My landlord has recently announced he is increasing my

rent. I'm still in my contract. Is this allowed?

Firstly, you must check yourtenancy contract because theremay be a rent increase clause

in there which would have been agreedand signed at the start of the tenancy.The procedure in the agreement shouldthen be followed.

If the tenancy agreement makes noprovisions for the landlord to make rentincreases, then the landlord has no legalright to increase the rent until suchtime the fixed term of the tenancy hascome to an end, in which case thetenancy will then automatically becomea statutory month to month periodictenancy.

In the case that your tenancy does or isdue to become periodic, then the landlordcan serve a Section 13 Notice of theHousing Act 1988, proposing an increasein rent, at the end of the fixed term.

The notice must give you not less thanone month's notice and the notice mustexpire on the day the rent is due.Another option is that you agree to renewyour tenancy agreement at the end of thefixed term but with an increased rent.

The short answer is no. If acontract is for a fixed termand does not contain a

break clause, then it will run its fullterm if the parties cannot agree tosurrender it.

If you and the landlord can agree tosurrender the contract, the landlordmay request that you pay an earlytermination fee, as the property maybe vacant for some time after it issurrendered. Alternatively, you couldfind a replacement tenant to takeyour place although the landlordwould have to agree.

If you abandon the property, thenyou are still liable for the rent upuntil the expiry of the contract andthe landlord can sue you for theremaining term.

Sellers by law have to complete a SPIF(seller’s property information form),which forms part of the contractbetween the seller and buyer. In thisthey are obliged to highlight anyneighbourhood disputes relating tonoise, boundary or shared maintenance.Unfortunately what constitutes a

dispute can be contentious and a greyarea but an issue that has resulted inwritten correspondence betweenneighbours or a council (or otherauthority) complaint should bedeclared by the seller on the SPIF.Failure to do so could result in thebuyer potentially taking legal actionagainst the seller. There have beennumerous cases where sellers havebeen sued in such circumstances.

The recently published TenantArrears Tracker, published by LSLProperty Services, highlights aworrying rise in the number oftenants who are more than twomonths behind on rent payments.

In the first quarter of 2013, thefigure rose from 90,000 to 94,000– which equates to 2.3% oftenants in England and Wales.

Joe Davison, of Paul Crowley &Co Solicitors, says: “We are seeingan increasing number of landlordswho find themselves in difficultieswhen their tenants are in seriousarrears. There is no easy way out,however there are some steps,which will minimise trouble.

“First, we would recommendthat landlords do theirhomework properly. It issurprising how many landlordsneglect to obtain full,trustworthy references for theirtenants. If a prospective tenantcan not provide two worthwhilereferences,then it’s best toleave thepropertyunoccupieduntil the righttenant comesalong.”

suggests April’s news of thecontinued rise in houseprices could ease the strainof a financial settlement.

Office of NationalStatistics figures showdivorce numbers in 2011 hadvastly increased from the30,870 granted in 1950, butthere has been a dip sincethe recession took hold.

Rebecca explains: “Thelegal profession widelyassociated that dip withpotential divorcees decidingnot to proceed because theycould not afford to deal witha financial settlement at atime when house prices hadtaken a nose dive. With thenews in April that houseprices had risen for thefourth consecutive quarter,now might be the time totackle the thorny issue ofdivorce for those people whohad put off the issue.”

This house priceannouncement does,however, coincide with thegovernment’s legal aidreforms.

Rebecca adds:“Unfortunately family legalaid was a significant casualtyin this and an estimated 75%of people who wouldotherwise have been eligiblefor legal aid no longer willbe. However legal aid is stillavailable for divorces andfinancial settlements(ancillary relief) if theindividual can evidence theyhave been a victim ofdomestic abuse within thepast 24 months.”

Liverpool FC and Englandcaptain Steven Gerrardwent back to his roots tohelp launch a new projectthat will provide much-needed new homes.

The Reds star was on hand tomark the start of work at BluebellPark in his home town of Huytonin Knowsley, a project that willprovide 101 new homes for rent toover 55s that need extra care andsupport to live independently,along with an additional 21apartments for older personsshared ownership.

The £14.4m development,driven by Knowsley HousingTrust, part of the First Ark Group,in partnership with KnowsleyCouncil, will be built on the siteof the former Wingate Towers flatsby contractor Bullock.

It will comprise of one and twobedroom apartments designed toLifetime Homes standards andwill be completed in Autumn2014.

Steven was brought up inHuyton and was pleased to returnand support this importantproject that will invest in thefuture of the town.

He says: “Huyton is where it allbegan for me and a lot of myfamily and friends live there so Iam still there quite a bit. It’s greatto see they are improving the area,and this will create many morejobs for people locally as well.”

The project has received a

£2.6million grant from the Homesand Communities Agency (HCA).

ince forming in Liverpool, Outfit have received muchcritical acclaim with their style of ‘melancholy pop to danceto’, and the likes of the Guardian and NME have cited them

as a band to watch out for. Now members Andrew Hunt, ThomasGorton, Nick Hunt, Chris Hutchinson and David Berger arepreparing to showcase tracks from their debut album, Performanceat this year’s Sound City. We caught up with drummer Davidahead of the festival.

Has Liverpool been a goodplatform for Outfit in terms ofexposure and opportunities?I'd say Liverpool has been prettygood to us over the years, evenbefore we were doing Outfit.There are a lot of people doingmusical things in what is really arelatively small city so there aresome good platforms for artiststo do their thing. Out of all theprojects we've been involved inindividually, Outfit is probablythe one that is least connected tothe city, which wasn't aconscious decision but maybehappened because we never feltvery comfortable with being a‘Liverpool band’ and all theweighty musical associations

that brings with it.Furthermore, aroundthe time we started we'dall been living andplaying in Liverpool fora while and were readyfor a change. Thisprompted the

temporary relocation to London,where musical communityobviously works completelydifferently. Not being tied inwith a particular scene isliberating and isolating by thesame stroke.You toured with EverythingEverything recently. Whatwas that like? It was brilliant,lots of fun. Their tour was soldout and some of the shows werequite big so we got to play infront of a lot of people, in decentvenues. Interesting to get someinsight into their touringoperation too, it's a pretty slickaffair, very pro. We were like thekids along for the ride, a little

curious and a little silly at times.Plus the band are total gentlemenand were very supportive, verykind. A real pleasure. What can people expect atyour Sound City gig? Willyou play tracks from yournew album, Performance?We haven't played in Liverpoolfor a while so we're very excitedabout it. We'll definitely beplaying songs off the album, themajority of our set actually.We're still learning to play acouple of them at the moment,rearranging bits of it. The waywe've recorded the album makesthis process kind of necessarybut it's also a lot of fun to comeat the tracks more directly. You’ve made a video for yourtrack Performance withFACT, which will be shownduring this year’s festival.How did this come about?The video is actually beingshown at FACT now as part of

their Art of Pop Videoexhibition. Sound Cityapproached us about it earlierin the year and we were lookingfor a way of showing everyoneone of the tracks off the albumso it worked out quite well.Andy and Nick had previouslycreated the concept for all ourvideos and shot and edited mostof them, and working withIsaac Eastgate (director) for thisone was a nice experiment.What is the atmosphere likewhen you play in Liverpoolcompared to other cities? Iguess it's always exciting to playin your home town, certainly ifyou haven't played there for awhile. All your friends are there,they want you to be good andwant to have a good time. It'sinfectious. At the same time it'swhat you want from theaudience in general and in a way

it can be more rewarding whenit comes from people you don'tpersonally know.Your EP, Another Night’sDreams Reach Earth Againreceived positive reviews.How does Performancefollow on from that and wasthere more pressure whilemaking it? The EP was a directproduct of our move to Londonand being pretty clueless in thisbig city, for better or worse. Ithink the album still has someof that in it, Andy and Tomwrote a lot of the songs whenwe were down there. We cameback to Liverpool to startrecording towards the end oflast summer and spent thewinter months locked awayworking on it, leading fairlystrange lives defined by acomplete lack of connection tothe real world. Maybe some of

this came through in songswritten during that time. Butthen again these are themeseven our early songs aren'texactly unfamiliar with.Because we sort of disappearedto make the record and weren'treally working to a deadline weonly felt whatever pressure weput on ourselves, which can besubstantial and has certainlygrown more so recently whilstfinishing things off. Everyonewho's ever made a record hasprobably felt like that at onepoint or another.

We're still working out thedetails for the album but itlooks like a late summer releaseat the moment.Outfit will also tour with theElectronic Voice Phenomenaproject soon. Can you tell usmore about this? We arecurrently working on a

completely new piece of musiccommissioned by literaturecompanies Mercy and PennedIn The Margins as part of theirElectronic Voice Phenomenaproject, which has to do withhearing unidentified voices inelectronic interference. Ourparticular piece is inspired bythe 1990 trial of Judas Priestand explores music's potentialto manipulate and how thispotential is being used andabused by people. Has Outfit got anything elsein the pipeline? There's alwaysmore but that would be telling.

on display.The Poetry & Painting 1960-2000 exhibition

brought together a collection of Henri’s pictures andpoems based on common themes such as popularicons, consumer products and cityscapes.

Playwright Willy Russell and CatherineMarcangeli, the wife of Adrian Henri, were amongthe guests at the well attended preview of the display.

The exhibition was launched to run parallel with theAdrian Henri Poetry in Art Prize, as part of the MuchWenlock International Poetry Festival during April.

Adrian Henri’s Poetry & Painting 1960-2000 runsat the gallery until 28 April.

Living just a stonesthrow from Old HallStreet I’ve often walkeddown it and thought itwas missing something.The busiest street in thecommercial sector, it hasno shortage ofsupermarkets and coffeeshops but is decidedlylacking when it comes tobars and restaurants.Luckily entrepreneur JafSiddiqi was thinking thesame thing. So much soin fact that he decided todo something about itand thus City Wine Bar& Kitchen was created.

Situated in the heart ofOld Hall Street, justopposite the CottonExchange, the bar andrestaurant has only beenopen three days when wepop in to try it out but isalready proving popular.Indeed, by the time weleave at around 7pmthere is standing roomonly in the bar area – asure sign of success.

The venue is split intotwo parts, the bar area atthe front with its wooden

benches, high stools andcool yet cosy feel and thequirky dining area at theback, all rustic furniture,wooden floors and comfyseats.

We arrive at 5pm andthe after work crowd isalready starting to driftin. After taking our seatsin the restaurant area ourfriendly waitressintroduces herself andhands us our menus toperuse.

It’s an overused clichébut there really issomething for everyoneon City Wine Bar &Kitchen’s menu. This isevidenced by the eclecticvariety of our fellowdiners, from the twoyoung women grabbing abottle of wine and asharing platter ofcouscous, home madecoleslaw, roast peppersand artisan breads afterwork, to the businessmen conducting ameeting over some beersand the father with hischildren, all tucking intothe delicious-looking

City burgers.Given the recent bout

of semi-nice weatherwe’ve been having Idecide to opt for a saladand, on Jaf ’srecommendation, choosethe smoked duck whichcomes with orangesegments, candied pecannuts and a raspberrydressing – a zesty,delicious combination.

My dining partnerchooses the 7oz rumpsteak with a flash friedchilli, spring onion andsoy sauce reduction andchunky chips – althoughhe was equally drawn tothe giant shrimp withgarlic butter. Onfinishing his perfectlycooked steak however,with its unusual butfabulously flavoursometopping, he was sure he’dmade the right decision.

City Wine Bar &Kitchen is just what thecommercial district needs– an affordable, attractivevenue with a relaxedatmosphere and animpressive menu.

Day Festival.Children’s TV star Mike the Knight made a special

appearance at the fun-packed family event, whichfeatured a funfair, a hog roast and a schedule ofactivities and workshops throughout the day.

Landmark attractions including the World Museum,Walker Art Gallery and St George’s Hall participatedby hosting indoor fun, while dragon inspiredSuperlambananas took up residence in Queen Squareand visitors to Williamson Square enjoyed musicalperformances on the Liverpool Bandstand.

Historical entertainment was provided by thePlantagenet Medieval Society, who worked to recreatethe pageantry and action of medieval combat andcourtly dancing at the festival.
