Convention on the Conservation of Migratory Species of Wild Animals

Format for reports of Parties on implementation of the

Convention on the Conservation of Migratory Species

of Wild Animals (revision of June 2003)

Reporting format agreed by the Standing Committee at its 26th Meeting (Bonn, June 2003) for mandatory use by

Parties, for reports submitted to the Eighth Meeting of the Conference of the Parties (COP8) (Nairobi, 2005).

The questions below combine elements of Resolution 4.1 (Party Reports) adopted by the Fourth Meeting of the

Conference of the Parties (Nairobi, June 1994) and Resolution 6.4 (Strategic Plan for the Convention on Migratory

Species 2000-2005), adopted by the Sixth Meeting of the Conference of the Parties (Cape Town, November 1999), as well

as commitments arising from other operational Resolutions and Recommendations of the Conference of the Parties.

Please refer to the separate instructions on completing the report. Parties are encouraged to respond to all questions,

since it cannot be assumed that the absence of a response indicates that no activities taken have place in the current

reporting period. Parties are also requested to provide comprehensive answers, including, where appropriate, a

summary of activities, information on factors limiting action and details of any assistance required.

Implementing legislation (the Netherlands): The Flora and Fauna Act of May 1998. . It replaces the 1936

Bird Act, the Netherlands Game Act, the Act of Endangered

Exotic Animal and Plant Species and part of the Nature

Conservation Act.)

The new Nature Conservation Act has come into force in

October 2005.

The two laws deal with species protection and area protection

respectively and they implement the EU Wild Birds and

Habitats Directives. (which, each of them, combine species and

area protection).

A European directive is in construction. Since august 1999 each form of oil dumping is prohibited. The Dutch policy and

standards are based on the MARPOL-convention. Coast guards intensively monitor oil pollution from the air.

Resolution 7.4 – Electrocution of Migratory Birds:

Existing power lines which are located in migratory routes are constructed with anti bird collision devices. For new powerlines

article 9 of the flora and fauna law is relevant. This article forbid killing or injuring of birds. This means that new powerlines

are not allowed in places with many possible victims.

Resolution 7.5 – Wind Turbines and Migratory Species:

For new wind turbines article 9 of the flora and fauna law is relevant. This article forbid killing or injuring of birds. This means
