Regulation in Europe for Import

All Members of the EU have adopted a

common trade policy towards imports from

third countries.

In general, import licensing is not required for

products entering an EU country, except for

certain sensitive products like agricultural

goods, tobacco, weapons, etc., and products

governed by quantitative restrictions (i.e.

quotas) and surveillance.

License are issued within ten days of notification of the

EU decision indicating the quantities to be distributed.

They are valid throughout the EU.

These licenses are valid for four months.

Country have to send all applications to the EuropeanCommission and will only issue a license after theapplication has been approved by the EuropeanCommission.

The Integrated Tariff of the Community, referred to as

TARIC (Tarif Intgr de la Communaut), is designed to

show various rules applying to specific products being

imported into the customs territory of the EU

Value added tax(VAT):

Standard rate: 19.6%

Reduced rate: 5.5% (applicable in certain

specific cases). Rate applied for medicines: 2.1%.

Supplies of goods are subject to different VAT

rules than supplies of services.

Refunds of VAT credits may be claimed.

Certain products may be exempt, as a special

Business tax:

Business tax is payable on the rental value of thetangible fixed assets used for the purpose of thebusiness.

The rate varies from one region, dpartementandcommune(town), to another. It is set each year by thelocal authorities.

The annual business tax cost varies from approximately

2% to 5% of the value of the tangible fixed assets usedfor the purpose of the business (subject to the minimumcontributions).

There are many cases in which companies can benefitfrom an exemption or a reduction, e.g.: -Creation of anestablishment;-New companies;-Measures taken by thelocal authorities (planning and development act);-Capping on the basis of the added value of the taxpayer(3.5%, 3.8% or 4% depending on the turnover and asingle rate of 3.5% for tax assessed with respect to2007).-Special exemption for certain properties.
