Introduction This case study is being done for the subject Occupational Safety & Health (AW101). The task requires us to do an interview and an observation to a company which has more than 40 workers. The objectives of this case study are to explore reality environmental situation at workplace in Malaysia related to safety & health matter, to get information on enforcement of Occupational Safety & Health Act 1994 to selected workplace, to give current scenario on knowledge and practicing of OSHA Act 1994 of employees and employer, to strengthened soft skills of students while dealing with employees and employers in selected workplace, to able the students applying knowledge they have on occupational safety and health at workplace to the real situation and lastly to come up with comments and suggestions in order to give better safe and health workplace environment to selected workplace. On 5 April 2013, an interview has been done to TF VALUE-MART Behrang 2020 and we had come up with few conclusions about the application of safety and health in the company TF VALUE-MART. The report had been prepared and a few comments and suggestion had also being given.

Background of company

TF Value-Mart has its beginnings as a Chinese medical shop in Bentong, Pahang. The Company first started operations as Chop Tong Fatt in 1957. Since then the Company has evolved through the years as a mini-market, departmental store and today as a thriving chain of hypermarket-concept outlets. Now, TF already has 11 branches spread all around Malaysia. They have adapted our retail format to meet changing consumer needs and will continue to do so to deliver the best value to our Customers. TF is abbreviated from "Thoong Fatt" which in Mandarin means to prosper together. And this has been the guiding principle in the Company's conduct of its business. Our business philosophy is to ensure the best value for our Customers by working closely with our business partners to achieve this.

Application of OSHA Act 1994 in the company.

As TF Value-Mart Sdn. Bhd. grows in size and employs more and more workers, the issue of application of Occupational Safety and Health Act 1994 becomes a more pressing issue that needs to be urgently addressed.

The OSHA is a relatively young legislation in Malaysia compared to others acts and regulations. In view of the constraints in the OSHA legislation, TF Value-Mart Sdn. Bhd. are still struggling to meet the minimum requirements for safety and health at workplace.

Luckily, OSHA has been successful in reducing the rate of accidents per 1,000 workers but the OSHA has only been effective to a certain extent in tackling OSHA problems while fatality rate still remains high. Injuries from the transportation of goods and exposures to seafoods are still rampant among TF Value-Mart Sdh Bhd.

company.

Puan Nur Shima Azlin binti Mahadi answer us that the responsibilities of employer to the safety & health of the employees in the company is to make sure that their employees are protected under SOCSO & PERKESO. It is the responsibility of the company to take steps to protect its workers’ safety and health. Other than that, if there is any accident happen during the working time, human resourse manager of the company while give immediate medical care to the respective employee. Compensation while also been given to the employee reasonably.

Under section 30 of the OSHA, employers who have 40 workers or above, or as directed by Director General, must establish a safety and health committee at their workplace. The committee’s main function is to review the measures taken to ensure the safety and health of workers at the workplace and investigate any related matters arising.

Kind of the employees responsibilities in the

company.

In our interview, we were informed that the employees of the company are required to protect themselves under SOCSO. They need to fill the forms for them to be protected before they start working in the company. Other than that, there is an employee union that is being conducted by the employees lead by the grand manager. The function of the employee union is to reduce the amount of work related to employee budgeting, because human resourse department can use figures outlined in the union contract from year to year. This allows employees to be able to predict what they'll earn, and employers can estimate their expenditures far in advance. Besides that, employee union is like a platform for the employee to stand up and give an opinion on employee’s rights.

Working environment and ergonomic concept applied in the company.

A safe working environment is applied in this company. As the company is grocery and seafood provided supermarket, the safe working environment is applied all around the market. The floor always kept dry and clean. Other than that, the back door of the premise always locked to prevent unwanted strangers to enter. The emergency signs always indicated clearly to the workers. The ergonomic concept is also applied. For secretary and officer workers, proper tables and chairs are provided. While for the cashier, the working table is built to ease the worker to do their jobs and facing customers. Trays and machines are provided to ease the employees to transfer heavy goods.

Accident prevention methods taken in the

company.

There are few accident prevention methods taken by this company. In fresh department and frozen food department, the floor always kept dry and not oily to prevent the worker to slip. There is also a chart on how to lift heavy things. This is to prevent back injury to the worker. The worker working in fresh department and related to handling food are required to wear covered shoes, apron and gloves to keep the foods hygiene. The wet floor sign is placed on the floor after the floor is being mopped.

Identification of hazard, risk assessment and risk control

method used to prevent from any incident and accident happen in

the company.

Hazard Identification

Hazards can be divided into three main groups :

1. health hazards2. safety hazards3. environmental hazards.

Risk Control Methods

Avoidance – identifying and implementing alternative procedures or activities to eliminate risk.

Contingency – having a pre-arranged plan of action that will come into force as and when the risk occirs.

Prevention – putting in place measures to stop a problem from occurring or having impact on a work area or organization.

Transference – transferring the risk to a third party, for example with an insurance policy.

Safety and health training given to the

employees of the company.

Safety and health training has been given to the employees during the start of their jobs. They were trained by the steps and positions to move the boxes of heavy products of grocery. The training also taught them about their own safety in the working place. Besides, everyday they will be given briefing about their working safety and the person in charge of every week if any incidents occur.

First aid tools provided to employees.

First aid tools are always provided in the premise of this company.

There are 10 things that are compulsory in the first aid kit such as a box of adhesive dressing(plasters) of different sizes for covering small wounds, antiseptic lotion to use with the cotton wool and antiseptic wipes and many more.

The medicines will be changed or checked every 2 months by respective officer. Other than that, the employees were trained to use the first aid tools just in case if there is an accident occurs, every employee will be ready.

Type of fighter equipments provided in

There are two types of fighter equipment provided in the premise that are co2 and ABC. They are around 15 fire extinguishers spreading all around the market.

Comments & Suggestions

There are few comments on the application of OSHA in this company. The application of safety and health in this company reached a standard level. The employees seem to have a quite comfortable and conducive working station. Anyway, there are still a few things that can be improved and become better. First, this company should hire a special officer to observe their safety and health frequently. Second, there should be dryer to make the floor at seafood section to dry faster. Many accidents can happen on the employees and customers due to the slippery floor. In addition, the pantry and restrooms for the employees should always be in a much better condition.

Conclusion

Based on our observation and interview with TF Value-Mart Sdn. Bhd. Behrang, we can conclude that this company is doing their best to apply the OSHA act 1994 in the company although there are some parts which are neglected. This company is being protective and concerned towards the welfare of their employees. The prevention of accident in their premises is also maintain at a standard level.

We think that more trays and machines should be provided for the employees to carry and transfer heavy goods in the market. In addition, the market should built and prepare a proper places for the employees to rest and drink water.

Though there are few things to be improved, the employees are observed to have a safe and protected working environment so far.
