The County Manager e-mailed an outline of this part of the agenda to the

board on March 13th

. As a follow-up to his presentation to the

commissioners in December last year, Dr. Don Tomas, president of

Southwestern Community College (SCC), will review the college’s plans for

expansion at the Macon County campus. SCC officials will be asking for

the board’s consideration of a Memorandum of Understanding (MOU) that

would give SCC the right of first refusal regarding approximately 19 acres

of county-owned property located adjacent to the Cecil L. Groves Center,

and that the board would take the proposed MOU under advisement for

consideration at a future meeting.

RE: Parker Meadows Recreational Park Permitting, Bidding, and Construction Administration in Macon County, North Carolina Project # 1300

Thank you for giving us the opportunity to provide this proposal for the Parker Meadows

Recreational Park Permitting, Bidding, and Construction Administration for Phase I and Phase II in Macon County, North Carolina. The subject property is located off Old Patton Road, Patton Road, and Maxwell Home Road and bordered by the Cartoogechaye Creek in the western portion of Macon County. We understand the property consists of approximately forty-seven (47) acres, identified as Parcel ID Number (PIN) 6564-80-2513 and with a property address of 1020 Maxwell Home Road. The property currently consists of mostly flat, undeveloped, partially wooded, agricultural fields that include a wetland, several small streams, the Cartoogechaye Creek, a pond and a stormwater basin. There is also an existing residential-style office building, construction trailer, irrigation pump house and old storage/maintenance shed on the property.

As part of the engineering services, we will work closely with members of the Macon

County Staff to create a grading, erosion control, and storm drainage design for Phase II. This design will be based on the master plan that was created for the PARTF Grant. We will also coordinate the permitting that will be required with Macon County, the North Carolina Department of Environment and Natural Resources (NCDENR), United Stated Army Corps of Engineers (USACOE), the North Carolina Wildlife Resources Commission (NCWRC), and the North Carolina Division of Water Quality (NCDWQ). We will assist and coordinate the Public and Private Bid Process for the Phase I and Phase II construction activities as listed below. We will provide Construction Administration and Observation Services to support the project during construction as listed below. We will provide a letter of certification to the Local Government Commission (LGC) for all the required permits for construction for the entire project as required.

Proposal for Professional Engineering Services:

I. Design, Permitting, and Construction Documents for Site Infrastructure on the Parker Meadows Recreational Park

A. Grading and Erosion Control (EC) Design and Permitting $5,000 Grading of youth fields, surrounding area, and parking areas Earthwork quantities Detailed erosion control design and calculations for submittal to the

NCDENR for review and approval of a Grading Permit, revisions per NCDENR comments, signed and sealed construction documents.

B. Preliminary Geotechnical Exploration $5,000

We will collaborate with Kessel Engineering Group (KEG) to provide geotechnical recommendations for the foundation design and site preparation of the recreation park

Perform a series of twelve (12) soil test borings (ASTM D 1586). At the completion of drilling, the boreholes will be backfilled with the soil cuttings brought to the surface by the augers. Samples obtained from the borings will be examined in our laboratory and visually classified (ASTM D 2488). Borings will extend to depths of 15 feet beneath the existing ground surface, or until refusal, whichever occurs first. We also propose to gather a minimum of one (1) bulk sample from proposed cut areas for Standard Proctor testing (ASTM D698)

A report will be provided that presents our geotechnical exploration and recommendations for foundation design and site preparation of the proposed construction. The report will include the following:

- An explanation of field and laboratory test procedures and presentation of test results.

- Estimated subsurface profiles as necessary to illustrate subsurface conditions including standard penetration resistance test data, groundwater levels, and other applicable data

- Evaluation of the site considering the proposed project and estimated subsurface conditions

- Recommended design and construction criteria (i.e. specifications) for project foundations

- Recommendations for flexible and rigid pavement design including subgrade requirements

- Recommendations for site preparation and construction of compacted fills

Includes the size and design for a private domestic water system to serve bathrooms, concession areas, and maintenance areas for the recreation park, to be permitted thru Macon County.

Coordination with Macon County for installation of domestic well, with architect for location of water services.

Includes design calculations and submittal package to Macon County Environmental Health Department (MCEH) for permit approval, signed and sealed construction documents.

Includes necessary details and specifications required for construction.

F. Sewer Extension $3,000 Includes the size and design for a private gravity sewer system and required

pump stations to serve bathrooms, concession areas, and maintenance areas for the recreation park, to be permitted thru MCEH for permit approval, signed and sealed construction documents.

G. Septic System Design $5,000 We will collaborate with Brooks Engineering and Associates (BEA) to

provide design and permitting services thru MCEH for the 1650 gpd septic system needed for the recreation park.

Provide engineering plans and specifications for the permitting of the septic system, including any pumping and pressure distribution to the gravity flow drainfield. Engineering plans and specifications provided for the proposed systems shall be in accordance with NCAC 18A .1900 Laws & Rules for Sewage Treatment and Disposal Systems.

Obtain permit approval from MCEH, signed and sealed construction documents.

H. Driveway Permit $1,500 Submit plans to the North Carolina Department of Transportation (NCDOT)

to obtain driveway permits for the park entrance off Patton Road and Maxwell Home Road.

I. Stream Crossing Permits $2,000

Submit creek crossing design and application to the United Stated Army Corps of Engineers (USACOE), the North Carolina Wildlife Resources Commission (NCWRC), and the North Carolina Division of Water Quality (NCDWQ) for the two (2) creek crossings that will be required for the entrance road into the park.

The above proposal does not include the following: Printing costs, travel miles, surveying, construction materials testing, lighting plan, power company coordination or any application/permit fees. We propose to perform the following scope of services for a fee not to exceed $49,500.00, which will be billed monthly on a percentage completed basis for the work performed. If at anytime the scope of services changes regarding this project, we will either bill at an hourly rate ($100/hr) for additional services or provide a written estimate for the changes and receive approval prior to proceeding forward. Professional services will be invoiced at the end of each month for services performed during the previous month or upon the completion of the project. All invoices are due within 30 days of invoice date. Interest will be due at 1 1/2% per month on outstanding invoices in excess of 30 days. If full payment is not made within 60 days of date on the invoice, Michael Lovoy, P.E. may exercise the right to terminate the performance of services without further obligation to the Client. Payment will still be due for services completed to the time this option is exercised. Macon County Recreational Center (Maxwell Home Road) Macon County, North Carolina

Dear Mr. Roland: The following summarizes the services to be provided and interest to be assumed by CEtech Associates, P.A. for the development of the subject parcel: PROJECT UNDERSTANDING The entire site is currently undeveloped 47.94 acres with previous landuse as a golf course. The site is proposed for development as a recreational facility to include eight baseball fields. A soccer/multipurpse practice field is also proposed. Parking, domestic utility infrastructure, and incidental building facilities are also proposed. It is also understood that the Macon County property is zoned to accommodate the proposed use. Funding will be in part by a PART F North Carolina Grant, along with County participation. Building Design will be by others. It is understood that time is of the essence. A bid let date of April 15, 2014 is proposed. SCOPE OF WORK I – Site Development Plans A conceptual site plan has been prepared by others and Macon County. The site plan will be reviewed for conformance with regulatory agency requirements, setbacks, municipal ordinances and rules, and existing land features including topography, buried utility locations, existing

Mr. Roland March 12, 2014 Page 2 roadways and access, soil types, waterways, vegetative cover, and other pertinent physical features. Based on the conceptual site plan by the Owner, the Engineer will develop construction drawings for regulatory permitting and sitework construction. The sitework plans will include a master site plan, and a paving, grading, and drainage plan, and water and sewer plans for bidding. It is understood that a Phase I and Phase II of the site is delineated for purposes of permitting, however the entire site will be included in this part of the engineering work. Design work and permitting previously done for Phase I will be included/incorporated into the plans/documents. Soil types at the site vary and the parking and road systems will be designed based on onsite evaluation by CEtech regarding compaction and subbase preparation requirements. The erosion and sediment control plan will be modified for the site concurrent with the grading plans and will be submitted to NCDENR for permitting and/or modification if necessary. Domestic utilities will be via on-site wastewater treatment system and a potable water well is to be drilled or the existing well at the site will be used. This will be coordinated with the Owner. CEtech will prepare plans for the domestic utilities installation. This includes wastewater collection system, pump system (to drainfield), well house/system design and water distribution piping. The working drawings and specifications will set forth in detail and prescribe the work to be done and the materials, and workmanship for the site work and utilities. II – Bidding and Bid Documents CEtech will assemble the necessary bidding information, proposal and contract forms, and conditions of the contract, for approval by the Owner. It is understood that time is of the essence and draft documents will be prepared and submitted to the Owner’s counsel for review within 2 weeks of acceptance of this agreement. CEtech shall request proposals via advertisement, conduct a bid opening, evaluate same and make recommendations of award to the Owner within five (5) days of the bid opening unless negotiations or redesign is required. Upon award of contracts, CEtech shall assure proper execution of the contract documents by the contractors and forward to the Owner for his execution and further approval. Bids shall be opened by the Owner, in the presence of the Engineer, and read aloud by the Owner at the bid opening. The bid opening will be conducted at the Owner’s facility. III- Construction Phase and Geotechnical Engineering (Onsite Observation, Pay Requests, Shop Drawings) The Construction Phase will begin with the notification of award of contracts. CEtech shall issue a letter of Notice to Proceed to the single prime contractor, which letter shall fix and definitely establish the beginning date of time of performance for the contract, and the required completion

Mr. Roland March 12, 2014 Page 3 date. Copies of the Notice to Proceed letter issued by CEtech shall be furnished to the Owner. After a contractor is selected, CEtech will prepare an agenda for a preconstruction meeting. The preconstruction meeting will be coordinated and facilitated by CEtech. CEtech shall establish and conduct monthly progress meetings for contractors' representatives and representatives of the Owner. Such meetings shall be for the primary purpose of assessing the progress of the work and recommending such remedial actions as are necessary to maintain progress and to complete the project within the contract time. CEtech shall process and approve, or take other appropriate action in respect of, progress schedules, shop drawings and other required submissions of contractors promptly; Prepare change orders as required, and have such change orders properly executed and approved before authorizing work on account thereof; Process contractors' applications for payment promptly for authorized work and issue certificates of payment. CEtech shall schedule and conduct onsite weekly and final inspections of the project, coordinating the dates for with the Owner. The Engineer of Record will dedicate 1 day (8 hours) per week at the site, or as required. The project is estimated to reach final completion within nine (9) months of commencement. Other services include: Provide general administration of the performance of construction contracts, including inspection and continuous liaison of the work to ensure compliance with plans and specifications, which inspection shall be by the Engineer of Record. CEtech will provide soils compaction as may be required during construction. This will be based on proctor samples from a local source. OWNER RESPONSIBILITIES Specifically, but not limited to, the following will be provided by the Owner as may be required: Survey data as required for design, including topography (contours on 2-foot intervals and spot elevations), boundaries and lots, easements, right-of-ways, roads utilities and other features necessary for preparation of the plans. This will be in digital format (AutoCad). Note: Construction staking will be by the contractor. Submital Fees (if required) Soils Investigations and Construction Testing (if required) Legal and Administrative Fees (if required) Costs for reproducibles (ie. blueprints, copies, mail, etc.) If required, outside services, including surveyor, geotechnical consultant, and archaeological consultant will be provided by the Owner, and are not included in lump sum fees or estimates.

Mr. Roland March 12, 2014 Page 4 Unless otherwise indicated, this proposal/contract does not include permit application filing fees, reproduction costs, survey services, geotechnical services, aerial photography services, costs incurred as a result of manipulation or encroachment of easements, alleys or right-of-ways, off-site improvements, costs incurred as a result of non-compliance, costs required as a result of environmental impacts, environmental studies or biological determinations not specifically identified herein, costs required for traffic studies or transportation engineering or any costs relating to the design or construction of the buildings, or other structures not specifically indicated in this proposal. Hourly work noted herein and additional work, only as authorized by the Owner, will be provided in accordance with the fee and expense schedule attached. Costs for reproducibles will also be invoiced as per the same schedule. PAYMENT FOR SERVICES CEtech Associates, PA will be compensated in accordance with the following schedule. This Proposal is valid for ten (10) days of the date noted herein. CONTRACT AMOUNT: Execution of this Contract by the Owner authorizes CEtech Associates, P.A. to proceed with the services as outlined herein for with the associated fees and invoice schedules. CEtech Associates, P.A. or its officers reserve the right to suspend or terminate work under this agreement upon failure of the client to pay invoices as due. Macon County may terminate this agreement upon written notification to CEtech Associates, PA; CEtech Associates, PA shall be compensated for work based on percentage of completion for work performed prior to the termination. ln response to your request, RITTBR ARCHITECTURE, P.A. is pleased to submit thisproposal for comprehensive Architectural and Engineering Services relative to theaforementioned proj ect.

BASIC SERVICES PROPOSALISCOPE OF WORK:

Provide comprehensive Architectural and Engineering drawings, as required for Macon Countypermitting, for the proposed approximate 1,800 Square Foot, two story, "concessions/scorer's"

building located atthe Parker Meadon's Recreational Complex in Macon County, North Carolina.

Proposed facilitl is expected to consist of approximately 450 SF concessions facility, 380 SFADA compliant restrooms on the ground level and an additional 483 SF scorer's booth and scorersuppofi facilities on the upper level. The entire footpnnt n'ill have a 10'-0" r.vide, covered patioslab for protection from inclement u'eather.

This proposed facility. is expected to be sited centered rvithin the proposed 'clover-leaf ball-fieldsat the County owned property at Parker Meadows.

It is anticipated the facility will utilize a shallolv, monolithic concrete footing/foundation system,

or alternate stem w-all foundation system, u'ith sealed, split faced insulated masonr\r llalls, pre-manufactured, pre-engineered u,ood roof trusses and metal roofing panels.

Phase 1: - Schematic Design

The Scope of Work is to include coordination with Macon County Planning and Parks and

Recreati,on Departrnent representatives to develop design pararneters and prelimina$ design

drawings, and up to thrce (3) anticipated schematic layout revisions. The documents prepared are

intended to be utilized for construction estimating and Board approval purposes. Documentation

to include boundary and t6pographic surve.v, (by others)^ floor plans, and exterior elevations

intended to delineate the proposed design intent-

Phase 2: - Production/Construction Documentation

Architectural drawings shall consist of floor plan, finishes plan, exterior and interior elevations,

sections, details, and outline specifications, as necessary to obtain the required Macon County

iurisdictional approvals.

Engineering drawings shall include structural engineering design and detailing, foundation plan,

framlng plans and sections" mechanical/plumbing floor/ceiling plans, electrical power and

lighting plans sufficient to depict s-Ystems distribution requirements.

Phase 3: - Construction Coordination

Includes up to four (4) Architectural Application for Palment revierv certifications.

COMPENSATION:

The above-described scope of services u,ill be provided for a lump sum fee of Ten Thousand

Dollars. ($10,000.00) broken dorrm as follorvs:

PAYMENT TO ARCHITECT:

Payment shall be considered due upon receipt and must be received thirty (30) days from date

of invoice. Pal,rnents pa.t d,.e shalibear inte;est at the rate of I ll2Yoper month from the date

Costs for printing, mileage, long distance and cellular telephone calls, postal and non-postal

handling of documents, any artistic materials and/or renderings, are reimbursable expenses to the

Architect. These will bL invoiced as a 1.15 multiplier of the direct expenses inclrred by the

Architect. Printing shall be provided at a cost of One Dollar and Tu'enty-Five Cents per sheet

($1.25lsheet)

For Project representation beyond Basic Services, compensation shall be computed at a rate of

$100.0d/hour, determined as the need for services should arise.

LIMITS OF LIABILITY:

The Owner agrees to limit the Design Professional's liability, to the Owner on the Prqect, due to

the Professionals' negligent acts, errors or omissions, such that the total aggregate liability shall

not exceed Two Hundred Fift--v Thousand Dollars ( $250,000'00 )

TERMS OF PROPOSAL:

This offer shall remain outstanding, for acceptance' for a period of thirtry' (30) days from the date

hereof, and, once u"".p*6, this proaposal shall constitute a binding contract betrveen Ou'ner and

Architect as more specifically described herein'

This proposal may be terminated by either party, with cause, upon seven (7) days r'vritten notice

to tfr" ott e, pafiy; should such paS'fail to perform its obligations in accordance with the terms

thereof. In the event of terminatiorr, ,qr"nit."t shall be compensated for services performed to

termination date, including miscellaneous expenses then due'
