PUBLIC WORKS Mowing Contract Council break at 11:00 a.m. Council reconvened at 11:04 a.m. with the same people as at the beginning of the meeting. NGC-20-049 MOVED by Councillor McLeod that Council enter into a 1-year contract

with Gelowitz Mowing Services for a cost of $1,500.00 with an additional $150 for trimming bi-weekly.

Options for Consideration: Council accept the 2019 audited financial statements as presented and authorize the Mayor to sign the financial return.

Background:Development Permit Update: Currently there are 51 development permits issued in the Summer Villages (20 in Birchcliff, 2 in Half Moon Bay, 11 in Jarvis Bay, 7 in Norglenwold, and 11 in Sunbreaker Cove).

The following is the list in Norglenwold:

83 Grand Ave (retaining wall) was recently closed.

Complaints Update: 1. 53 Grand Avenue - Complaint - Enforcement

a. Driveway constructed without Permit. ($10,500 in legal fees so far)

Agenda Item: Local Improvement Levy Shortfall

Background: On August 29, 2008, Council passed Bylaw 190-08 to impose a local improvement tax for the installation of a Municipal Wastewater Collection system. This Bylaw addresses a 10 year local improvement (LIL) tax which would be paid in equal payments during each year over which the cost of the Local Improvement project would be amortized commencing in 2009.

The annual unit rate per property would be payable at a rate of 12% per annum and be $889.70 per residence. Alternatively, residents had the option of paying their portion in one lump sum. Thirteen properties signed the Local Improvement Levy and have been paying the $889.70 on their taxes since 2009.

However, as the last year to pay the 10 year commitment ended in 2019, it became apparent that this LIL had not been fully collected in it’s entirety. Administration and the Auditor looked into this shortfall and it was found that the LIL had not been collected in 2011 nor 2012.

The remaining shortfall of this LIL is currently $14,891.45.

Options for Consideration: 1) Amend Bylaw 190-08 to add an additional 2 years to collect remainder of LIL on

the 13 properties. Notification would need to be given to these residences, somenot being the original signors.

2) To write off this outstanding historical debt due to past Administative error.

Administrative Recommendations: 1) That Council review, discuss and provide provide direction on this shortfall.

Authorities: Pursuant to the Municipal Government Act, Chap. M-26.1 and amendments thereto, a municipal government may pass a by-law to construct, control, and operate a sewer utility for the purposes of providing residents and consumers of a municipality with the disposal of sewage wastes, charging such rates and fees as deemed necessary.

SUMMER VILLAGE OF NORGLENWOLD

BYLAW 190-08

A BY-LAW OF THE SUMMER VILLAGE OF NORGLENWOLD TO AUTHORIZE A

LOCAL IMPROVEMENT IN RESPECT OF LANDS BENEFITING FROM THE

INSTALLATION OF A MUNICIPAL WASTEWATER COLLECTION (THE “LOCAL

IMPROVEMENT PROJECT”)

WHEREAS the Local Improvement Project has been authorized by the municipal Council of

the Summer Village of Norglenwold as a local improvement project as described in Schedule

“A” attached hereto and forming part of this By-Law;

AND WHEREAS the lands that will benefit from the Local Improvement Project are described

in Schedule “B” attached hereto and forming part of this By-Law and shall bear the local

improvement tax imposed by the By-Law;

AND WHEREAS the persons and corporations listed in Schedule “B” and there successors in

title shall pay the local improvement tax established by the By-Law in equal instalments over

the period which the cost of the Local Improvement Project will be spread;

AND WHEREAS the local improvement tax is to be based on assessments prepared in

accordance with Part 9 of the Municipal Government Act R.S.A. 2000, c.M-26;

AND WHEREAS the estimated cost of the Local Improvement Project is $2,960,000.00;

AND WHEREAS the cost of the Local Improvement Project will be spread over TEN (10)

years;

AND WHEREAS funding for the Local Improvement Project shall include $919,941.00 from

the Local Improvement Tax in the Summer Village of Norglenwold, $1,600,000.00 from the

Canada-Alberta Municipal Infrastructure Program, $303,500.00 from the Alberta Municipal

Infrastructure Fund, and $136,559.00 from the Summer Village of Norglenwold, Municipal

Sustainability Fund.

THEREFORE, THE COUNCIL OF THE SUMMER VILLAGE OF NORGLENWOLD

DULY ASSEMBLED ENACTS AS FOLLOWS:

1. A local improvement tax levy is hereby imposed at the rates and on the lands described in

Schedule “A” attached hereto and forming part of this By-Law.

2. The local improvement tax hereby imposed shall be paid in equal payments during each

year over which the cost of the Local Improvement Project will be amortized, being TEN

(10) years commencing in 2009.

3. Annual unit rate per property to be payable for a period of 10 years calculated at 12% per

annum will be $889.70.

4. Notwithstanding Section 2 above, the Persons liable to pay the local improvement tax will

have the option of paying, in advance, their portion of the costs of the Local Improvement

Project in one lump sum payment.

5. The By-Law shall take effect on the date of the final passing thereof.

DONE AND PASSED in open Council assembled at the Summer Village of Norglenwold, in

the Province of Alberta, this 25th day of April, A.D., 2008.

Read a second time this 29th day of August, A.D., 2008.

Summer Village of Norglenwold 2020 Property Tax Bylaw

A BYLAW TO AUTHORIZE THE RATES OF TAXATION TO BE LEVIED AGAINST

ASSESSABLE PROPERTY WITHIN THE SUMMER VILLAGE OF NORGLENWOLD FOR

THE 2020 TAXATION YEAR.

WHEREAS, the Summer Village of Norglenwold has prepared and adopted

detailed estimates of municipal revenue, expenses and expenditures as

required, at the council meeting held on April 24, 2020.

WHEREAS, the estimated municipal revenues and transfer from all sources other

than taxation is estimated at $252,820.37 and the balance of $462,811.30 is to

be raised by general municipal taxation; and

WHEREAS, the estimated municipal expenses (excluding non-cash items) set out

in the annual budget for the Summer Village of Norglenwold for 2020 total

$715,631.67; and

THEREFORE, the total amount to be raised by general municipal taxation is

$462,811.30 and

WHEREAS, the requisitions are estimated to be: Alberta School Foundation Fund

- Residential & Farm Land $514,686.13. - Non-residential $ 1,898.27.

Designated Industrial Property $ 40.05.

Total Requisitions Collected $516,624.45. WHEREAS, the council is authorized to sub-classify assessed property, and to establish different rates of taxation in respect to each sub-class of property, subject to the Municipal Government Act, Chapter M-26, Revised Statues of Alberta, 2000; and

WHEREAS, the assessed value of all property in the Summer Village of Norglenwold as shown on the assessment roll is:

Residential $197,470,330. Non-Residential & Designated Industrial Property $ 526,940. Taxable Assessment $197,997,270. Exempt $ 10,326,480. Total 2019 Assessment $208,323,750.

NOW THEREFORE under the authority of the Municipal Government Act, the Council of the Summer Village of Norglenwold, in the Province of Alberta, enacts as follows:

1. That the Chief Administrative Officer is hereby authorized to levy the following rates of taxation on the assessed value of all property as shown on the assessment roll of the Summer Village of Norglenwold:

Agenda Item: Encroachment Agreement Policy

Background:Last Council meeting the following information was presented to Council, Council directed administration to come back with where current Encroachment Agreements are. The 11 Encroachment Agreements are:

99 Grand Ave – House, shed, sidewalk and railing (expires 2021) 13 Ravenscrag Crescent – Fence and driveway (expires 2022) 367 Last Chance Way – Deck, stairs and shed (expires 2022) 15 Grand Ave – Driveway gate (expires 2021) 359 Last Chance Way – Deck (expires 2021) 151 Grand Ave – Fence, Retaining walls and concrete steps (expires 2021) 349 Last Chance Way – Use of EOS with non-permanent structures (expires 2021) 195 Grand Ave – Sign (expires 2022) 197 Grand Ave – Concrete pedestals (expires 2022) 85 Grand Ave – Retaining Wall (expires 2024) 67 Ravenscrag Crescent – Rock Face (expires 2025)

Current Encroachment Agreement Policy:Under previous administration, residents that obtained an agreement have been charged a flat fee of $30.00 per year for encroachments on Municipal land. As per the Encroachment Policy passed in 2016, there is a formula that is to be calculated to determine this fee and is to be reassessed every five years.

Current Formula: Fee is calculated on actual square foot assessment of adjacent property (i.e. 1200 sq. ft. lot assessed at 16,000 land value – encroachment is 10 sq. ft. (16,000 / 1200 = 13.33 assess value per square foot) (10 x 13.33 = 133.30 encroachment value) times the mill rate for the current year.

Examples of the Calculation: 20,945.49 sq. ft. lot assessed at 597,840 land value – encroachment is 3.62 sq. ft. (597,840 / 20,945.49 = 28.54 assess value per square foot) (3.62 x 28.54 = 103.31 encroachment value) 103.31 x 0.0233 = $2.41 yearly encroachment fee.

9,034.26 sq. ft. lot assessed at 736,860 land value – encroachment is 86.23 sq. ft. (736,860 / 9,034.26 = 81.56 assess value per square foot) (86.23 x 81.56 = 7,032.92 encroachment value) 7,032.92 x 0.0240 = $168.79 yearly encroachment fee.

This formula can be difficult under some circumstances with stairs or older encroachments where we do not have the proper measurements of the encroachment. Administration also feels that this current formula has residents who have a larger lot paying more for the exact same encroachment than a resident with a smaller lot.

Municipal Examples: Lacombe County charges a non-refundable fee of $2,000.00 for a 10-year encroachment agreement, then charged again once expired. (This would be $200.00 per year).

Red Deer County has license to occupy agreements which sometimes comes with a fee (roughly $25.00 year) but moving towards leases and trying to phase out licenses of occupancy.

The Town of Blackfalds does not allow encroachments, if discovered the encroachment is required to be removed.

The Town of Sylvan Lake charges a preparation fee for encroachment agreements of $350.00. No yearly fee.

Staff Involvement: Currently there are 11 Encroachment Agreements in Norglenwold, for dwellings, fences, decks, sheds, stairs, driveway gates, retaining walls, etc. During preparation and yearly review of the agreements, Development, CAO and Accounting is involved.

Options for Consideration: 1. Council to accept as information and continue with current policy. 2. Council to amend policy to charge a base yearly fee of $250.00.

Administrative Recommendations: 1. Council to amend policy to charge a base yearly fee of $250.00 for encroachment

agreements going forward and that come up for review every 5 years. Administration feels $30 does not cover staff time nor the registration fee with Alberta Land Titles. As per the Policy, encroachments should not be allowed, and having a $250 fee may deterrent encroachments going forward.

THIS ENCROACHMENT AGREEMENT MADE THIS DAY OF , 2016.

BETWEEN:

OWNER NAMES (hereinafter called “the Owner”)

and

THE SUMMER VILLAGE OF NORGLENWOLD (hereinafter called “the Summer Village”)

WHEREAS the Owners are the owners of the following described lands, namely:

PLAN 5116AE

BLOCK 5

LOT 10

EXCEPTING THEREOUT ALL MINES AND MINERALS

(hereinafter called “the Owner’s lands”)

AND WHEREAS the following described lands are under the direction, control and management

of the Summer Village.

Aspen Lane – Road Allowance

(hereinafter called “Environmental Open Space”)

adjacent to the boundary of the Owner’s lands;

AND WHEREAS the owners constructed a house, shed, sidewalk and railing on the

Environmental Open Space, the nature, extent and location of which is designated on the plan

annexed as Schedule “A” to this agreement (Hereinafter called “the encroachment”) and has

requested that the Summer Village consent to the location of same;

AND WHEREAS the Summer Village is prepared to approve the request made by the Owner

therein;

NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the premises,

and in consideration of the sum of One ($1.00) Dollar now paid by the Owner to the Summer

Village, receipt whereof is hereby acknowledged, and in consideration of the Summer Village

approving the request by the Owner, the parties hereto covenant and agree together as follows:

1. The Summer Village hereby authorizes the Owner’s location of the said encroachment

upon the Environmental Open Space:

(a) so long as the encroachment is maintained in an excellent state of repair and does

not become a hazard to the general public.

(b) development permit applications are made to the Summer Village and approvals

are obtained from the Summer Village for any maintenance and repair work

undertaken to the encroachment.

2. The Owner covenants and agrees with the Summer Village that the said encroachment

shall not at any time hereafter be enlarged or extended beyond the designation set forth in

Schedule “A” and that in the event of default of this covenant, the Summer Village may

terminate this agreement, or alternately may give notice requiring the Owner to correct

such default by removing, the enlargement or extension within thirty (30) days of the day

the Summer Village gives notice of such default.

3. Notwithstanding anything herein contained, and provided that the Summer Village

required the land on which the encroachment is located for public purpose, the Summer

Village may give notice to the Owner requiring the Owner to remove the encroachment

from the Environmental Open Space within thirty (30) days of the day the Summer

Village gives notice to the Owner. The Owner shall be responsible for and make

payment of all costs of removal of the encroachment at the Owner’s sole cost and

expense and hereby waives all claim or entitlement for any costs, damages or expenses of

removal of the encroachment. In the event of default of payment of any sum required to

be paid by the Owner hereunder, such amount shall be deemed to be municipal tax and

may be collected in the same manner as provided for pursuant to the Municipal

Government Act, 2000 Chapter M-26, Statutes of Alberta, as amended from time to

time, or successor legislation.

4. Should the Owner fail to remove the encroachment from the Summer Village’s lands

when required pursuant to this agreement and correct such default within the time limited

in paragraph 2 hereof, then the Summer Village with its own resources, or through the

services of an independent contractor, employed by it for that purpose, shall be at liberty

to enter upon the Owner’s lands and take all such steps as are necessary to either remove

the said encroachment, or to correct the default of the Owner by removing the

unauthorized encroachment, and all costs incurred by the Summer Village through its

own forces, or through the employment of an independent contractor shall be payable by

the Owner to the Summer Village upon demand.

5. The Owner shall indemnify and save harmless the Summer Village from, of and against

all liability, claims, demands, judgements, suits and damages in connection with the

continuance, use and operation of the said encroachment upon the Environmental Open

Space.

6. The Summer Village shall continue to have and reserves unto itself the full, free and

uninterrupted right to occupy and use the encroached area in any manner in which it

considers as appropriate but the Summer Village shall not unreasonably interfere with the

rights conferred on the Owner.

7. The parties hereto covenant and agree that the covenants herein contained shall and are

hereby deemed to be covenants running with the land. The Owner acknowledges that

the present agreement does not constitute an interest in the Environmental Open Space

and that no Caveat or other instrument may be registered against the Summer Village’s

lands, but the Owner may caveat the Owner’s lands with the respect to this agreement.

The Owner acknowledges that the within agreement is not a disposition of an interest in

the Environmental Open Space by the Summer Village within the meaning of the

Municipal Government Act of Alberta.

8. The Owner shall:

(a) maintain the encroached area in a good and husband like manner to the

satisfaction of the Summer Village’s Development Authority or other authorized

administrator.

(b) maintain and keep in good and safe repair the encroached area and any structure

or thing placed or erected upon or overhanging the encroached area;

(c) pay the Summer Village on demand for all damage to property and utilities of the

Summer Village arising out of the activities of the Owner on or adjacent to the

encroached area, whether or not such activities are in accordance with the rights

herein granted to the owner;

(d) pay the Summer Village on demand for all costs of repairing any damages to any

utilities which may in any way be caused directly or indirectly as a result of,

arising from, or be due to the Owners use of the encroached area;

(e) the Owner will pay to the Summer Village on or before January 1 of each year, an

annual charge for the Encroachment in the sum of THIRTY DOLLARS ($30.00).

(f) this Agreement shall be for five years from the date above stated, unless earlier

terminated. If the Owner is not in default of any provisions of this agreement,

the Owner may apply to have this agreement renewed for another term.

9. The Owner shall throughout the term of this encroachment agreement provide and keep

enforced general liability insurance in the amount of not less than $1,000,000.00 in

respect of injury to, or death of, any person, or damage of any property, which insurance

shall:

(a) name the Summer Village as an additional insured under the policy, only in

respect to liability arising from the encroachment agreement of the Environmental

Open Space;

(b) be effected with insurers, and upon terms and conditions satisfactory to the

Summer Village;

10. Provide for thirty (30) days prior written notice of cancellation of, or material change in

the policy to be provided to the Summer Village by the insurer. Notices to be given

under this agreement shall be effective upon personal service thereof or seven (7) days

after mailing by ordinary mail, in the case of the Summer Village, to:

WHEREAS the Owners are the owners of the following described lands, namely:

AND WHEREAS the following described lands are under the direction, control and management of the Summer Village.

permanent structures. (Hereinafter called “the encroachment”).

AND WHEREAS the Summer Village is prepared to approve the request made by the Owner

therein;

NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the premises,

and in consideration of the sum of One ($1.00) Dollar now paid by the Owner to the Summer

Village, receipt whereof is hereby acknowledged, and in consideration of the Summer Village

approving the request by the Owner, the parties hereto covenant and agree together as follows:

1. The Summer Village hereby authorizes the said encroachment upon the Environmental

Open Space:

(a) so long as the encroachments and reserve are maintained in an excellent state of

repair and do not become a hazard to the general public.

(b) so long as any new planting of trees/shrubs will be a native species.

2. The Owner covenants and agrees with the Summer Village that the said encroachment

shall not at any time hereafter be altered beyond the designation set forth in this

agreement and that in the event of default of this covenant, the Summer Village may

terminate this agreement, or alternately may give notice requiring the Owner to correct

such default by removing or revising within ninety (90) days of the day the Summer

Village gives notice of such default.

3. Notwithstanding anything herein contained, and provided that the Summer Village

required the land on which the encroachment is located for public purpose, the Summer

Village may give notice to the Owner requiring the Owner to remove the encroachment

from the Environmental Open Space within ninety (90) days of the day the Summer

Village gives notice to the Owner. The Owner shall be responsible for and make payment

of all costs of removal of the encroachment at the Owner’s sole cost and expense and

hereby waives all claim or entitlement for any costs, damages or expenses of removal of

the encroachment. In the event of default of payment of any sum required to be paid by

the Owner hereunder, such amount shall be deemed to be municipal tax and may be

collected in the same manner as provided for pursuant to the Municipal Government Act,

2000 Chapter M-26, Statutes of Alberta, as amended from time to time, or successor

legislation.

4. Should the Owner fail to remove the encroachment from the Summer Village’s lands

when required pursuant to this agreement and correct such default within the time limited

in paragraph 2 hereof, then the Summer Village with its own resources, or through the

services of an independent contractor, employed by it for that purpose, shall be at liberty

to enter upon the lands and take all such steps as are necessary to either remove the said

encroachment, or to correct the default of the Owner by removing the unauthorized

encroachment, and all costs incurred by the Summer Village through its own forces, or

through the employment of an independent contractor shall be payable by the Owner to

the Summer Village upon demand.

5. The Owner shall indemnify and save harmless the Summer Village from, of and against

all liability, claims, demands, judgements, suits and damages in connection with the

continuance, use and operation of the said encroachment upon the Environmental Open

Space.

6. The Summer Village shall continue to have and reserves unto itself the full, free and

uninterrupted right to occupy and use the encroached area in any manner in which it

considers as appropriate but the Summer Village shall not unreasonably interfere with the

rights conferred on the Owner.

7. The parties hereto covenant and agree that the covenants herein contained shall and are

hereby deemed to be covenants running with the land. The Owner acknowledges that

the present agreement does not constitute an interest in the Environmental Open Space

and that no Caveat or other instrument may be registered against the Summer Village’s

lands, but the Owner may caveat the Owner’s lands with the respect to this agreement.

The Owner acknowledges that the within agreement is not a disposition of an interest in

the Environmental Open Space by the Summer Village within the meaning of the

Municipal Government Act of Alberta.

8. The Owner shall:

(a) maintain the encroached area in a good and husband like manner to the

satisfaction of the Summer Village’s Development Authority or other authorized

administrator.

(b) maintain and keep in good and safe repair the encroached area and anything

placed upon or overhanging the encroached area;

(c) pay the Summer Village on demand for all damage to property and utilities of the

Summer Village arising out of the activities of the Owner on or adjacent to the

encroached area, whether or not such activities are in accordance with the rights

herein granted to the owner;

(d) pay the Summer Village on demand for all costs of repairing any damages to any

utilities which may in any way be caused directly or indirectly as a result of,

arising from, or be due to the Owners use of the encroached area;

(e) pay to the Summer Village on or before January 1 of each year, an annual charge

for the Encroachment in the sum of SIX HUNDRED DOLLARS ($600.00).

(f) this Agreement shall be for five years from the date above stated, unless earlier

terminated. If the Owner is not in default of any provisions of this agreement, the

Owner may apply to have this agreement renewed for another term.

(g) temporarily store their boat hoist and pier on the Environmental Open Space but

prohibited between the third weekend in May (Victoria Day) and the first

weekend in September (Labour Day) weather permitting.

9. The Owner shall throughout the term of this encroachment agreement provide and keep

enforced general liability insurance in the amount of not less than $1,000,000.00 in

respect of injury to, or death of, any person, or damage of any property, which insurance

shall:

(a) name the Summer Village as an additional insured under the policy, only in

respect to liability arising from the encroachment agreement of the Environmental

Open Space;

(b) be effected with insurers, and upon terms and conditions satisfactory to the

Summer Village;

10. Provide for ninety (90) days prior written notice of cancellation of, or material change in

the policy to be provided to the Summer Village by the insurer. Notices to be given under

this agreement shall be effective upon personal service thereof or seven (7) days after

mailing by ordinary mail, in the case of the Summer Village, to:

THE TOWN OF SYLVAN LAKE LIBRARY BOARD – REGULAR MEETING HIGHLIGHTS

WEDNESDAY – MARCH 11, 2020 – 6:30PM

1. Communications

The Town of Sylvan Lake Library Board sent a letter earlier in the year to thank the Government of Alberta

for the funding received; a response to this letter was received from Minister Kaycee Madu noting the

important role libraries play in each community.

2. Treasurer’s Report

The Treasurer’s Report was approved as presented.

3. Director’s Report

The Director’s report was approved as presented.

A priority of the Library Director over the past five months has been creating partnerships within the

community. Two of these partnerships include Snake Lake Brewery and Undercurrent Brewery. Both of

these businesses will host “Bring Your Own Book Club” once a month, check the library website for more

details at https://sylvanlibrary.prl.ab.ca/

Exciting new programming that has been developed includes “Sensory Story Time” being offered on

Saturdays starting March 14. Other upcoming programs include “Stars and Strollers” movie screenings for

new moms with babies, “International Film Series” screenings and “Cookbook Club” where attendees can

discuss dishes and bring samples to share.

4. Open Items

The OH&S subcommittee provided an update on the progress of the safety documents.

An annual review of the Personnel Policy is being undertaken with a subcommittee taking the lead on

making recommendations for improvements to this document.

The Parkland Regional Library, located in Lacombe, is currently in the process of constructing a new two

storey head office in the Iron Wolf Crossing subdivision. After 60 years of serving Central Alberta from their

building in the heart of Lacombe they hope to be moving into the new state of the art building in the fall of

this year. In addition to the traditional offerings of internet access and book-lending, there are new

resources such as radon detection kits and virtual reality headsets that give world class accessible resources

to everyone. PRL offers support, material, training, resources and IT network support to 49 public libraries

serving 64 municipalities throughout Central Alberta.

The annual Minister’s Awards for Excellence in Public Library Services will receive two nominations from

The Town of Sylvan Lake Library Board for programs within the Sylvan Lake Municipal Library. The first

program is “The Little Free Pantry” which has snacks and more substantial food items available for library

users to take from shelves located in the middle of the library book stacks. This program is largely

supported by community donations, money collected through the annual Polar Dip fundraiser and items

brought in by the staff members. The second program was a collaboration between the Sylvan Lake

Municipal Library and the Sylvan Lake Food Bank. This project had two major components; one was

centered at the food bank and the other at the library. The food bank project included raised garden beds

that were constructed from scratch and planted to subsidize other food items offered; the library also had

raised garden beds that were planted and nurtured by participants of the Summer Reading Program. In

addition to the raised garden beds at the library more greenery was planted around the perimeter to make

this area more like a park setting for all community members to have a beautiful outside space to enjoy.
