The development will include an OK Mini Market, ATM facilities and a group of smaller shops. Con- struction started three weeks ago and the projected completion date is April next year. People’s Post was alerted to the development by residents who were concerned that the site was not fenced off and trucks using the smaller roads to offload building materials. They are also worried about the possibility of a “bottle store” opening at the mini mall. People’s Post visited the site on Thursday to investigate and it ap- peared that the site was cordoned off and staff were busy erecting big- ger warning signs about dangers on site. Ward councillor for the area, Ir- ma Jackson, explained to People’s Post that she was also contacted by residents about various safety as- pects on the construction site. Jackson says: “I alerted the City of Cape Town’s building inspectors to assess the site to ensure that con- tractors were meeting building reg- ulations.There were a few concerns that we conveyed to the contractor. I did follow-up site inspections and found that the contractor has com- plied with the requests.” She adds that residents were also concerned about job creation issues and that many people were unem- ployed in the area. “The development is a positive thing for the community of Strand- fontein. The majority of the resi- dents welcome the development. Only a fraction are upset. They are under the impression that a bottle store will be opening. However this is not confirmed as a fact.” She is negotiating with the con- tractor to employ local labour on site and is encouraging businesses from the area to lease space at the mini mall. “I am aware that some locals have been employed at the site. However, I will inform the contractor about the City’s database so that more people can be employed.” The contractor, Structural Sur- vey Boland’s site manager, Hendri Barnard, tells People’s Post, that they are willing to engage with the community about any concerns they may have. “Concerns about a bottle store are unfounded. Know the house rulesA SALE agreement comesinto effect when a prospec-tive buyer makes a writtenoffer to a seller and theseller accepts that offer topurchase his/her propertyon the terms and condi-tions agreed upon.

The next step is to give ef-fect to this sale by formallytransferring the propertyfrom the Seller to the Buyeras registered and recorded inour Deeds Office.

The Seller either directlyor through an estate agent orauctioneer, then instructs aconveyancing attorney totransfer the property interms of the sale agreement.

The average time to com-plete the process from sale totransfer is about 12-14 weeks,though complicating issues,arising from a deceased es-tate or divorce, could in-crease this period considera-bly.

Once instruction has beenreceived, the transferring at-torney opens a file and en-sures that suspensive condi-tions have been compliedwith. Example of a suspen-sive condition is the pay-ment of a deposit.

The transferring attorneywill draft the transfer docu-ments in preparation for sig-

nature by the Seller and Buy-er. Five basic documents arerequired for the transfer ofan immovable property,namely the Power of Attor-ney; the existing Title Deedin terms of which the Selleris the current registeredowner; the Deed of Transferin terms of which the Buyerwill become the new regis-tered owner; the TransferDuty Receipt and RatesClearance Certificate.

Transfer Duty is a tax pay-able by the Buyer on the pur-chase and transfer of immov-able property. This cost is inaddition to the transferringattorney’s fees. However, thetransaction may be exemptfor transfer duty tax if thepurchase price is R600 000 orless (as per current legisla-tion). Transfer duty tax iscalculated as follows:

R0-R600 000=no transferduty payable

R600 000.01 toR1 000 000=3% of the valuebetween these amounts

R1 000 000,01 toR1 500 000=5% + R12 000

Above R1 500 000=8% +R37 000

A Rates Clearance Certifi-cate is issued by the City ofCape Town to the transfer-ring attorney upon settle-ment of the Seller’s rates,

which includes advance col-lections on the rates accountfor a period of 120 days.

This cost is payable by theSeller. Once the documentsare in order the transferringattorney will contact thebond attorneys and the bondcancellation attorney and ar-range a date to lodge their re-spective deeds simultane-ously at the Deeds Office.

The documents are exam-ined and usually becomeavailable for registrationwithin 10-12 working daysfrom date of lodgement.

The transfer, bond andbond cancellation are thensimultaneously registeredresulting in the transfer be-ing effected between the Sell-er and Buyer.

This is a basic overview ofthe transfer process and cir-cumstances may vary ac-cording to the particularitiesof each transaction.

TheBuyerwill be liable forthe bond attorney’s registra-tion costs in addition to thetransfer costs. The Sellerwill be liable for the settle-ment amount of the bond aswell as the bond cancellationattorney’s costs. Prospectivebuyers should request a quo-tation in advance so thatthey are able to budget forthe transactions.

THE Mitchell’s Plain BackyardDwellers and Residents’ Associa-

tion (MPBYRA) has once again cometo the aid of the poor and homeless bypartnering with an investment com-pany which aims to assist backyarddwellers in getting a house.

The MPBYRA has been in the spotlightfollowing the illegal occupation of vacantland in Swartklip Sports field and Ka-pteinsklip station in May (“Weekend ofviolence,” People’s Post, 17 May).

What was planned as a “peaceful” landoccupation to highlight the desperateneed for housing in Mitchell’s Plain, ledto violent clashes between Metro Policeofficers and the backyard dwellers of thearea – resulting in several injuries.

The arrests came after thousands ofpeople fromMitchell’s Plainandother ar-eas invaded vacant land at SwartklipSports field and Kapteinsklip Station inTafelsig.

The people who participated in thismass action were mostly registered mem-bers of the organisation.

The MPBYRA has been mobilisingbackyard dwellers and those on the coun-cil’s housing waiting list to take action asthey feel “the people of Mitchell’s Plainhave been failed by politicians and thegovernment.”

People’s Post has followed the back-yarders plight and the remaining fami-lies were relocated by the City of CapeTown recently to Blikkiesdorp in Delft.

Chairperson of the MBYRA, CharlesAdams, says he and other executivemembers have been inundated with callsand visits from families asking the organ-isation for assistance.

“Those coming to the organisation has

lost everything during the land invasionand removals. Many of these families areunemployed and are struggling.

“I was approached by Ebrahim Abra-hams, an investor who wants to assistthese residents. We have formed a part-nership and so far have managed to givethree families a wendy house,” says Ad-ams.

Ebrahim Abrahams, owner of Sum-mear Investments, says they have starteda housing scheme and are looking to pur-chase land in all areas, and start buildinghomes for these backyard dwellers.

“We are looking to buy land from pro-vincial and national government so thatwe can build houses for the people. Theresidents will then have to pay for theirhouse directly to the business and theywill be the owners of the property,” Abra-hams says.

The duo will be going to various partsof Mitchell’s Plain to inform the commu-nity of the project.

The organisation has assisted anumber of families with accommodationby providing them with a wendy housewhich is erected in the backyards of theirfamily members.

Abubaker Karriem, who is unem-ployed and has a family with three chil-dren,wasprovidedwithaccommodation.

Karriem says: “My family was trauma-tised by the land invasion events. I wasdevastated because we lost everythingand, being unemployed, I could not afforda place for my family.

“I approached theorganisation forhelpand they assisted me by donating awendy house to me and my family. I amvery grateful for what they have done sofar.” Anyone needing assistance can vis-it the organisation’s office at 7 MarciaStreet, Tafelsig or call Adams on074 689 5980.

Man killed in RocklandsMELISSA PAPIER

THE Mitchell’s Plain Police are “in-vestigating all possbile leads” in thefatal shooting of a 19-year-old man inRocklands.

No arrest has been made and the sus-pects are still at large.

Captain Mugelaine Van Der Vendt,spokesperson for Mitchell’s Plain Policestation, says on Saturday at 19:00, the po-lice responded to a shooting incident inHammerkop Street.

“On arrival in Hammerkop Street, of-ficers discovered the body of a 19-year-oldman lying in the street.

“The motivefor the shootingis unknown,”says Van DerVent.

Weekend operations:The weekend crime prevention opera-

tions by the police netted 72 suspects.During these operations the following

were confiscated: 66 packets of tik, 32 dag-ga stoppe, 30 daggaplants, 15heroinunits,12 mandrax tablets, four crushed man-drax tablets, one dagga parcel and a smallamount of loose dagga.

Constable Jerome Voegt, spokespersonfor the station, says on Friday afternoonofficers received a tip- off about drug deal-ing at a house in Jonkershoek Street,Tafelsig.

At the house officers found 21 packetsof tik, 12 heroin units and 7 half mandraxtablets.

On Sunday officers raided a house inSpring Street, Tafelsig. “During the raid

officers found hidden in the house a .38Rossi revolver with five live rounds. A 22-year-old man was arrested,” Voegt says.

Later the same day a 21-year-old manwas arrested in Suikerbos, Lentegeur, af-ter police found an illegal firearm in hispossession.

Drug arrestsTwo-day crime operations by the

Mitchell’s Plain Police station resulted in15 arrests.

Mitchell’s Plain police made severalsearches on Monday and Tuesday and thearrests were for possession of drugs.

The drugs confiscated were 47 packetsof tik, 22 dagga stoppe, three heroin units,

12 half mandrax tab-lets and seven wholemandrax tablets.

Voegt says on Mon-day at 17:30, the offic-ers were busy withroutine vehicle pa-

trol duties in Gene Gardens Street, Wood-lands when they spotted a suspiciouslooking man in the street.

“The suspects were searched and offic-ers confiscated 36 packets of tik, a daggastop and two half-mandrax tablets. A 21-year-old man was arrested,” says Voegt.

In Steyn Street, Eastridge, after a tip-off, officers found19dagga cigarettes, sev-en whole mandrax tablets and 10 half-mandrax tablets.

A 31-year-old man was arrested. Allsuspects appeared in the Mitchell’s PlainMagistrates Court.

Bridging the gapthrough sportsMELISSA PAPIER

A LOCAL organisation has partneredwith an international skills organisa-

tion and the British government to initiatea sporting programme at schools in CapeTown.

Making an Impact Though Sports (MITS) isan NGO with the aim to revitalize sport partic-ipation in the community and schools and “toprovide youth with viable alternatives to idle-ness, crime and drugs.”

Founder and programme director of the or-ganisation, Keith Meyer, tells People’s Postthat the organisation was formalised in 2009.

“Our volunteers, peers and specialisedcoaches teach both sport and life skills. Teach-ing sporting skills is the easy part, but affect-ing young people’s behaviour is very difficult.Our programme uses the influence of our vol-unteers and local coaches.

“They are closer in age to their charges andcan be role models. This relationship is key forteaching life skills. Teachers and parents arein too much of a position of authority, preclud-ing an opportunity for honest discussions orlearning.”

Meyer adds that the volunteers address sen-

sitive, but critical, aspects of the young peo-ple’s lives, about which some teachers andadults may feel uncomfortable.

“We seek to educate young people on manyfacets of life. Sport has a way of doing this, of-ten just by getting kids out of the neighbour-hood, meeting new people and making friendsof diverse backgrounds.”

Samyia Satti of Manchester tells People’sPost that she will be staying in Cape Town forthe next six months.

“I found out about the programme at univer-sity and it was offered to students who had fin-ished their sports degrees. I decided to applyand have never regretted my decision.

“I have found this experience absolutely in-credible and its the best experience ever. I loveworking with the children and all the peoplehave been very helpful,” Satti says.

Volunteers work mainly in schools, but anumber of them also spend time with the afterschools programme.

“The international volunteers learn a wholenew culture and become part of a South Afri-can family, also making a difference to thecommunity,” Meyer says.

Cape Town is open for businessTHE City of Cape Town is driving a jobcreation agenda by providing an ena-bling environment motivating CapeTown Entrepreneurship. This is beingdone partly through a series of events atthe City Hall from now until Monday 21November, as well as numerous satelliteevents across the city.

“Cape Town recognises the role andimportance of small to medium enter-prises in job creation,” says CouncillorGarreth Bloor, chairperson of the City’sEconomic, Environment and SpatialPlanning Portfolio Committee.

“We can create a supportive environ-ment by helping existing organisationsdirectly so they can increase their cur-rent capacity. Primarily, however themajor drive is one of sound policy and ef-fective administration.”

Bloor says while Council will use itsmandate to drive job creation across allsectors, it will take extra steps to helpCape Town’s businesses – particularlysmall to medium enterprises (SMEs) – tocomply with existing national regula-tions.

The City and the Provincial Govern-

Greening the environmentPUPILS at Oval North School of Excel-lence in Beacon Valley did their bit forthe environment last week Wednesdaywhen they planted 50 trees at the school.The Plant-for-the-Planet project wasstarted in 2009 at a childrens conferencein Korea.

Children at the conference pledged toplant 1 million trees in every country by

2020, to try and save the planet. Oval NorthSchool of Excellence is one of 12 schools whoare part of this project. The teachers steeringthe project at the school are Samuel Julius,Gary Lewis and Tershia Arendse.

At the tree planting event the pupils tookresponsibility for the environment and thetrees that they planted at the school. Theyalso pledged to be the ambassadors of theWestern Cape Education Department.

MINSTREL troupes are to sign a codeof conduct as part of the agreement

to march through the historic Bo-Kaap ar-ea.

The news comes after lengthy discussionsbetween representatives of the City of CapeTown, provincial government and minstrelassociations over the past two months.

On Tuesday 8 November an agreement wasreached between the parties, which includedthe return of the normal routes through thehistoric Bo-Kaap area and hosting the eventon 2 January. City of Cape Town will also pro-vide R3.5 million for Tweede Nuwe Jaar cele-brations.

A further R500 000 was made available forevents after Tweede Nuwe Jaar and competi-tions. Peoples Post extensively covered the dis-cussions at the Cape High Court, “Minstrelbattle marches on (1 November 2011),” withretired Constitutional Court Judge, KateO’Reagan, as independent mediator, appoint-ed by provincial government.

According to Osman Shaboodien, chairper-son of the Bo-Kaap Civic Association, theminstrels will have to sign a code of conduct,ensuring, amongst other things, timeliness,with strict starting and finishing times, andensuring orderly conduct.

The city council has set up a task team toensure that there will be enough toilets alongthe routes.

The conduct of the minstrels will be policedby the City Council and any transgressionswill be evaluated in March, said Shaboodien.He added that safety and security as well asdisaster management, will ensure that con-duct on the day is not offensive or unruly.

“We have walked for 150 years withoutcouncil, but to take it to the next level andmake this a calendar event we need strongpartnerships that work.”

The concerns of residents, based on theirexperience of previous eyars, were of min-strels marching into the early hours of the

morning; minstrels not respecting prayertimes; and allegations of minstrels urinat-ing against Mosque walls.

Minstrel leaders and the Bo-Kaap Resi-dents Association applied for a High Courtorder against the decision to ban minstrelsfrom entering the Bo-Kaap area.

CEO for the Cape Town Carnival Associa-tion, Kevin Momberg, was delighted at theoutcome and said: “This is what we wantedand now we can work on restoring a part ofhistory which should rightfully be stagedevery year.”

Momberg highlighted the importance ofthe minstrel culture in Cape Town, mention-ing the days of a packed Wale Street, march-ing past the old Slave Lodge in AdderleyStreet, with faces painted black and whiteand thousands of minstrels lining up to en-tertain Cape Town.

“These are the fond memories you havewhen you talk about the minstrels, so wehad to fight for this, for something thatrightfully belongs here,” says Momberg.

According to Solly Malatsi, spokespersonfor the Executive Mayor of Cape Town, Pa-tricia De Lille, the agreement “paves theway for the successful hosting of one of CapeTown’s historic and celebrated culturalevents.”

Malatsi further confirmed: “All minstreltroupes will be allowed to march throughthe Bo-Kaap to revive the historic and cul-tural significance of this event.”

Momberg said the work is only startingand could barely contain his excitement.

“We will be working very closely with theCity of Cape Town to ensure that we host asuccessful event that will be rememberedand remind people of the good old days.”

The agreement will serve as a pilot projectto guide the management of future minstrelevents.

“It has been a long, long road”, said Sha-boodien. “This is not a victory; it is just arestoration of rights and recognition of theculture, heritageandhistoryof theBo-Kaap,and an acknowledgement of the importance

of the area.”Not all Bo-Kaap residents are overjoyed to

have the minstrels back in their narrowstreets.

“The minstrels have no respect for the sanc-tity of the Mosques and urinate against them,”this is but one major area of concern for someresidents, as voiced by The Mosque Associa-tion of the Bo-Kaap.

Other concerns were about minstrels not ar-riving and finishing on time, disturbing resi-dents into the early hours of the morning andnot respecting prayer times in the traditionalcommunity of Bo-Kaap.

However, according toShaboodien this yearwill be different.

“This has become a way of life for many peo-ple, and it is reassuring to see the tradition re-instated,” said Shaboodien. The Mosque Asso-ciation is cautious: “let’s see what happens thisyear; if it will be better than previous years.”

According to Cape Town Tourism, theKaapse Klopse festival has been compared to

that of the Carnival in Rio de Janeiro, and theMardi Gras in New Orleans and is “a spectac-ular and colourful event that should not bemissed.”

Cape Town’s famous Tweede Nuwe Jaarcarnival has been described as a “bright,noisy and vibrant celebration.”

The production, ’n Plekkie indie Son ... Mitchells Plain seMense, is a co-production be-tween the Suidoosterfees andArtscape with stars such as Emoand Loukmaan Adams, theKhoisan rapper Blaqpearl, theSA’s Got Talent winner JamesBhemgee and Melanie Jones.

Basil Appollis is the directorof this musical theatre produc-tion, which features storytellingand songs to illustrate the pastand present of Mitchell’s Plainwith compassion.

Marlene le Roux, director ofArtscape and the Suidooster-fees, compiled the book of the same titlethat will be launched on 15 February be-fore the première.

A reading from the book will take placeon 17 February before the show at 17:00.

A play about leading separate livesA DIVORCED former politician, a re-tired military man, a bullying mother,her repressed daughter and a fashion-able divorcée are some of the charac-ters in the beautifully crafted play,Separate Tables, that opens at theMasque Theatre, Muizenberg, on Fri-day 18 November.

The setting for the play, wovenaround the foibles and personalities ofhotel residents, is Bournemouth, Eng-land, 1954. Playwright Trence Ratti-gan was a master of characterisationand his convincing and compassionatestudies of ordinary human beings ringas true today as they did 57 years ago.

English playwright Terence Ratti-gan was born 100 years ago and the Clare-mont Dramatic Society decided to honourhim in his centenary year by presentingone of his most famous plays. The play isdirected by Sue Bolton.

The show runs from 18 to 26 November(excluding Sunday to Wednesday). The

A Goldin opportunityTHE Brett Goldin Bursary fund is the bene-ficiary of a special performance of LaraFoot’s acclaimed Solomon and Marion,staring Dame Janet Suzman and Khay-alethu Anthony, on Sunday 20 Novemberat 14:00. The Brett Goldin Bursary was setup after the young actor and a friend, fash-ion designer Richard Bloom, both 28, werebrutally murdered on 16 April 2006.

Goldin was murdered just days before hewas due to leave for Stratford-upon-Avonto perform the role of Guildenstern in Ham-let, directed by Suzman, in the RoyalShakespeare Company’s Complete WorksFestival. The double murder sent shock-waves throughout South Africa and Eng-land. The bursary was established by TheRoyal Shakespeare Company, The ActorsCentre in Johannesburg and the BaxterTheatre Centre to give another young actorthe opportunity denied Brett, and to hon-our his memory in an appropriate manner.The first donations were from South Afri-

can-born actors Sir Antony Sher and Hon-orary RSC Associate Dame Janet.

The bursary is for a short post graduatecourse to fine-tune the skills of actors to in-terpret Shakespeare. The first three recipi-ents were Omphile Molusi, Thami Mbongoand Nicholas Pauling. All three actors hadroles in The Tempest, which marked thesecond collaboration between the BaxterTheatre Centre and the Royal ShakespeareCompany in 2009. The 2010 recipients wereThato Moraka and Josette Eales.

M'Plain cluster views on the MEC directiveTHE directive by MEC Dan Plato to estab-lish a team to resolve complaints byformer Mitchell’s Plain NeighbourhoodWatch Association members is unconsti-tutional.

MEC for Community Safety Dan Platoissued this directive at a general meetingin the Portlands Indoor Centre on 2 No-vember. He appointed John Cloete as con-venor.

The Uniform Constitution for Commu-nity Police Forums and Boards in theWestern Cape 2010, section 25 dealingwith amendments to the constitutionstates:

25. Amending the Uniform Constitution25.1 Proposed amendments to the con-

stitution should be submitted in writingto the Provincial Board, the ProvincialCommissioner or to the Head of the De-partment;

25.2 The proposed amendments must bediscussed at a Special Meeting of theBoard and if there is any consensus, [...]the request for the amendment should beaddressed to the Provincial Commission-er and the Head of the Department;

25.3 The Provincial Commissioner, inconjunction with the Head of Depart-ment, must, after receiving the requestfor an amendment, establish a committee

consisting of representatives of the SAPS,the Provincial Board, the Departmentand/or a designate from the MunicipalPolice Service to consider the proposals;

25.4 The Committee may, after consid-ering the request and proposals, recom-mend that:

25.4.1 the request or proposal be ad-dressed with a Departmental Instructionor Directive, or;

25.4.2 that the Constitution may beamended;

25.5 If it is recommended that the Con-stitution be amended, the ProvincialCommissioner, in conjunctionn with theHead of the Department must instruct theCommittee to make the necessary amend-ments to the Constitution and present theamended Constitution for adoption by theProvincial Board.

In light of the above constitutional pro-visions, the MEC’s decision to issue a di-rective is seriously flawed and has no con-stitutional basis. As such, we are underno obligation, as the Community PoliceCluster Board, to participate in a commit-tee that was not properly constituted.

“We are managing Motsoeneng atthis moment in time and as soon aswe have an opportunity we will tryand solve this injury problem,” saidSolomons.

THEY ARE always in the background,spurring the players on and formulat-

ing strategies to take their team to the top.This week People’s Post will introduce theteam behind the national women’s soft-ball side.

The eight-strong management team hasbeen working around the clock, preparingthe squad for arguably the biggest tourna-ment of their softball careers.

The Softball Junior Women’s World Cham-pionship takes place from Wednesday 7 toSaturday 17 December at Turfhall Stadiumand People’s Post is the print media sponsor.

Former national softball players and pro-vincial coachesmakeup the experiencedpan-el, with four of them hailing from the MotherCity.

Lester Smith is the head coach and known

as the man who led the senior WP softballteam to victory in the National Interprovin-cial Tournament in 2010.

He almost repeated this feat earlier thisyear, however the team fell short when theywere beaten by Gauteng in the final.

Smith is also the former head coach of theWestridge Yankees and thanks to his vision,his former side has scooped knockout andleague titles in 2007 and 2010.

Smith says his team is fully-focused on thetask ahead and looks forward to a respectableresult.

“South Africa will go out and be competi-tive in every game. Our objective is to playbetter than what we are ranked.

“Our strongest competitors in our prelimi-narygroupwouldbe theUSAandCanadaandwe have to be mentally prepared for eachgame.

“Goals are essentially tough, and I can onlydeal with what is in my control,” he says. “My

goal is to have the girls prepared as well aspossible. I can’t tell how many games wewill win, though,” he says with a laugh.

Shihaam Nacerodien, the assistant coachto Smith, has a whole history of softball sea-sons behind her.

She started off at the age of 10 and playedin the Super League until the age of 45.

“I am excited to be part of the coachingstaff, and it’s great to be coaching at this lev-el. Being part of the World Series is a bigachievement, and I’m proud of them all.”

Fitness trainer Shaheeda Majiet was alsoa former national athlete and holds a recordin 100m, 200m and relay track events.

She was also part of the WP Masters soft-ball team which went to Melbourne, Aus-tralia, in 2002.

Assistant manager Lynn Alexander is aformer national player and has representedthe country since 2000.

Her first tournament was in Lesotho, and

she also played in two World Series.She was also part of the team that played in

the EuroAfrica Olympic qualifier which tookplace in Italy in 2007.

“I hope that I serve as a role model and thatwhat I’ve achieved serves as an example ofwhat can be done when you work hard,” Alex-ander says.
