Introduction Project Background:
ADB Assisted North Karnataka Urban Investment Program (NKUSIP) is envisaged to
facilitate economic growth in 25 selected towns of North Karnataka and bring about urban
development by means of equitable distribution of urban services in an environmentally
sound and operationally sustainable manner. Tranche II improvements focus on rehabilitation
and construction of water supply, sewerage, and urban drainage infrastructure as well as slum
improvements and procurement of firefighting and emergency services equipment. Gokak
Sub-Projects include providing underground drainage system. The Investment Program is
designed to minimize land acquisition and resettlement impacts.
Need of the Sub-Project:
The North Karnataka Urban Sector Investment Program will finance investment in the sectors
of sewerage and sanitation. It will also have a poverty alleviation and non-municipal
infrastructure component.
The overall development goal of the NKUSIP is to facilitate economic growth in the towns of
North Karnataka and bring about urban development through equitable distribution of urban
basic services to the citizens, which are environmentally sound and operationally sustainable.
The development purpose is designed to assist Urban Local Body (ULB) to “promote good
urban management, by developing and expanding urban infrastructure that increases
economic opportunities and reduces vulnerability to environmental degradation and urban
poverty”.
The Investment Program is designed to minimize land acquisition and resettlement impacts.
Sub projects involving construction of sewerage treatment plant are planned that envisage
land acquisition in some towns, which is specific town. However, the land acquisition process
is facilitated in such a method that the negative impacts are avoided or minimized through
careful sub project sitting and alignment. The resettlement and rehabilitation plans are
prepared for providing compensation for land owners and rehabilitating them that cater to
sustainable development of the towns.

ADB Assisted KUIDFC-NKUSIP has selected Gokak ULB for providing sewerage and
sanitation system to citizens. The investment program is designed for the construction of
Sewerage Treatment Plant, Sewage Pumping Station & Wet Well.
Location of the project site:
1) Sewerage Treatment Plant - The site is situated near Gokak Town. The site is not
easily accessible in the town and villages is around 5.55 Km from Gokak city, on the
Gokak - Maldini village road, East of State Highway 31. Figure-1 shows the layout
map of the proposed STP site and figure- 2 shows the satellite image of the proposed
STP site at Gokak
2) Sewage pumping station and Wet Well – The construction is proposed in 30 guntas
of land. The site is situated in Jodatti plot, Survey No. 137 & 138 in Gokak town,
Belagavi Dist. This is Govt land in the name of CMC, Gokak. The site is easily
accessible and is around 1 KM from Gokak town.

Objectives of the Sub-project
Promote scientific sewage disposal system
Improve the environmental sanitation system
Sewer net work for the area where feasible depending on the population
Avoid open defecation
Avoid un-hygienic condition in the town
Avoid directly discharge in to open drain without proper treatment
Avoid sewage stagnation in the town
Avoid the mosquito breeding and is the main cause for the spreading the water bound
diseases
Improve health and hygiene
Improve the quality of life
Promote peoples for construction of 100% House hold latrines

The main objectives of the STP are as follows:
Scope of the Sub-project
The salient features of the subproject are as below:
1)Construction of Sewerage Network and FAL type STP of 8.70 MLD which entail the
following:
21.38 KM of sewer network including HSC receiving chambers of 2099 Nos.
1 No. of SPS including works of DG room, Operator quarters, Screen chamber, valve chamber. Pumping main from SPS to STP 5.90 Km of DI pipes
Wet well
STP (8.7 mld) including PTU, FAL Lagoons, Chlorine contact tank, Operator quarters, Laboratory Room, Generator Room, Gate House, Fencing , Internal road etc. .
1 No. of Sewer Cleaning Jetting Machine and
Electrical and allied works
Requirement of Due-Diligence Report
1)Private land procurement through Direct Purchase for Construction of STP
Private land has been procured for the Sub-project through direct purchase from 5 land
owners for the purpose of construction of Sewage Treatment Plant. In this project there is no
involuntary resettlement involved and hence the preparation of RP for this project is not
required. The objective of this Due diligence report (DDR) is to review the Sub project land
acquisition and resettlement (LAR) impacts if any, based on the detailed design and propose
mitigation measures if, necessary in accordance with ADB’s Involuntary Resettlement
Policy, (IR)1995.
Prior to detailed design, the cadastral maps were examined to understand the ownership of
land. Verification of the cadastral maps was done in the field based on the survey and
measurement.
For the construction of the STP, 11.00 acres of land was required. After detailed negotiations
with the land owners the entire 11.00 acres was purchased and compensated the land owner
accordingly. This entire process was undertaken in consultation with the Revenue
department, the land owners and the representatives of the ULB (Urban Local Body) and
project officials. There are no Involuntary Resettlement Impacts on this subproject as land

was procured through direct purchase from the land owners of Maldinni village. The details
of land owners are given below

3. Saralappa Lakkappa Bandi:- Sy. No. 986/5,
4. Yallappa Satyappa Bandi:- Sy. No. 986/6 and
5. Siddappa Lakkappa Bandi:- Sy.No. 986/7
2)Government land used for construction of Pumping Station and Wet Well
Government land has been used for the purpose of construction of Pumping Station and Wet
Well. For the Construction of Pumping Station and Wet Well , land has been identified in
Survey No. 137 & 138. Vacant Govt land was earmarked for implementing the projects.
The subproject will not entail any permanent land acquisition and resettlement. Site
assessment of the entire proposed areas, where works will be undertaken was taken up.
Based on it: there will be no expected impacts on private/public land, private properties like
housing, shops, commercial buildings, religious and community infrastructure. No negative
impacts on livelihood are envisaged. The proposed area is completely vacant and in
possession of CMC . There are no Non-Titled Holders in the earmarked land.
Scope of Land Acquisition and Resettlement
1)Private land procurement through Direct Purchase for Construction of STP
As mentioned earlier, the total land requirement for STP was 11.00 acres. After a series of
consultations the assessment of the compensation amount was arrived at after due
negotiations with the land owners, Project officials, ULB commissioner and Revenue
Department. The final amount was arrived at in the General Body meeting held at the ULB
office, presided by the CMC Commissioner at Gokak on 18.02.2010, proposal has been
verified and approved by the Under Secretary to Government, Govt of Karnataka, Govt. order
No.UDD 18 TMD 2010, Bengaluru, dated: 31.05.2010 (Annexure I- Proceedings of
Karnataka Government). The cheque for the payment was issued to the land owners on
02.08.2010.

2)Government land used for construction of Pumping Station and Wet Well
As mentioned earlier, the total land requirement for this sub project was 00.30 guntas, for
which government land was utilized.
Project Impact and Outcome:
The expected outcomes of the project are:
The sanitary system is focusing on environmental sanitation improvement
It will bring urban development through equitable distribution of urban basic services to the citizens
It will improve the urban services through improved governance
System enhance accountability and financial soundness at the municipal level
To improve the general quality of life in urban areas particularly the urban poor through increased access to sustainable urban infrastructure and services.
Extent of Impact
1)Private land procurement through Direct Purchase for Construction of STP
The land owners willingly agreed to sell their land of 11.00 acres to the CMC. Series of
meetings was held with land owner at CMC office presided by the Commissioner. Alongside,
the methodology of fixing the rates to be given to the land owner was decided through mutual
discussions with all parties concerned and was finalized in Govt. order No.UDD 18 TMD
2010, Bengaluru, dated: 31.05.2010. The land owners were given a compensation amount of
Rs. 45.65 Lakhs for 11.00 acres and the possession handed over to the CMC for further
action.
2)Government land used for construction of Pumping Station and Wet Well
Since the construction of Pumping Station and Wet well is being undertaken in Government
land ,there is no negative impact on the community.
Indigenous Peoples
There will be no impact on Indigenous peoples (IPs). No Indigenous peoples Plan will be
needed for this sub-project. The sub project area does not have any tribal population and thus
there is no impact on their lives/livelihood.

Public Consultations
1)Private land procurement through Direct Purchase for Construction of STP
Regular consultations were held with the land owner on the process of purchase and the
compensation to be paid for the affected land parcel. These consultations were organized
regularly to ensure transparency in the process of land procurement and to ensure that no
coercion was involved in the entire process.
Findings
1)Private land procurement through Direct Purchase for Construction of STP
Land for the sub project was procured through direct purchase therein ensuring that the
principle of a willing buyer and willing seller was followed. The affected party got
appropriate compensation and land for the project was available quickly. Thus this process
prevented any delay in the execution of the sub project on account of unavailability of land.
The land owner was satisfied with the compensation amount and encountered no delay in the
receipt of payment as is generally observed in land acquisition cases. Hence this process
helped all the stakeholders in achieving their desired objectives.
2)Government land used for construction of Pumping Station and Wet Well
The Subproject will not cause any permanent and/or temporary impacts as government land
is proposed to be used for construction of Pumping Station and Wet well. The land earmarked
is vacant, no common property resources are affected.

Proposal :
For the construction of Sewage Treatment Plant (STP) of Gokak ULB in Belagavi
District under ADB assisted NKUSIP project, as read in reference (1), Government has
ordered to purchase the land of 12 Acres 31 Guntas of survey No. 986, part of 3,4,5,6 at
Maldinni village @ Rs. 4,15,000/- per acre.
As per Project Consultants of Karnataka Urban Infrastructure Development and
Finance Corporation, it was opined that technically only 11 acre of land is sufficient for the
construction of STP in survey No. 986, part of 3,4,5,6 and 7 at Maldinni village, but it was
informed that in already released order for purchase of 12 Acre of land R.Sy. No. 986, part
no.7 was included. In the resolution of General Body meeting of Gokak ULB held on
18.02.2010 to purchase the land at Maldinni village survey No.986 part of 3,4,5,6, and 7,
only 11 acre for Rs.4,15,000/- per acre was decided. In this regard under reference (2), the
Municipal Director requested to pass the necessary sanction.
Proposal has been verified in detail, and ordered as below

The reasons as detailed in the proposal, for construction of Sewage Treatment Plant
(STP) of Gokak ULB under NKUSIP project in R.Sy.No. 986, part of 3,4,5,6, and 7 at
Maldinni village, to purchase 11 acre of land @ Rs. 4,15,000/- ( Four Lakh Fifteen Thousand
only) per acre is approved.
