The finalization of the action was to occur once the road had been surveyed. The road has now been surveyed, and the legal description for the road is known. The matter is before the Board for acceptance of the legal description and formalization of the matter.

WHEREAS research of records for the road named Wildwood Laneproduces evidence that Wildwood Lane is a Public Road;

WHEREAS due to an omission or defect in the public records,there is some doubt whether Wildwood Lane was ever properlyestablished as a Public Road and, therefore, whether it is a publicroad over which the public has a right of use;

WHEREAS the Board of Commissioners on March 15, 2000, by Order

No. BCC2000-06 initiated proceedings to legalize the public road,specifically a local access road, named Wildwood Lane, located inSection 15, Township 5 North, Range 28, East of WillametteMeridian, Umatilla County, Oregon, at its current location;

WHEREAS public hearings were held April 5, 2000, and July 24,2000 to consider the legalization of Wildwood Lane as a publicroad;

WHEREAS on December 13, 2000, the Board adopted Order No.BCC2000-35, finding that Wildwood Lane was a Public Road,specifically a local access road, that the road was to be surveyedas time permits, and once the results of the survey are known, thelegalization of Wildwood Law as a Public Road would be complete,which order was recorded as Document Number 2000-3800265 in theUmatilla County Records;

WHEREAS a Record of Survey for the Legalization of PublicRoads known as Wildwood Land and Margaret Avenue has been completedand filed as Survey No. 19-063-B.

NOW THEREFORE, the Board of Commissioners orders as follows:

1. Wildwood Lane is a Public Road, specifically a localaccess road.

2. Margaret Avenue is a Public Road, specifically a localaccess road.

3. The legal description for the Public Roads is as follows:

A 60.00-foot wide strip, being 30.00 feet on each side ofthe centerline thereof, for road and utility purposesover that portion of Margaret Avenue and Wildwood Lane,according to the road plat thereof recorded under SurveyNumber 19-063-B, Umatilla County Survey Records, locatedin the West Half of Section 15, Township 5 North, Range28 East, Willamette Meridian, City of Umatilla, UmatillaCounty, Oregon, lying East of the most easterly margin ofUS Highway 395 and South of the most southerly margin ofUS Highway 730, the centerline of said 60.00-foot widestrip being further described as follows:

Beginning at the intersection of the centerline of USHighway 395 and the East-West centerline of the SouthwestQuarter of said Section 15 (said intersection beinglocated at US 395 Station 30+61.37, South 33º41'54" East,1,597.98 feet from a brass cap marking the West onequarter corner of said Section 15 ); thence along theEast-West centerline of the Southwest Quarter of saidSection 15, North 89º34'27" East, 466.11 feet to a 2 inchaluminum cap marking the Southeast corner of theNorthwest Quarter of the Southwest Quarter of saidSection 15; thence North 00º52'31" West, along theNorth-South centerline of the Southwest Quarter of saidSection 15 for a distance of 1338.68 feet to a 2 inchaluminum cap marking the Northeast corner of theNorthwest Quarter of the Southwest Quarter of saidSection 15; thence North 00º52'31" West along theNorth-South centerline of the Northwest Quarter of saidSection 15 for a distance of 840.02 feet to thecenterline of US Highway 730, and there terminating, saidpoint bears North 57º08'04" East, 1,570.82 feet from abrass cap marking the West one quarter corner of saidSection 15.

All being East of Willamette Meridian, Umatilla County,Oregon.

The sidelines of said 60.00-foot strip shall belengthened or shortened as to create a single contiguousstrip, terminating on the southerly right-of-way line of
