April 3, 2014 J.B. Van Hollen Kevin J. Kennedy Wisconsin Attorney General Director and General Counsel Wisconsin Department of Justice Wisconsin Government Accountability Board P.O. Box 7857 P.O. Box 7984 Madison, WI 53707 Madison, WI 53707 A.G. Van Hollen & Director Kennedy: I am requesting the Wisconsin Government Accountability Board (GAB) and Attorney General (A.G.) examine the validity of Mr. Nick Vander Puy’s vote dated April 1, 2014 in the Town of Anderson, Iron County. It is my concern that Mr. Vander Puy’s vote may be in violation of Chapter 6.10 of the Wisconsin State Statutes. Chapter 6.10 states: “Residence as a qualification for voting shall be governed by the following standards:

(1) The residence of a person is a place where the person’s habitation is fixed, without any present intent to move, and to which, when absent, the person intends to return.”

In a social media post dated April 1, 2014, Mr. Vander Puy described his voting in Iron County (please see attachment). On March 13, 2014, the Iron County Board moved to evict Lac Courte Oreilles harvest camp under Iron County ordinance section 12-1-3 (b). Mr. Vander Puy signed an affidavit identifying himself as “homeless,” but the location he is to return to is no longer permitted under Iron County ordinance. In addition, I have the following questions related to the voting eligibility of Mr. Vander Puy for the A.G. and GAB for consideration:

(1) Did Mr. Vander Puy vote in any other jurisdiction on April 1? (2) Does he currently have a permanent address not in Iron County or the jurisdiction he voted in on April 1,

2014? Therefore, I am requesting the Wisconsin Government Accountability Board and Attorney General’s office review, as soon as possible, the voting qualifications of Mr. Nick Vander Puy and relay their findings to my office. Sincerely, Tom Tiffany Wisconsin State Senator 12
