    fees when public entities are involved wasvetoed by Governor Edmund G. Brown Jr.yesterday.

    In vetoing AB 559 (Swanson; D-Alameda), the Governor agreed withCalChamber, saying In this case, I think theSupreme Court got it right. Judges are in thebest position to decide whether to award ordeny fees in these instances.

    AB 559 would have unreasonablyincreased business litigation costs by limiting

    judicial discretion to reduce or deny exorbitantattorneys fees in fair employment and housingclaims that should have been raised in alimited civil proceeding.

    The bill attempted to overrule Chavezv. City of Los Angeles, 47 Cal.4th 970, andwould have made it easier for plaintiffslawyers to receive attorneys fees inemployment cases. Even after the Chavezdecision, however, trial court judges do nothave unlimited discretion to deny attorneysfees in Fair Employment and Housing Act(FEHA) cases. Rather, a judge can denythese awards only if the trial court is rmlypersuaded that the plaintiffs attorney hadno reasonable basis to anticipate a FEHAdamages award in excess of the amount

    recoverable in a limited liability case, andalso that the action could have been fairlyand effectively litigated as a limited civilcase... (emphasis added).

    The California Supreme Courthas left ample protections in place forthe victims of workplace civil rightsviolations and for plaintiffs attorneyswho often take these cases on under acontingency fee arrangement to ensure

    low-income workers have access tojustice.

    There is no evidence, aside fromspeculation by the appellate court,that the denial of the attorneys fees inthe Chavez case has discouraged anyattorney from representing a plaintiffin a FEHA case on a contingency feebasis, yet AB 559 proposed to eliminateall incentive for plaintiffs to bring thesecases expeditiously through a limited civilproceeding when appropriate.

    As a threshold issue, the CalChamberopposes legislative attempts to carve outan entire category of claims from anystatute, particularly when there is noshowing that such a bold step is necessaryto protect the rights of individuals. The

    carve-outs create uncertainty for partieswho rely on the laws being applied equallyand fairly to all cases. In particular, thisapproach creates a real problem foremployers struggling to make the best ofthe states already-poor legal climate bymanaging risks and potential litigation costup front, before any dispute arises.

    AB 559 would have exposedemployers to unanticipated costs after thefact merely because a plaintiff happens toallege a FEHA claim.

    The facts surrounding the denial ofattorneys fees in the Chavez case show thathe trial court properly used its discretionto deny an exorbitant fee request, savingthe taxpayers of Los Angeles more than$870,000, while showing adequatedeference to the important policy reasonsfor awarding attorneys fees in FEHAcases. Under the circumstances, there isno justication for undermining judicialdiscretion in an entire class of cases.

    As most of you know by now, we saidgoodbye to Lisa Batto after eight years ofdedicated service to the NapaChamber of Commerce. Since beingappointed to the CEO position twoyears ago, Lisa has grown as aprofessional and as a person. Lisaworked hard to ll this role and herefforts were noticeable. It is trulyunfortunate that those of us thatoriginally supported Lisa in taking the job alsohad to be the ones to make this most recentdecision to terminate her employment as theCEO. However difcult a decision it was, it is inthe best interest of the Chamber that we now seekand hire an established Chief Executive Ofcer tolead the Napa Chamber into the future.

    We have all noticed the dramatic shiftsin our local economy lately. These shifts arehaving a signicant impact on the Chambersbusiness model. In addition to addressing theseimmediate issues, changes are also necessary to

    Two institutions in Napa are central tofostering local arts from a musical perspective.The Napa School of Music, founded in 2005,

    offers students of every age a broad rangeof study across many different instrumentsand styles. The Jarvis Conservatory, whichopened in 1995, offers performance space inan extraordinary gem of a theater via their FirstSaturday Sing Along program.

    Peter Sykes is the founding director of theNapa School of Music. He has been playingmusic professionally and teaching music forover 30 years. He has composed for lm andtelevision and has worked in both Australia andLos Angeles. Upon moving to Napa Mr. Sykesfound there was a need for a place wherestudents could come and learn many differentinstruments in many different styles in a safe,family-friendly environment. The School holdsto a promise of building self-esteem throughmusic and when asked to elaborate Mr. Sykeshad this to say, When someone struggles,works hard and is nally able to do somethingas complicated as play music, thats an instantbuilder of self-esteem. Thats what we try toempower kids to do. You gain self-esteem fromachieving difcult goals.

    To date the school serves 400 studentsaged four to adult offering a broad base ofclasses on twenty different instruments. Mr.

    Sykes continues; We teach all styles of music,classical, pop, rock, jazz, world music andmore. We offer a rock band program, GarageBand 101, String Ensemble for violin, viola,cello, ute, guitar and piano, PerformanceClasses with Terry Bradford - Celine Dionsduet partner and 1990 male Champion singeron Star search - and an Introductory MusicClass featuring Rhythm, Melody & Harmonyfor grades K-2.

    The school works symbiotically in thelocal community partnering with the NapaValley Opera House and Blue Oak, Justin-Siena and Salvador Schools. We hold our

    Garage Band 101 Concerts at Napa ValleyOpera House and sponsor NVOH withthe Idol NV competition, we are currentlysponsoring Silos A Cappella competition,two of our teachers provide band and choirinstruction at Justin-Siena High School, wehave implemented a rock band program atBlue Oak School and are looking at providingan introductory music class called Rhythm,Melody & Harmony for K-5 to SalvadorSchool.

    Chamber Member Spotlight:

    The Jarvis Conservatory building wasrescued from oblivion by owners, Williamand Leticia Jarvis in 1994. Once a winery

    in the 1860s, the distinctive stone buildingwas meticulously renovated and transformedinto a state of the art performance theater bythe Jarviss in order to feature their love ofZarzuela a Spanish light opera music anddance form. A professional acoustician wasused to ensure that no microphones would beneeded in the 220 seat theater. While Zarzuelaproductions are no longer scheduled, there aremany current programs on the roster. The verypopular Saturday Opera Night brings singersfrom around the San Francisco Bay Area onthe rst Saturday of each month, offering

    them exposure to a live audience and theambience of a professional theater. Singers areprofessionally accompanied on the piano whilethe members of the audience get exposure to

    a fun evening with many forms of singing.Known as Its a Grand Night For Singers,these events are regularly hosted, narrated,and accompanied by internationally-knowncomposer, coach, and pianist Richard B.Evans, who divides his time between the WestCoast and New York City.

    Each program features professionalvocalists as well as promising new talentwho perform excerpts from opera, musicaltheatre, cabaret, and zarzuela as well asdelightful surprises from lesser knownrepertoires. Join the monthly selected singers

    on the rst Saturday of every month whenthe doors open at 6:30. Every singer or vocalensemble accepted to perform receives a smallhonorarium. In addition, singers currentlyenrolled in a Music Program at a college,

    junior college, or university are offered theopportunity to compete for the monthly cashEncouragement Prize offered by the JarvisConservatory. One singer at each eventmight also have the opportunity to participatein a short on-stage Master Class coachingsession with Maestro Evans, who was namedCalifornias Statewide Outstanding Professor

    before he left the California State UniversitySystem to pursue his current career composingBroadway musicals.

    Professional, amateur, and student singersinterested in applying to participate shouldemail an application to Theater Manager, VladPonomarov. Each program can accommodateonly ten singers, and because the roster foreach monthly program lls up quickly, singersare encouraged to apply as far in advance aspossible.

    Performances that are staged at the JarvisConservatory are professionally videotapedutilizing the latest HD digital recordingtechniques and the videos are made available topublic broadcast stations, educational institution

    and libraries. Numerous productions have beenup linked via satellite to PBS stations throughouthe United States, Canada and Puerto Rico andhave reached upwards of a million viewers.

    Mr. Ponomarov joined Jarvis four yearsago and hails from Russia. A graduate of PaciUnion College he brings his expertise in digitalmedia to the table and has been instrumental inexpanding the theaters art-lm program.

    Four years ago the Conservatory branchedout into presenting art lms and moviesotherwise unavailable to Napans on non-singinSaturday nights. The state of the art digitalscreening facility at Jarvis has made for a perfecpartnership with the inaugural Napa Valley FilmFestival. Jarvis will be the main venue for Napapresentations during the November 9 13 evenYou can frequently nd a treasure of a lmshowing at Jarvis that you would otherwise havto drive 35 miles to Berkeley or Marin to view.
