter under reference has directed to all CEOs to first place the matter before the Cantt Board with the recommendation to pay the enhanced rate of DA to employees and only after obtaining approval of the Cantt Board, the amount be paid to the employees with the advice to forward a copy of CBR to the Directorate within month.

4. Board is informed that there is financial implication on a/c revision of rate of DA is Rs.1,86,731/- per month w.e.f.01.07.2017. Thus, total Arrear for the period July 2017 to Feb 2018 (08 Months) worked out to Rs.14,93,848/-.

Budget provision in the respective heads of Establishment exists in BE 2017-18 (R) sanctioned by the GOC-in-C,CC . Relevant file is placed on the table.

19. SANCTION OF REVISION OF RATE OF DEARNESS RELIEF ( DR) FROM 4% TO 5% W.E.F.01.07.2017 ON BASIC PENSION IN R/O PENSIONERS OF CANTT BOARD MEERUT.

Reference : Directorate DE HQ CC sanction letter No. 49260/UP/DR/PENS/LCP dt 05.01.2018.

To consider & note the sanction for revision of rate of Dearness Relief from 4% to 5% on Basic Pension w.e.f. 01.07.2017 to CB Pensioners accorded vide Directorate DE CC letter referred above.

OFFICE REPORT:

1. Board is informed that proposal seeking sanction for grant of revised DR 4% to 5% on Basic pension w.e.f. 01.07.2017 to the Pensioners of Cantt Board Meerut at

par with Pensioners of UP Govt as per UP Govt GO NO.37/2017-G-3/774/X-2017-301/2000 TC dt 14.12.2017 was forwarded to the Directorate DE vide this office letter No.641/A/Revision of D.R./494 dt 27.12.2017 under authority of Cantt Board Resolution No.668 dated 26.08.2002.

2. The sanction of the competent authority under FR 44 read with Rule 19 (b) of Cantt Account Code 1924 to incur the expenditure on a/c of payment of revision of DR from from 4% to 5% (01%) w.e.f. from 01.07.2017 in r/o of Cantt Board Pensioners has been received vide Directorate DE HQ CC letter under reference.

3. The Directorate DE vide para 4 of letter under reference has directed to all CEOs to first place the matter before the Cantt Board with the recommendation to pay the enhanced rate of DR to Pensioners and only after obtaining approval of the Cantt Board, the amount be paid to the employees with the advice to forward a copy of CBR to the Directorate within month.

4. Board is informed that there is financial implication on a/c revision of rate of DR is Rs.72,846/- per month w.e.f.01.07.2017. Thus, total Arrear for the period July 2017 to Feb 2018 (08 Months) worked out to Rs.5,82,768/-.

Budget provision in the respective head of Pension `I’ exists in BE 2017-18 (R) sanctioned by the GOC-in-C,CC . Relevant file is placed on the table.


19. Resolution:Noted and approved.

20. SHOW TAX: SUBMISSION AND OBJECTIONS FILED BY CINEMA OWNERS AGAINST THE INCREASED SHOW TAX FROM Rs. 20/- PER SHOW TO 100/- PER SHOW.

Reference : CBR No. 233 dated 10-06-2016.

It is intimated that the Board vide CBR No. 41 dated 16-09-2015 had revised rates of show tax from 20/- per show to 100/- per show. No cinema owner has been paying show tax since then i.e. 16-09-2015.

Board is informed that the joint submission/objection dated 21-09-2015 of cinema owners of Nishat, Golcha and Regal Cinemas against the revised rates of show tax of Rs. 100/- per show describing therein their financial difficulties to pay the revised show tax had been rejected vide CBR under reference. Hence, a demand letter dated 17-08-2016 to pay show tax @ 100/- per show was sent to Nishat, Golcha and Regal Cinemas. Instead of depositing tax , Cinema owners has further filed a joint letter dated 26-08-2016 describing therein that CBR No. 233 dated 10-06-2016 is against the provision of law as per clause (2) of ARTICLE 276.

In reply to the above letter, a letter No. Tax/Show tax/974 dated 24-04-2017 was served upon all the three cinema owners/occupiers describing therein show tax being levied under section 295 of the Cantonments Act 2006 can not be considered as infringing constitutional provisions, as quoted by them in their letter. There was no response from the cinema owners.

A letter dated 18-02-2017 was further served upon the cinema owners even tax staff has individually contacted with the Cinema owners/occupier many times to recover the show tax but according to cinema owners the rate is 20/- per show in City Area of Meerut and cinemas are facing from poor economic condition. Hence, they are not able

to pay Rs. 100/- per show rate. There is no recovery on account of show tax since 16-09-2015 i.e from the date of revision of rates of show tax. A letter dated 21-11-2017 by Nishat Cinema and Golcha Cinema has been sent to this office requesting therein that show tax may be charged at the rate of 20/- per show.

Completer file alongwith the letters is placed on the table.

Matter is put up before the Board to consider joint letter dated 26-08-2016 and letters dated 21-11-20107 filed by the cinema owners.

20. Resolution:Considered and resolved that the show tax be fixed at par of the adjoining

Municipal Corporation in view of the provisions under clause (2) of Article 276 of Constitution of India read with section 295 of Cantonments Act, 2006 and recovery of arrears be made accordingly and in future also at the same rate bill of show tax be generated.

21. LONG OUTSTANDING FEES BILLS OF PANEL ADVOCATES.

Board is informed that Sri Rajiv Singhal vide letters dated 08-04-2012, 23-11-2015, 11-03-2016, 14-02-2017 and 03-07-2017 has requested for payment of Rs. 3,12,000.00 for 29 bills which were raised for consulting and drafting of replies to objections in house tax matters. The PD DE and DG DE vide letter dated 16-10-17 and 14-11-2017 respectively have asked that details of representation be checked and report be furnished to Dte General.

Office Note: It is submitted that Sri Rajiv Singhal, Advocate was engaged by this office 01-11-2008 to aid and advise the then CEO in drafting of reasoned order for house tax matters in various properties for finalization of assessment for the triennial year 2008-11 under which payment @ 10500.00/- per case was approved by the Board vide CBr No. 181(i) dated 24-06-2009 and due payment had been made to Sri Rajiv Singhal Advocate at that time. Many schools/properties’ cases being under litigation were not paying house tax because their ARV was fixed without basis and a reasoned order and Competent Court had directed the Cantt Board to decide these with a reasoned order. Honble Supreme Court’s order dated 06-08-2008 in SLP No. 73 of 2003 was also passed in this regard. The Cantt Board Office is being benefited on the basis of these draft reasoned order as taxes from many schools and similar other properties are being collected regularly. During the next triennial assessment for the period 20011-14 and in some other cases consulted the adviocate the then CEOs consulted and perused drafting of reasoned order given by Sri Rajiv Singal Advocate for finalization of triennial assessment but no approval was taken from the Board due to which the bills of Sri Rajiv Singhal Adovocate which are on the record even being duly verified by the then Tax Supdt and considered by the then CEO are pending since then.

The complete file alongwith representation of Sri Rajiv Singhal is placed on the table.

The matter is put up before the Board for necessary consideration regarding payment of the pending bills of the advocate so that action taken report can be sent to the higher authorities.

The technical staff of this office vide report dated 03.06.2017 has reported that the said new unauthorized constructions has been carried out by Shri HariBhagwanKansal S/o Shri Bhagwat Prasad Kansal in part of Bungalow No. 311, Hill Street, Meerut Cantt. The site is situated outside civil area under the management of DEO, Meerut Circle, Meerut. The land is classified as B-3 comprising under survey no. 288 part.

A show cause notice as well as notice to stop the unauthorized construction bearing no. MCB/BLDG/ENGG/288/2376 dated 27.09.2017 & No. MCB/BLDG/ENGG/311/2377 dated 27.09.2017 were issued and served to the offender on 17.10.2017 directing him to stop construction forthwith. The offender has not been submitted reply of the show cause notice.

The offender has raised new unauthorized construction without prior permission of the competent authority.

In view of the above it is recommended that the notice u/s 248 of CA, 2006 be issued to the owner/occupier requiring him to demolish and remove the unauthorized construction within 30 days from the receipt of the notice.



25. Resolution:Considered and resolved that notice u/s 248 of CA, 2006 be issued to the offender

requiring him to demolish and remove the unauthorised constructions mentioned on the agenda side within 30 days from the receipt of the notice.

Further resolved that the unauthorised constructions already carried out and which are compoundable should be compounded so that the general public may get some relief. It is further resolved that as a policy in case of residential property the composition fee be charged @ 5% of the cost of construction worked out as per MES SSR and in case of commercial construction the composition fee be charged @ 10% of the cost of construction worked out as per MES SSR.

Board further resolved that in case of re-erection of roof or boundary wall notice u/s 248 should not be issued till CEO inspects those properties to ascertain whether it is a case of unauthorised construction or simple repair, if the CEO finds during his inspection that there are unauthorised constructions notice u/s 248 of CA, 2006 be issued.

The offender submitted reply

A show cause notice as well as notice to stop the unauthorized construction bearing no. MCB/BLDG/ENGG/221/2370 dated 27.09.2017 & No. MCB/BLDG/ENGG/221/2371 dated 27.09.2017 were issued and served to the offender on 09.10.2017 directing him to stop construction forthwith. The offender submitted reply dated 12.10.2017 stating therein that offender has not raised any unauthorized construction or re-erection. He has made only repairs which does not needs any permission under the policy No. 11013/1187/D (Land) Vol. II dated 09.02.1995, hence, the notice issued by this office is illegal and baseless which is not admitted.

MCB/BLDG/ENGG/E7A/2542 dated 31.10.2017 & No. MCB/BLDG/ENGG/199/2548 dated 31.10.2017 were issued and served to the offender on 31.10.2017 directing him to appear of the competent authority on 07.11.2017 at 1600 hours for his support of his claim. But, Shri Saraju failed to appear before the CEO/Competent Authority on the above date and time to prove his case. The CEO/Competent Authority passed order in the matter accordingly.

Show cause notice as well as notice to stop the unauthorized construction bearing no. Board is informed that Shri Naresh Kumar filed a Civil Suit bearing No. 72 of 2018 titled as M/s Mahadev Associates through partner Shri Naresh Kumar V/s Cantt Board Meerut before the court of Civil Judge (SD), Meerut with prayer that Cantonment Board Meerut be restrained for demolition of construction in question. This office has prepared the parawise comment of plaint with relevant documents and the same case will be contested by this office before the Hon’ble Court forcefully.

In this regard Board is informed that the Hon’ble High Court, Allahabad vide order dated 29.01.2014 in contempt application (Civil) No. 380 of 2001 and common order dated 01.03.2016 in special appeal by the Hon’ble High Court, Allahabad has passed that all the sale deeds in favour of third parties are cancelled and whatever construction has been raised by the third parties without getting any map sanctioned from the Cantt Board has no right to raise any construction over and above the property in question.

74. VIOLATION OF OLD GRANT TERMS IN B.No. 173, ABU LANE MEERUT CANTT.

Reference: Circular Agenda No. 13 dated 06.02.2018.

To consider issue resumption of B. No. 173 and quarters No. 173/1 to 173/10 and 173-A/1, Abu Lane, Meerut Cantt on account of violation of old grant terms under GGO No. 179 dated 12.09.1836.

Board is informed that B. No. 173 and quarters No. 173/1 to 173/10 and 173-A/1, Abu Lane Meerut Cantt comprises Sy.No. 357/1751 held on old grant terms recorded in the name of Shri Jyoti Prasad Jain S/o Murari Lal admeasuring 3.015 acres description of the premises given in GLR is bungalow.

The Govt. of India Min. of Defence had ordered for resumption of the vacant land admeasuring 52000 Sq.Ft. out of total land recorded in GLR vide Govt. of India, Min. of Defence sanction letter No. 1/12/L/L&C/68/9549/D(Lands) dated 15.10.1968. The HOR Shri Jyoti Prasad had filed court proceedings in the form of CWP No. 919 of 1979 Shri Jyoti Prasad Jain V/s UOI & others. In the year 1996 possession of the property was taken over by the DEO Meerut Circle in pursuance of the Judgment of the Hon’ble Supreme Court and handed over the same to the Cantt Board being situated inside civil area.

The Cantt Board Meerut is maintaining a open Vivah Mandap as a facility to the poor inhabitants of the Cantonment on nominal charges but the unauthorized occupants have tried to stop the public facility and filed a civil suit in the Court of Civil Judge Meerut against which 1st Appeal No. 335 pf 2014 Cantt Board Meerut V/s Dinesh Kumar Jain is

pending in the Hon’ble Court Allahabad since 2014 regarding the passage to the above mentioned resumed land.

It is noticed that from time to time the old grant land of the residential bungalow aforementioned is being misused and land sharks have eye over the land for commercial exploitation at the cost of public exchequers as one Shri Ravi Maheshwari has raised illegal unauthorized constructions of shops on the open land in the compound of the said bungalow along the road side. Necessary legal proceedings under section 248 of Cantt Act, 2006 were initiated against him, directing him to demolish the unauthorized constructions the said action of the Board was challenged by him in the Hon’ble High Court Allahabad by way of CMWP No. 19025 of 2012 Smt. Sarita Mahewhari V/s Cantt Board & others. The Hon’ble High Court vide order dated 07.12.2016 directed that pending appeals be disposed off expeditiously by the appellate authority and the parties shall be maintain status quo on spot as on date. The appellate authority disposed off the appeal vide order dated 05.07.2017.

Shri Ravi Maheshwari filed another writ petitions bearing No. 232724 of 2017 and 33853 of 2017 Ravi Maheshwari V/s Cantt Board & others the Hon’ble High Court vide order dated 28.07.2017 have directed to maintain status quo. But in violation of said order the construction has been completed and regular shops have been opened.

Again on the vacant land 04 new shops have been constructed recently measuring 14’-10”x40’-10” (approximately) each as per field staff’s report dated 08.12.2017, though necessary order u/s 239 of Cantts Act, 2006 to stop the unauthorized constructions has been issued to Shri Tarun Prakash S/o Shri Ram Prakash on 23.01.2018 and also to demolish the unauthorized construction on 24.01.2018.

Since, the old grant vacant land of the Govt. of India is being misused by the unauthorized persons/builder mafias as neither Shri Ravi Maheshwari or Shri Tarun Prakash above mentioned are recorded HORs or legal and authorized occupants after the death of Shri Joti Prasad and there is no effective machinery is available with the Cantt Board to prevent commercial exploitation therefore, the Govt. of India be requested to convey sanction of the President of India to the resumption of the remaining land of B.No. 173 and quarters No. 173/1 to 173/10 and 173-A/1, comprising Sy.No. 357/1751 in the public interest with sanction to reclassification of the land so resumed from class B-3 to ‘C’.

Note: Board is informed that the circular agenda under reference had been circulated vide this office letter No. 167/G/237 dated 06.02.2018 being urgent under clause 41 of Business Regulation for opinion/approval of the Members of the Board the following members have approved that circular agenda:

The Vice president and the elected members neither signed for approval nor non approval except Shri Vipin Sodhi Member who has attached a note dated 20.02.2018 placed on the table. Subsequently, the members were again requested vide letter No. Misc/G/355 dated 27.02.2018 requesting to approve or disapprove the agenda point to all the elected member except Shri Vipin Sodhi but none of the member accepted the letter the report of the peon dated 20.02.2018 and 28.02.2018 are also put up on the table.

Board is requested to consider and decide.

74. Resolution:Considered as the old grant land under Sy No. 357/1751 is being misused by the

builders and unauthorised persons for commercial exploitation and unauthorised constructions of shop have taken place on the vacant land of the bungalow. Hence, it is resolved that necessary proposal be forwarded to the Central Govt through GOC-in-C, Central Command for resumption of entire remaining land of B. No. 173 and Qtrs No. 173/1 to 173/10 and 173-A/1 comprising Sy. No. 357/1751 admeasuring 3.015 acres (52000 sq ft has already been resumed) and after resumption the land be reclassified

from B-3 to C and vested in the Cantonment Board Meerut for the use of public welfare purposes.

Further it is resolved that as unauthorized construction is carried out violating the status quo order of the Hon’ble High Court, contempt proceedings be initiated against the defaulters.

The landlord of the said land is Cantt Board/ Govt. of India, Ministry of Defence under the management of Cantonment Board Meerut Cantt.

Against the said illegal encroachment on Govt. land the technical staff of Cantonment Board Meerut submitted reports in the year 2007-2008 to the Chief Executive Officer, Meerut regarding various encroachments made by the said department without prior approval of competent authority. The matter was referred to the Estate Officer, Meerut for initiate proceedings under the provisions of Public Premises (Eviction of unauthorized occupants) Act, 1971. The Estate Officer Meerut after hearing both the parties passed final order for removal of above mentioned encroachments vide order dated 24.06.2017. Against the said order of Estate Officer Meerut the Department/UPPCL approached Distt Judge Meerut and filed appeals (18 nos) before the Distt Judge Meerut u/s 9 of PP Act, 1971. The Distt Judge Meerut vide a common order dated 04.08.2017 dismissed all the appeal at the stage of admission.

Against the said order the UPPCL filed 17 nos of writ petitions bearing No. 9280/18, 9276/18, 9285/18, 9317/18, 9320/18,9282/18, 9303/18, 9311/18, 9318/18, 9306/18, 9285/18, 9291/18, 9326/18, 9322/18, 9146/18, 9152/18 & 9328/18 all titled as Executive Engineer EUDD-II, Power Corporation Ltd v/s Cantonment Board Meerut through CEO, Estate Officer Meerut and Union of India, Ministry of Defence through its Secretary against order dated 24.06.2017 passed in above mentioned cases. (total 17 numbers)

The Hon’ble High Court vide order dated 13.03.2018 disposed of the writ petition giving liberty to UPPCL to file proper application for permission before the Chief Executive Officer, Cantonment Board Meerut for construction of room for the purpose of installation of transformer of electricity within a period of two weeks with direction for passing suitable order on the application within two month in accordance with law. The Court further order that order dated 24.6.2017 shall be kept in abeyance till disposal of the application filed by the petitioner and shall be abided by the final order passed by the Chief Executive Officer.

This office vide letter dated 06.02.2018 informed the UPPCL that as per Hon’ble High Court order dated 23.01.2018 it has has clearly stated that as per Section 10 of the Indian Telegraph Act, 1885 permission for construction of installation of electricity equipment within limit of Cantonment Board by the Chief Executive Officer is necessary. As such you are required to submit applications for installation/regularization of all transforms against which the Estate Officer has passed final order on 24.06.2017. The said department was also directed that except of above, various transformers, rooms, office has been installed/constructed by you in the various location of Meerut Cantt without prior approval of competent authority and required to to give details of the same with request to regularized as per law.

The UPPCL/ petitioner has filed an application dated 19.02.2018 with request for regularization of encroachment as made by them on Govt Land in all cases.

As per GLR’s the land in question is part of Govt. B-4 & Class “C” Land and the landlord is Cantonment Board/ Govt. of India, Ministry of Defence under the management of Cantonment Board Meerut. As the landlord of the land in question is Cantonment Board/ Govt. of India, Ministry of Defence, the matter be refer to the competent authority through PDDE for issue suitable instruction/direction in the matter in compliance of order of Hon’ble High Court Allahabad as quoted above.



77. Resolution:Considered and resolved that necessary proposal seeking sanction of the

competent authority be forwarded through PD DE, Central Command after calculating the amount of lease rent and premium as may be applicable as per current STR and also recommended that the competent authority should convey its decision at the earliest regarding grant of lease to the UP Power Corporation Limited as per orders of the Hon’ble High Court, Allahabad. 78. REQUEST FOR INSTALLATION OF TRANSFORMER IN COMPLIANCE OF ORDER DATED 23.01.2018 & 13.03.2018 PASSED BY THE HON’BLE HIGH COURT, ALLAHABAD IN VARIOUS WRIT PETITIONES ALL TITLED AS EXECUTIVE ENGINEER EUDD-II U.P.POWER CORPORATION LTD V/S CANTONMENT BOARD MEERUT AND OTHERS.

To consider the order dated 23.01.2018 & 13.03.2018 passed by the Hon’ble High Court in the subject matter & application dated 19.02.2018 by Executive Engineer, PVVNL, University Road, Meerut City.

Fact of the Case

Board is informed that UPPCL (Uttar Pradesh Power Corporation Ltd) a Stare Govt of UP department erected/installed transformers/rooms/office towards property No. 297, Abu Lane Meerut Cantt, by way of encroachment on Govt land classified as Class B-4 part of survey No. 357/1703 illegally and unauthorisedly without prior permission/approval of competent authority. The landlord of the said land is Govt. of India, Ministry of Defence under the management of Cantonment Board Meerut Cantt.

Against the said illegal encroachment on Govt. land the technical staff of Cantonment Board Meerut submitted report on 01.08.2017 regarding encroachments made by the said department without prior approval of competent authority at ground floor and first floor by way of constructing hall, rooms, toilets, verandah, shed and installation of transformers etc on Govt. B-4 Land. The matter was referred to the Estate Officer, Meerut for initiate proceedings under the provisions of Public Premises (Eviction of unauthorized occupants) Act, 1971. The Estate Officer Meerut initiate following proceedings under the provisions of PPE Act, 1971 and issued notices accordingly.

The Estate officer after hearing both the parties passed final order for removal of said encroachment on 17.11.2017. The same was not complied with by the said department.

Against the other orders dated 24.06.2017 passed by the Estate Officer in others similar matters the UPPCL filed 18 nos of writ petitions before the Hon’ble High Court Allahabad. The Hon’ble High Court vide order dated 23.01.2018 and 13.03.2018 disposed of all writ petition giving liberty to UPPCL to file proper application for permission before the Chief Executive Officer, Cantonment Board Meerut for construction of room for the purpose of installation of transformer of electricity within a period of two weeks with direction for passing suitable order on the application within two month in accordance with law. The Court further order that order dated 24.6.2017 shall be kept in abeyance till disposal of the application filed by the petitioner and shall be abided by the final order passed by the Chief Executive Officer.

This office vide letter dated 06.02.2018 informed the UPPCL that as per Hon’ble High Court order dated 23.01.2018 it has has clearly stated that as per Section 10 of the Indian Telegraph Act, 1885 permission for construction of installation of electricity equipment within limit of Cantonment Board by the Chief Executive Officer is necessary. As such you are required to submit applications for installation/regularization of all transforms against which the Estate Officer has passed final order on 24.06.2017. The said department was also directed that except of above, various transformers, rooms, office has been installed/constructed by you in the various location of Meerut Cantt without prior approval of competent authority and required to to give details of the same with request to regularized as per law.

To consider and approve the payment of total Arrear of Rs.6,05,46,864/- on a/c of revision of Pay as per 7th Pay Commission Report in r/o employees of Cantt Board Meerut in accordance with UP Govt GOs dated 22.12.2016 & 22.12.2017, out of which Rs.2,97,93,804/- is to be paid in 2017-18 as per subject GOs & including arrear of Rs.8,30,022/- of 08 employees of time scale/ACP as per sanctions received in 2017.OFFICE REPORT 1. Board is informed that sanction for revision of Pay Scales in r/of Cantt Board’s employee as per 7th Pay Commission Report as adopted by the UP Govt for its employees as per UP Govt GO No. 67/2016/Ve-Aa-2-147/Das-04(M)/2016 dt 22.12.2016 w.e.f. 01.01.2016, duly approved by the Board vide CBR No.392 dt 17.01.2017, has been accorded by the GOC-in-C,CC & conveyed by Dte DE CC vide letter referred above in r/o of all eligible employees of Cantt Boards located in UP as per UP. Pay fixation of 582 entitled employees of Cantt Board Meerut as per Pay matrix has been done as per DO Part II order No.136 dt 21.09.2017 & requisite option and undertaking from each employee/ pensioner was sought as UP Govt GO & condition mentioned in sanction of the GOC-in-C,CC referred above. OFFICE REPORT 1. Board is informed that the DG DE (Govt of India Min. of Def) vide letter No.25/51/

C/DE/MISC/98 dt 24.07.2017 has viewed that as per Rule 31 of CFSR 1937, the provisions of the CCS(Pension) Rules, 1972 as amended from time to time mutatis mutandis govern the grant of Pension, family pension and death cum retirement gratuity to eligible permanent Cantonment fund servants. Therefore, the DOPT & PW OM No. F No.38/37/2016-P & PW (A) dated 6th July, 2017 in respect of revision of pension of pre-2016 pensioners/family pensioners with effect from 01-01-2016, is also applicable to pre-2016 pensioners/family pensioners of Cantonment Boards. The said directions of the DG DE have been received in this officer vide Directorate DE CC letter No.82562/Pension/ GEN/LCP/714 dt 26.07.2017.

2. Based on above decisions of the Govt and directions of the DG DE & PD DE, the pension/ family pension of the entitled 489 Pre 2016 pensioners/ family pensioners has been fixed in terms of Govt of India, DOPT OM No.38/37/2016-P & PW (A) (II) dt 04.08.2016 vide DO Part II Order No.137 dt 21.09.2017 and revised pension/family pension is being paid from the month of Sept 2017.

3. Further, pension of 77 Post- 2016 retired/expired employees has also been revised as per their last pay revised as per 7th Pay Commission Report sanctioned vide GOC-in-Chief HQ Central Command Lucknow contained in letter No.260506/REV PAY SCALE/ PAY MATRIX 7th CPC/MRT/Q3L2 dt 10.08.2017 & Pension was revised as per Part II Order No.178 dt 29.11.2017.

4. Now, arrears of pension/family pension of all 566 pensioners ( pre 2016 & post 2016) have been worked out after preparing arrear sheet in r/o each and every pensioner/family pensioner w.e.f. 01.01.2016 which comes to Rs.2,60,69,628/-

5. Board may consider and approve the Payment of total Arrear of Rs Rs.2,60,69,628/- in 2017-18. However, payment on a/c of arrears will be released depending upon availability of funds to be received on a/c of Grant/Service Charge/ pending payment of Mily consy for 2017-18.

3. As per memorandum of Settlement, Cantt Board employees are entitled for the pay and allowances at par with State Govt. employees. Therefore, pay and allowances of Cantt Board employees have been revised w.e.f. 01,01,2006 at par U.P. Govt employees by the GOC-in-C, CC vide letter No.PC-34238/UK/Pay Rev-06/LC-06 dated 19.08.2009.

4. Since, the state Govt has revised the system of time scale by introducing ACP scheme in the revised structure to its employees vide GO referred above, the employees of Cantt Board are also entitled to get 03 ACP in place of time scale w.e.f. 01.12.2008 on date of completion of 10,16 or 26 years service.5.The sanctioning authority for grant of ACP is the GOC-in-C, Central Command, Lucknow under Rule 47 read with rule 19(b) of Cantt Account Code 1924.

5. It is recommended that proposal seeking sanction for grant of ACP to the above entitled Cantt Board employees w.e.f. 01.12.2008 on date of completion of 10,16 and 26 years service under Rule 7 read with Rule 19(b) of Cantt Account code, 1924 may be forwarded to the HQ CC, Lucknow.

sanction for grant of conveyance allowance to blind & orthopeadically handicapped 07 employees of Cantt Board Meerut in terms of UP Govt GO No.137//65-1-2008-380/96 dt 12.05.2008 & DG DE letter No.PC-25/CC/C/DE/2010 dt 19.07.2011 @ Rs.300/-, Rs.400/-& Rs.500/- per month as per pay scales.

2. Shri Sandeep S/O Shri Naresh, S/W C.No.6A vide application dt 17.08.2017 has informed that due to an accident he became physically handicapped. He has submitted certificate issued by CMO Meerut dt 26.07.2017.

3. Based on facts given in para 1 & 2 above, Shri Sandeep S/O Shri Naresh S/W is entitled to get Rs.300/- per month as Conveyance allowance applicable to Blind/ Orthopedically handicapped employees w.e.f. 17.08.2017.

4. It is recommended that proposal seeking sanction for grant of Conveyance allowance @ Rs.300/- per month to Shri Sandeep S/O Shri Naresh S/W w.e.f. 17.08.2017 as per UP Govt GO No.137/65-1-2008-380/96 dt 12.05.2008 under Rule 47 read with Rule 19 (b) of Cantt Account code, 1924 be forwarded to the HQ CC, Lucknow.

83. IMPROVEMENT OF COMMUNICATION CONNECTIVITY BY MOBILE TOWER/ ATENNAS IN MEERUT CANTT.

To consider the issue of tenders of Cell Tower on Wheels in Meerut Cantt.

Board is informed that in terms of policy issued vide MoD letter No. 11026/1/2005/D (Lands) dated 16.05.2016 e-tender were invited by the office which are to be opened on 27.03.2018. Meanwhile, the Govt of India, Ministry of Defence has issued revised policy vide letter No. 11026/1/2005/D(Lands) dated 28.02.2018 as circulated by DG DE, Delhi Cantt vide letter no. 751/4/L/DE/POL/06 dated 06.03.2018 superseding the previous policies.

In view of the above Board may note the revised policy. It is further stated that Board has to decide whether e-tender floated earlier which are to be opened on 27.03.2018 would be considered or not, as under the new revised policy issued vide letter No. 11026/1/2005/D(Lands) dated 28.02.2018 all previous policies have been cancelled.

92. Resolution:Considered and resolved that NOC for improvement of road side works of

interlocking tiles in Lal Kurti Ghosi Mohalla comprising C class land Sy No. 460 as sought by the RES to carry out those works out of the MLA funds recommended by Shri Satya Prakash Aggarwal, Hon’ble MLA, Meerut Cantt is approved.

Further resolved that concerned authority of RES be also informed that Kaseru Khera area mentioned at Sr. No. 2 in the letter is not within the jurisdiction of Cantt Board for that site they should contact Municipal Corporation, Meerut.

94. AUCTION OF UNSERVICEABLE STORES

To consider for auction of unserviceable stores on the charge of Cantt. Board lying in Central Stores as well as Hospital/CAB Inter College/Primary Schools and other units.

Board is informed that huge unserviceable stores is lying in Central Stores and other branches for the last more than 04 years, which has resulted into shortage of space for keeping regular store items.

Board may consider for auction of all unserviceable stores which has already been condemned by the Condemnation Boards formed from time to time. Similarly, the old stock of material lying in store for last many years which is not in use these days may also auctioned and removed from the stock ledgers. A detailed list of such items is put up on the table.

Board may consider and take suitable decision in the matter.

95. Resolution:Considered and approved subject to following modification to the

recommendations of the committee:(i) The monthly retainer fee be fixed at Rs. 15000/- per month w.e.f. 01.06.2018.(ii) Fee for each case be paid @ Rs. 5000/- and Rs. 2500/- be paid while handing

over the case to the Advocate and Rs. 2500/- on receipt of final judgement.(iii) The engagement of the Advocates will be provisional and reviewed after six

months.(iv) Roster be maintained to give the cases on rotational basis. This will also help

96. SANCTION OF REVISION OF RATE OF DA FROM 05% TO 07% W.E.F 01.01.2018 ON BASIC PAY IN R/O EMPLOYEES OF CANTT BOARD MEERUT.

OFFICE REPORT :

1. Board is informed that proposal seeking sanction for grant of revised DA @ 07% w.e.f 01.01.2018 to the employees of Cantt Board Meerut employees as per UP Govt. GO No. 4/2018/ Ve-Aa-1-361/Das-2018-8(M)/2016 dated 18.04.2018 was forwarded to the Directorate DE vide this office letter No. MCB/10020/2018-19/Acctt/Payment/112 dated 21.04.2018 under authority of Cantt Board Resolution No. 668 dated 26.08.2002.

2. The sanction of the competent authority under FR 44 read with Rule 19 (b) of Cantt Account Code, 1924 to incur the expenditure on a/c of payment of revision of DA from 05% to 07% (02%) w.e.f 01.01.2018 in r/o of Cantt Board employees has been received vide Directorate DE HQ CC letter No. 9334/UP/DA/LCP/ dated 26.04.2018.

3. The Directorate DE vide para 4 of letter under reference has directed to all CEOs to first place the matter before the Cantt Board with the recommendation to pay the enhanced rate of DA to employees and only after obtaining approval of the Cantt Board, the amount be paid to the employees with the advice to forward a copy of CBR to the Directorate within month.

4. Board in informed that there is financial implication on a/c revision of rate of DA is Rs. 3,68,516/- per month w.e.f. 01.06.2018. Thus, total arrear for the period January, 2018 to April, 2018 (4 months) is 14,74,064/-.

Budget provision in the respective heads of Establishment exists in BE 2018-2019 (O) sanctioned by the GOC-in-Chief, CC.

Similarly, the Board vide CBR No.530 dated 05.06.2017 has approved temporary engagement of Joy K Singh, Male Staff Nurse for a period one year on the above honorarium and the period of engagement expired on 30.04.2018.

The RMO has stated that in the exigency of the services of Cantonment General Hospital the above staff are required for smooth function of the Hospital and sought for extension of their engagements.

Vice President stated that Cantt General Hospital is a white elephant for Cantt Board being only a liability and it is not serving the poor patients while it is located in the centre of the city at a prime location having vast area and good constructed building, but most poor in service. Special attention is required on the hospital and for its improvement separate hospital committee meeting be convened exclusively to discuss the issues of the hospital. She further stated that Public Private Partnership modal should be adopted to bring specialties in the hospital on the pattern of medical college.

PCB stated that strict supervision is required on the hospital as its performance is very poor. He directed that the MO I/c should personally visit the hospital frequently and submit his suggestions for discussion after consulting the SEMO.

101 ORDER DATED 22.12.2017 PASSED BY THE HON’BLE HIGH COURT, ALLAHABAD IN CIVIL MISC. WRIT PETITION NO. 61673 OF 2017 ANUJ SINGH V/S CANTONMENT BOARD OTHERS.

To note the DO part II order No. 50 dated 6.02.2018 passed by the then CEO in compliance of order dated 22.12.2017 passed by the Hon’ble High Court, Allahabad in Civil Misc. Writ Petition No.61673 of 2017, Anuj Singh V/s Cantonment Board, Meerut and others.

Board is informed that Shri Anuj Singh CEE has filed a Civil Misc. Writ petition No. 61673 of 2017 Anuj Singh V/s Cantonment Board, Meerut and others in the Hon’ble High Court, Allahabad against his deemed suspension. Information was received from the Counsel of the Cantonment Board, at Allahabad in this regard who was properly briefed about the facts of the case. The Court after hearing both the sides passed an order dated 22.12.2017 staying the suspension of the petitioner.

In this regard it is also informed that legal opinion from Shri Prshant Mathur, Advocate Allahabad had been sought who vide his opinion dated 20.02.2018 received on e-mail has informed that the Hon’ble High Court has confirmed the above mentioned order dated 12.02.2018 by extending the order till further orders. The members were informed about the facts vide circular note No. 167/G/320 dated 26.02.2018 and DO part II order No. 50 dated 26.02.2018 was issued to re-instate the individual.

Board is also informed that necessary counter affidavit in the above mentioned writ petition has been filed in the Hon’ble High Court with stay vacation application.

Board is further informed that necessary legal opinion to file SLP in the Hon’ble Supreme Court challenging the order in WP Sl.No 61673 of 2017 Anuj Singh V/s Cantt Borard, Meerut passed on 22.12.2017 by the Hon’ble High Court Allahabad had been

sought from Smt. Rekha Pandey, Advocate Supreme Court, she has opined that it is not a fit case to challenge the interim order dated 22.12.2017 before the Hon’ble Supreme Court.

101. Resolution:Shri Vipin Sodhi, Member stated that with due respect of Hon’ble High Court.

Circular note issued regarding reinstatement of Shri Anuj Singh is illegal and without jurisdiction and therefore same should be cancelled first. The matter should had been brought before the Board by convening either Special or Ordinary meeting as the Board is the only competent authority to take the decision regarding reinstatement of Shri Anuj Singh being a supervisory post.

Col. Rohit Pant is of view that the procedure followed is wrong and it should have been otherway. The order of Hon’ble High Court should have noted and the order for re-instatement be given.

Smt Manju Goel, Member read out a detailed note before the Board and the same is pasted below and she demanded that the order passed for re-instatement of Shri Anuj Singh should be cancelled as the Board is the appointing authority of Shri Anuj Singh and the Board has taken decision to suspend him under CBR No. 10 dated 11.01.2018 and only the Board can take decision to reinstate him honouring the order of the Hon’ble High Court, Allahabad.

PCB stated that prima-facie he is of confirmed view that the order passed is illegal, should have been brought before the Board as the individual was appointed by the Board, therefore, his disciplinary authority is the Board, as such the order regarding reinstatement of Shri Anuj Singh issued by the then CEO should be cancelled and Board should now take suitable decision in the light of the orders of the Hon’ble High Court, Allahabad.

Smt Beena Wadhwa, VP stated that there will be contempt of the Hon’ble High Court.

Therefore, it is unanimously, resolved that the Circular note dated 26.02.2018 and DO Part II Office Order No. 50 dated 26.02.2018 is cancelled.

Further resolved that in view of the order dated 12.02.2018 and 20.02.2018 passed by the Hon’ble High Court, Allahabad in CMWP No. 5445 of 2018, Anuj Singh v/s Cantt Board Meerut and others staying the resolution No. 10 dated 11.01.2018 regarding suspension of Shri Anuj Singh, he is reinstated in service with immediate effect. CEO is authorized to issue necessary Office Order.

Board has been informed that already counter affidavit along with stay vacation application has been filed in the Hon’ble High Court. Accordingly, the case should be pursued vigorously and the case file be handed over to Shri SK Rai, Advocate, High Court to defend the case on behalf of the Cantt Board.

Thereafter, Board deliberated on the duties/works given to Shri Anuj Singh. Smt. Manju Goel was of the opinion that he should not be given any work. Smt. Beena Wadhwa and Shri Anil Jain are of opinion that when Board is giving salary he should be given the work. Smt. Beena Wadhwa, Shri Anil Jain are of the opinion that he had done very good work on field in last two and half months. After deliberation it is resolved that CEO will take decision regarding allocation of such duties to Shri Anuj Singh as deemed fit and his performance will be reviewed after every two months by the Board.

102. FILING OF SLP BEFORE THE HON’BLE SUPREME COURT AGAINST ORDER DATED 18.02.2016 PASSED BY THE HON’BLE HIGH COURT DELHI IN LPA NO. 1051 OF 2011 UNION OF INDIA AND OTHERS V/S RAJESH AGARWAL AND THE ORDER THEREOF.

Reference: CBR No. 10 dated 11.01.2018.

To note the order dated 14.05.2018 passed by the Hon’ble Supreme Court in SLP (Civil) Dy. No. 11841 of 2018, Union of India & others V/s Rajesh Agarwal.

The DGDE vide letter no. 707/1/L/DE/CC/1/07 dated 28.12.2017 along with legal opinion dated 21.12.2017 of ASG, Supreme Court of India had instructed to file the SLP as the ASG has opined that this is a fit case for filing of SLP.

The matter pertains to sanctioning of building plan of Bungalow No. 167, Chapple Street Meerut Cantt in year 2008 by Cantonment Board vide CBR No. 330 dated 04.01.2008. The CBR dated 04.01.2008 was set aside by Govt of India, Ministry of Defence under section 57 of CA, 2006. Against the said decision Shri Rajesh Aggarwal (HOR) had filed writ petition before the Hon’ble High Court, Delhi and after 3rd round of litigation, the Hon’ble High Court, Delhi allowed the writ petition vide order dated 26.07.2011. Aggrieved with the said decision the UOI had filed LPA No. 1051 of 2011 before the Division Bench of Delhi High Court. The Division Bench of Hon’ble High Court, Delhi vide order dated 18.02.2016 had dismissed the appeal of UOI and upheld the order dated 26.07.2011 passed by the learned single Judge in WP No. 1808 of 2011 titled as Rajesh Aggarwal v/s UOI & others.

The said LPA was contested by Shri Sanjay Jain ASG of High Court, Delhi along with Smt Rekha Pandey, Advocate of Cantonment Board, Meerut at Supreme Court. Smt Rekha Pandey vide her opinion dated 05.03.2016 had opined that UOI should challenge the judgment dated 18.02.2016 before Hon’ble Supreme Court by way of filing SLP.

This office informed the whole position to the higher authorities and requested to issue suitable instruction/directions in the matter from time to time. The Cantt Board also informed the issue to the Board vide CBR No. 221 dated 10.06.2016. DG DE vide letter dated 28.12.2017 had informed that the matter had been marked to the panel advocate by Central Agency Section (CAS) for drafting of SLP with instructions that Cantonment Board, Meerut to liaise with CAS section for providing necessary inputs for filing the SLP.

The Central Agency Section, Ministry of Law and Justice, Department of Legal Affairs had filed SLP in the Supreme Court of India. The same has been dismissed on the ground of delay in filing the Petition.

102. Resolution:CEO briefed the Board about the order dated 14.05.2018 passed by the Hon’ble

Supreme Court regarding SLP in the matter of B. No. 167, Chapple Street, Meerut Cantt. He further advised the Board that review petition should be filed before the Hon’ble Supreme Court this issue involved in this court case relates to approval of building plan by Cantonment Board wherein ‘Authorized Floor Space’ has been interpreted by the Cantt Board contrary to the provisions contained in MoD’s Land policy of 1995 and it is for the responsibility of the Board, to take all appropriate measures including their own advocate.

Shri Anil Jain, Member stated that there is no use of filing review petition as the Hon’ble Supreme Court has dismissed the petition on the ground of delay and it will be waste of expenditure.

Smt Manju Goel, Member stated that there are 05 other building plans illegally sanctioned for which GOC-in-C, Central Command has already issued direction for taking action against the all concerned staff, but no action has been taken in this regard. The files of all those 05 building plans should be taken out and charge sheet should be issued.

The Board considered the order of the Hon’ble Supreme Court and is of the unanimous view that review petition should be filed explaining the delay of more than 02 years as the judgment dated 16.02.2016 was promptly conveyed to the Defence Ministry through DG DE for filing SLP on the basis of the advise of Cantt Board Counsel, but the sanction to file SLP could not be conveyed for more than 02 years inspite of the fact that Cantonment Board Meerut was regularly requesting through reminders. Therefore, the appropriate authority under the Defence Ministry through DG DE be requested to provide necessary details at the earliest regarding the time taken to take decision for filing SLP through Central Agency Section of the Central Govt.

The Board has been informed that time limit for filing review petition in this case is 30 days from the date of order excluding the period of summer vacation. Therefore, immediately on the opening of Supreme Court after summer vacation necessary review petition be filed through the Counsel of the Cantonment Board.

It is also resolved that any competent advocate preferably Shri Siddarth Luthra, ex-ASG be engaged for this purpose. Board authorized CEO to incur necessary expenditure in filing the review petition.

103. CONTRACT FOR COLLECTION OF DAILY/WEEKLY TEHBAZARI FEE WITHIN THE LIMIT OF MEERUT CANTONMENT AREA EXCEPT ARMY AREA PROHIBITED BY THE MILITARY AUTHORITY FOR A PERIOD OF ONE YEAR.

To consider cancellation of subject contract & forfeit of security money deposited by M/s Gaurangi Stuffing Solution, Meerut for contract of daily/weekly tehbazari fee within the limit of Meerut Cantonment for a period of one year.

OFFICE NOTE.

Board is informed that the subject contract was awarded to M/s Gaurangi Stuffing Solution, Meerut @ Rs. 59,59,595/- per annum for a period of one year w.e.f. 01.01.2018 to 31.12.2018. As per terms & conditions of tender, the contractor had deposited Rs. 15,19,697/- on a/c of tehbazari fee & allied charges as 1st installment & Rs. 14,89,899/- as security money in advance in Cantt Board treasury. As per terms & conditions of tender, the contractor is liable to pay contractual amount in 04 installments in advance.

The contractor had not deposited 2nd installment which was due on 31.03.2018. The Cantt Board vide letter No. vkj@108@nSfud@lkIrkfgd rgcktkjh@478 fnukad 11-04-2018, vkj@108@nSfud@lkIrkfgd rgcktkjh@516 fnukad 21-04-2018 & vkj@108@nSfud@lkIrkfgd rgcktkjh@531 fnukad 26-04-2018 intimated to contractor for depositing of 2nd installment & execution of necessary agreement but he failed to deposit the same.

As per clause 3.2(3.2.2) of terms & conditions, the contractor may be deposited the said installment within 30 days from the due date subject to depositing of Rs. 10,000/- per day as penalty, if he fails, the Cantt Board will be forfeited security money & cancelled the contract & balance amount if any may be recovered under the provisions of Section 324 of CA, 2006.

Due to non-depositing of 2nd installment in advance, the Cantt Board has taken the possession of collection of daily/weekly tehbazari fee area on 01.05.2018 & started the collection of said tehbazari fee since 01.05.2018 to till date regularly.

Board is informed that sanitary staff of this office on 12.11.2015, 24.11.2015 and 21.03.2016 reported about the construction is been carrying out in Part of Bungalow No. 73, Boundary Road, Meerut Cantt by Shri Rajeev Ahlavat s/o Shri Vijay Pal Singh. Necessary notices u/s 239 of CA, 2006 dated 12.11.2015, 07.12.2015 and 22.03.2016 was issued and served upon the offender. The offender submitted wrong reply dated 23.01.2016. The technical staff of this office inspected the site on 08.01.2016 and took measurement of new unauthorized construction in property in question.

Board vide CBR No. 163 dated 27.01.2016 consider and resolved that the notice u/s 248 of CA, 2006 be issued to the owner/occupier. In compliance of above CBR notice u/s 248 of CA, 2006 for demolition of unauthorized construction bearing No. MCB/BLDG/ENGG/73/692 dated 30.04.2016 was issued and served upon Shri Tushar Ahlawat s/o Shri Rajeev Ahlawat being aggrieved with the notice the offender field an appeal u/s 340 of CA, 2006 before the appellate authority/GOC-in-C, Central Command, Lucknow.

The comments was forwarded to the appellate authority vide this office letter dated MCB/BLDG/ENGG/170 dated 30.04.2017. Appellate authority fixed 08.07.2017 and 05.08.2017 and notices of hearing served upon the offender time to time i.e. on 28.06.2017 & 01.08.2017. The appellate authority vide order dated 25.04.2018 has allowed the appeal and decided accordingly.

To consider the tender query received from Shri Gopal Agarwal. 3R technology though e-mail for exemption of tender fee and EMD being a manufacturer and service provider under Ministry of Micro, Small & Medium Enterprises (MSME) category being manufacturer registered.

Board is intimated that intimated that online e-tenders for the work sanctioned by the competent authority has been considered in meeting under reference w.r.t. “Setting up of (Constructing, erecting and commissioning) Effluent/Sewage Treatment Plant alongwith pumping station and Sewage trunking lines in Sadar Bazar area in Meerut Cantt based on SBR Technology including Operation and Maintenance of collection system. Pumping Station and STP for 1 year” have been invited based on single stage two bid system as technical bid and financial bid. The e-tenders for the execution of the work were invited and published on 22.08.2017 and bids were invited from 23.08.2017 to 19.08.2017 but no tender /bid was received therefore the e-tenders /bids were re-invited and published on 28.11.2017 but bids of only one eligible participant was received. The Bids are third time invited and published on 28.02.2018. Initially, the Bids were invited from 02.03.2018 to 27.03.2018 and the bid submission date has been extended up to 26.06.2018.

Shri Gopal Agarwal, 3R Technologies sent e-mail dated 06.12.2017 and dated 18.12.2017 at the time of second time publication of the tender with above mentioned request which was replied in consultation with the consultation engaged for the project vide this office letter No. 164/E-5 dated 20.12.2017. 3 R technologies did not participate in the tender. However, sufficient number of bids were received but due to mistakes made by the bidders in submission of documents in online bids, e-tenders have been re-invited third time. Shri Gopal Agarwal (for 3R technologies) has again made the same request vide email dated 22.03.2018 alongwith some attachments claimimg registered as manufacturer of the plant.

The matter was forwarded to the GE(S) vide letter No. 164/E-5/448 dated 29.03.2018 and GE (S) has replied that opinion sought is not in jurisdiction of MES and competent authority be approached.

The project of Cantt Board includes sewer lines, STP building and STP pant as under:

GE (S) has been further requested vide letter No. 164/E-5/552 dated 28.04.2018 whether MES is allowing exemption of tender fee, EMD and experience to the firms. Reply is awaited.

110. Resolution:Considered and resolved that the Cantonment Board is an autonomous body and

is not governed by the Rules followed by the CPWD or any other Central agency. The tenderer has to deposit cost of tender, EMD and all other requirements of the tender floated. Accordingly, the request is rejected. In case he is not found eligible rates of quoted by second lowest tenderer may be considered. Matter be put up in the next Board.

111. APPROVAL OF RATES FOR RUNNING MAINTENANCE CONTRACT OF PUMP HOUSES/OHT’s AT VAROUS WATER SUPPLY INSTALLATION IN CANTT AREA.

To consider the rates quoted by M/s Agarwal & Co @ Rs.67260/- per water supply pump/OHT per month for Running, maintenance contract for pump houses/OHT’s at various water supply installations in Cantt area in e-tender proceedings in which e-tenders were invited by the office award of aforesaid contract.

Board is intimated that; 1. Due to shortage of qualified staff i.e. operators / MPA’s, 10 No. pumps/

installation are being outsourced for running & maintenance presently.2. Online E-tenders were invited through e-procurement portal by e-publishing

as well as press advertisement in national /local newspapers for Running, maintenance contract for pumps houses/OHT’s at various water supply installations in Cantt area, based on two bid system on 16.02.2018.

3. In the tender proceeding, 03 tenderer i.e. M/s Manoj kumar, M/s Sushil kumar Co. & M/s Agarwal & Co. have participated. All the three participates found eligible for opening of the financial bids and financial bid have been opened. M/s Agarwal & Co has quoted lowest rates @ Rs.67260/- per water supply pump/OHT per month for Running, maintenance contract for pumps houses/OHT’s at various water supply installations in cCantt area.

4. Board is informed that present rates for the running & maintenance of pump houses / OHT’s are @ Rs.57000/- per OHT/Pump house per month installed in Cantt area.

The lowest rates seems to be reasonable, keeping in view of annual rates of last year approved by the Board.

113. ISSUANCE OF NOTICE U/S 248 OF CA, 2006 TO BE DROPPED.

Reference: Agenda point No. 73 of ordinary Board meeting which was postponed on 27.03.2018.

Board is informed that as per the agenda under reference the matter is placed before the Board for issuance of notice u/s 248 (1) of Cantonment Act, 2006 requiring the offender to demolish the unauthorized carried out by Shri Naresh s/o Late Shri DarshanLal in part bungalow no. 210-B, West End Road, Meerut Cantt.

Board is informed that the necessary show cause notice and notice under section 239(1) to stop the unauthorized construction was issued and served upon the offender on 23.01.2018, aggrieved with the notices the offender filed civil appeal no. 72/2018 before the Civil Judge (SD), Meerut.

Board is further informed that the said unauthorized construction has been demolished on 23.04.2018 by the Cantonment Board agency with the help of Police assistance in compliance of the order ofHon’ble High Court, Allahabad order dated 19.03.2018 passed in PIL No. 3043 of 2018 titled as Karanvesh v/s UOI and Others.

In view of the above agenda point no. 73 for issuance of notice under section 248(1) may be dropped now.

114. BAD CONDITION OF CERTAIN ROADS: URGENT REPAIR REQUIRED BEFORE MONSOON.

To consider the request letter dated 23.05.2018 submitted by Vice President Smt Beena Wadhawa and 06 elected members Smt Rini Jain, Smt Bushra Kamal, Shri Neeraj Rathore, Shri Anil Jain and Shri Vipin Sodhi regarding bad condition of roads and requirement of their urgent repairs.

It is intimated that the roads requested to be repaired urgently before monsoon by Vice President and 06 elected members are same roads which were considered and resolved to be undertaken out of grant received after change in names with the approval of competent authority vide CBR No. 734 dated 05.12.2017 and proposal have been forwarded to the PD DE, CC. The sanction is not received till date. The members have stated that the said roads are used by the public /school children’s and causing accidents, agitation and annoyance of the public therefore, they are requested to undertake the roads.

115. REGULATING THE TRAFFIC AND PARKINGS IN ABULANE /BOMBAY BAZAR IN SADAR BAZAR AREA

To consider the traffic congestion and development of parking places alongwith public utilities at Abulane, Bombay Bazar and nearby area of Sadar Bazar of Meerut Cantt.

Board is intimated that police authorities have raised the issue of traffic congestion at Bombay Bazar, Abulane and nearby area of Sadar Bazar. CEO has taken round in the area along with the ASP (CO Sadar Bazar) of police to evaluate the situation and further discussed for the plan with ASP and SP traffic to cater for streamlining the traffic, development and provision of parking facilities/public utilities & conveniences and beautification works to address the issue.

A blue print has been prepared showing the parking places to be developed at class ‘C’ land pockets viz. Near shiv chowk, circular road, road side portions along Abu Nala (2 places), road side at Kele wali kothi road near Kath ka Pul . The site at B. No. 180 is presently being used as Bharat Ghar namely ‘Mangalam’ for marriage/private functions on payment of booking and bookings are very less & only on specific dates for example last year there were only 06 bookings. The parking options will generate revenue and may be under taken departmentally initially to assess the quantum of revenue being generated in a month on the rates approved by the Board i.e. Rs 10/- for two wheelers & Rs. 20 for four wheelers so that it become easy at later stage to auction on minimum reserve price. In addition some public conveniences/ utilities like toilets are also to be upgraded/ provided to cater for the users. The improvement to the road crossings are also made the part of development plan to regulate the traffic at crossings in order to reduce congestion at selected points.

measuring 1.537 acres under the management of Cantt Board Meerut for the purpose of cinema (commercial).The land as on date is not being utilized to yield the optimum revenue and lot of money is spent on the maintenance of same, only six marriages have taken place during last year collecting the revenue of just Rs 90,000.

(b) Removal of illegal dairies: Vide resolution No. 731 of Camtt Board meeting dated 24 Oct 2017 it was decided that all dairy owners would be given time till 31 Dec 2017 for removal of their illegal dairies. It was decided that after 31 Dec 2017. The dairies would be removed by the Cantt Board and legal action would be taken.

These illegal dairies are a major source of mosquito and fly-breeding. The area is unsightly due to dirt and dung lying around. Residents of neighborhood are condemned to live in noxious environment/air. The cattle are kept in dirty conditions and subjected to cruelty. In addition health of civil and military population is put at risk by the consumption of milk from these illegal and un-hygienic dairies.

CEO is requested to take action for removal of illegal occupants and the safeguard the Cantt residents from health hazards due to mosquito-borne, fly-borne and milk-borne diseases or intimated the Board regarding the actions taken.

(c) Hygiene Inspection of restaurants: Hygiene Inspection is being carried out jointly with Cantt Board to safeguard health of the public. It is important that this drive gets whole hearted support from all members so that hygiene standards of restaurants are improved.

Relevant letter is put up on the table.

Board is requested to consider and decide.

116. Resolution:Considered and resolved that

(a) Board has already approved for extension of engagement of GDMO, Staff Nurse, OT Attendant and Pharmacist. Regarding engagement of Physician, Gynae Specialist,

Skin Specialist, Ortho and Pedeatrician, the MO I/c will submit report regarding qualification required, proposed honorarium payable to the above doctors. The report may be discussed in the Hospital Sub-Committee and recommendations be placed in the next Board meeting.

Further resloved that all civil work and electrical work including repair of AC be carried out within one month by the office.

(b) All illegal dairies from Cantt area be removed within 60 days from today as the dead line for their removal upto 31.03.20018 as recommended by the then CEO is already expired. Necessary action be initiated for removal of illegal dairies from Cantt area with necessary Police assistance forthwith.

(c) Necessary inspection of hygine and sanitation in all the eatables, shops and restaurants etc be carried out by the AHO along with concerned Ward Member and Sanitary staff of the Cantt Board to ensure that all establishments dealing in the food and vendors are medically examined, food is prepared and served hyginically and all the owners and vendors are issued trade license in accordance with the provisions of section 277 of Cantonments Act, 2006.

117. General Points:-(1) Smt Bushra Kamal, Member submitted that in the matter of action against unauthorised constructions uniform action is not being followed against all the offenders to demolish the illegal constructions at the initial stage. She referred specific case of B. No. 177 where overnight lintel has been made unauthorisedly. CEO assured that he will enquire into the matter and take all necessary action.

(2) Smt Bushra Kamal, Member proposed that the Butchery Road should widened at both sites and divider be provided to stop accidents as the road is accident prone being connected to the National Highway No. 119 opposite Telephone Exchange to Mall Road. CEO assured that he will inspect the road and take suitable action on the suggestion.

(3) Smt Bushra Kamal, Member proposed that the crossing at Mall Road to Lal Kurti Bada Bazar in front of Royal Hotel has become accident prone. Therefore, to prevent accidents on this crossing a fountain be provided. CEO assured that the site will be inspected and if found feasible necessary action will be taken on the suggestion.
