FOREIGN NATIONALS ­ LEGAL ENTRY AND STAY AT THE TERRIRORY OF RP

Basic definitions:

Foreign nationals ‐ a foreign national is anyone who does not have Polish citizenship.

The entry and stay of foreign nationals, nationals of third countries is governed by the Law of 12 December 2013 on foreign nationals (Journal of Laws of 2013 item 1650 as amended).

CITIZENS OF THE EUROPEAN UNION AND MEMBERS OF THEIR FAMILIES ­ they benefit from the freedom of movement of persons (applies to citizens of EU member states, citizens of the Member States of the European Free Trade Association (EFTA) ­ parties to the agreement on the European Economic Area ­ Iceland, Liechtenstein, Norway, Switzerland

Entrance and stay of third­country nationals on the territory of Republic of Poland.

1. The entrance to Poland

a) Visas

A foreign national from a third country may enter Poland based on:

visa residence card under the agreement on visa­free traffic

Visas are issued as Schengen visas or national visas by Polish consul. In order to obtain a visa one should report to apply for the relevant Polish diplomatic or consular post.A Schengen visa (marked with C) ­ is issued, when the intended stay in the territory of the Member State of the Schengen area does not exceed 90 days in any 180­day period. The maximum validity period of such a visa is 5 yearsA National visa (i.e. long­term­ marked with D) ­ it entitles to entry, and continuous stay on the territory of the Republic of Poland for several consecutive stays lasting a total of more than 90 days, the period of validity of a national visa may not exceed 1 year.

Where to obtain a visa?Territorial jurisdiction of the consul:

Pursuant to the art. 6 of the Community Code on Visas the application for a visa is being examined by the consulate of the competent Member State in whose jurisdiction a person applying for a visa is legally residing.1 The Consulate of the competent Member State also examines the application filed by a third­country national, who legally stays but not resides in the area of jurisdiction of the consulate, if the person applying for a visa has justified the application filed at that consulate ­ it applies to foreign nationals legally residing in a Member State other than the State of their residence.)A national visa in order to perform a work is issued by the consul competent for the country of permanent residence of the foreign national, and in case of a foreign national staying legally on the territory of another Member State of the EU/EEA/Switzerland ­ by a consul, whose office is located in the country in question, as long as the foreign national has justified an application outside the country of permanent residenceAddresses of Polish diplomatic and consular posts abroad are available on the website of the Ministry of Foreign Affairs at the following link:

b) The entrance to Poland of a third­country national holding a valid "D" visa or residence permit issued by another Schengen StateA foreign national holding a valid national visa (marked with D) or a residence permit issued by one of the Schengen Member States is entitled to move on the territory of other Schengen Member States (including Poland) for a period not exceeding 90 days within any 180­day period under the following conditions:­ has a valid travel document,­ can justify the purpose and conditions of the intended stay and­ has sufficient funds or the ability to obtain them legally, and­ is not considered a threat to public order, internal security, public health or international relations of any of the Member States, and in particular he/she was not a subject on this basis of an entry in the national databases of the Member States, for the purpose of refusing free entrance.

In addition, the foreign national's data should not be included in the national list of alerts for refusal of entry of the Member State.

c) Visa­free traffic

* Nationals of these countries or the special administrative regions may enter Poland again in the framework

of visa­free traffic regime without the need to maintain 180 ­days limit, on the basis of bilateral agreements

regulating the visa­free traffic regime, concluded by Poland with these countries before Polish accession to the

EU.

2. The rules of stay as part of visa­free traffic regime

Total stay on the territory of all Schengen Member States (including Poland) without the need to obtain a visa cannot exceed 90 days within any 180 ­day period.

Schengen area states include:

Austria, Belgium, Denmark, Finland, France, Greece, Spain, Luxembourg, the Netherlands, Germany, Portugal, Sweden, Italy, Estonia, Latvia, Lithuania, Malta, Poland, Czech Republic, Slovakia, Slovenia, Hungary, as well as Switzerland, Liechtenstein, Norway and Iceland (the last 4 states are Schengen area countries not belonging to the EU).

Note: United Kingdom, Ireland, Cyprus, Croatia, Bulgaria and Romania are EU Member States which do not belong to the Schengen area countries.

During his/her stay without a need to obtain a visa, a foreign national should meet the following conditions:

he/she holds a valid travel document, he/she is able to justify the purpose and conditions of the intended stay and he/she has sufficient funds or the ability to obtain them legally, he/she is not a person registered as a person for the purpose of refusing entry in the SIS and he/she is not considered as a person posing a threat to public order, internal security, public health or

international relations of any of the Member States, and in particular he/she was not a subject on this basis of an entry in the national databases of the Member States, for the purpose of refusing free entrance.

2. Extension of stay in Poland

1. Visa extension

Schengen visa

Mandatory extension of Schengen visa:

• as a result of force majeure

or

• for humanitarian reasons

it is not possible for a foreign national to leave the Schengen area

Optional extension of the Schengen visa:

the visa holder shall present an evidence of serious personal reasons justifying the extension of stay in the Schengen area

National visa

If the following conditions are jointly met: it is justified by an important professional or personal interest of a foreign national or humanitarian

considerations, preventing him/her to leave Poland the aforementioned events occurred independently of the will of the foreign national and were

unforeseeable at the date of an application for a national visa; the purpose of stay of a foreign national will not be other than the one declared lack of statutory grounds for refusalRequired documents

application valid photograph documents certifying: purpose of stay and necessity to extend a Schengen visa or a national visa other circumstances stated in the application public health insurance (NFZ) or travel medical insurance 30 000 Euro ­ national visa travel medical insurance ­ 30000 Euro ­ Schengen visa financial funds ­ national visa travel document ­ for inspection residence certificate stamp duty

National visa can be extended once, and the period of stay based on the extended national visa may not exceed the period of stay provided for the national visa.

Exception ­ stay in hospital Duration of stay based on the extended Schengen visa may not exceed the period of stay provided for this visa.

Re­enactment of national visa If the passport of a foreign national staying in Poland on the basis of a national visa has been replaced,

the province governor puts a new national visa sticker

2. Extension of stay in visa­free traffic regimeA foreign national who stays on Polish territory under an international visa exemption agreement or to which applies the partial or total visa exemption, may be granted in justified cases, the extension of period of stay on the Polish territory for a further 90 days if such a possibility is provided for in the visa exemption agreement. (Currently provided for by the Agreements with Brazil, Argentina, Chile, Honduras, Costa Rica, Nicaragua, Singapore and Uruguay).Method of filing an application:The foreign national submits an application (petition) for an extension of period of stay within the visa­free traffic regime in the Republic of Poland in person to the province governor competent for the place of stay of the foreign national, not later than the last day of his/her legal stay on the territory under the visa­free traffic regime, and justifies this application. Fee: free of chargeDeadline to settle the matter: at once, up to one month.Note: The extension of period of stay within the visa­free traffic regime within the territory of Poland is done by placing a stamp confirming the extension of period of stay by 90 days in foreign travel document. The refusal to extend by way of a decision.Necessary documents:A) an application drawn up in Polish (petition) containing data which identifies the foreign national (full

name, date of birth, citizenship), address of residence, and justification (there is no formal application form).

Note: If any of the aforementioned elements is missing in the application, the foreign national will be called to complete it within 7 days of service of summons under pain of leaving the application without examining.Typical documents proving the circumstances indicated in the application:A) Documents proving legal stay on Polish territory,B) Photocopy of the travel document (original for inspection).Note: If it is required to explain or clarify details of any proofs held by the authority during the proceedings, the foreign national may be called upon to provide other documents or to give evidence of the circumstances referred to in the application.3. Permission for temporary residence A foreign national wishing to stay in Poland for more than 3 months may submit, not later than the last day of his/her legal stay on the territory of Poland an application for temporary residence to the province governor competent for the place of stay of the foreign national. 4) Temporary Polish travel document for a foreign nationalA temporary Polish travel document for a foreign national can be issued to a foreign national who does not hold a travel document and it is not possible for him/her to obtain a new travel document, if a foreign national intends to leave the territory of Poland or was obliged to leave this territory. It is issued by the province governor Period of validity ­max 7 days Fee ­ PLN 50

A foreign national is granted the refugee status, if due to well­founded fear of persecution in his/her country of origin because of:

• race• religion• nationality• political beliefs • affiliation to a particular social group

Submitting an application for the refugee status is possible: while entering the territory of the Republic of Poland during the border control (the officer of the

Border Guard must be informed of the desire to apply for a refugee status) while staying on the territory of the Republic of Poland (one must report to the Nadwiślański Oddział

Straży Granicznej (Vistula Branch of Border Guards) in Warsaw at ul. Taborowa 33), through the commanding officer of the branch of the Border Guard, whose geographic scope of operations

covers the headquarter of guarded centre, deportation centre, custody suite or correction unit ­ when the person who wishes to apply for the refugee status is staying in the aforementioned places of detention.

4. Recognition as a Polish citizenThe recognition as a Polish citizen takes place under an administrative decision given by the province governor based on the foreign national's application. The condition for recognition as a Polish citizen, is, in particular, documented knowledge of Polish language and the fulfillment of other conditions laid down in the provisions of law, that are dependent on the individual legal circumstances of the foreign national.

5. Re­enactment of Polish citizenship A foreign national who lost citizenship before January 1, 1999 may apply for re­enactment of Polish citizenship. An application for re­enactment of Polish citizenship must be submitted to the Ministry of Internal Affairs and Administration, with the reservation that the persons residing outside the territory of the Republic of Poland apply for re­enactment of Polish citizenship through a consul competent for the place of residence.

ISSUING OF PASSPORTS AND TEMPORARY PASSPORTS

IN POLAND

Each Polish citizen has the right to obtain a passport .

1. Application for and collection of the passport document.

An application for a passport document is submitted in person at any chosen province governor in Poland, and the passport is collected only where it was applied for.

The passport application for a child is submitted by the parents or legal guardians. The child that is 5 years and older must also be present.

A passport for the child is collected by one parent or legal guardian, and the child does not have to be present.

2. The documents required for passport application: The completed application form signed by the applicant, and in case of a child by a parent or legal

guardian (application form can be collected at all Passport Offices and at the headquarters of Malopolska Provincial Office in Krakow, at ul. Basztowa 22)

FOREIGN NATIONALS REPORTING OBLIGATION OBOWIAZEK MELDUNKOWY

Every Polish citizen or a foreign national staying in Poland is obliged: to register at the place of permanent residence, to register at the place of temporary residence, to de­register from the place of permanent residence, to de­register from the place of temporary residence, to inform about going abroad, to inform about returning from abroad.

Every foreign national who stays in Poland for more than 14 days is obliged to register The registration must be reported in the commune office competent for the place of residence of the foreign national: in person by proxy

o a citizen of the Swiss Confederation or a family member of such a foreign national,

not later than at the 4th day from the date of arrival at the place of residence in Poland – registers a foreign national not included in the aforementioned group, who will stay in Poland for more than 14 days ­ a foreign national from a third country which is not a family member of an EU citizen.

A foreign national can register only for the duration of his/her legal stay in Poland. DE­REGISTRATION

De­registration must be reported in the Borough Office competent for the place of residence, at the latest on the day on which the foreign national moves out from the place of previous registration: in person by proxy electronically by signing an application by means of a secure electronic signature through registering at a new location ­ then the clerk will register a person in a new place and

automatically de­register from the previous place of residence
