1. DECLARATION OF OPENING /ANNOUNCEMENT OF VISITOR
The CEO, John Read, welcomed those present and declared the meeting open at 3.00pm.

were circulated. The term of Shire President is for 2 years.
Cr Meeking nominated Cr Smoker. There being no further nominations, Mr Read declared Cr Smoker
elected unopposed to the position of Shire President for a two year term.
4. ELECTION OF DEPUTY SHIRE PRESIDENT
The CEO, Mr Read requested nominations for the position of Deputy Shire President. Written nomination
forms were circulated. The term of Deputy Shire President is for 2 years.
Cr Smoker nominated Cr Meeking. There being no further nominations, Mr Read declared Cr Meeking
elected unopposed to the position of Deputy Shire President for a two year term.

Summary/Comment
With Council’s approval, it is proposed to close the Shire Offices to the public from 12 noon, Thursday, 24th
December, 2015 to Friday, 1st January, 2016 inclusive. The outside crew will be taking their annual leave
from 19th December 2015 through to January, 2016. Basic crews will remain to cater for cleaning public
facilities and parks & gardens watering, etc. A Christmas get together (BBQ, etc.) of Councillors and
partners and inviting Shire employees and partners is planned to be held at a venue and time to be
arranged.
This year we will be conducting the Carols by Torchlight event at the Memorial Gardens adjacent to the
Kondinin Hall on Sunday evening, 20th December, 2015.

13.2.2 Kondinin Housing Requirements

Extract from Agenda 16th September 2015
“It has been brought to the Shire of Kondinin’s attention the important need for adequate housing for
teaching and hospital staff. Currently the Kondinin Primary School has no residence available to house
married teachers with children and the Kondinin Hospital is in the same position. This situation is impacting
negatively on both organisations.
A meeting was held on 3rd September attended by the Kondinin Primary School Principal, Simon Paton and
the Hospital Administrator/Registered Nurses, Lisa Biglin & Ben Dennis, along with the Shire President,
CEO, DCEO and Mrs Janet Repacholi from the school board and KPA. The School Principal advised that he
has a married teacher with four children who is forced to leave Kondinin School because there is only single
accommodation available. The hospital is in a similar situation with no family accommodation available,
making it impossible to attract good quality married nurses and longer term staff.
At the abovementioned meeting, the need to satisfy the Kondinin Hospital’s staff accommodation was
discussed. As only single accommodation with shared bathroom facilities is provided currently, what is
ideally required is a 4X2 transportable, which including fencing, landscaping, septics, utility connections,
etc. is expected to cost in the order of $300,000. At a meeting held at the Kondinin Hospital recently with

representatives of WACHS, the capital improvements to be made to the hospital were advised and in
respect of hospital staff housing, we were advised that WACHS could possibly assist financially towards the
cost of married accommodation in Kondinin.
Council currently has a $150,000 housing loan maturing in May, 2017 and a Kondinin Swimming Pool loan
$200,000 maturing in June, 2017. Six monthly repayments on a $300,000 loan over 15 years are estimated
at $13,579.86, based on 4.2% interest rate. With the significant increase in Roads To Recovery road grants
and other budget savings in the current and next (16/17) financial year, I am optimistic that we will be in a
financial position to pay out the loans for the provision of the two houses by the end of the 2016/17 year.”

That the CEO take the matter of urgent need for adequate housing for teaching and nursing staff in
Kondinin up with Government Regional Officer Housing (GROH) and WA Country Health Service (WACHS)
with a view to the State Government providing the housing needs and report on the outcome to Council.
WACHS Housing
The ACEO contacted the Regional Director of WACHS, Caroline Langston on 18th September and a
teleconference was arranged with her and Jenny Menasse WACHS Operations Manager-Narrogin for 30th
September 2015. The following was the results of the discussions.
The current position regarding the lack of suitable family type housing to attract staff with families and
longer term staff was outlined.
Caroline Langston advised that several years ago the minister for Housing, Kim Hames had planned to put
aside money to upgrade housing for hospital staff (this however was mainly in the north west) through R4R.
This was not followed through due to budgetary restraints.
It was then proposed that the housing be taken over by GROH however this proved too expensive and
would have cost WACHS up to $9million p.a.
With the current state of the WA government finances there is no money in the budget to be in a position
to either build a new house or enter into a joint venture.
However, I brought up the possibility of WACHS entering into a long term lease with the shire should we
build a suitable house. Both Caroline and Jenny intimated that they were very interested in this proposition
and certainly would entertain WACHS entering into a long term lease agreement of say a term of 3 to 5
years with further options to extend. They could then use it as an incentive to either keep the existing HSM
or alternatively attract a suitable replacement, or other staff, should one be required.
The proviso would be that it would be at a reasonable cost. (I would base any rent on the GROH rate much
along the lines of the Ed. Dept subsidised amount for the school principal.)
Caroline and Jenny have both left the door open for further negotiations should council decide to purchase
a house.
The purchase of a quality transportable building (preferably ex display) for lease to WACHS has -

2. Fulfills council’s unofficial policy of replacing staff housing on a regular basis.
3. Puts a house on land that the council owns within the LandCorp timeframe.
Cons
1. Additional loan funds required – impact on budget cash flow.

GROH Housing
The ACEO contacted GROH on 21st September regarding the unsuitable housing provided in Kondinin and
the need for adequate housing to both retain and attract teachers. The matter of funding appears to be the
same as for WACHS.
The initial discussions revolved around a long term lease of the property to GROH to be utilised as housing
for the principal so that the current 3 bedroom house could be used for a teacher with a family.
Initially contact with GROH was encouraging and they forwarded the information to the relevant party in
the Education Dept. who have since been in contact with Simon Paton the school Principal seeking
information about the house from him and the problems regarding his current housing situation.

The Ed. Dept. are in favour of the proposition and advised GROH that they were prepared to take on the
lease of the property should the shire go ahead and purchase it. (GROH actually lease the property for use
by Ed. Dept. and is reserved for the school Principal).
GROH, however, have now advised that they do NOT want to take on the lease as the property being
offered is older than the current house. Simon Paton has been requested to provide more information
regarding the house and his family situation to the Ed. Dept. so that they can argue the case that they
should take on the lease on the property should the Shire go through with the purchase.
This matter remains ongoing.
The Pros and Cons of the Shire purchasing the existing property at 28 Repacholi Parade Kondinin are pretty
much the same as the proposed WACHS proposition.

employees, school teachers and hospital staff, as well as employees of private enterprise.

(ii) give consideration in the 2016/17 budget to additional housing needs.

13.2.3 Hyden Sports Pavilion Extension

SUMMARY
At the September council meeting the following item was presented and the recommendation was
subsequently accepted.
Summary/Comment
Following a meeting that I attended along with Councillor Ibbotson and members of the Hyden Sports
Council on 11th August, 2015, amongst other matters affecting sports facilities in Hyden, the matter of the
second stage extension to the Hyden Sports Pavilion was discussed.
The preliminary estimate of the proposed 152.73m2 extension to the north end of the building, which
includes a gymnasium, trainer’s room, store room, umpires change room and minor changes to the players
change rooms, is $270,000. I propose that the project be funded by one third ($90,000) contributions from
the Shire, Sports Council/Hyden Progress Association and Department of Sport & Recreation (DSR) grant.
Applications for the DSR grant close on 30 September, 2015 and such application needs to incorporate
Council’s decision to go ahead with the project.
It is proposed that, subject to funding being obtained, the project be carried out in the 2016/17 financial
year with a completion date no later than April 2017.

change room, with the project completion date to be no later than April, 2017.

COMMENT
On 14th September the DCEO contacted DSR regarding some queries regarding our proposed funding
application. Jennifer Collins from DSR phoned the DCEO on 21st September in response. After the discussion
it was mutually decided that we would not be in a position to put in a strong application for the funding by
the closure date of 30th September 2015 due to the following:
1. The 1/3 contribution by the Hyden Sports Council and/or its affiliates could not be confirmed.
2. We could not provide sufficiently accurate quotes for the construction of the extension.
3. Anecdotal evidence from the Hyden Sports Council indicated that they were not prepared for the
extensions yet.
4. Jennifer Collins advised that unless the application is 100% rock solid that it would not be accepted.
In light of the discussion it was obvious that if we did go forward with the application that it would not be
viewed favourably. I was advised that it was in our best interest to wait until next year’s round of
applications and to present a fully thought out, planned approach which meets all the criteria.
To that end it is advised that the Department of Sport & Recreation (DSR) grant was not submitted.
It is therefore recommended that the above resolution be amended as per below.

13.2.4 Creating Aged Friendly Communities (CAFC) – Local Transport Solutions Project

Summary/Comment
The State Government through the Departments of Local Government & Communities and Regional
Development, (Wheatbelt Development Commission, etc.) have implemented grant funding programs
aimed at providing improved facilities in regional West Australian towns for our aged population.
Recently the Shire of Kondinin was successful in obtained a $47,500 grant, to which the Shire added $5,000
(total $52,500), which provided for the construction of pedestrian/goffer concrete footpaths as well as
parking and shelter type facilities in the Kondinin town site. These facilities are currently under

construction. It is the Shire’s intention to source additional funding to carry out similar pedestrian footpath
facilities in the town of Hyden to service the Hyden elderly residents in giving them improved access to
community amenities. A future priority major project in the area of catering for our aged population to
remain living in our Shire is the construction of a four unit extension to Yeerakine Lodge and possibly
extensions to Westcourt & Whispering Gums retirement villages.
The Wheatbelt Development Commission (WDC) has recently announced the ‘Creating Aged Friendly
Communities (CAFC) – Local Transport Solutions Project’. From over 60 wheatbelt based local governments,
three projects were selected involving some three local governments in each group, where a six month
pilot project is created involving the provision of a weekly or fortnightly bus services for the aged from
small towns to regional centres to attend to health related appointments, speciality retail as well as
recreation and social opportunities. One group selected is Kondinin, Kulin and Wickepin with a bus service
to Narrogin recommended. The (modest) WDC funding for the wheatbelt project is in the order $150,000
and local governments are expected to provide the community bus with the WDC financially assisting in
areas such as payment of a bus driver if a volunteer is not available. Obviously with the group consisting of
Kondinin, Kulin and Wickepin travelling to Narrogin, the bus would need to commence from Kondinin and
most likely be provided by Kondinin Shire in this pilot project.
A meeting was held in Kulin on 13/10/2015 attended by representatives from the WDC (Lauren Clarke and
Elise Woods) and the three CEO’s of the local governments (Kondinin, Kulin & Wickepin). Concern was
expressed that the bus service not become a service to allow local residents to shop in the regional centre,
Narrogin, out of their own town. It is proposed that a fee $5 be charged to participants, collected by the
local CRC. Due to logistics with Merredin being closer to Hyden than Narrogin, the group considered it best
that just Kondinin residents be involved in the project, but this decision is best determined by Council.

FINANCIAL IMPLICATIONS
It is envisaged that the relatively small cost of the proposed project be mainly funded by the WDC.

Providing improved facilities for the Shire’s aged population is consistent with the objectives and goals of
our Integrated Plans.

13.2.6 CEO’s General and Project Status Report
1) Staff Matters
Doug Davey is on annual leave from Thursday 15th October to Monday 26th inclusive, returning to
work on Tuesday 27th October, 2015.
Greg Gleeson, Building Maintenance Officer, after obtaining the necessary formal qualification, has
been appointed Shire Ranger, replacing Perth based contractor Yahie Saade.
1) Kondinin Swimming Pool – Upgrade
July 2015 - Council will be visiting the site prior to the meeting. After the June Council meeting Mr.
Smeed was advised that the building must be completed by 15th July. Since the June council
meeting the rails on the northern verandah has been completed, internal painting has been
completed, the footings for the southern retaining wall have been poured and preparation of the
car park has commenced (by the shire). The poles for the shade sails have been installed and the
paving reinstated. The sails will be put up prior to the pool season.
August 2015 – since the last council meeting work has progressed well on the building. The front
retaining wall and steps have been completed and the disabled ramp is nearing completion. The
final touches are being made to the interior with plumbing connections to be finished to the
change rooms and the main entrance to be grouted. The construction of the car park is in full
swing.
September 2015 – final plumbing connections should be completed by the time of the council
meeting and grouting finished. Furnishing of the building is underway; sewerage system needs its
final commissioning. Building should be ready for its final inspection by the end of September.
October 2015 – some small things still require finishing however final inspections by the shire EHO
and building surveyor are underway and all will be ready in time for the LIWA conference on 28th
October.
2) Hyden Recreation Centre Extensions
July 2015 – the extensions and fit out is finished with only some small items remaining. There have
been some teething problems but hopefully they have all now been rectified.

With the assistance of Hayley Fegan and the ROE EHO Julian Goldacre temporary permission was
granted to use the building on Saturday 27th June and 4th July. The building must be inspected and
passed for occupancy prior to the next home game on 18th July.
August 2015 – the job is all but complete. The handrails need to be installed in the disabled toilets
and an emergency light in the kitchen. The fire hydrant required by DFES has been installed. The
hydrant requires pressure testing, which has been arranged, before the building can officially be
signed off.
September 2015 – All items have now been completed and the final sign off is required.
October 2015 – nothing further to report.
3) Kulin Bendigo Bank – Hyden Branch Proposal
August, 2015 – Discussions have taken place with Rick Ford, Manager of Bendigo Bank Kulin. Rick
has been advised that the Shire of Kondinin support the establishment of a branch in Hyden and
that the Shire of Kondinin is prepared to become a bank customer, placing fixed term deposit funds
with Bendigo from time to time subject to satisfactory interest rates and flexible withdrawal terms
being available.
September, 2015 – Kulin Branch management continue to gain new accounts from Hyden
residents. It is expected that a decision will be made soon as to whether they will establish a sub-
branch in Hyden.
October, 2015 – Hyden Progress Association has requested that Council transfer its banking to the
Bendigo Bank Hyden Branch. I have advised HPA of Council’s decision to support the branch by
fixed term deposit investments in accordance with Council’s Policy relating to financial investment
strategy, providing rates are competitive.
4) Poseidon Nickel Ltd – Lake Johnson Nickel Project
July, 2015 – I met with John Croall, General Manager of Poseidon Nickel in Kondinin who gave an
update on progress made in developing the project. John advised that he would
investigate/research contributions made to local governments towards road maintenance in similar
situations in an effort to arrive at a fair annual contribution amount. He advised that there was
very little of their traffic using the road currently. He also mentioned that the company will be
recruiting personnel over the next few months and that they are keen to consider locally based
candidates.
August, 2015 – Nothing further to report.
September, 2015 – I have encouraged local businesses to contact Poseidon Nickel regarding
servicing their project.
5) Swipe Card System
September 2015 – Work is currently underway for the installation of the swipe card facilities at
Allen Rock, McCann’s Rock and King Rocks with work to be completed by 15th September 2015. A
demonstration morning has been arranged for interested users on the morning of 15th September
at McCann’s Rock. Training for the administration staff is being held on the morning of 16th
September. Users of the 3 sites who have indicated that they require a swipe card have received
their cards and it is anticipated that access to the sites will be restricted to card users only from 1st
October 2015. It is to be noted that the system will be able to be bypassed remotely by
administration staff in case of emergencies.
October 2015- All 3 sites have now been completed and access is now only via swipe card. There
have been no indications of any problems or complaints so far. There is some concern regarding
the replacement of the standpipe with camlock fittings at McCanns Rock.
6) King Rocks Dam Upgrade – Department of Water
A copy of the draft report on King Rocks Dam was received from DoW on 21st September.(Tabled)
This report outlines the options regarding the repairs to be undertaken after testing was completed
on the dam wall. DoW is currently reviewing the report and will then organise a time to come out to
discuss the options with the Shire and local community representatives.
7) Yeerakine Rock – New Water Tank Proposal
Following a successful on-site meeting with Minister for Water, Hon. Mia Davies on 9th October,
2015, we are hopeful that with the Minister’s support an alternative location for the new $20

million water tank facility will be agreed to by Water Corp’ which will keep the Yeerakine Rock

8) Annual Audit / Annual Meeting of Electors
Recently our Auditors, Byfields, conducted their annual audit. The annual audit report is expected
to be presented to Council at its November, 2015 meeting which will allow for the annual meeting
of electors to be held on 15th December, 2015 (December Council meeting ).
Appreciation is extended to Vince Bugna, Manager of Finance, for his excellent work in preparing
the 2014/15 annual financial statements, including the comprehensive asset valuation register.
9) Main Roads WA Submission
A submission has been forwarded to the MRWA (attached) proposing that the Shire of Kondinin
take on a five year contract from March, 2017 in respect of road maintenance and construction
works on all MRWA roads within the Shire of Kondinin; that section of the Hyden Lake King Road
encompassing the Shires of Kulin and Lake Grace to Lake King and west of Lake King (Lake King
Collie Road) to the Lake Grace/Ravensthorpe Shire(s) boundary.
Craig Manton, Wheatbelt Regional Manager for MRWA has acknowledged receipt of the
submission and advised that MRWA Perth Head Office is considering the proposal.

SUMMARY/COMMENT
I have received information from Shane Melotte of Melotte Consulting who are assisting Canadian Solar
with its proposal to access Federal Government Energy Agency funding for a large scale solar project
proposed to be located north of Kondinin. Comprehensive information regarding Canadian Solar is attached
for Councillors information.
The project, if it goes ahead would involve $100 Million CAPEX and the solar panels would cover a 50Ha
area and generate 50 mega Watts of electricity that would be fed into the sub-station north of Kondinin.
The proponents are seeking a letter of support from the Shire of Kondinin and have provided a draft letter
for the Shire to consider. Careful consideration is recommended before support is offered as the project
may well create a very unattractive entry along the highway to Kondinin town site and reflection/glare may
prove a problem. Because of the size of the proposal, the decision as to whether it goes ahead or not on
the proposed location would be a decision of DAP, however the Shire of Kondinin would be able to submit
its recommendations to DAP for its consideration. One such recommendation is that the project be GRV
rated by the Shire of Kondinin rather than remain its current UV farming status.
Administration needs to carefully consider this proposal from a town planning and environmental health
perspective. The subject lot is zoned ‘Rural’ under the Shire’s Town Planning Scheme No.1. The objectives
of a Rural Zone are:
• To ensure the continuation of broad-acre farming as the principal land use in the District and
encouraging where appropriate the retention and expansion of agricultural activities; and
• To consider non-rural uses where they can be shown to be of benefit to the District and not
detrimental to the natural resources or the environment.

It is assumed that the proposed use would be classified as ‘Industry – General’ under the Shire’s Town
Planning Scheme No.1, which is an ‘A’ use. This means that ‘the use is not permitted unless the local
government has exercised its discretion by granting planning approval after giving special notice in
accordance with clause 9.4’ . Alternatively it would just be an Unlisted which would also be treated as an ‘A’
use.
Our Town Planning Officer has spoken with the Shire of Merredin regarding its wind farm application and
they are forwarding the Agenda Report considered by the Merredin Council regarding the matter. As an
interim however they provided the following information:
• A number of conditions were issued in relation to environmental health
• Aesthetic concerns were not considered valid planning concerns and were not factored into the
determination
• They conditioned that the applicant pay $120,000 per year to the Merredin community (like
developer contributions)
• The land remains zoned Rural
• In hindsight they said that would have conditioned a change to the rating of the land in the
planning conditions
In summary, the proposal could be considered for planning approval, but would require extensive
advertising and adherence to any environmental health conditions and any other relevant matters from
service providers. The land would not require re-zoning.

13.4 Community Development Officer’s Report
Archery Lessons in Hyden and Kondinin
The lessons held in Hyden and Kondinin from the 21st – 27th September 2015 proved to be a great success
with positive feedback received from many participants and parents. In total we had 53 children and adults
attending lessons during the week and over the weekend for 6 consecutive days. The accredited coach,
Andrew Postma from “Arrows Across Australia” was very professional and ran educational and fun
sessions.
Seniors Week Grant
The Shire of Kondinin and the Hyden Community Resource Centre are now actively promoting the event
‘The Beggars Present SING!’ in Merredin on Sunday 8th November 2015. We are hoping to fill both buses
leaving from Hyden and Kondinin. It is $20 per person.
Yeerakine Lodge Bingo and Morning Tea
The hospital in conjunction with the Shire provided morning tea and bingo on Monday 28th September
2015 at Yeerakine Lodge. Approximately 20 people attended, including West Court, Yeerakine and Hospital
residents, together with some of their families. Prizes were offered for bingo winners. The Shire’s new
Bingo wheel worked well (although the Shire’s Community Development Officer probably needs to get up
to date with ‘Bingo Lingo’) and everyone seemed to enjoy the gathering. The Shire is looking to team up
with the Kondinin hospital to provide monthly activities for seniors on an on-going basis.
Mobile Cinema in Hyden and Kondinin
Mobile Cinema ‘Kangaroo Paw’ was in Kondinin and Hyden on the 5th and 6th October 2015 respectively,
showing morning and afternoon film screenings. The afternoon children screening of ‘Paper Planes’ was
well attended, with approximately 25 children in Kondinin comprising locals and visitors staying at the
caravan park, and similarly around 25 local children attended at Hyden. Morning tea was provided for the
morning screenings and fresh popcorn, choc tops, drinks and lollies were provided for the children in the
afternoon. Despite invitations being sent and extensive advertising and providing lifts for hospital and
Yeerakine Lodge residents, attendance was low for the morning movies. Pleasingly those who attended in
the morning enjoyed the movie and the outing. A thank you goes to the Kondinin Tennis Club and the
Hyden CWA who assisted with the catering.
Girls’s Night In
The Kondinin Shire and the Kondinin Community Resource Centre are hosting a ‘Girl’s Night In’ as part of
October breast cancer awareness month. All proceeds to the event will go towards the Cancer Council. The
event will be held at the Kondinin Community Resource Centre. It will be $20 per person. We will be doing
an ‘Italian Food’ theme, so everyone will be asked to bring a plate. We are also looking to have an auction
and door prizes.
Kondinin Community Garden
The vegetables are growing well and a number of locals have been dropping in to collect the fresh produce.
The internal hexagon central garden has been completed as has the internal pathway. At the working bee
on Friday 9th October 2015 we had a group of ten (10) children and adults come along to help, in which we
completed the brick paving, planted the summer vegetables, filled another raised bed, put together the
compost tumbler and did some general weeding and cleaned up the front garden area. The water
connection has also been fixed by a plumber and new water connections installed to improve options for
watering.
Yeerakine Rock Wildflower and Local History Walk
A series of morning and afternoon walks were arranged and advertised to coincide with the October school
holidays and wildflower seasons. Unfortunately despite widespread advertising through the central
wheatbelt visitors centre, in the Sunday Times, and in locally in Kondinin and Hyden, there was limited turn
out to the walks. As a positive, a local Kondinin resident in conjunction with the Shire compiled a booklet
with the wildflowers and other vegetation in order of the route of the Yeerakine Rock Walk, which the Shire
will look to streamline and make publically available for tourists and locals.
Noongar Sports Day
The Noongar Sports Day was well attended on the 7th October 2015 with 20 participants. Next holidays the
Sports Day will be held at the Kondinin Swimming Pool.
Department of Infrastructure Bike Path Grant

A grant was submitted to extend the bike path from Lovering Road along Wave Rock Road to the Wild
Flower Shoppe. The project cost has been estimated at $61,000, with $29,280 been requested in grant
money. If successful with this grant, expenditure is to be undertaken in the 2016/2017 financial year.
Stronger Community Programme Federal Government Grant
A grant has been submitted to the Department of Infrastructure and Regional Development to construct
BBQ shelters at the Kondinin and Hyden Swimming Pools. The estimated cost of this project is $16,000 and
if successful $8,000 would be grant money with matched funding to be provided by the Shire. This project
would be undertaken in the 2015/2016 financial year.
Community Infrastructure Grants 2015 Application
The Shire was unfortunately unsuccessful in this grant from WALGA and the Disability Services Commission
for the footpath upgrades in Hyden. Other grants are currently being investigated for this.

This report recommends that a planning application submitted by the owners and applicant Colin and Sally
Nicholl to clear Lot 1476 for the purpose of cropping and livestock grazing be conditionally supported,
subject to approval issued by the Department of Environment and Regulation.
Background:
The Shire received email correspondence on the 22nd September 2015 from the Department of
Environment Regulations advising that they had recently received an application from Mr Colin and Mrs
Sally Nicholl to clear 55 hectares of native vegetation within Lot 1476 on Deposited Plan 204202, Hyden, for
the purposes of cropping and grazing
In this email correspondence the Department of Environment Regulation invited the Shire to provide
comment on the proposal and to advise if the approval is consistent with the Shire’s Local Planning Scheme
and whether any approvals were required. The Shire responded to the email advising that the proposal did
require planning approval and the matter was being presented to the Ordinary Meeting of Council
scheduled for 21 October 2015.
The CEO for the Department of Environmental Regulation will, after having taken into account any
comments received and subject to sections 51O and 51P of the Environmental Protection Act 1986, either
grant a clearing permit (including any specified conditions) or refuse to grant a clearing permit.
The owners of the subject lot submitted a letter to the Shire to accompany the planning application, which
outlined the following points for the Council’s consideration:
• The application involves clearing of re-growth vegetation on a lot which has been cropped and
grazed prior to the owner’s purchasing it;

• The owners have planted approximately 12,000 trees and saltbush on their property and will
continue to do so and have left other areas of their farm under native vegetation; and
• The owners have had the subject lot inspected by their farm consultant, ‘Planfarm Pty Ltd, who
have considered it good agriculture land and advised that the proposed clearing will not degrade or
impact on adjoining land.
Statutory Assessment:
The subject lot is zoned ‘Rural’ under the Shire’s Town Planning Scheme No.1 and is bound by rural zoned
land, with the exception of the northern boundary which is zoned ‘Conservation’.
Clause 5.24.1 of the Shire’s Town Planning Scheme No. states that in a Rural Zone ‘not more than
2,000m2 on any lot shall be cleared of indigenous trees or substantial vegetation. If the local government is
satisfied upon receipt of a submission the clearing of an area greater than 2,000m2 will not adversely affect
the amenity, character and landscape qualities of a locality it may approve such land to be cleared subject
to conditions as may be required by the local government’.
As the land proposed to be cleared is greater than 2,000m2, the matter is being considered by the Council
for approval.
Under clause 4.2 of the Shire’s Town Planning Scheme No.1, the objectives of a Rural Zone are outlined as
follows:
• To ensure the continuation of broad-acre farming as the principal land use in the District and
encouraging where appropriate the retention and expansion of agricultural activities;
• To consider non-rural uses where they can be shown to be benefit to the District and not
detrimental to the natural resources or the environment; and
• To allow for facilities for tourists and travellers, and for recreation uses
The proposal to clear Lot 1476 for cropping and grazing is consistent with the objectives of the Rural Zone
under the Shire’s Town Planning Scheme No.1.
Conclusion
As the purpose of the proposed clearing to use the land for cropping and grazing is consistent with the
objectives of the Shire’s Town Planning Scheme No.1 and given the rigorous assessment process
undertaken by the Department of Environmental Regulation in determining an application for a clearing
permit it is considered that without access to an environmental impact study on the site, the Council
support the application subject to approval and compliance with all conditions imposed by the Department
of Environment and Regulation and request a copy of the approval and any environmental impact studies
undertaken as part of the assessment process.

13.5.2 GENERAL UPDATE ON TOWN PLANNING MATTERS
Proposal for ‘Horse Paddock’
A meeting was held on the 22 September 2015 with the Department of Education, the Hyden Primary
School Principal, the applicant, the Shire’s Planning Officer and Environmental Health Officer, a Shire
Councillor and representatives from the Lions Club and the Whispering Gums Retirement Village
committee, in which it was agreed that the Lots 330 and 331 Clayton Street, Hyden were not appropriate to
house horses.
Alternative sites were discussed, in particular Lot 800 south of the Shire depot. Part of this Lot is zoned

zoned area of the Lot, then planning approval will not be required and it will be exempt from the

BACKGROUND
This report provides an update for Council on work that Council’s Environmental Health Officer provides for
the communities within the Shire of Kondinin for the period of August and September 2015.
COMMENT
Kondinin Clean-up Project – Notices Served for overgrown and disused materials in yards
Following on from the Notices served the EHO continues to conduct site investigations and where possible
meet up with and/or contact the owners to determine that progress is ongoing or at all; the following
information is now available for efforts undertaken for August and September 2015:
• Mr M Smeed, property at 14 Rankin Street; Mr M Smeed met with the EHO and DCEO at the Shire
office to discuss matters which were causing a delay in further cleaning up of the property in
question. Mr M Smeed said the matter of the scrap metal was still bothersome because he insists
he must be there to supervise removal, the EO said he can mark the items with paint and supervise
the scrapper whilst material was being removed to which Mr M Smeed said he will ‘look into it’.
Based on this days discussion with Mr Smeed with the EHO and DCEO it was agreed that an
extension until the 4 January 2016 would be in order due to the particular circumstances and that
progress would be most welcome during the extended time period.
• Mr J Ljubic & Ms G Zagar, property at 49 Rankin Street – no further works observed since last
discussion with owner.
• Mr A Chambers, properties being Number 26 (Lot 30) and number 28 (Lot 29) Rankin Street
Kondinin has been assessed since the occupier Mr D Chambers, acting on behalf of the owner Mr A
Chambers gave his word items would be removed. Observations have shown some progress to
remove vehicles and disused items from the verandah which in light of previous progress is a good
result although more is required and will be followed up.
Bendering Landfill Update
26 August 2015 - Site inspection with EHO Pitman & Goldacre and Mr A Fisher of Avon Waste to discuss
expansion programme of landfill (Stage II & III) and items generally. Key issues were the existing unused
areas of Stage I located at the northern and middle portion of the East end. Mr A Fisher was convinced that
with the correct machinery those areas previously deemed unsuitable would be opened up for better use.
It was acknowledged that they became unusable in wet weather but there exists presently trench three

plus the gravel trench when the gravel is taken out which would be able to be used in the wet times and
are already set up with netting, fencing and tree buffers.
Discussions after the failure to get appreciable depth in the Stage II & III areas both Mr Alf Brooks and DCEO
Mr A George said that depth of up to 5m to 6m was achievable in the Stage I area and should be revisited
for further investigation potential due to the same equipment being needed for Stages II & III. To
accomplish the maximising of Stage I areas efficiently it would require the use of a dump truck to take out
overburden and the use of machinery to push out the hard conglomerate/calcite type hard rock which
generally speaking requires a ‘rock breaker’ attachment and/or a heavy duty dozer; it has been suggested
that explosives could be used. There exists contractors who can provide this type of machinery and the
team which needs to be seriously considered. It was discussed logistically that although the costs would be
greater if more trenches are dug out in one operation the mobilisation costs which can be expensive are
minimised (2 trenches + $2,100 mobilisation fee Vs 6 trenches + $2,100 mobilisation fee). When it is
decided on the next stage of development for the landfill a tender will need to specify the exact details of
what is required and also how the trenches need to be finished off such as flat and level to allow the trucks
to get into the trenches without having to articulate the suspension so much the vehicles get damaged.
EHO Goldacre will work on the plan for extending the life of Stage 1 bearing in mind the approach to
digging the trenches will need to be modified to get the desired outcome. Now that we know Stage II and III
did not meet expectations there is potential to save costs overall in the life of the Bendering site by
developing Stage 1 more efficiently but will require supplementary outlay to get the best outcome with the
main factor being removing the conglomerate/calcite type waves with the most appropriate
digging/explosives and removal gear.
Mr A Fisher inspected the test trench in the new area and said they could use it but would need to flatten
out the base more to enable the trucks to drive over it. Netting was suggested but Mr A Fisher said this
would inhibit the collection of overburden on the sides unless another trench is dug out nearby. It was from
these discussions that it was floated the remaining Stage I area should be utilised by having the right gear
to get through the hard ground; essentially a ‘6 and two 3s’ situation when measured against the
requirements of Stage II & III.
Discussions with Mr A Fisher about covering asbestos placed in the asbestos pit to which Mr A Fisher said
they could accommodate this but would need to put a filter in the AC system as required for this duty. All
received asbestos is wrapped and it may be wise to require that it is double wrapped to ensure minimal
breakage when covering with overburden and should this be adopted it can be placed into the asbestos
disposal forms. This would mean disposal of asbestos at the Bendering site would be on Mondays only but
would negate the need to mobilise a vehicle from a neighbouring shire to cover the asbestos waste within
the required 24hrs.
One area of concern is the green waste which is now well seasoned and requires a burn off, neighbouring
Shires will be approached to see if a fire truck and fire control officer can be made available to burn off. In
this case if in October a burning permit may be required.
Food Act Registration & Inspections
From time to time the EHO conducts inspections of registered food premises to determine compliance with
the Food Act 2008. In this instance three more premises were inspected and also a pre-start up inspection
for a café to be located in the CWA building in Hyden. The Wave Rock Weekender temporary food premises
have been contacted to ensure all the appropriate approvals were in place which after some negotiations
and assistance from the LGs in the City everything was in order for the event.
Wave Rock Weekender
The final stage of the risk management plan and emergency management plan were fine-tuned with
emphasis on ensuring a safe public event. Areas of fire safety onsite as well as the surrounding vegetation
were assessed to ensure the safety of the event. The swimming pool at the caravan park was tested and
declared safe to open. An inspection on Friday 25 September in the evening revealed a well set up event
with good security and good operators in the temporary food stalls and vans.
Landfill-Transfer Station Annual Reporting operational review
The EHO is still completing a report on the transfer stations operations and is endeavouring to complete a
report. The Dept of Environment Regulation annual reporting has been completed where one response
back was ‘you have not told us how you are controlling dust at the site’ and this is in reference to the gravel
road into the site as it’s now a transfer station. The reply to this was if dust is a serious issue for the DER

then they may want to start contacting all the farmers about the seriousness of it when they start tilling the
land.
Septic investigations and approvals
The EHO visited the Forrestania mine site to sort out the disposal area for the aerobic treatment unit for
the new paste plant accommodation. Later on this site was found to be prone to flooding so a more
traditional disposal system was implemented. The Hyden Airport Terminal had a Schedule 8 test done for
soil absorption to determine type of leech drain required. The results were good and it passed the test
resulting in a traditional system being able to be installed.
Caravan Parks and Lodging Houses
The EHO has carried out an inspection of the Wave Rock Caravan Park; in part in preparation for the Wave
Rock Weekender and to issue the license required and has provided a report to the manager of the site.
EHO L Pitman inspected the Tressies caravan park and a report has been issued to the owners.
Kondinin Swimming Pool
The EHO as well as DCEO Mr A George have been working with the builder Mr R Smeed towards getting full
compliance with the swimming pool in preparation for the season opening and the swimming pool
manager’s meeting/accreditation event on the 28 October. Discussions with the Dept of Health reveal no
concerns from their side due in part to having inspected the swimming pool and being happy with the
result. The DoHWA will wait on the EHOs Form 4 public building approval and assessment documentation
to then issue the Certificate of Approval for a Class 1 swimming pool as well as the Certificate to Operate
(last years was a special exemption).
Potential Horse Keeping in the townsite of Hyden
The EHO along with CDO Mrs T Young met with the Dept of Education, the proponents and concerned
members of the Hyden community regarding keeping of horses on the north side of the townsite. From an
Environmental Health perspective the Health Local Laws only apply to permit the keeping of horses within
the townsites only with Council permission. There exist in the Health Local Laws standards for stables and
storage for manure and well as regular cleaning and the like. Due to the assistance from the community
members it was agreed that another site, outside the townsite boundary, be investigated and
arrangements made with the owners of that land which is believed to be ongoing. Provided the keeping of
horses does not occur within the townsite boundary (as gazetted) then the Health Local laws will not apply.

13.9 MAINTENANCE REPORT – SEPTEMBER/OCTOBER 2015
The Month took in a small but steady amount of routine Maintenance around the Kondinin caravan park
and chalets.
A great deal of time and effort was put into removing all the old copper logs from around the car parks and
walkways at Wave Rock. We had a few very long into the night days doing this work and then installing all
copper log post and rails. Hippos Yawn has had all new post and rails around the entire car park with a
couple of places blocked and a new "One point of entry" at the pathway to Hippos. While doing this area a
lot of time was spent consulting with Coach Drivers in regards to the way it was planned out as to make
their drop off point more convenient. Over the next month or so some new signs will be erected making
"Bus Only" parking as requested.
The front of the café came up well as did the bus drop off point at the side. The entire length of the
walkway from the caravan park to the rock face walkway was also replaced. A lot of this work was done at
night to try and keep disruption to visitors down to a minimum. This was able to be achieved with the help
from Sheena Collins who very kindly donated two nights accommodation and we were then looked after
with refreshments during the day from the staff of the café. So thank you ladies - it was very much
appreciated.
The Hyden swimming pool had some general maintenance carried out with a new fence erected at the
Eastern end near the pump house. We are awaiting the frame for the new gate to be made and it will then
be erected and the old fence and gates removed. Arrangements were made for the old urinal and pipework
in the male toilet to be removed and replaced and this will be done very soon. The old roller doors were
removed from the front of the kiosk and replaced with very smart looking new windows and sliding screens
along with a new screen door. Further work will be carried out at the pool in the next few weeks.
New LED lights were sought with the first 60 being installed at the Kondinin Administration Building. Once
again this work was carried out at night extending into the small hours of the morning. A further 60 tubes
will be arranged as a second stage install in the next couple of months or so.
The Hyden sports pavilion had new hand towel dispensers installed in the new male toilets and female
toilets/change rooms .
Both Repeaters at Karlgarin and East Hyden were inspected for the month.
Avon Waste environmental toilet was serviced.
KN-53 is currently off the road after an accident.
