    REGULAR MEETING May 6, 2014

    I. CALL TO ORDER: ROLL CALL:

    Mayor Parlet called the regular meeting of the City Council of the City of Lakeport to at 6:00 p.m. with Council Members Tom Engstrom, Stacey Mattina, Martin Scheel, and Marc Spillman present.

    II. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Council Member Spillman.

    III. MOMENT OF SILENCE: A moment of silence was held for former council member and mayor, Arlin Pischke.

    IV. ACCEPTANCE OF AGENDA: A motion was made by Council Member Scheel, seconded by Council Member Engstrom, and unanimously carried by voice vote to consider an application as an urgency item because the need for action came to the Citys attention after the posting of the agenda and must be acted on prior to the next meeting. A motion was made by Council Member Spillman, seconded by Council Member Mattina, and unanimously carried by voice vote to accept the agenda as amended and take up the urgency item following the Consent Agenda.

    V. CONSENT AGENDA:

    A. Ordinances Waive reading except by title, of any ordinances under consideration at this meeting for either introduction or passage per Government Code 36934.

    URGENCY ITEM: A motion was made by Council Member Mattina, seconded by Council Member Spillman, and unanimously carried by voice vote to approve the application for the Future Pro Tour to be held on May 17, 2014.

    VI. PUBLIC PRESENTATIONS/ REQUESTS:

    A. Citizen Input Christina Basor addressed the Council regarding her concerns about police department staffing.

    B. Update on Measure L Scott DeLeon from the County of Lake gave an update on Measure L, the lake tax. Suzanne Lyons asked questions about the Watershed Protection District. Kim Beall asked questions about expenditures being used for administration.

    VII. PUBLIC HEARING:

    A. Housing Element Progress Report

    Planning Services Manager Britton gave a background regarding this item. A public hearing regarding the 2013 Housing Element Progress Report was opened at 6:57 p.m. There was no public input. The hearing was closed at 6:58 p.m.

    A motion was made by Council Member Mattina, seconded by Council Member Engstrom, and unanimously carried by voice vote to approve the 2013 Housing Element Progress Report and direct staff to submit the report to the Department of Housing and Community Development.

    VIII. COUNCIL BUSINESS:

    A. Public Works Director

    1. Surplus Vehicles A motion was made by Council Member Engstrom, seconded by Council Member Mattina, and unanimously carried by voice vote to adopt a Resolution Declaring Certain Property Surplus and Approving Its Sale.

    B. City Clerk

    1. Legislative Policy A motion was made by Council Member Scheel, seconded by Council Member Engstrom, and carried by voice vote, with Council Member Spillman voting no, to adopt a Resolution Approving the City of Lakeport Legislative Policy.

    IX. CITY COUNCIL COMMUNICATIONS:

    A. Miscellaneous Reports: Council Member Spillman will be attending a fire meeting next week and is hoping the new fire chief will be there.

    Council Member Engstrom reported that three council members will be riding in the Memorial Day Parade. He also expressed that he was interested in what the City of Ukiah is doing in allowing restaurants to expand out into the street.

    Council Member Mattina will be attending APC and transit meetings.

    Council Member Scheel will also be attending the APC and transit meetings. He has also been attending Indian Gaming Committee meetings. He will be leaving tomorrow and will be out of state through May 13.

    Police Chief Rasmussen thanked the City for the wreath and moment of silence for his father in law, a former council member and mayor, who recently passed away.

    Public Works Director Brannigan reported that the docks are in. The intake structure for the water surface treatment plant was inspected.

    City Attorney Ruderman will be attending the League of California Cities City Attorneys Conference next week.

    There will be a Redwood Empire Division meeting on May 16 in Fort Bragg. Any council members who are interested in attending should contact the city manager.

    Mayor Parlet reported that he attended a Board of Supervisors meeting and spoke as a citizen about the Harbor House business.

    Planning Services Manager Britton said that there has been a drastic reduction in banners and feather flag signs. He is quite pleased with the amount of voluntary compliance that the City has received.

    X. CLOSED SESSION: The meeting was adjourned to a closed session at 723 p.m. for conference with labor negotiator pursuant to Government Code 54957.6; Name of City Negotiator Attending Closed Session: Rick Haeg and Administrative Services Director Kelly Buendia; Employee Organizations: All units.

    XI. REPORT FROM CLOSED SESSION: The meeting reconvened to open session at 7:35 p.m. The Mayor reported that there was no reportable action.

    XII. ADJOURNMENT: Mayor Parlet adjourned the meeting at 7:35 p.m.

    RE: Illegal Fireworks-Police Operations Plan MEETING DATE: 05/20/2014

    PURPOSE OF REPORT: Information only Discussion Action Item

    WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

    The City Council is being asked to receive and file the illegal fireworks police operation plan for the 30-day period surrounding the 4th of July (June 17 through July 16).

    BACKGROUND/DISCUSSION:

    Lakeport Municipal Code Chapter 5.30 Fireworks, sub 5.30.220(a) requires that the Police Department present to the City Council an operation plan. Said operation plan shall include the following information:

    (i) Identification of areas within the City where illegal fireworks were a problem in the previous year;

    (ii) A detailed explanation of the deployment of fire and law enforcement personnel to deal with those troublesome areas as well as with the balance of the City;

    (iii) A report on the apparatus and personnel wholl be on duty for the period of June 17th through July 16th of that year, and more particularly, on the 1st through the 5th of July, inclusive;

    (iv) Recommendations on and discussion of what, if any, dedicated illegal fireworks enforcement patrols there should be for that year and all other relevant information and statistics deemed necessary by the City Council.

    There are significant increases in the number of visitors to our city during the July 4 holiday and the 30-day period surrounding it. The number of visitors to the city peaks on July 4 as many persons arrive to enjoy fireworks related activities. In order to provide for proper public safety, the Police Department increases its staffing levels as much as possible in the period surrounding July 4. During the fireworks show on July 4, the Police Department deploys all of our staff as well as mutual aid staff from other law enforcement agencies in Lake County. The police department has developed the 2014 fireworks period operation plan along with public notices regarding the use and discharge of legal fireworks.

  • POLICE OPERATIONS PLAN FOR ILLEGAL FIREWORKS

    EFFECTIVE JUNE 17-JULY 16

    1. Identification of areas within the City where illegal fireworks were a problem in the previous

    year.

    The Police Department has identified the areas described as The Parklands and Will-O-Point as those areas most affected by illegal fireworks.

    2. Detailed explanation of the deployment of law enforcement personnel to deal with those troublesome areas as well with the balance of the City.

    The Police Department provides routine patrol to those areas which present the most problems on a daily basis when staffing levels permit and during the course of the patrol officers duties. Increased patrols with targeted enforcement will occur in specific areas when deemed necessary.

    3. A report on the apparatus and personnel wholl be on duty for the period mentioned above

    and more particularly on the 1st through the 5th of July.

    The Police Department will provide uniformed patrol to those areas described above through June 17 and July 16 when staffing levels permit. As it relates to Independence Day, the Police Department will set up a command post at City Hall and with the assistance of allied agencies and conduct a mass canvass of the Parklands utilizing officers on foot patrol. Officers assigned to the Parklands will directly target the troublesome areas and seek out illegal fireworks violators. Officers will also be assigned to the remaining areas of the City, not demeaned as troublesome, in patrol units.

    4. Recommendations on and discussion of what, if any, dedicated illegal fireworks enforcement

    patrols there should be for that year.

    The Police Department is coordinating, as in years past, with members of the Lakeport Fire Department, California Department of Forestry, Lake County Sheriffs Department, Clearlake Police Department, Lake County Probation Department, Lake County District Attorney-Investigations Division, California Highway Patrol, and California State Parks-Law Enforcement Division-Clearlake Sector to provide personnel during Independence Day throughout the Parklands and Will-O-Point. Patrol units will provide patrol coverage to the identified problem areas and other areas demeaned to be troublesome, as well as continuing to provide public safety services throughout the city.

    The City Council is being asked to receive a supplemental engineering & traffic study and adopt an ordinance establishing the speed zones associated with the study.

    BACKGROUND/DISCUSSION:

    In June of 2011 an engineering and traffic study was performed for all of the current speed zones in the City. This study is required to be performed every five years as to establish the speed limits on City Streets. At the time of the 2011 study Mendocino College was developing the Lake Center Campus in its current location on Parallel Drive. Due to the construction occurring and not having the true traffic impact from classes and students, Parallel Drive was omitted from the study with the intent to revisit the location once the college was established.

    The college is now well established at that location and traffic patterns and speeds have stabilized. A study was performed by Dow & Associates which included four locations before (8/6/13) and after (9/19/13) the start of the fall semester.

    Currently the speed limit south of what used to be the southern city limits on Parallel Drive is 55 mph, 35 mph from the previous city limits to Lakeport Boulevard, and 30 mph north of Lakeport Boulevard to Craig Avenue.

    Attached for your consideration is the body of the report with the engineer's recommendations as well as a copy of the proposed ordinance highlighting the proposed changes and a clean copy for introduction.

    OPTIONS:

    Introduce the ordinance and set a public hearing to consider adoption thereof for the June 17, 2014, meeting.

    Do not introduce the ordinance and allow the speed limits to remain the same.

    WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

    The City Council is being asked to approve entering into a contract with Ricoh Americas Corporation for the lease of a new copy machine.

    BACKGROUND/DISCUSSION:

    The City of Lakeport currently leases a Ricoh Aficio MP 6001SP copier/printer/scanner for $448.20 per month. This lease is set to expire in June of this year.

    The current machine prints and copies in black and white only. In addition to this machine, there are several printers located throughout City Hall. The cost to print a black and white copy on these printers averages $.03 per page. Three of these extra printers allow for color printing. An analysis of these color printers shows that the average cost of printing a color copy on these devices is $.27 per page.

    Ricoh has provided a quote for the lease of a new Ricoh MP C4503 copier/printer/scanner for $330.56 per month (not including tax). In addition to the features we now have with our current machine, this machine will also print and copy in color. The quote includes up to 6,700 black and white images per month as well as all supplies except paper. We are currently averaging 5,887 copies per month. If we were to have a large print job that exceeded our monthly allotment, we would be billed an additional overage rate of $.008 per page (we are currently being billed an overage rate of $.014 per page). The price for color copies is not included in the lease but would be billed at a rate of $.048 per page.

    Lease of this equipment will enable us to discontinue use of some of the other printers located around City Hall and will enable us to see a significant savings in the purchase of expensive toners to operate these printers.

    In addition to the savings in the lease itself, the new machine will use less electricity and have fewer C02 Emissions. Over the term of a three-year period, the current copier uses 1,051 kWh in electricity and has 1,598 pounds of C02 emissions. The new copier will use 289 in kWh and have 439 pounds of C02 emissions over that same time period. This would save 28 trees over the lifetime of the three-year lease.

    The City of Lakeport is a member of U. S. Communities, which is a government purchasing alliance. This allows the City to participate in a cooperative procurement program that includes contracts that have been competitively solicited by a lead agency and contain language that advises all supplies of the contract that it may be used by other government agencies throughout the United States. Ricoh is one of the suppliers in the U. S. Communities program. The proposal submitted by them through this program satisfies the competitive bid requirements under Public Contract Code section 10299(a).

    The City is moving towards more digital storage of images; and, therefore, our copy costs should continue to decrease as we move forward. Our average number of copies over the past three years has decreased by about 2,000 copies per month. This savings has been noticed through the utilization of paperless agenda packets and the scanning and emailing of documents instead of production of hard copies.

    The City does have the option of continuing on a month-to-month basis with our currently copy machine, but the new lease will afford a significant cost savings to the City of Lakeport and will enable us to have updated equipment. Included in the new lease are supplies, maintenance, and the transfer of all programming information from our old copier to the new one. If we were to go with another brand of copier, we would have to reprogram all of the departments codes and emails from the old machine resulting in additional staff time.

    OPTIONS:

    Authorize staff to proceed with entering into a new lease for a RicohMP C4503; Continue to lease current copier on a month-to-month basis; or Provide other staff direction.

    The City Council is being asked to adopt a resolution calling for, providing for, and giving notice of general municipal election and request election services to be provided by the County of Lake.

    BACKGROUND/DISCUSSION:

    There are two City Council members whose terms will expire at the end of 2014 (Thomas Engstrom and Stacey Mattina). The election to fill these seats will take place on November 4, 2014.

    In the past, we have been able to consolidate our elections with the County of Lake at a significant cost savings to the City. The City Clerk's Office is staffed by one part-time person. The ability for the City to conduct the election itself with this level of staffing would be impractical. There is a significant cost savings to the City to consolidate its elections with the County. If we were to conduct our own elections, there would be significant costs for personnel (poll workers) and publications.

    As part of the elections process, the City must adopt a resolution calling for, providing for, and giving notice of the General Municipal Election. If the City is to request election services from the County, it must pass a resolution requesting approval from the Lake County Board of Supervisors. The attached resolution meets both of these requirements.

    OPTIONS:

    The Council may adopt the resolution or provide alternative direction to staff.

    A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKEPORT CALLING FOR AND PROVIDING FOR AND GIVING NOTICE OF THE GENERAL MUNICIPAL ELECTION TO BE HELD IN

    THE CITY OF LAKEPORT, COUNTY OF LAKE, STATE OF CALIFORNIA, ON THE 4TH DAY OF NOVEMBER, 2014, FOR THE PURPOSE OF ELECTING TWO (2) CITY COUNCIL MEMBERS, EACH TO HOLD OFFICE FOR A TERM OF FOUR YEARS, OR UNTIL THEIR SUCCESSORS ARE ELECTED

    AND QUALIFIED, REQUESTING CONSOLIDATION OF THAT ELECTION WITH THE STATE GENERAL ELECTION AND REQUESTING APPROVAL OF THE LAKE COUNTY BOARD OF

    SUPERVISORS FOR ELECTION SERVICES TO BE PROVIDED BY THE COUNTY ELECTIONS OFFICIAL

    WHEREAS, the general municipal election of the City of Lakeport is scheduled for November 4, 2014; and WHEREAS, the interests of efficiency call for the consolidation of that election with the state general election to be held that same date; and WHEREAS, the City Council requests to obtain services from the Lake County Clerk for the conduct of that election. RESOLVED, by the City Council of the City of Lakeport as follows: Section 1. The General Municipal Election is hereby called and ordered to be held in the City of Lakeport, County of Lake, State of California, on the 4th day of November, 2014, for the purpose of electing two (2) members of the City Council, each to hold office for a term of four (4) years, or until their successors are elected and qualified.

    Section 2. The General Municipal Election hereby called and ordered to be held, shall be held and conducted, and the votes thereat received and canvassed, and the returns thereof made, and the result hereof ascertained, determined, and declared as herein provided, and in all particulars not recited herein, according to the laws of the State of California, providing for Municipal Elections; and the polls for such election shall be and remain open during the time required by said laws.

    Section 3. The interests of efficiency call for the consolidation of that election with the state

    general election to be held that same date, the Lakeport City Council hereby declares its intent to consolidate this general election with the Statewide General Election to be held on November 4, 2014. This resolution shall constitute the request for consolidation required by Elections Code section 10403 and the City Clerk shall forward a certified copy of this resolution to the Clerk of the Lake County Board of Supervisors not later than 99 days prior to November 4, 2014.

    Section 4. All voting places, precincts, and election officials within the boundaries of the City of

    Lakeport shall be the same as those for the general election and the ballots to be used at the general election shall be in form and content as required by law.

    Section 5. The two (2) City Council Member nominees, receiving the highest number of votes

    for their respective offices and who have filed the required disclosure statements, shall be declared elected for their four (4) year terms beginning when first administered the oath of office, and ending when their successors are elected and qualified.

  • Section 6. The City of Lakeport determines that the length of Candidate Statements shall not exceed 200 works and cost of the Candidate Statement shall bey paid by the Candidate in accordance with Elections Code section 13307.

    Section 7. The Lakeport City Council hereby requests approval of the Lake County Board of

    Supervisors to authorize the County Elections Official to provide election services to conduct said election.

    Section 8. The City Clerk is hereby authorized to utilize the services of the Lake County Clerk for

    the conduct of the general election. The City of Lakeport hereby agrees to pay the costs of those services as outlined by current policy of the Lake County Elections Division.
