So why does my thesis have to be copyright compliant you may ask. Well the requirements of the university for submission of a higher degree is that from the start of the academic year 2008‐9 all students are required to submit an electronic copy of their final approved thesis (eThesis) to the White Rose eTheses Online server, in addition to the 2 hard copies submitted to the library. In producing a piece of work for publication, including the eThesis, students must comply fully with UK copyright law. 

Therefore it is GOOD PRACTICE to ensure you work is copyright compliant.

What I am going to briefly highlight and cover today is the common issues that I have seen and that we often face in the Faculty/in scientific research. The first is the use of a third party diagram, figure or table. Often a cell signalling pathway has been described and beautifully illustrated by someone else  ‐ rather than just copy and paste the original figure most students will redraw the image and may – or may not even quote the original paper. Or they will draw an image and state that it is adapted from the original – as in this image here where the student has just used colour and prettier icons. In both these cases this is a breach of copy right law!

The simplest solution is to obtain permission to use the image from the holder of the copyright – which in most cases is the journal publisher.

If we take the adapter figure in the previous example it comes from this paper – which is available online. As you can see there is an article tool entitled request permissions – so we just click on this!

This opens up RightsLink as part of copyright clearance centre. You select the use that you require which is both reuse in a thesis – but more importantly post on a website.

Make sure that you go through to the end of the process and obtain the actual licence –which will explain what you can and can not do to the figure – and also how to correctly cite it. All of your licences get automatically filed in your copyright clearance centre account – so you can provide evidence of having obtained permission if needed. Easy and quicker than spending hours on powerpoint!!

The next most common issue is when someone actually publishes their work before they submit their thesis. Lets take for example this work in this FASEB paper  ‐ these are images of data from the thesis of a PhD student – again do you think this is ok under copyright law?

The next most common issue is when someone actually publishes their work before they submit their thesis. Lets take for example this work in this FASEB paper  ‐ these are images of data from the thesis of a phd student – again do you think this is ok under copyright law?

Well it rather depends upon the mandatory copyright transfer agreement that was signed at the time of getting the work published. In which you transfer your copyright rights to the publisher. Now in this actual agreement there isn't that much information given as to what right you are giving up and what you are retaining.

However the FASEB journal states on their website that it does not charge author to replicate their own work – in these circumstances – but that you still do need to request permission via another online form!

As seen here. – AND you have to  submit this and get it approved in order to have their permission to republish your own work!If you  as a student or as a PI any of your students are in the position to publish before submitting your thesis then pay attention to what you are signing! Often they will let you do it but you still have to ask permission!!

There is also the possibility of signing an alternative copyright agreement form – and again advice about this can be found in the copyright guide online in the section about publishing

Ok so these are the most commons scenarios as I’ve come across– but what if you are not grant permission or if you have to pay a fee and you don’t want to pay it? Well the easiest thing to do is to essentially redact the image – you can often get free permission for using in a thesis – so could use it for your first draft and for the viva process – but then redact and replace with a hyperlink afterwards.
