Under correspondence, the Clerk read a letter into the record from Chris Harrifeld, Field Representative from Jail Standards. The annu-al inspection of the jail facility will be held on June 13, 2017. Next, the Clerk read a letter from Cathy Armstead, Neptune & Company, Inc., and Doug Gillespie, Nebraska Department of Health and Human Services, which stated that Union Oil Company of California had voluntarily conducted inspections and abatement activities along the former Arapahoe Pipeline Corridor in Kimball and Cheyenne Counties. Roger Conley, Building and Grounds Superintendent, updated the Board on department activities. Superintendent Conley presented a pro-posal from Kevin’s Custom Electric for electrical repair at the fairgrounds. The repair included installing a terminal box, refeeding the existing load center and installing a separate disconnecting means for the carnival hookup at the fairgrounds in the amount of $1,350.00. This repair will be addressed in the 2017-2018 budget. The sale of the surplus equip-ment of the County was discussed. No action was taken at this time. Eugene Nienhueser addressed the Board regarding the use of the camping facilities at the fairgrounds. A dis-cussion followed. A motion was made by Miller to allow camping at the fairgrounds by individuals renting the 4-H, Exhibit and/or Pavilion buildings for an event and when such event has been approved by the County Commissioners; and, camping will only be allowed by individuals involved with such County-approved event and will be permissible only on the dates the building(s) are being rented. Also, there will be no hookups to the electricity, water or sewer permitted. There is no designated parking area; however, there will be no parking inside the Pavilion building and no tents will be allowed. Sanders seconded the motion. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None. Brad Zalesky, Fair Board member, appeared before the Board to discuss an informal quote to relo-cate the power pole at the fairgrounds. Present for this discussion were Gerald Frerichs, Anita and Gerald Pennel and Jason Juracek. Mr. Zalesky stated he had discussed the mat-ter with the Wheat Belt Public Power District Board. Zalesky further stated that there would be no cost to the County to relocate the power pole. No action was taken at this time. Mr. Zalesky informed the Board that he would not be speaking, at this time, as to the informal quote to enlarge the arena at the fairgrounds. Mr. Zalesky discussed the use of the arena by the Sidney Cycle Association to hold a motocross race during the Cheyenne County Fair. He stated the Association carried its own insur-ance and waivers and the members of the Cycle Association would restore the arena to its previous condition prior to the 4-H Horse show at 9:00 A.M., the following day. Due to the time constraints to restore the condition of the arena, Commissioner Miller suggested the Fair Board members discuss the matter with the Cycle Association members and select another date. There was no Informal quote to repair damage to the arena lighting. Gerald Frerichs, President of the Fair Board, updated the Commissioners on Fair Board activities. Gerald Pennel, Fair Board mem-ber, spoke to the Board regarding door locks on some of the fair buildings. At the February 21, 2017 Commissioners meeting, Mr. Pennel was directed by the Commissioners to rekey locks on some of the fair buildings. After a

d i s c u s s i o n , Commissioner Miller sug-gested that a meeting be arranged to discuss the door locks. Included in the meeting with Commissioner Miller would be Sheriff John Jenson, Building and Grounds Superintendent Roger Conley, County Attorney Paul Schaub

and Fair Board members Gerald Frerichs and Gerald Pennel. The meeting was scheduled for Tuesday, May 2nd at 6:00 P.M., in the County Commissioners meeting room. At 9:00 A.M., a motion was made by Sanders, seconded by Miller to go into executive session for a strategy ses-sion regarding real estate purchases. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None. Present in executive session were County Attorney Schaub, Clerk Fiegenschuh and Treasurer Scott. At 9:20 A.M., a motion was made by Miller, seconded by Sanders to go out of execu-tive session. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None. Highway Superintendent Doug Hart, presented an Agreement for professional engineer-ing services regarding the asphalt overlay of approxi-mately 3 miles of County Road 46 from County Road 125 to County Road 131 and an Agreement for professional engineering services regarding con-struction of a double 12’ x 12’ reinforced concrete box culvert on County Road 109 approximately 1⁄4 mile south of County Road 38. The cost of the asphalt overlay project was $53,139.00. The cost of the box culvert project was $25,583.00. A motion was made by Miller, seconded by Sanders to approve the Agreement for the asphalt overlay project in the amount of $53,139.00 as above described. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None. Next, a motion was made by Miller, seconded by Sanders to approve the Agreement for the box culvert project in the amount of $25,583.00 as above described. Larry Nelson previous-ly spoke to Superintendent Hart regarding the con-dition of a County road. A motion was made by Johnson, seconded by Sanders to put this item on the Agenda for the May 15, 2017 Commissioners meeting. Roll Call: Aye: Miller, Sanders, Johnson. Nay: None. At 9:45 A.M., Chairman Johnson declared the public hear-ing open to review and consider approval of the One and Six Year Road Improvement Plan. Highway Superintendent Hart explained the One and Six Year Road Improvement Plan. There was a discus-sion. There were no mem-bers of the public pres-ent and no objections were heard. A motion was made by Sanders, sec-onded by Miller to adopt Resolution 2017-8 approv-ing the One and Six Year Road Improvement Plan as reviewed. Roll Call: Aye: Sanders, Johnson, Miller. Nay: None. A complete copy of the Resolution as adopted is on file at the Office of the County Clerk. At 9:55 A.M., Chairman Johnson declared the pub-lic hearing closed. Next, the Board considered selling the surplus weed chemi-cals to Cris Burks d/b/a C-Weed Management. Cris Burks was present for the discussion. Burks pre-sented a proposal for the purchase of the unopened chemicals in the amount of $2,480.39. A motion was made by Miller, sec-onded by Sanders to sell the unopened chemi-cals to Cris Burks d/b/a C-Weed Management in the amount of $2,480.39. Any opened chemicals will be disposed of as direct-ed by the Commissioners. Commissioner Miller will meet with Burks regard-ing the disposition of the chemicals. Roll Call: Aye: Johnson, Miller, Sanders. Nay: None. Assessor Sybil Prosser updated the Board on the Assessor’s activi-ties. Public Comments: Teague address the Board regarding barking dogs and better enforcement options.

Geo Spec Drilling, Bo Bonn and Bill Christenson presented information on well rehabilitation as a pos-sible solution to help the arsenic level in the water. After a discussion, Taylor and Lofton will gather information and send it to Geo Spec to determine if this option would be fea-sible for Lodgepole.

At 8:12 PM a motion by Savely, seconded by Misegadis to go into execu-tive session to the pur-pose reviewing past due accounts. At 8:23 PM a motion by Bondegard, sec-onded by Savely to come out of executive session, Runge, Savely, Bondegard and Misegadis voting yes, none voting no, Dishman absent, motion passed.

Reports were heard from the village attorney, sewer & water department, parks, sanitation, roads, fire hall, community hall and clerk.

A motion by Savely, seconded by Misegadis to accept with regret the res-ignation of Eric Dishman from the Village Board of Trustee due to relocation; Runge, Misegadis, Savely and Bondegard voting yes, none voting no; Dishman absent, motion passed. Letters of interest for the Board opening will be

L17-322ORDINANCE NO. 1789AN ORDINANCE OF

THE CITY OF SIDNEY, NEBRASKA, RELATING TO SANITARY SEWER SERVICE RATES, EFFECTIVE DATE OF RATES, AMENDING SECTION 1045.31 OF THE CODIFIED ORDINANCES OF THE CITY OF SIDNEY, NEBRASKA; AND PROVIDING FOR PUBLICATION.

BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF SIDNEY, NEBRASKA:

SECTION 1SECTION 1045.31

CHARGES(A) Unless the context

specifically indicates other-wise, as used in this sec-tion:

(1) “Normal domes-tic wastewater” means wastewater that has a bio-chemical oxygen demand concentration of not more than 200 mg/l, a total sus-pended solids concentra-tion of not more than 240 mg/l and a total nitrogen concentration of not more than 40 mg/l.

(2) “Operation and Maintenance” means all expenditures during the useful life of the treat-ment works for materials, labor, utilities and other items which are necessary for managing and main-taining the sewage works to achieve the capacity and performance for which such works were designed and constructed.

(3) “Rep lacement ” means expenditures for obtaining and installing equipment, accessories or appurtenances which are necessary during the useful life of the treatment works to maintain the capacity and performance for which such works were designed and constructed.

(4) “Residential con-tributor” means any con-tributor to the treatment works whose lot, parcel of real estate or building is used for domestic dwelling purposes only, and is not a multi-family unit or used for mixed purposes.

(5) “Sewer use charge” means the charge which is levied in a propor-tional and adequate man-ner for the cost of opera-tion, maintenance and replacement of the waste-water treatment works.

(6) “Useful life” means the estimated peri-od during which a treat-ment works will be oper-ated.

(7) “Water meter” means a water volume measuring and recording device, furnished and/or installed by the City, or fur-nished and/or installed by a user and approved by the City.

(B) The total sewer charge shall consist of a customer charge as fol-lows:

(1) The residential customer charge is six-teen dollars ($16.00) per month. The above rate is effective July 1, 2017.

(2) The commercial customer charge is:

(3) Sewer use charg-es:

a)For residential cus-tomers, the monthly charge for the twelve months following March 1 of each year shall be based on average water used during the preced-ing months of December, January and February for that property. Adjustments will be considered for bro-ken underground water service lines, provided written proof of repair is provided to the Water/Sewer Superintendent. Until consumptive history is properly established, and for previously unoccupied residential properties, the monthly charge shall be based on typical residen-tial consumption of 3,000 gallons.

c)If the concentration of wastes from any user exceeds 200 mg/l B.O.D. or 240 mg/l T.S.S. or 35 mg/l T.N.,such user will be subject to a surcharge. The surcharge shall be based on that amount of waste which exceeds the following concentrations. Effective October 1, 2014, the charge shall be at the following rates:

charges prescribed by this section shall be collected at the same time, in the same manner and by the same officers as the water charg-es are collected by the City and shall be included on the same billing or state-ment that is used for the billing for water services.

(D) Each sewer ser-vice charge prescribed by this section shall be a lien upon the premises or real estate on which, or for which, the sewer service was used or sup-plied from and after the time such amounts are delinquent, as provided in Section 1040.01. The City Manager shall, on June 1 of each year, or at such other times during the Municipal year that he or she deems it necessary to protect the interests of the City, report to Council a list of all unpaid accounts due for sewer service, together with a description of the premises or real estate on which or for which the sewer service was used or supplied. Such report shall be examined and, if approved by Council, shall be certified by the Clerk-Treasurer to the County Clerk giving the amounts due and the description

of such premises or real estate. Such amounts shall be certified, assessed, collected and returned in the same manner as other Municipal taxes. Such sewer service charges are also the personal liability of the owner of such premises or real estate and may also be recovered by the City in an action at law by the City against such owner. When any sewer service charge becomes delinquent for nonpayment, water service and sewer service of such user may be disconnected until payment is made and a reconnection charge of sixty dollars ($60.00) is paid.

(E) There are hereby established the required accounts for the purpose of managing the revenues derived and to be derived from the City’s sanitary sewerage system. A separate account, to be known as the “Operating and Maintenance Account,” shall be established for the purpose of paying the operation and maintenance costs of the wastewater works. Funds required for this account shall take precedence to ensure sat-isfactory operation of the system. An account to be known as the “Repair and Replacement Account” shall be established for the purpose of repair-ing or replacing portions of the works. Deposits shall be allowed to accrue without a maximum limit. Other accounts as estab-lished by a bond ordinance shall receive deposits as required in the ordinance.

(F) Sewer use rates shall be reviewed and revised as necessary to keep revenues reasonably in balance with anticipated expenditures. This review shall include an analysis of the balance credited to the “Repair and Replacement Account,” such that suf-ficient funds are accrued to provide for the expect-ed replacement costs of the wastewater works. Adequate funds shall con-tinue the fair and equitable distribution of all costs to all users of the system.

(G) Excess funds shall be carried forward from year to year in the respec-tive accounts. Funds transferred from other sources for temporary shortages in the Operation and Maintenance or Repair and Replacement Accounts shall be returned to those respective Accounts upon adjustment of user charge rates. The rates shall be adjusted such that the funds transferred will be returned to their respective accounts in the fiscal year following the year in which the funds were transferred.

(H) Any user dis-charging toxic pollutants to the system shall pay for such increased costs of managing the effluent or sludge by the treat-ment works. Charges shall be as deemed necessary by the City to recover the increased costs.

SECTION 2 – ORDINANCES REPEALED

That Section 1045.31 of the codified Ordinances of the City of Sidney, Nebraska, 1977, as the same currently exist, be and hereby is repealed and replaced by Section 1 set forth above.

SECTION 3 – PUBLICATION

This Ordinance shall be published in The Sidney Sun Telegraph.

This ordinance shall take effect from and after its passage at the time provided by law.
