Under the proposals beingconsidered, buyers moving tothe least energy efficient homeswould have to bear anadditional 0.5 per cent levy ontop of the normal rate of stampduty, adding hundreds, if notthousands of pounds to the costof a new home. As part of thescheme, initially commissionedby the previous government,those purchasing homes withan energy efficiency rating of For G would be liable for thenew tax and would only beeligible for a rebate ifsignificant upgrades weremade. The tax would penalisehomes with insufficientinsulation, an old inefficientboiler or draughty windows,with the cost of upgrading to aminimum E grade amountingto several thousand pounds inmost cases. It is believed thosewho improved their property tothe required minimum withinan allocated time frame wouldbe refunded the 0.5 per centlevy, together with anadditional 0.5 per cent.

Sue Taylor, head of KeppieMassie Residential, believes theplan would create a freshobstacle to prospective firsttime buyers. She said: “This isyet another “fund raiser” bythe Government which willpenalise house buyers or sellersin the most vulnerable sectors

of the market. We are alreadyproducing Energy PerformanceCertificates on all propertiesfor sale and let, which doesn’tinfluence buyers or renters inany way. The market forproperties in need ofrenovation is one of the onlyavenues available to some firsttime buyers. Let’s not deterthem from entering thehousing market yet again.”

The proposal was part of areport by the ‘GreenInvestment Bank Commission’initially commissioned byformer Chancellor AlistairDarling and produced by BobWigley, chairman of the YellGroup. The tax could form partof the Government’s “Green

Deal”, which is expected to belaunched towards the end of2012. That initiative wouldagain favour the most energyefficient homes, withhouseholders offered ‘greenmakeovers’ as part of the widerpromotion of the climatechange lobby, advocated by theprevious government and theincumbents. According to the

Energy Saving Trust, theGovernment aim to have allnew homes built in Britainmeet “zero-carbon standards”by 2016.

Nick Dawson, head ofresidential at Venmore,Allerton, thinks the stamp dutypenalty could be considered aform of stealth tax. He said: “Ithink it would be fair andjustified for some form oftaxation to be placed onhouseholds who fail to recycleor create excessive wastage, beit refuse or homes who fail toinsulate properly. On the otherhand there may be some whoconsider this a form of stealthtaxation. From a propertyperspective it will furtherwiden the gap between richand poor with many poorer,less affluent households beingunable to remedy any sub-standard insulation. Prices forlower income housing, un-modernisned or poorlymaintained stock will continueto inevitably fall and this maycause a landslide in pricesacross all property classes.”

A spokesman for theDepartment of Energy andClimate Change told YourMove that although theGovernment is consideringintroducing the tax, no planshave been finalised: “There aremany incentives that we areconsidering to tackle the hugechallenge of making homesmore energy efficient andsaving money on energy bills aspart of our Green Deal. We

Knowsley Housing Trust issponsoring a special anti-bullying message onMerseyside.

Songwriter Paul Browne haswritten and produced an anti-bullying song called Safe andSound, with the help of year threechildren from Kirkby C of EPrimary School. The project wasfunded by Knowsley HousingTrust, where Paul has worked as aplasterer for the past 29 years. Heapproached KHT for help withhis idea and they paid for the 35children to record their song in astudio earlier this year. He hopes

the CD can be used to raisemoney for anti bullying charitiesand help empower children whomay be suffering at the hands of abully. Paul, from Kirkby, has beenwriting songs for the past six yearsand has had 40 songs published

on 20 dance music compilations.He commented: “I approachedthe school and KHT and theyboth thought it was a great idea. Iwant this song to help givechildren back some of theconfidence that bullies take away.”

Q I am a landlord of a house and I have a tenant who iscomplaining about repairs needed to the roof. He isseeking compensation. Do I need to complete thoserepairs and do I need to pay him compensation?

A As a landlord you have a duty to keep the structure ofthe property, which includes the roof, in a reasonablecondition. You are liable to carry out repairs to thestructure and to certain installations within the property,such as the hot water supply. You are only liable tocomplete those repairs of which you are aware, such as theroof. Your tenant should notify you of any repairs. Onceyou are notified you need to complete those repairs withina reasonable time of them being brought to yourattention, which will depend on the nature of the repair. Ifyou fail to complete the repair within a reasonable timethen you are liable to pay your tenant compensation forinconvenience until the work is completed. You could facecourt proceedings being issued against you seeking a courtorder for the repairs to be completed, compensation,interest and costs. It is therefore in your interest tocomplete the repairs immediately, as that will limit anycompensation and it will also protect the value of theproperty.

Q I sold a property and contracts were signed. A depositof 10% of the purchase price was paid. However thebuyer has since changed his mind and has not completedthe transaction. What can I do?

A If the contract that has been exchanged uses the LawSociety prescribed standard conditions of sale your solicitorneeds to send to the buyer’s solicitors a notice to complete.If the buyer fails to complete the transaction within thetime provided in the notice, normally 10 days, then you cancancel the contract which will allow you to keep the 10%deposit along with any interest that has accrued. You canthen resell the property. If that resale results in a loss toyou, i.e. it sells at an amount less than you agreed in thefirst sale, you can seek that shortfall from the first buyer,although you would need to show you have tried tominimise your loss by seeking the full market price for theproperty on the second sale. Alternatively, you could seekto issue court proceedings to enforce the first contract ofsale, although it is unlikely the court will force the salethrough a damages award would be the alternative.

We both really like Liverpool.Since the Capital of Culture

the city has beenrejuvenated.

There’s areally differentcharacter todown south.There’s alsotwice the spacehere at half theprice!

Why did you chooseThe Gallery?It came recommended. Thesize was a big factor and it hasbeen so nicely furnished. Someapartments we saw were muchtoo small and it didn’t seem asmuch care had been taken ashere. New builds are so nicejust to spend time in. It feelsquite luxurious. The location isgreat too and it’s nice to be soclose to the marina.

Tell us aboutthe kitchen...We both take

turns in the kitchen andwe cook a lot of Mexicanfood. It’s larger andmore modern than we’vehad before. It’s possiblyour favourite area of theapartment. We’re notused to having such abig freezer. It’s changedthe way we shop.

And the living area?

We love the livingroom too. There arepictures of Sydneyand Fiji which Kellytook and also a photoof Kelly’s first matchat Anfield. There’sthe TV which webought for the WorldCup. It’s large but itcan fit in this flatquite comfortably.Also Kelly likes toplay a lot of Mario onthe Wii!

What aboutthe bathroom?

Again it’s somuch bigger than otherplaces we saw. It’s sonice to have a brandnew, clean bathroomand it’s done out reallywell. Kelly loves tohave a nice long soak inthe big bathtub.

I have my computer in therebecause I do a lot of work athome and there are morephotos that we both took ofLiverpool and New Zealand.

They’ve done a greatjob furnishing the

Comedy panel show regular Rhod Gilbert brings his “The cat that looked likeNicholas Lyndhurst” tour to the Liverpool Philharmonic in September. The faceof Welsh tourism speaks to Jonathan Kearney about living on a desert island,performing the first-ever stand-up routine in Taiwan and his ambitions fordoing not very much.

What’s the thinking behind the title ofthe tour?It’s all to do with this bloke who follows meround. He’ll just bring something along thatrelates to the title of my show, like when Idid the “Mince Pie” tour he brought me amince pie. God knows why, he’s just one ofthose people. I just tried to call it somethingso that he couldn’t bring anything. It’s alldone just to annoy one person.Are you glad to be coming back toLiverpool?I always look forward to performing inLiverpool. It’s always good fun. It’s a nicecity to hang round in for a couple of days.Some places I’m not that bothered aboutbut I quite enjoy a stroll through LiverpoolI must say.

You have a pretty relentless schedule.Is it tiring?It’s going to be very busy but I’m used to itnow. It’s kind of easier than it used to bebecause of the little luxuries that I canafford now, like a driver. A few years ago Iwas driving myself and that’s a real killer.Do you have a laugh with the TV panelshows or would you prefer to be out onthe road?Some of them are a laugh; some of them

aren’t to be honest. I enjoy some but othersare a bit of a nightmare. It’s very difficult todo as a comedian because sometimes it canget a little bit competitive. I think you cansee the ones where comedians are havingfun because it probably comes across thatthey’re enjoying themselves. Stand-up iswhat I do and it’s probably what I do best. Ienjoy doing these TV things but really it allcomes about because of stand-up. I don’tknow how much longer I can keep doing itbecause it’s tiring and there’s a lot of nightsaway but at the moment it’s what I do best.You’ve travelled quite extensively. Youeven spent five months living on anexotic island...Yeah I did. That was after university whenI didn’t quite know what to do with myself.I ended up living on a little island inIndonesia, climbing coconut trees for mybreakfast and fishing for my lunch. Weused to go hunting and all that kind ofthing. It was a nice way of life and quite abit different to what I’m doing now! It wasamazing and one of those things you look

back on and think “did I really do that?” Ithink stand-up is a bit like that. I thinkonce I stop doing it I’ll look back and think“was I really on ‘Live at the Apollo’?” It’sone of those things where it all happens sofast that you look back and think “did thatreally happen or have I made it up?” Were you really the first stand-up toperform in Taiwan?I’m not sure if I was or not! An article putthat somewhere and that’s somehow

became gospel but I don’t know whetherthat’s a myth or not. I certainly did do a gigin Taiwan and they certainly hadn’t hadmuch comedy there but it was actuallyquite good fun. There’s a guy who puts ongigs in the Far East in places like Bangkokand Hong Kong and I think he just tried itout in Taiwan. I don’t even know if he everwent back. I think I was the guinea pig. Would you like to tour more abroad?I don’t know. I’ve done quite a lot of stuffin Australia and New Zealand and it’s greatfun but you have to make a real effort withit and commit to doing it every year andbuild up your audience there. I don’t knowif I can be bothered to do that. I’m quitehappy to do it here.Who is your comedy idol?I think Eddie Izzard is probably the closestthing I’d come to a comedy idol. Right nowI think Gervais is pretty phenomenal too. Do you have any TV work lined up afterthe tour?I’ve got a BBC One series coming up whichwill be on Monday nights and I’ve gotanother series of the work experience showdoing jobs like farming, so it’s all very busyfor the foreseeable future.Tell us about your new radio show...Yeah it’s on Radio 2. I’ve got my RadioWales show which I do every Saturday andI really enjoy doing that and then I’ve gotthis Radio 2 series which starts at thebeginning of September. I just finishedrecording it this week. You’re really given alot more freedom when you’re on the radio.The series I just recorded was just me andtwo of my mates d***ing around in front ofan audience. We’ve just messed about fortwo or three hours and they’ve edited itdown into an hour. I love it. I don’t do anypreparation, I just turn up and have fun.

A false wallwill help you conceal all the cables andsockets that may be required. lunch in between site visits andmeetings at the Anfield andNetherley developments ofaffordable new build housing.As we browse the extensivemenu offering sushi, sashimi,and a selection of charcoal plateswith fish, poultry and meatdishes, Salford-born Peterdescribes the movements whichhave brought his career fullcircle. From a beginningworking in sales for a city centredeveloper, Peter took theopportunity to build on hisskills on site, in part exchangeand sales management beforeprogressing quickly up theladder. A year ago, he washeadhunted by Miller afterbeing made redundant by a

competitor. Peter started hiscareer in property 22 years ago,with Fairclough Homes, whoMiller later acquired. “I feel verylucky to have joined Miller. Ispent 12 years with Faircloughand learned a lot about thebusiness, and while technologyhas changed some of the wayswe work it’s essentially stillabout finding the right homesfor the right people, and gettingeverything to go as smoothly aspossible during what can

sometimes be a stressful processof moving house.” Over maincourses from the express lunchmenu of chicken and salmonteryaki, served with numeroussauces and jasmine rice, wediscuss how changes in themarketplace have seeninitiatives such as thegovernment’s HomeBuy Directshared equity scheme andMiller’s own shared equityscheme, MiWay (which willcontinue to be available topurchasers even after thegovernment’s scheme comes toan end) make it possible formany would-be buyers topurchase their own properties.Peter commented: “From theinitiatives on offer to make

purchasing possible, rightthrough to the designs of thehomes and apartments, withlarge open living spaces,accessible gardens, and parking,we’re doing everything we can tomake finding the right homeeasier.” He adds: “AtBridgewater Park in Netherley,two bed apartments are availablefrom £80,500 and houses from£125,950. At Connaught Greenin Anfield which is a verydifferent, more urbandevelopment on the edge of thecity, prices start at £93,950 for atwo bed apartment and £139,950for the houses with a mixture oftypes. Our Tarporley style withthe whole top floor for themaster bedroom and en-suitehas been particularly popular.”Although we decide we’re toofull from lunch to enjoy the

extensive dessert menu, whichincludes a tempting coconut andrum sorbet or Fuji apple dessert,we continue to talk about Peter’spassion for socialising andtravel, as well as the ongoingsubject of the city’s - and thenorth-west’s - regeneration.Peter adds: “Winston Churchillwas right when he said that weshape the buildings, but thenthey go on to shape our lives.Development is all aboutcreating something to workbetter for us, now, and to lead tofurther improvements of ourinfrastructure. It’s about makingthings better than they werebefore.” From this vantagepoint, where Japanese food andchic interiors are also makingtheir impact in a stunning, butoften hidden, part of the city, Icouldn’t agree more.
