As we bring 2013 to an end, I can’t help but be reflective of the year. I first want to Thank all of you for continuing to support the Sacramento Claims Association throughout this past year. We continue to build on a strong foundation for the SCA and look toward 2014 with optimism and excitement as we continue to focus on the 4 areas of our Vision statement; Education/Communication/Social/Charitable.

This past year we worked on providing educational seminars and luncheons that supported our Members in the Industry in which we all work. Additionally we added some Social events that helped us all network together and enjoy each other’s company in a more leisurely setting.

Our Community Day with Habitat for Humanity expanded the charitable side of our Vision for 2013 as we will also be honoring the key charities for the SCA at the December Luncheon, as well as hosting a Food Drive for the Sacramento Food Bank. Please do bring non-perishable food supplies to contribute to our donation.

The SCA Annual Golf Tournament was also a tremendous success for the organization, as well as the members. This is our signature event for the year and once again brought out the BEST in the day for all.

Another key event for us is the Winter Party, which is right around the corner, being held February 8, 2014 at LionsGate. This event will be such a great way to kick-off 2014 as this is always a tremendous evening for all that attend.

The Board worked hard on revising some of the areas in the SCA bylaws that needed clarity for the organization, and we held our second annual “strategy meeting” that helps us all communicate ideas and

He taught me, while estimating on the loss as a whole, the importance of making sure there is a focus on the insured getting their landscaping back to its original state.”

A native of Meadow Vista, California, Levi states plainly that “my entire family has been in the insurance industry my whole life. I am confident that I know what adjusters and contractors are looking for in a landscape provider.”

The November 14, 2013 lun-cheon meeting of the Sacramento Claims Association was one of the strongest gatherings in recent months, including a good number of claims personnel on-hand to hear longtime claimsman turned defense attorney, Robin Singer, on “What Adjusters Need to Know About Appraisal". Singer, who spent years in various roles within the claims industry, is now with Morris Polich & Purdy LLP.

“Like nuclear games,” he stated, “the only way to win is not to play. Appraisals are the same way.”

In order to even need a formal appraisal, he went on to explain, there has to be a failure to agree.

Often times, he said, “the first thing PA (Public Adjuster) does is give notice of claim and say ‘we want to go to appraisal’. There must be a failure to agree before that can hap-pen,” Singer explained.

In order for appraisal to be invoked, the two parties must have a dis-agreement about the value of the loss. “It’s very much like arbitration, except appraisal is a very limited type of arbitration,” he said. “You can only resolve one item.”

Appraisers are held to a higher standard of impartiality than a normal arbitrators. “You want to find a way to negotiate and agree. Appraisal is going cost you time and money. Unless it's a significant difference, you will want to avoid appraisal.”

All that said, he then pointed out there appraisals are mandatory? “If the insured demands appraisal, you have to go. Likewise, if you insist on ap-praisal, the insured must comply,” he added.

When you see the word “shall”, he explained, this means “must” in legal terms.

“In the old days each side would pick an appraiser,” he said. “Now, language reads ‘Umpire shall be selected by a judge’.

“Informal” appraisal is quicker and cheaper, and are the standard, except when a “formal” is specifically requested by the insured, or the company in-volved. A “formal” appraisal involves a lot more, he said.

Important to note that the appraiser cannot determine cause or coverage.“You've got to be sure to limit the scope of your appraisal going in,” he

advised. “Work with your appraiser ahead of time.”Mr. Singer went on to explain that an appraisal award is not a money

judgement. You may still reserve the right to deny based on coverage. That said, he added that you “don't have to have coverage battle before hand. Have items appraised and then deal with whether they're covered.”

We are fortunate to have two strong additions to the Board for the year 2014 in April Wilkinson & Tami Umland, both of whom will bring not only great energy to the table but also a “can do” attitude that keeps the SCA and Membership foremost in their actions.

In closing, I would like to Thank all the people that have supported not only me but the

Insurance Commissioner Jones Commends Proposition 103’s Saving Consumers And Businesses Tens Of Billions Of Dollars On The 25th Anniversary Of Its Passage By voters

SACRAMENTO, Calif. - Insurance Commissioner Dave Jones November 12, 2013 issued the following statement regarding the 25th anniversary of Proposition 103:

“Proposition 103 has saved consumers and business tens of bil-lions of dollars in auto and homeowner rates since it was first passed by California voters in 1988.

“Proposition 103 requires auto, homeowners and all property and casualty insurers to file their rates and get approval for rates from the insurance commissioner. Since I was elected commissioner in Novem-ber 2010, we have saved consumers and businesses over $1.4 billion in insurance rates alone. The Consumer Federation of America report describes how California motorists have benefitted from Proposition 103. Californians appropriately are celebrating the 25th Anniversary of the passage of Proposition 103.”

“Unfortunately, while the insurance commissioner has the authority under Proposition 103 to reject excessive auto, homeowners and other property and casualty insurance rate hikes, no one in California including the insurance commissioner has the authority to reject excessive health insurance rate hikes. Californians are surprised to learn that the insur-ance commissioner in California, unlike 35 other states, does not have the authority to reject excessive health insurance rate hikes.”

“Health insurance rates will continue to climb even with the imple-

mentation of the Affordable Care Act. We see these rate hikes with the 1 million health insurance cancellation notices sent to individual Cali-fornians. California law needs to be changed to give the insurance com-missioner the authority to reject excessive health insurance rate hikes.”

Jones Calls Covered California’s extension Denial A Disservice To PolicyholdersAllowing Californians to keep their health insurance through 2014 won’t undermine implementation of the ACA

Insurance Commissioner Jones issued the following statement November 21, 2013 in response to Covered California’s decision to deny health insurers the ability to renew existing policies:

“Over a million Californians have received cancellation notices from their health insurer. On behalf of these policyholders I am disappointed in Covered California’s action, which denies individuals and families the opportunity to keep their existing health insurance as President Obama promised.

“Covered California rejected what President Obama and I asked for—that individual policyholders be allowed to keep their existing health insurance through all of 2014. Covered California’s decision

denies Californians the same opportunity health insurers are giving to its small business customers who are being allowed to renew current policies throughout 2014.

“Covered California could have honored President Obama’s request, without causing damage to the implementation of the Affordable Care Act or the Exchange.

“The preferred and more equitable course of action for California consumers is for Covered California’s unnecessary cancellation to be rescinded. Allowing existing policyholders to keep their health insurance for the duration of 2014 will not undermine the implementation of the ACA, but rather will give consumers more time to figure out what makes sense for their families.”

Commissioner Jones has been a staunch supporter of the ACA since its passage and throughout its implementation. Last week President Obama called on states and insurers to allow existing policyholders the option to renew their plans for an additional year. Commissioner Jones expressed his support of the President’s request and asked that Covered California rescind its contractual provision with 11 insurers, which impeded their ability to honor the President’s request.

As the state’s insurance market regulator, Jones has made it clear that neither state nor federal law, including the ACA, requires December 31 cancellations. More than 1 million Californians are receiving cancella-tion notices from insurers, who are upset because they were told by the

President if they liked their health insurance, they could keep it. Jones pointed out that all existing policies are not “junk insurance.” California has strong coverage mandates, as demonstrated by the many policyhold-ers who want to keep their existing policies and doctors. Jones noted that it is disingenuous for health insurers to argue that allowing renewals will harm the exchange, because cancellation notices being sent to policyhold-ers are steering them into insurance products outside the Exchange, which deprives the policyholder of the federal premium subsidy.

Jones also stressed that allowing existing policyholders to renew for a full year will not undermine the risk pool, as the ACA has robust features which mitigate the risk of health insurers having a disproportionate share of sick people in their risk pool in 2014. Additionally, it is estimated that 400,000 existing policyholders are eligible for subsidies. Even if allowed to renew their current coverage, many consumers will purchase new insurance through the Exchange because of the subsidy. For all of these reasons, the Insurance Commissioner concluded that allowing renewals would not hurt the Affordable Care Act or the Exchange, but should be allowed to make good on the promise to policyholders.
