Department of Liquor Licenses and Control Liquor License Application #128176, Series 4 – Wholesaler, as submitted by Kim Louise Callahan for Gladiator Worldwide Logistics LLC, 670 South 91st Avenue, Tolleson, AZ 85353. This non-transferable liquor license allows a wholesaler to warehouse, sell and distribute all types of spirituous liquor (beer, wine, distilled spirits) to Arizona-licensed retailers.

To date, the City Clerk’s Office has not received any comments for or against this liquor license

application. Following the Public Hearing, Council Action: Approve/Deny Arizona Department of Liquor

Licenses and Control Liquor License Application #128176. CONSENT AGENDA – ACTION ITEMS Items on the Consent Agenda are of a routine nature and are intended to be acted upon in one motion. Council Members may pull items from Consent if they would like them considered separately.

b. Approve Claims and Bills Report. c. Approve Fifth Amendment to Cooperative Purchasing Agreement between the City of

Tolleson and Sterling Computers Corporation, f/k/a NextNet Partners, LLC, for technology products and services, and authorize the City Manager to execute and deliver said Agreement. The City and Vendor desire to amend the Agreement and Amendments as applicable to reflect an increase in compensation for additional services and materials. The City shall increase the compensation to Vendor by not more than $65,000 for the additional services and materials at the rates set forth in the Fee Proposal, resulting in an increase of the aggregate not-to-exceed compensation from $545,997 to $610,997. Heavenly Father, we come before you to thank and praise you for all the blessings you have bestowed upon us. We are grateful for the opportunity to be here this evening and ask that you confer wisdom and guidance on our City Council as they make decisions regarding the betterment of our beloved City. We ask you to help us grieve the recent loss of community members that meant so much to us and others for Maria Ayala, Barney Morado and Dr. Charles Landis. Their souls and memories will live on forever and their impact on our community is enduring. This is going to be taken up by Employee Resource Department, which is Director Jackson. Jackson, you have the floor.

EMPLOYEE RESOURCES DIRECTOR JACKSON: Hello, good evening, Mr... Oh, yes, I'll defer to our City Manager. CITY MANAGER MEDRANO JR.: I'm sorry, Mr. Mayor, members of the Council. I talked to Wendy. I asked her, if you wouldn't mind, that I can offer a brief explanation, and I'll turn it over to Wendy. With regard to these two bodies and historically with most bodies appointed by Council, we've always struggled to maintain quorum. Our primary focus is to do just that, specifically with public safety, the Public Safety Board, not to say that the people I grew up with in the organization are getting older, but it's inevitable. We're starting to see more and more retirements. And for a little while, we're concerned about being able to maintain quorum on both the Police and Fire Public Safety Boards. So as we talked about it, I believe, Wendy, and you can correct me if I'm wrong, Wendy asked Mr. Donald Gerhart if he wanted to continue his service on the Public Safety Board. He indicated that he wanted to take a little break, which is understandable. He has been very consistent for us for many years. As you can attest, Mr. Mayor, as you were the Chair of both Boards for such a long time. CITY MANAGER MEDRANO JR.: Mr. Gerhart applied for the council vacancy and they went through that process. I said, well, why don't you ask Mr. Salazar, who went through the same process, if he would be interested, and he indicated in the affirmative. So he has agreed to serve on the Public Safety Board and we are eternally grateful for that. Then the matter of the retirement of Alfredo Gomez from the P and Z was brought to my attention. We thought, well, we knew that Mr. Aponte was available. I don't think he's doing much out there right now. I'm not sure if he has a second job or not. You are threre, Mr. Frank? For the record. So I asked Mr. Earp to give Mr. Aponte a call to see if he'd be interested in the planning and zoning commission, given the fact that he worked in the City of Tolleson for over 30 years, is very adept and well versed in our economic development goal of generating as much retail sales tax as possible. CITY MANAGER MEDRANO JR.: We also wanted to make sure that we were spreading the wealth and spreading the responsibility so that no one person is doing more than one body. In the future, as we see more retirements from either Board, we will certainly entertain others; and we've done this historically, mostly because it's difficult for people to find time. So I can express my gratitude enough to both gentlemen for agreeing to volunteer their time because these are not paid positions, and we know how much they both love Tolleson. With that I turn it over to Mr. Jackson if you want to add anything or take any questions. EMPLOYEE RESOURCES DIRECTOR JACKSON: No, I think you got it covered, Sir. Thank you.

MAYOR RODRIGUEZ: I will add as the Chairperson for both the Fire and the Police Board for many years, one of my biggest challenges, and Wendy will attest, we have deadlines that we have to pass certain things; and for that, you have to have a quorum. The Public Safety Boards are a little different because they require that two public safety officers also sit on the Board. So you have two public safety officers, the Chairperson, which is typically a Council Member in my case. And then you have two residents of the community. I was fortunate to have Mr. Gerhart for a very long time. Prior to that, I asked Melissa Herrera to come over and help out, and she helped out for quite a while until she wasn't able to do it. MAYOR RODRIGUEZ: And prior to that, we were blessed to have the Vice Mayor's father, who helped out for many years as well. It's a tough thing to get people on there. So I want to thank both of you guys for having the interest and being willing to help us out. And so before we even take a vote, I want to bring to the floor Council Members comments, questions. Please raise your hand. Council Member Gamez, you have your mute button on. Your mute button is on. COUNCIL MEMBER GAMEZ: Can you hear me now? MAYOR RODRIGUEZ: Yeah, we can. Thank you. COUNCIL MEMBER GAMEZ: Was this open up to the community for people to maybe consider applying or know about this Board as opposed to... I have nothing against appointees or anybody else. I'm just saying. Was it open out to the community? CITY MANAGER MEDRANO JR.: Mr. Mayor, members of Council. In this instance, it was because we were doing our best to fill the quorum and maintain the quorum. But as you're aware, we have opened it up in the past. We don't get the best response. But in this particular instance, our primary focus was to establish a quorum and maintain a quorum, but absolutely open to doing so in the future. COUNCIL MEMBER GAMEZ: I think that we should. And another comment I would like to add is that you guys have mentioned in terms of spreading the wealth, we have some individuals that have served in the P and Z for years, Carolina, Diana... I think that maybe it's time that maybe we consider paying these people on a monthly basis to put a little incentive for them to continue to serve and maybe attract other people to maybe serve. That's something we

I know that COVID during this time also caused there to be somewhat of a delay. But we have shared this information through our City newsletter. So it has gone out to the community. I think it's a wonderful idea to consider compensating anyone that serves on any of our boards or to churn interest and to honor their service. Even though we're not going to pay them a lot. I know we have a number of boards we certainly need to take into consideration and step it up a little bit as we move forward. So the point is duly noted. It's a good point. Which one did you just read? MAYOR RODRIGUEZ: Item number two on a regular agenda action items. It's to discuss and consider appointment of Mr. Frank Aponte as commissioner. CITY MANAGER MEDRANO JR: Yes, I thought we covered that one when we discussed it, but that's fine. Yes. Obviously, those of you who've been with the City of Tolleson for an extended period of time know Mr. Aponte. I certainly know Mr. Aponte since I was in grade school because my aunt worked in the same department, and I’d go over there to get money for food, for pizza every day. And I'd see Frank. He started out as a mechanic, worked his way up, and he eventually finished as a Field Operations Superintendent. We wholeheartedly recommended his appointment. Hold on a second. I'm in a car, if you can't tell, so I'm jumping around here. CITY MANAGER MEDRANO JR: Here we go. To fill this vacancy left vacant by Alfredo “Golfer” Gomez, who when I began in the City, was on Council with his brother, and that was always a need for fun council meetings. And as I mentioned earlier, he was a major contributor to many of our missions for his 30 years of service in the City of Tolleson. MAYOR RODRIGUEZ: Alright, let's move on to work study presentation for discussion number one, fiscal year 2021-2022, a budget kick off discussion and second quarter fiscal year 2020-2021 update and financial presentation. Financial Chief Advisor Vickie, you have the floor. CHIEF FINANCIAL OFFICER JUVET: Thank you, Mayor, Vice Mayor, Council Members. Welcome to fiscal year 2022 kick off. And I'm also going to be giving an update on the second quarter of our current fiscal year. I just wanted to remind everybody what the City of Tolleson mission and vision statement is, and this is kind of what we're thinking about when we're building our budget. Our mission is the City of Tolleson provides an inclusive, healthy, safe, affordable place to live, work, play and raise a family. And the vision of the City of Tolleson is to be financially sound to fund reliable programs and services. We support leadership, development opportunities for all. And then we have the following core values, our core values are caring, collaboration, equity, inclusion and inspire. CHIEF FINANCIAL OFFICER JUVET:

These are our strategic anchors or our areas of focus, which is economic development, public safety, neighborhood revitalization, leadership programs and services. And these are the budget priorities we have, and I kind of bolded the bottom one because that is what we are going to be using most of our unassigned fund balance to supplement the bond proceeds for our new library and senior center in city hall. So we have all of these priorities. But our main focus for the FY 22 is going to be building our new building. To do that, it's going to require 10 million dollars out of our general fund unassigned fund balance. So we have bond proceeds, but we're using an additional 10 million from our general fund, which is a very huge number. CHIEF FINANCIAL OFFICER JUVET: But we've been building up our fund balance over the years because we've known we're going to be building a first class library, senior center and city hall. So we do have the funds available. But this is a big chunk of our unassigned fund balance that we need to be aware of. We've started our benefits and compensation process; so H.R. and Finance are working together on the RFP for our health benefits and our dental projects. CHIEF FINANCIAL OFFICER JUVET: We were lucky enough to get a multi-year rate lock on vision and life; so there won't be any changes to our vision and life insurance. And we're also implementing the results from the compensation study that Wendy and our vendor will be providing more detail of the results from our compensation study at a later meeting. So the next step in our budget process is the department directors are going to work their submittals and meet with the City Manager and myself in mid-February. Then after we come to agreement on all the departmental requests, the next council work study session is going to be on March ninth to kind of go over what all the budget requests are. And then we do have three additional meetings after that, depending about how far we get along in each of these budget meetings, that we could go into more detail as we present the budget to you. If you have additional questions or want additional information, we have three extra meetings before. CHIEF FINANCIAL OFFICER JUVET: If we're meeting my timeline, the Council would approve the tentative budget on May 11th, and then the final budget on June 8th, and then setting the property tax on June 22nd. So we will be having quite a few budget meetings between now and the end of the fiscal year. Now for the second quarterly update of where we are in the current fiscal year, I wanted to go over the public safety retirement process because a lot of the cities are actually having to create debt to pay for their unfunded liability for their police and fire. CHIEF FINANCIAL OFFICER JUVET: But as you can see, the fire as of June 30th of 2020 is 85.8% funded. The police is now 82.10% funded. And just to kind of give you in comparison, the ASRS is currently 72.8% funded. So ASRS is not anticipating it will be fully funded until 2047. So we are in good shape in our public safety fund, but we're going to be continuing to pay in additional

because we still another five million roughly of unfunded liability. But in comparison, I'm kind of considering that we are fully funded. If you compare the public safety fund with the Arizona State Retirement System, and the elected officials retirement system is only currently actually 32% funded. So that's why the elected officials retirement contribution has actually gone up to 61% each year that governments are paying in to help get that funded percentage for the elected officials retirement. So I would say we are doing very well on our public safety and funded balance. CHIEF FINANCIAL OFFICER JUVET: This is kind of a good news slide too. Looks like, at least on my screen, the bottom percent is cut off. Comparing our sales tax for the two quarters of the fiscal year to last fiscal year, our sales tax is actually come in 10.5% higher than last year. So we are doing well so far this year with our sales tax. Thanks to our economic development leadership, bringing in new businesses and your focus of wanting to bring in good businesses for our City. The budget adjustments so far to our contingency, we started off the year with $750,000. We've had two budget adjustments. So our main remaining contingency is right now $261,000. This mostly is due to the extra funding we've received for COVID. If we receive extra funding that we didn't anticipate what we need to move budget authority around to spend that additional funds. So that's basically what's going on with our contingency funds. CHIEF FINANCIAL OFFICER JUVET: And then this kind of shows where each of the departments are so far this fiscal year; 50% of the year is done. So I would anticipate each department to be around 50% spent. There are a few departments that I am watching to determine if a budget adjustment might be needed to be made before the end of the year. This just kind of gives you where each department is through the end of December. But for the most part, everyone is definitely watching their budgets closely and being good stewards. (INAUDIBLE) fund and it's kind of showing what the revenue has been for the last several years since 2014-15. What this is showing in the red is the expenditures. Did the presentation just go off? SPEAKER: Yes. It did. SPEAKER: You are back. CHIEF FINANCIAL OFFICER JUVET: Okay, good. The expenditures are the red, and the revenues are the green. So you can see in 2014-15 time frame, the expenditures were a lot higher than the revenues we were getting in, and so that was not sustainable. So that was about the time that we went out and got the RAD company to pick up the trash. We had a five-year contract with them with two one-year extension. So this next fiscal year will be the first year extension that

we're planning to renew because the fund has, ever since we've been working with them, has become healthy again. So the revenues are higher than the expenditures, which means we don't have to have a rate increase for this. And it looks like we won't need to have even consider rate increases to roughly the 2022-2023 years when it looks like they may start connecting again. That's an indication that we're not bringing in enough revenue to cover the costs for the sanitation fund. So just wanted to let you know that we are planning to exercise our next one year option. CHIEF FINANCIAL OFFICER JUVET: We also wanted to point out because of the competitive rate, we were able to increase the trash pickups from quarterly to monthly, which I think our citizens do appreciate. The drop off program was started and the household hazardous waste program was expanded to include curbside pickup. Which I think all are deeply appreciated. Earlier this week, actually, last week, we had a conversation about COVID-19 and I asked the City Manager and the Fire Chief to please provide an update, not only at this meeting, but I ask him to provide an update at every council meeting until we're able to be in a much better place. And so expect that every two weeks so that we have the latest and greatest. MAYOR RODRIGUEZ: And before you get started, Chief, I just want to personally take the time to thank you for everything that you've done thus far, working with our vendors, everybody, actually. Chief, I know you're our quarterback when it comes to this, but the whole team has done a tremendous job of just getting everything lined up and helping our community the most that they can. So thank you in advance. And we look forward to your presentation.

FIRE CHIEF GOOD: Thank you, Mayor, members of the Council. You are correct, I'm just not one person who's doing this. Our entire team has been working on this for over a year. And today actually marks the day, historically, the first COVID case in Arizona for whatever that's worth. Since then, we've seen 732,000 in one year, which is just amazing, and 12,000 deaths. So it's a huge problem despite all the mitigation efforts. The problem continues to increase, and we are doing everything we can. FIRE CHIEF GOOD: A couple of notes historically are that ex-mayor Tovar and City Manager Medrano worked to partner with Embry Women's Health to bring testing to our City so we know how to size up. I think you're all aware at Veterans Park and behind City Hall, that's been going really well. I was staggered when I heard this number today. They've conducted over 95,000 tests to residents of our community and region. That's just amazing. We're very lucky that they've been doing that. SPEAKER: That's in Tolleson. Right, Chief? FIRE CHIEF GOOD: Well, from the Tolleson sites. SPEAKER: Right, from the Tolleson sites, not Tolleson property, but the 95,000 tests were conducted from the Tolleson sites. I wanted to clarify. FIRE CHIEF GOOD: Yes, that's correct. SPEAKER: Thank you. FIRE CHIEF GOOD: Then amongst our employees, we've seen 44 active cases, confirmed cases of COVID, which represents about 20% of our workforce. So it has had an impact on us, and every department is dealing with it a little bit differently in every department. It's been quite a toll, and Wendy has really been the CDC of Tolleson. I think it really is a great term. She does a lot of the tracing. She has traced 173 different employees in terms of cases, quarantines and exposures. It's a lot of work. She's calling me on weekends at 2:00 a.m., and the phone rings, it's Wendy. No, I'm kidding. It seems like that because she just all over it.

FIRE CHIEF GOOD: We have, as of today, our City has an application with the Department of Health Services in order to be able to administer the vaccines ourselves. Our preference. and we've shared this with a few council members and with Embry, is that we continue to partner with Embry and have them once the vaccine becomes available to continue to serve and provide those vaccines to our community. They have the infrastructure in place, which we don't. Now we have that backup plan, and we may be able to do that. That plan could be approved for us as early as tomorrow if you have not heard of this yet. Embry has another partnership with the high school district and on Friday, Saturday and Sunday of this week, from 7:00 in the morning to 10:00 at night, they will be providing 3800 vaccines to the 1B population from the school district. That's really good. FIRE CHIEF GOOD: They have expressed to us they don't know that they'll be able to administer that; there will be many people they will be able to administer to those people if they come. If there are not that many, that we're making arrangements with them to have 1A and 1B phases be able to get the vaccines. We're working very diligently with them. We're in contact with them several times a week. If you're unclear, I'll just review it because it's kind of hard to remember, even for me. That is 1A people. Phase 1A are health care providers such as firefighters, nurses, that kind of folks, doctors, people who care for the elderly. Phase 1B is the police officers, teachers and people over 75 years old. Our goal is to bring this to Tolleson as soon as possible through Embry to where the supply, when it opens up, that we're able to provide that to everybody. There are discussions, but there's a limited amount of supply right now. Embry is just waiting to get that. FIRE CHIEF GOOD: I know that per the Mayor's direction, we're in touch with the governor's office, to see what we can do to expedite the delivery and supply to Tolleson, whether it's directly to Tolleson or through Embry or whatever that may look like. We're working on that. We are also continually developing and evaluating transition plans. We were on a call earlier today with the Mayor, and we talked about that… that is what does it look like when we open up the City, when we open up city hall and people can go there? How do we determine metrics to open up the library and Parks and Rec and the senior center where our most vulnerable population resides? What can we do, and when is it safe to do that? And looking at all kinds of different metrics again. There's probably a lot of questions. There's a million things I didn't cover, certainly. If anybody else on our team would like to add something, then please jump in or our team would be happy to answer any questions you may have some. SPEAKER: Fellow staff, any of you want to add to the presentation of George Good? SPEAKER:

If you guys know of anyone, please share that information with me personally. I can definitely try and register them if they're Tolleson residents for 75 plus. MAYOR RODRIGUEZ: Yes, thank you, Santiago. By the way Santiago does do house calls, so if you do know somebody that is 75 or older, and they do not have transportation. VICE MAYOR ERIVES: Thank you, Mayor. Do we have our infection rate? I know that's a metric that's used to open up the schools that they use. Just do we know that number? SPEAKER: I can take that. I know several of our team members also have that, but in Tolleson, not just at the schools, that may have some more specific information… but in Tolleson, our percentage of positivity is 23%. I know the schools are looking to have to go back once they hit 5%. They've got quite a way to go. Their individual metrics may be less, but it is 23% as of last week… way too high. VICE MAYOR ERIVES: Thank you. Thank you for that information. Thank you. That was the number I was looking for. Thank you. SPEAKER: Yes, go ahead. SPEAKER: Sorry, Sir, I just said worst in the world, literally. SPEAKER: Yeah, the County does have a really good webpage, and they send out updates on local percentages broken up by zip code. We all know it, but it represents a much bigger area. But it gives us a pretty good snapshot on the performance of the school districts, for example, when they could open and yeah, 5% versus 20%. That's a stretch. It's a big

stretch. MAYOR RODRIGUEZ: Other questions. Council Member Davis, you have the floor, and Council Member Mendoza, I have you next. COUNCIL MEMBER DAVIS: Which vaccine will they be distributing this weekend? FIRE CHIEF GOOD: They are going to be using the Pfizer vaccine, Councilman. SPEAKER: Okay, Council Member Mendoza and then Councilwoman Laborin, I have you next. COUNCIL MEMBER MENDOZA: I was just going to ask if we still have the mask mandate, and if so, is it being enforced? SPEAKER: Do you want to take it? CITY MANAGER MEDRANO JR: Sure. Thank you Mr. Mayor, members of Council, Council Member Mendoza, the easy answer is yes. When we enforced since the beginning, the police department's focus has been in the public arena when it comes to mass social distancing, overcrowded events, etc., has been to collaborate with the property owners to help enlighten and raise awareness to the need to observe these measures. We haven't cited anybody. That's not been our objective. That is the ultimate last resort. And thankfully, nine times out of ten or even 99.999% of the time when the PD responds, those that they have to respond and counsel respond positively internally within the organization. As George mentioned, we had had our fair share of cases. It's counterintuitive within our organizational culture, when there's a tragedy, when there's a crisis, we respond. That's just the nature of cities. That's certainly the nature of the City of Tolleson, specifically. To get our organizational family to fully embrace the fact that the best thing we can do for each other is to stay away from each other. CITY MANAGER MEDRANO JR: It sounds completely counterintuitive because it is, it's not who we are. However, they've done a wonderful job doing so. We have had a very small minority who have come to work when they shouldn't have. And we counsel, we inform or we empower them to take care of themselves and their families first, because by doing so, they help to slow the spread. It's not easy because we hire people for their work ethic. They show up before COVID, they show up sick. John Paul was the worst offender. I used to wrestle him and

put him in a headlock and walk him out the door because he loved to come to work sick. He's not on, so I don't know if he knows I'm making fun of him, but he can't deny it and we used to make fun of it. Don't John Paul it if you're sick, go home. And John Paul's gotten better, so I'll give him credit for that. It's not easy. As you all know, I don't have to explain how deadly the consequences are. CITY MANAGER MEDRANO JR: I'm grateful to report, and I believe I did in the email last week, that we haven't lost anybody from the virus. We've lost some people through other means, and those were tragic enough and heartbreaking enough, but we've done an incredible job. And I want to publicly thank everybody on the screen and every teammate within the City of Tolleson for being so diligent. It's not easy. SPEAKER: We have Council Member Laborin and then I see… I'm sorry, the hand held up after that and then I'm going to take (INAUDIBLE). COUNCIL MEMBER LABORIN: My question is for Mr. Good. The shots that are going to be given out to this program, are they going to be the Moderna shots too? FIRE CHIEF GOOD: Mayor and Council Member Laborin which program were you asking about, the one this weekend?, COUNCIL MEMBER LABORIN: The vaccines. Which shots are they doing? Which brand are they going to be using? FIRE CHIEF GOOD: The ones the one for this weekend, I believe, is going to be the Pfizer. Going forward in the future, what we have for our community is undetermined at this point. It will be whatever we can get, quite frankly, either the Moderna or Pfizer. A couple others are on the horizon, Johnson & Johnson and AstraZeneca, which have both been approved in the United Kingdom. Their approval is pending here in the United States. COUNCIL MEMBER LABORIN: Thank you, Chief. SPEAKER: Thank you, Mayor and Council. We are also looking to run some new campaigns that we ran at the beginning of the pandemic to encourage people to continue to wear masks. I know we're designing some new masks to be given out to the public and hoping to engage them on why they decide to mask up so we can have people share why they're

deciding to wear a mask. Then we'll start to distribute masks that are branded, not necessarily like the staff ones, but that are branded with the City of Tolleson. I know that Jason Earp did say that he was working with our local businesses to redistribute more masks. We did that initially at the beginning of the pandemic. We've done it throughout as far as businesses who have requested them. But we're looking to reinitiate some campaigns that we did at the beginning of the pandemic to help people encourage them. SPEAKER: Again, we've been hanging on for such a long time and everyone's tired and want to help reignite people's hopes and really just to continue doing their best to mask up. MAYOR RODRIGUEZ: This is no time to take the gas off the pedal. As a matter of fact, it's time to double down. We've still got a ways to go. Council Member Gamez. COUNCIL MEMBER GAMEZ: Actually, they have asked and answered my question in terms of mass being distributed to businesses. You know, sometimes I walk into the (INAUDIBLE), 50% have a mask. 50% don't. The question of enforcement came to my mind. If we could disperse more masks to the businesses, and they don't come in with one, make sure they have one. They have no excuse if it has a logo on it, that’s even better. But that was exactly where I was going. You see it everywhere. That's a problem. MAYOR RODRIGUEZ: Council Member, I agree. I was at the (UNKNOWN) this weekend and I walked in, and there were some folks who didn't have it. I think it may make sense right now for us to double down. In a soft, authoritative manner, use some of our folks in uniform to go down there and educate folks directly in their business… and show up with a packet of masks and encourage them and give them a mask and say, ''Hey, thank you for helping our community stay healthy. Here you go. I noticed you don't have a mask on. Let me provide you with one.'' It's a good education. When you have somebody in a uniform, it's at the time you let them know that we're taking this very seriously. COUNCIL MEMBER GAMEZ: The problem is that also there are afraid of losing business because they have the signs on the doors saying masks are required, yet they don't enforce their own sign out there. We get to help them a little bit. I agree with you. In terms of how you approach them has to be positive, and I think that if we do that, they'll help us in the long run as the City. MAYOR RODRIGUEZ: Agreed. Chief, you get to work. FIRE CHIEF GOOD:

I want to go back to the transition plan I referenced earlier and one of the things that's been of critical importance to our City Manager is to issue a directive to all of us to ensure that we maintain the highest level of service possible to the public. We're talking about things that we're doing for employees. I don't want that to be lost in terms of what we're doing, because that's why we exist to serve others. He is directing all of us to do that, to make sure that we're still providing the highest level of service to the public, and we have different hours and different work plans. One of the true unsung heroes as part of that directive, and he's just never at the forefront, is Steve Holliday and his team. As part of this effort, we see a lot of us working from home and his department is set up virtually the entire City. It's been a monumental task. Again, he'd be the last guy to raise his hand and say, look at me. I would be remiss by not mentioning what a critical part his department has done in supporting our efforts. SPEAKER: Well said, Chief. MAYOR RODRIGUEZ: Yeah, well done, and I agree. You guys know I'm here at City Hall and the only other person in this entire building is Mr. Holliday. We're here together, and we're not together. Alright. Other questions? Council Member Davis, you've got the floor. COUNCIL MEMBER DAVIS: Just something that I wanted to point out, I think it's really important that we... I saw a couple of posts on Facebook, but I think we need to continue to put out fact based, scientifically backed information on the vaccine in particular. There's just so much misinformation everywhere. I think it's important that we just keep pushing that stuff out there, because, I mean, even in my own family and my close friends, some of the stuff that they come up with about this vaccine, I'm like, this is way off. So I think the more we can put good information out, the more it'll make people really willing and wanting to get the vaccination. I'm going to be getting my second dose on the 2nd. I'm excited for that. I'm going to try to film this time. I was telling some of them that the first one I was trying to film with my phone, and they gave me the shot before I even had the thing open. I'll try to film it this time so I can put it up just to encourage people to get vaccinated when they're able to. COUNCIL MEMBER DAVIS: Then the other thing that I just wanted to touch on was, you know, we're talking about masks and some of these businesses, sometimes the anti-masks people can be pretty aggressive. It puts business owners in an uncomfortable situation when they have to ask somebody to put a mask on. With my business, I have definitely faced that a couple of times. I've dealt with it accordingly. You have to have a mask to come into my building. That's the end of it. But for some of the other business owners, I can see how it would be a touchy area and something that they might not be wanting to risk because it could turn

ugly. MAYOR RODRIGUEZ: Thank you Council Member, Davis. I will add that I have a mask right here. You guys can't see it, but even when I go outside from one building to the next. This is definitely the time to double down on our commitment to the community. The term, the easy phrases to mask up anywhere you go, mask up. I understand some of our business owners, they may have cold feet. They don't want to turn people away or end up in a verbal confrontation. MAYOR RODRIGUEZ: Personally, I prefer a verbal confrontation than to having to go to a funeral. A lot of our local businesses, their staff members are an extension of the family. I mean that literally; they're family owned businesses so they can have their son or their brothers or sisters working there with them. The people that are most in jeopardy are the people that they actually work with. I agree with everybody. This is time to just double down and mask up. Chief, thank you for the information. I don't know if you have anything else to add, but that was pretty loaded. I want to thank you in advance for the presentations that are forthcoming at every council meeting and just keeping us up to date. Of course, if there's anything pressing or anything that is time sensitive, you can reach out to all of us and just update us as you go within the two week cycle if necessary. FIRE CHIEF GOOD: Okay, thank you, Mayor. I'll be happy to continue whatever efforts we have as part of our team. But as a reminder to you, I think I've been to all of your homes delivering masks. If you need more masks that you can distribute throughout the community, let me know. We do have more at the fire station. As I mentioned to you, I would much rather have them out there on the street. Whether resident or not is irrelevant. They don't do anybody any good sitting in a box at the fire station. I am asking you and appreciate the help that you provided getting them out there. MAYOR RODRIGUEZ: Council Member Laborin? COUNCIL MEMBER LABORIN: My question was, Mr. Good, the shots that are going to be given at your department, are they going to be for certain ages or is it going to be for everybody? FIRE CHIEF GOOD: Mayor and Council Member Laborin, at this point, that's undetermined. We don't have a specific plan yet because we haven't seen what they're going to be doing with Embry. Again, our preference is to work with them. And if they are unable to get those out, then we'll look at other alternatives. One of the things that's challenging for us is that they

have to be stored at 70 degrees below zero centigrade, the Pfizer vaccine. We're not equipped for that at this point. We are depending on Embry at this point. Then we'll see. It's just kind of depends how it goes. We'll keep you up to date as we have more information every two weeks. We've talked about it that if something major rises before the two week threshold, then we'll be sure to communicate that out ahead of time. COUNCIL MEMBER LABORIN: Thank you. MAYOR RODRIGUEZ: Councilman Gamez, I just saw your hand. COUNCIL MEMBER GAMEZ: Yes, Chief, when it gets to the point that your paramedics and you guys get to the point of maybe you guys administer the vaccines, I'm looking forward to you poking me, brother. Thank you. FIRE CHIEF GOOD: I can't wait. MAYOR RODRIGUEZ: On that note, I think we put an end to this. Alright. We're going to move on to number two. This is a drug prevention initiative. This drug prevention initiative is something that I've been wanting to see happen here in Tolleson for a number of years. I should start by saying that this is not a foreign thought, it's not a foreign program. Our City has had initiatives in the past that have been successful. Some of them were marketing. Some were program based. Through the years, it kind of died. I think it's time that we revisit the importance of having a drug prevention education initiative that we launched. I've been having some conversations with staff. I've been having some conversations with the community. It's been a big point of discussion. From my experience, it's only become a bigger issue. MAYOR RODRIGUEZ: There's a proliferation of just minimal drug activity to serious drug activity, depending on what street of Tolleson you're on, and now we have a lot of folks that are coming into our City that are adding to that, no fault of ours, and nonprofits that are located right across the street that we have to address. I think in the past it's been piecemeal, and I think what we need to do is we need to create an initiative that is holistic. What I mean by holistic is we need to call in those nonprofits that are working with us and those that we need to kind of get to work with us. MAYOR RODRIGUEZ: We need to tap all of our City staff members who are professionals in their own right,

whether it's public safety or human services or whether it's parks and recreation or fire or what have you, all the resources that we have available, our local school districts and of course, our residents. It needs to be something that is grandiose. Something that brings all the voices together and just has an honest conversation about what our state is here in Tolleson as it pertains to drug enforcement and education. In the last couple of years, one of our fellow Council Members has been very proactive when it comes to setting up speaker forums, when it comes to disseminating information about drug education and prevention. It's been something that she is very passionate about. I've been talking to her here and there, but today I really want... Well, I want to charge her with the duty of leading this initiative. So, Councilwoman Lupe Bandin, I want you to know that I've been impressed with the work that you've done in the past. MAYOR RODRIGUEZ: I think your passion for the subject matter and your ability to get people behind this cause has been significant, to say the least. It's been very empowering, and I think it's time to take it to the next level. With that being said, I know there's been many world national models, local model, state models, some of the models that we've had ourselves. I want you to work with everyone that we've talked about to come up with a model that benefits our community, and it is going to be very unique. It's going to be many voices that you have an opportunity to interchange with, have them part of the committee, the coalition, whatever it is you want to call it. My biggest fear is that I'm one of those people that want to get overly involved, and I can't give you the freedom to run with this initiative and get overly involved. So my parameters are very broad. MAYOR RODRIGUEZ: Education, intervention, and if necessary, we also have to look at enforcement. There's going to be some people that are going to learn when you teach them. There's going to be some people that are already involved in drugs, and we need to do whatever we can if we want to get off of them. There is going to be some people that will be on drugs and don't care. It's got to be multifaceted; so this challenge is a big one. Like I said, I have a lot of confidence in you and your ability to discharge this conversation and come up with some strategies for our community that not only fit what we're doing here in Tolleson, but that are going to have results. They're going to help us reduce the proliferation of drugs in our community. And so as part of my first act is to ask you a question, and that is, if you accept the challenge? If you're ready to accept this charge? COUNCIL MEMBER BANDIN: I am ready to accept the challenge here. Thank you for this opportunity. I'm just looking forward to all the good work I'm sure that we'll be able to put forth for the members of our community. MAYOR RODRIGUEZ: The last thing I want you to know is the reason that we've been having conversations with

staff is because we have a lot of very talented, hardworking, dedicated people that know our community in and out. They're going to be one of our strongest resources, along with our residents and other stakeholders in our community. The last thing I want you to know, because I think it's extremely important, is I want you to know that you can count on my support 100% as Juan Rodriguez and as the Mayor of our City… whatever it is that I can do to help you be successful. I'm going to be there for that. I would encourage everybody else to get behind this initiative because it's going to take all of us. We're one family, and we have an issue in our family. We have to address it head on. We all have to be on board when it comes to not only identifying the solutions, but the implementations and then building ourselves back up as a community. Council Member Bandin, you have the floor. COUNCIL MEMBER BANDIN: Well, we're going to educate, educate, educate. We're going to use scientific and medically sound information to help people make good decisions. I'm looking forward to working with everyone. We're going to bring in an outline here in the next few days so that everybody's aware of the direction we'd like to head in and get started. I just want to thank you again for your confidence. MAYOR RODRIGUEZ: Council and the rest of you, I just want you guys to know that the committee is going to come up with strategies for us to consider, and when they're ready to present them to us or give us updates as they develop, they're going to ask for our feedback. Ultimately, as a council, we will be able to come up with these initiatives that we ultimately adopt and apply resources to and begin to initiate in our community. Councilwoman Bandin will be coming to us periodically to update us on her findings and her work. Those that are interested in the committee that want to be there are more than welcome as well. CITY MANAGER MEDRANO JR: Thank you, Sir. Mr. Mayor, members of Council. The number three pertains to the cancellation of council meetings for these specific holidays; we do it year round. We started doing it a few years ago ahead of time, just so that everybody can plan appropriately, and then number four for the holiday closure… We did start doing this quite a few years ago, sporadically. We want to be more consistent, especially when the Christmas and New Year's holiday occur on a day that allow for us to do so. This year, 2021 Christmas and New Year's is on Saturday, and we will observe those holidays the previous Friday, so Christmas Eve and New Year's Eve, obviously on Fridays. Technically we'd only be asking to close for the four days in between Monday through Thursday. We did it last year. CITY MANAGER MEDRANO JR: Council Member Gamez, remember when you were mayor when I was assistant manager, and we started doing things like this… we realized that the cause really isn't that exorbitant. You might pay a little overtime here and there for those that do have to come to work. But this is a great way to reward our people, especially during these times, as you did this previous holiday season. This thing isn't over yet. I know we'll still be exhausted by the end of this calendar year. I think the exhaustion will originate in the euphoria, the stress we feel from getting through this horrible experience. MAYOR RODRIGUEZ: City management, just to clarify, number three is the notice of cancellation for the meeting for Tuesday, July 27 and August 10 for summer recess, Tuesday, November 23 for fall recess, and Tuesday, December 20 for the winter recess. I think you're referring to the holiday closure. That is item number four. CITY MANAGER MEDRANO JR: Yes, I mentioned number three briefly because those are pretty routine for us. We always close on those days for the recess which started of about 10 years ago. Then you get to November 23rd for the Thanksgiving holiday and the Christmas holiday, December 28th. Those are routine council meeting cancellations. I just covered three and four because they were under management report. Sorry. MAYOR RODRIGUEZ: No, appreciate clarification here. Just to stay with the agenda. We're going to take item three separate and then we're going to take item four after that just so that our votes line up with what's been organized. The budget amendment pertaining to this item was approved by Council on January 26th for computer hardware to replace the existing Police Dispatch computer system. The existing hardware suffered a major interruption on December 3, 2020. This interruption put undue pressure on officers, dispatchers and records staff. Through this Amendment, the computer system will be purchased from Sterling Computers Corporation.

AMENDMENT NUMBER FIVE TO COOPERATIVE PURCHASING AGREEMENT BETWEEN

THE CITY OF TOLLESON AND

STERLING COMPUTERS CORPORATION F/K/A

NEXTNET PARTNERS, LLC

THIS AMENDMENT NUMBER FIVE TO COOPERATIVE PURCHASING AGREEMENT (this “Amendment”) is made as of February 9, 2021, between the City of Tolleson, an Arizona municipal corporation (the “City”), and Sterling Computers Corporation, a California corporation, f/k/a NextNet Partners, LLC.

RECITALS

A. The City entered into a Cooperative Purchasing Agreement as of February 28,2017 with NextNet Partners, LLC (the “Agreement”), as amended by that First Amendment dated August 20, 2018, a Second Amendment dated June 11, 2019, a Third Amendment dated December 10, 2019, and a Fourth Amendment on June 26, 2020 (collectively, the “Amendments”).

B. Sterling Computers Corporation (the “Vendor”) has acquired NextNet Partners,LLC.

C. The City has found it necessary to purchase Additional Services and Materialsfrom Vendor.

D. The City and the Vendor desire to amend the Agreement and Amendments as applicable to reflect an increase in compensation for Additional Services and Materials.

AMENDMENTS

NOW, THEREFORE, in consideration of the foregoing recitals, which are incorporated herein by reference, the following mutual covenants and conditions, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City and the Vendor agree to amend the Agreement as follows:

1. Compensation. The City shall increase the compensation to Vendor by not more than $65,000.00 for the Additional Services and Materials at the rates set forth in the fee proposal attached hereto as Exhibit A and incorporated herein by reference, resulting in an increase of the aggregate not-to-exceed compensation from $545,997.00 to $610,997.00.

2. Effect of Amendment. In all other respects, the Agreement is affirmed and ratified and, except as expressly modified herein, all terms and conditions of the Agreement shall remain in full force and effect.

3. Non-Default. By executing this First Amendment, the Vendor affirmatively

asserts that (i) the City is not currently in default, nor has it been in default at any time prior to this First Amendment, under any of the terms or conditions of the Agreement and (ii) any and all claims, known and unknown, relating to the Agreement and existing on or before the date of this First Amendment are forever waived.

4. Israel. Contractor certifies that it is not currently engaged in, and agrees for the

duration of this Agreement that it will not engage in a “boycott,” as that term is defined in Ariz. Rev. Stat. § 35-393, of Israel.

5. Conflict of Interest. This First Amendment and the Agreement may be cancelled

by the City pursuant to ARIZ. REV. STAT. § 38-511.
