    DIVISION 9 - FINISHES

    A. All portions of the work, including plumbing, mechanical, and electricalwork shall be performed in full compliance with all applicable city, county, stateand national codes. The General Contractor shall be responsible for obtainingthe necessary certificates required from the local building inpsector. TheGeneral Contractor shall be responsible for the safety of all people on or nearthe construction site during the construction period. Implementation of allnecessary and prudent safety pre- cautions shall be the full responsibility of theGeneral Contractor. Methods of construction and erection of materials andassemblies shall be the contractor's responsibility.

    A. These specifications and the accompanying drawings are intended todescribe and provide for a finished piece of work. They are intended to becooperative, and what is called for by either shall be as binding as if called forby both. The Contractor shall understand that the work herein described shallbe complete in every detail, not withstanding every item necessarily involved isnot specifically mentioned, and the Contractor will be held to provide all laborand materials necessary for the entire completion of the work intended to bedesired, and shall not avail himself of any manifestly unintentional error oremission should such exist. Should any error or inconsistency appear in thedrawings or specifications, the Contractor, before proceeding with the work,shall make mention of the same to the Owner's Project Manager in writing forproper adjustment, and in no case shall he proceed with the work inuncertainty.B. Titles to chapters and paragraphs in these Specifications are indicatedmerely for convenience and shall not be construed as a correct or completesegregation of the several units of materials and labor. No responsibility, eitherdirect of implied, is assumed by the Owner for omissions or duplications by theContractor or his Subcontractors, due to real or alleged error in arrangement ofmatter in these Specifications.C. It shall be the duty of the Contractor to verify all dimensions given on thedrawings and to report any errors or inconsistencies to the Owner's ProjectManager before commencing the work. In submitting a proposal, it will beconstrued by the Owner that the bidder has examined and familiarized himselfwith the site and has carefully checked all the details and assured himself thatthey conform in every respect with both local and state requirements.Ignorance or failure on the part of the Contractor or Subcontractor to examineor familiarize themselves with the site will not be accepted as an excuse forclaims to extra or additional payment above contract price.D. The Owner's Project Manager shall within a reasonable time make decisionson all points brought up by the Contractor, on matters relating to theinterpretation of the plans, the specifications and the execution, and theprogress of the work.E. Should any dispute arise as to the quality or fitness of materials orworkmanship or interpretation of the plans and specifications, the decisionshall rest with the Owner's Project Manager and shall be based on therequirements that all work done and all materials furnished shall be in strictaccordance with the plans and specifications and what is usual, customary, andstandard practice in erecting buildings of similar type.F. Where necessary for field work, or proper interpretation of the general plansand specifications, the Contractor shall submit with such promptness as tocause no delay in his or any other Contractor's work, three copies of amplifieddetails and schedules for the approval of the Owner's Project Manager and shallfurnish the Project Manager three copies of the final details, one to be returnedto the Contractor approved and two to remain in the Project Manager's files.G. Figured dimensions and detailed drawings shall be followed in preference toscaled measurements. In case of any doubt on the part of the Contractor as tothe exact meaning of the drawings and these specifications, he shall apply tothe Owner's Project Manager for an interpretation before proceeding with hiswork.H. Should discrepancies appear among the contract documents, the Contractorshall request an interpretation from the Owner's Project Manager beforeproceeding with the work. If the contractor fails to make such request, noexcuse will thereafter be entertained for failure to carry out work in therequired manner or provide required guarantees, warranties, or bonds. Shouldconflict occur in or between drawings and specifications, Contractor is deemedto have estimated on better quality and larger quantity of work, unless he shallhave requested and obtained written decision from the Owner's ProjectManager before submission of bid as to which method or materials will berequired.I. The Contractor shall carefully study and compare all drawings, specifications,other instructions. Where dimensions are governed by existing conditions orby conditions already established, Contractor shall take actual measurementshimself and shall report in writing to the Owner's Project Manager, forexplanation or adjustment, any errors, disagreements or inconsistencies in thedrawings and specifications or figured dimensions of the drawings which mayexist or appear to exist, before proceeding to execute that part of the workaffected. Thereby, this field verification shall be done within ten days of thereceipt of the drawings, specifications and instructions. Failure to do so shallconstitute a waiver of all right to or claim for extra work on such account.J. No deviation from specifications, drawings or instructions shall be madewithout written authorization by the Owner's Project Manager.

    A. Unless otherwise stipulated, the Contractor shall provide and pay for allmaterials, labor, water, tools, equipment, light and power, transportation andother facilities necessary for the execution of the work.B. Unless otherwise specified, all materials shall be new and both workmanshipand materials shall be the best of these respective kinds. The Contractor shall,if required, furnish satisfactory evidence as to the kind and quality of materials.C. Only skilled, thoroughly trained and experienced foremen and workmenshall be employed on the work, and when required by the Owner, theContractor shall discharge and shall not re-employ on the work, any personwho commits trespass, or who is in the opinion of the Owner, disorderly,dangerous, insubordinate, incompetent, or otherwise objectionable, nor shallhe employ any person who has been discharged by another Contractor uponthe order of the Owner's Project Manager.D. Unless otherwise stipulated, no allowance or compensation whatsoevershall be due or paid to the Contractor for any temporary roads, excavations,embankments, or other work or structures that he may make to facilitate hiswork, nor for any construction plant, tools or equipment which may be requiredin the performance of the work.E. All work and materials delivered on the premises shall be intended to formpart of the work and shall not be removed without consent of the Owner. TheContractor shall have the right to remove all surplus materials after thecompletion of all work included in his Contract.F. It shall be the duty of the General Contractor to see that all Subcontractorsare fully informed in regard to the general conditions and preliminaryspecifications.

    A. The exact property lines, corner monuments and grades set by the Owner'ssurveyor will be furnished to the Contractor, and all precautions shall be takenby the Contractor to preserve same. If any are displaced, lost or disturbedthrough the act or neglect of the Contractor or his agents or employees, heshall pay for cost of restoration.B. The relation of the building to the lot lines and established city grades shallbe as shown on the drawings. The Contractor shall accurately lay out his workon the ground according to the drawings furnished, and will be held responsiblefor the correct location of all work on the premises.

    A. The Contractor shall be responsible for all violations of city ordinances andstate laws involved in the performance of his work; for obstruction of Streets,side-walks, alleys and pavements and shall in all cases make good any damageto any streets, sidewalks, alleys and pavements.B. Contractor shall use every precaution to brace and otherwise support andsecure the structural frame, walls, floors and roof during the construction ofthe work; and shall provide during the progress of his work every and allsafeguards and protection against accidents, injury and damage to persons andproperty including adjoining property.C. The Contractor shall be responsible for his work and every part thereof, andfor all materials, tools, appliances and property of every description used inconnection therewith.

    A. The Contractor shall give personal supervision to the work, using his bestskill and attention, and shall keep a competent Foreman and necessaryassistants constantly on the jobsite. The Foreman shall be the personalrepresentative of the Contractor and all directions given by him shall be asbinding as if given by the Contractor. Communication delivered to the Foremanby Owner's Project Manager shall be as binding as if delivered to theContractor.B. The contractor shall layout all work and shall be responsible for allmeasurements and dimensions.

    A. TRAILER: Contractor shall at his own expense provide such temporarytrailers, offices, and sheds for storing of cement, tools, etc., with necessarytelephones, heat, etc., all of which are to be removed by him at the completionof the job.B. TEMPORARY TOILET FACILITIES: As conditions require, and in accordancewith state and local regulation, the Contractor at his own expense shall installtemporary toilet facilities for the use of his employees. These toilet facilitiesmust be placed at suitable points, enclosed against weather, maintained inproper condition, disinfected, and at completion of the job cleaned out andremoved from the premises.C. TEMPORARY ELECTRICAL SERVICES: General Contractor, without cost toBurger King or Subcontractors, shall provide and maintain all temporaryelectrical services for any or all Contractors, for use of apparatus, lights, or toolsto facilitate the completion of the building. (See SECTION 16000, BasicElectrical Requirements.)D. TEMPORARY HEAT: In the event that temporary heat during freezingweather is necessary, this Contractor shall provide for and include same in hisbid, or make necessary arrangements with the several Subcontractors requiringtemporary heat to provide for and include same in their bids. He shall makesure that proper fuels and apparatus are furnished and installed with flue pipesto the outside of the building, and that the fuels are properly housed.Installation shall be such as to in no way damage any of the finished work orwork in progress. In event of any damage resulting from improper heatingarrangements, same shall be corrected at the expense of Contractor. If storeHVAC system is used, filters must be changed.

    A. Each Contractor shall leave all chases, holes or openings in walls andpartitions straight, true and of proper size, in his own work or cut same inexisting work as may be necessary for the proper installation of his own oranother Contractor's work. Each Contractor shall coordinate with the GeneralContractor regarding proper location and size of same. In case of his failure toleave or cut same in the proper place, he shall cut them afterwards at his ownexpense. No excessive cutting will be permitted, nor shall any structuralmembers be cut.B. After all work has been installed in chases, holes or openings, eachContractor shall carefully fit around, close up, repair, patch and point up sameas directed, to the complete satisfaction of the Owner's Project Manager. Allwork shall be done with proper tools and by the skilled workmen who arethoroughly trained and experienced in the particular trade to which such workbelongs, and shall be done without extra charge to the Owner.

    A. The Contractor shall at times keep the premises free from accumulations ofwaste and flammable material or rubbish caused by his employees or othersduring the progress of the work. At the completion of the work and before finalacceptance, the Contractor shall, at his own expense, clear away and removefrom the premises and from public and private roads all plant debris, rubbish,tools, scaffolding, surplus materials, and excess excavated materials due to hisoperations, and shall leave the premises and the work in perfect order andrepair, and the building broom clean and ready to use.

    A. Throughout these specifications a manufacturer, model number, color,finish, etc. has been used. These are to be used as a guide to quality and designstandards and equal products may be substituted but ONLY aftersubstitutions are submitted to the owner and the owner approves substitutionsin writing. Do not order any materials/products until written approval is given.All unapproved materials/products used will be removed and replaced atcontractors own expense.
