Q I bought a flat from a local developer six years ago.The lease is made between the developer and myself(there is no management company as a party) who hasretained the freehold and delegated management to alocal management agency. The developer has nowbeen struck off at companies house for none filing andthe management agency is threatening to resign overnone payment of service charge/insurance rent.If there is no party to enforce payment how do weresolve this?

A Not simply, assuming again there is no charge on thefreehold then the title is “Bona Vacantia” or “propertywithout owner”.

If the developers company had its registered office inparts of Merseyside/Lancashire then the Duchy ofLancaster has title. If the developer had its registeredoffice elsewhere in England (excluding Cornwall) thenthe Crown has title via the Treasury. The Duchy ofLancaster largely follow the same practises as theTreasury. Both will look to the residents to form acompany to acquire the title. The price is calculated by afixed formula (see website www.bonavacantia.gov.uk).

The forms for completion by the residents are also onthe same website. It is clearly in the interests of theresidents to form themselves a company to acquire thetitle. They need to be persuaded to do this by the veryfact their value is affected by ability to sell/remortgage.

If the tenants do not wish to proceed then you couldstill look to a handful of tenants or a third party toacquire. The enfranchisement/rights of pre-emption lawsdo not bind the Crown.

Once the Duchy of Lancaster/Treasury solicitor havetransferred title to the residents company, then thecompany can take action against the tenants for thearrears of insurance rent and service charge. The leaseswill also need to be varied to ensure that when leasesare sold on in the future – membership rights in thecompany have to transferred as well and any directorsappointments resigned.

Four Liverpool youngsters havebeen given the opportunity totrain in the constructionindustry as part of the HousingMarket Renewal programme.

The teenagers will be working withhouse builders Bellway on theWilliamson Place development inEdge Hill. The scheme, which fallswithin the Kensington RenewalArea, will provide 164 three andfour bedroom houses, and twobedroom bungalows. Nineteen-year-old Jordan Spencer, who livesin the area, commented: “I waslooking for work for a while and

was really pleased when I got onthe apprenticeship. It’s in a great location, right inthe heart of the commercialquarter. The developers arewell known for good qualitybuilds and I think it’s a perfectfit for young professionals.There are great amenities onmy doorstep and I’ve got myown parking space on Old HallStreet. I’m very pleased with it.

The apartment is really spacious.I was renting before so it’s niceto have the space and privacy. Ireally enjoy spending time here.

Probably the living room. I’ve got abit of a Cuban cigar collection and afew other pieces I brought back from

Havana last year.There’s a hand carvedcobra I bought inMarrakesh and somehand crafted chopsticks from Japan. Iactually saw thembeing made in frontof me. You’ll alsofind my pool cueand a few pooltrophies which Iwon while I was atLancaster Uni’.

Myfavouritepiece is my

leather arm chair. It’s finestleather and it was designedand made in Italy. I had tohave it really! It’s a completelybespoke item and my centralpiece of furniture.I’ve also got oneof the MankeyMonkeys which Ibought at action.

It’s a lovely space. I want to have a herbgarden to help with cooking so I’m tryingto grow chives and basil out there.

I’ve gone for chocolate brown and green. Ibought the sofa from SCS and the limegreen rug from IKEA. The next focus isthe walls. They’re white at the moment andI’m planning a feature wall. I’m looking fora local artist to create something themedaround the natural colours, in keeping withthe rest of the room.

bedroom apartments that I’veseen with a bedroom this size.I’ve added a couple of pictures Ibrought back from Japan and asigned Liverpool shirt. BecauseI bought the apartment it was acomplete open canvas.

I’d say I’m a wannabe chef. I liketo cook but I know there’s roomfor improvement! I’m a fan of

Far Eastern food and also really into gameat the moment, like venison. I’m startingto try exotic foreign meats like boar andkangaroo as well. I just like to discoverdifferent dishes.

I like my boy’s toys so I’dlike to have a surroundsound system and ahome cinema. Bang &Olufsen is round thecorner so it would be

rude not to!

The new coalition government described the budget as‘tough but fair’. The headlines to date have been dominatedby the VAT increase to 20%, but what is the likely effect onthe property sector?

For buy-to-let landlords the key change came (as widelypredicted) to the Capital Gains Tax rate. The rate of CapitalGains tax has risen from 18% to 28% for higher ratetaxpayers but remains at 18% for basic rate taxpayers. Thischange applies from the 23 June 2010. The annual exemptband stays at £10,100 for 2010/11 and will thereafter risewith inflation.

At first glance keeping the lower rate of 18% for basic ratetaxpayers seems quite generous, but this will only have alimited benefit as in many cases the capital gains themselveswill be likely to push taxpayers into the higher rate band.Overall however the new rate of 28% is significantly less thanthe 40 or 50% many people feared and is unlikely tosignificantly deter activity in the property sector.

The VAT increase will eat into profits for buy-to-let landlordsas they are unable to pass on VAT to their tenants. Howeverthe fact that the increase has been delayed until 4 January2011 does give some time to plan ahead.

Much harder to assess will be the impact of housing benefitrestrictions. This will potentially hurt landlords in the privatesector supporting local authorities who do not have theproperty stock to house people. The Government haspromised to cap housing benefit payouts.

There was good news for Furnished Holiday Lettings. The verybeneficial tax treatment enjoyed by property owners whohave qualifying holiday lets will not be withdrawn aspreviously threatened, but there will be a consultationdocument relating to possible changes next April.

Finally for developers, builders and contractors, thecombination of falling corporation tax rates and increasingpersonal tax rates for those on higher incomes will be yetanother incentive towards becoming a company. Using a verysimple example, individual earning profits of £175,000 wouldpay total tax and National Insurance of £72,400, afterincorporation the same person could pay tax of only £62,365.
