(Motion carried under the Consent Agenda) Mayor Schmitt asked if there was anyone in the audience who wished to speak on a matter that is not on the agenda. Jamie Polley presented Council with the Park Reserve CIP 2009-2013 Interfund Loan Payback Extension. Ms. Polley said that in 2006 the City committed a significant amount of current and future funding resources toward completing the Huber Park project, including $2 million inter-fund loan. As a result of this action and the subsequent slow down in development and decrease in park dedication revenue, there is a significant change in the Capital Improvement Program (CIP) from what is proposed for 2009-2013, with many projects deferred until funding is available in 2013. Ms. Polley said that staff presented the proposed Park Reserve CIP to the Parks and Recreation Advisory Board (PRAB) on June 22, 2009 for comments prior to submittal to the Finance Department. Ms. Polley highlighted the proposed options suggested by the PRAB for Council which is to change the payback of the inter- fund loan from five years to 10 years. This would allow for two larger parks in the Riverside Fields/ Riverside Bluffs and the Greenfield East/Park Meadows developments to be constructed in 2010. Discussion followed. Council asked Ms. Polley to come up with variations of the CIP by reducing the payback interest, changing the payback time from five years to seven years, etc., and then provide the information at the Parks, Recreation, and Natural Resources budget presentation at the end of July. Ms. Polley presented Council with the Shakopee Sponsorship Program. Clay/Lehman offered Resolution No. 6921, A Resolution of the City of Shakopee, Minnesota, Adopting the Shakopee Sponsorship Program, and moved its adoption. Motion carried 4-0. Mark McNeill, City Administrator, presented Council with 5.F.5 which was removed from the Consent Agenda as well as 13.F.1, concerning the Derby Day’s celebration. Mr. McNeill said that the Derby Day’s Committee has presented items to Council that the City will be participating in for this year’s Derby Day’s. Mr. McNeill stated that the requests are the same items requested last year. Mr. McNeill noted the two changes which are that Derby Day’s will begin on Wednesday instead of Thursday. The other item is that the Sunday parade will be held on 10 th Avenue from Shakopee Town Square to the Jr. High School. Lehman/Heitzman moved to approve the application and grant a temporary on-sale 3-2 percent malt liquor license to the Shakopee Jaycees, Inc., for the fenced in beer garden at Huber Park, on Thursday, July 30, 2009 with sales to cease at 8:00 p.m.; and on Friday and Saturday, July 31 st and August 1 st , 2009, with sales to cease at 12:00 a.m. and the bar being cleared of alcohol by 12:30 a.m. and everyone out of Huber Park by 1:00 a.m. Motion carried 4-0. Clay/Lehman moved to approve the various requests of the Derby Days Committee and staff regarding the Derby Days weekend to be held Wednesday, July 29 th through Sunday, August 2, 2009 (as outlined in the July 7, 2009 memo from Mark McNeill, City Administrator, Document No. CC-468). ORDINANCE NO. 823, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CHAPTER 10 (PUBLIC PROTECTION, CRIMES AND OFFENSES) OF THE CITY CODE 1. Adds a new Section 10.81 to the City Code entitled “Social Hosts.” 2. This Ordinance holds a person criminally responsible who hosts events or gatherings where the person knows that underage persons are consuming or in possession of alcohol or alcoholic beverages with the intent to consume it, unless the person takes reasonable steps to prevent the possession or consumption of the alcohol or alcoholic beverages by underage persons. 3. A person is also criminally responsible if he or she intentionally aids, advises, hires, counsels or conspires with or otherwise procures another to commit this prohibited act. 4. This Ordinance does not apply to conduct solely between an underage person and his or her parent while present in the parent’s household; legally protected religious observances; retail intoxicating liquor or 3.2 percent malt liquor licenses, municipal liquor stores or bottle club permit holders who are regulated by Minnesota Statutes Section 340A.503, subdivision 1(a)(1) (with the exception of persons who host a gathering or event at such establishment); and situations where underage persons are lawfully in possession of alcohol or alcoholic beverages during the course and scope of their employment. July 20A 29-year-old man from Sav-

age was arrested for driving while intoxicated (DWI) and hit-and-run at 3:26 p.m. on the 1500 block of Dalles Drive.

A Shakopee boy, 17, was cited for possession of drug paraphernalia and driving without a license at 5:45 p.m. on Spencer Street and Shakopee Avenue.

Motor vehicle tampering and theft of a wallet were reported at 8:09 p.m. on the 1800 block of Evergreen Lane. The wallet later was returned to the owner.

A motor vehicle fire was reported at 8:34 p.m. on Canter-bury Road and Highway 169.

A Shakopee man, 39, was arrested for fi fth-degree assault and domestic assault by stran-gulation at 8:54 p.m. on the 1000 block of Bluff Avenue.

A 23-year-old Shakopee man was cited for possession of drug paraphernalia and no proof of insurance at 10:41 p.m. on the 100 block of Lewis Street.

July 21A 33-year-old St. Paul man

was arrested at 2:44 a.m. for DWI, false information to police, test refusal, driving after revo-cation and on an outstanding Hennepin County warrant on Highway 169 and Canterbury Road. A New Brighton man, 40, was also cited for possession of a small amount of marijuana.

Burglary and theft were re-ported at 4:18 a.m. on the 2100 block of Chester Street.

Theft was reported at 5:34 a.m. on the 2900 block of Wyn-dam Court.

Theft was reported at 6:58 a.m. on the 2900 block of Glacier Drive.

Burglary was reported at 7:24 a.m. on the 2400 block of Thrush Street.

A 37-year-old woman from Rosemount was arrested for

felony theft for shoplifting at Kohl’s at 5:04 p.m.

An injury crash was reported at 5:34 p.m. on Marschall Road and County Road 78.

July 22A Shakopee man, 19, was

cited for possession of a small amount of marijuana in a motor vehicle and underage consump-tion of alcohol at 12:51 a.m. on Limestone Drive and Vierling Drive. Also cited was a 20-year-old Shakopee man for underage consumption.

A 17-year-old boy from Plym-outh was arrested for posses-sion of a stolen motor vehicle, theft and minor consumption at 3:03 a.m. on the 1300 block of Greenwood Court. Also, another 17-year-old boy from Plymouth was cited for drinking and driving and driving after suspension.

Theft was reported at 7:56 a.m. on the 1200 block of Heri-tage Drive.

Theft was reported at Val-leyfair at 9:27 a.m.

Assault was repor ted at 11:21 a.m. on the 200 block of Lewis Street.

Theft was reported at Wal-Mart at 12:31 p.m.

Theft was reported at 7:11 p.m. on the 2900 block of County Road 79.

A 20-year-old Shakopee man was cited for minor consumption of alcohol at 9:25 p.m. at Canter-bury Park.

A grass fi re was reported at 10:19 p.m. near the high school.

Three Shakopee boys — two 16-year-olds and a 17-year-old — were jailed for burglary and minor consumption at 10:25 p.m. on the 300 block of Alexander Court.

A Stillwater man, 30, was arrested for DWI at 10:46 p.m. on Eagle Creek Boulevard and Canterbury Road.

July 24A man, 21, of Waseca, Minn.,

was cited for a disorderly house, and four other people were cited for minor consumption at 3:19 a.m. on the 2300 block of Vierling Drive. The others included two 19-year-old women, from Glen-

wood and Moorhead, Minn., and two 20-year-old men, from Golden Valley and Kewaskum, Wis.

Theft was reported at 9:22 a.m. on the 1500 block of Vierling Drive.

Theft was reported at 12:54 p.m. on the 100 block of Holmes Street.

A 21-year-old Shakopee woman was arrested for interfer-ing with a 911 call at 3:06 p.m.

July 26A Chaska woman, 32, was

arrested for DWI at 1:42 a.m.

on Highway 169 and County Road 18.

A 26-year-old man from Mound was arrested for DWI at 1:54 a.m. on Quaker Avenue and 185th Street W.

Theft was reported at 2:25 a.m. on the 5600 block of County Road 101.

Two 20-year-old men and a 19-year-old man from Sha-kopee were arrested for minor consumption at 5:08 a.m. on the 5600 block of County Road 101 E.

Burglary of a motel room was reported at 5:08 a.m. at Valley Inn, 1181 First Ave. E.

Theft was reported at 2:22 p.m. at SandVenture Aquatic Park, 1101 Adams St. S.

A 42-year-old woman from Chaska was cited for theft by gate-crashing at Valleyfair at 5:15 p.m.

A 22-year-old man from Win-ona, Minn., was cited for theft by gate-crashing at Valleyfair at 8:31 p.m.

A Shakopee man, 22, was arrested for disorderly conduct at 8:41 p.m. on the 800 block of First Avenue W.

A 27-year-old Shakopee man was arrested for obstruction with force at 11:32 p.m. on the 700 block of Garden Lane.

plete chemical-dependency treatment, abstain from alcohol, random tests, provide DNA sample, $285 in fi nes.

Jeffrey Michael Misgen, 41, Shakopee, theft of motor vehicle, a felony. Adjudication stayed: one year probation, 10 days of com-munity service, $300 in fi nes.

David Clarence Jarveis, 41, Pearlington, Miss., theft, a felony. Probation to be determined, 145

days in jail, provide DNA sample, $285 in fi nes.

Curtis Duane Rank, 55, Prior Lake, furnishing alcohol to minor, a gross-misdemeanor. One year probation, $185 in fi nes.

Jonathan Robert Gaylord, 30, Apple Valley, driving while intoxicated (DWI), a gross-mis-demeanor. Two years’ probation, one day in jail, evaluation, restitu-tion, $995 in fi nes.
