1 Declaration of Opening and Announcement of Visitors. The Shire President welcomed all in attendance and declared the meeting open at 6:00pm.

This Council meeting is being held on the traditional lands of the Ngadju people and I wish to acknowledge them as traditional owners and pay my respects to their elders, past and present. The Chief Executive Officer read aloud the disclaimer that is on the front page of the agenda. The Shire President read aloud the following Affirmation of Civic Duty and Responsibility.

The Shire President responded by reading aloud the Shire of Dundas Local Law No 1 Standing Orders section 9 Petitions. Bonnie Vicensoni: Can the petition be recalled? The Shire President advised that a petition would be recorded and filed as per the records management archives and disposal procedures. Bonnie Vicensoni: Why did the Shire President make the comment “pity I didn’t tell the truth” to a member of the public regarding my resignation? The Shire President responded that this is a private matter and she will speak to Bonnie after the Council Meeting. Darren Alley entered the chambers at 6:03pm.

The Shire President brought forward agenda items 12.2 – Resignation of Cr Vicensoni and 12.3 – Application for a Home Occupation Licence.

Background The Department of Lands has received a proposal from the Lessee, John Douglas Brady, to make amendments to the Lease’s area and purpose. The purpose is currently “Residence and Grazing” which expires in October 2027. Mr Brady has proposed to excise one-third portion (adjacent to Coolgardie Esperance Highway) of Lot 238. A new lease is to be issued over the excised portion for the purpose of “Fuel Depot”. Summary In order to maintain equity with other properties with similar land use, Council approval is required to commence a change to the method of rating to include Gross Rental Value (GRV) on predominantly used Unimproved Value (UV) land. Background Council Officers have undertaken a review process of the use and development of land currently valued as Unimproved that provides mining camp accommodations (including office, mess and ablutions). Where the land use has been recognised as mining camp accommodation, a consultation with Landgate was undertaken to determine the impacted change in the rating method to include GRV. The relevant resource company, Independence Group (IGO) was contacted in writing to inform them of the proposal to include a GRV method of rating and requested comments or objections. No submissions were received within 28 days’ time period. Financial Implications Based on the current 2016-17 GRV Mining rate in the dollar expected incremental rates payable on these mining tenements would be approximately $36,415.47 as indicated below.

Consultation CEO and Deputy CEO General Manager – Nova Mining Camp Comment By requesting to change the method of rating by split valuation to include GRV on a predominantly used UV land enables consistency with the rating of other mining camps within the Shire. The approximate area of the land is 7.5 hectares. Improvements on the land are accommodation, mess, office and ablutions. As indicated above, financial impact on these mining tenements would be approximately $36,415.47. Considering the scale of the operations of Nova, there is very little evidence to believe that, this change will materially impact them. However, if there had been any submission, the Shire could have considered phasing in the effect on the valuation change. Summary For the Council of the Shire of Dundas to consider and approve the awarding of the contract for the haulage of unscreened rock from OK mine site (on CNGC tenements) to Norseman Airstrip. Background Council have approved the commencement of phase 2 of the Airstrip Update project and the haulage of the rock from Higginsville to Norseman Airstrip by MLG OZ. Statutory Environment Local Government Purchasing Policy. Local Government (Functions and General) Regulations. Policy Implications Compliance with Policy F-3 Purchasing Policy Financial Implications The cost of haulage forms part of the budget prepared for this fully funded project. Strategic Implications The Shire’s Strategic Plan includes the upgrade of the Norseman Airstrip. Consultation Works Manager, CEO, Project Consultants, CNGC. Comment

Volume of the rock being hauled by MLG is significantly below the budgeted volume due to many factors beyond the control of the haulage contractor. Further, the issue has been aggravated to a greater extent with receiving of oversize rock from Higginsville. This resulted in Shire having to explore the possibility of sourcing rocks from CNGC since it is the only other mining company situated in close proximity to the Norseman Airstrip. CNGC has advised the Shire in writing that they will be able to supply approximately 100,000 tonnes of unscreened rock (approximately 35% of the total requirement) at nil cost to the Shire subject to the condition that rocks to be transported only through the trucks owned by CNGC. CNGC has proposed a haulage price of $2.80 plus GST per tonne. MLG charges $2.86 plus GST to transport material form Higginsville. However, MLG is in a unique position to backload rock on their return run to Mt Henry and hence MLG rate is not a direct comparable. The statement received from CNGC provides an acceptable exemption from the requirements of the Local Government Purchasing Policies (and those accepted by the Shire). The exemptions are as set out in Local Government (Functions and General) Regulations 1996 – Reg 11 (f). This document is included in Papers Relating. For the Council of the Shire of Dundas to consider and approve the draft agreement between the Shire of Dundas and Dr Rowlands regarding the provision of medical services. Background The Shire does not have a formal agreement with Dr Rowlands regarding benefits provided by the Shire nor the availability or extent of medical services provided by the doctor. Previously any agreement between Doctor and Shire existed as “gentleman’s agreement”. The document tabled is intended to fill that that gap. Statutory Environment Nil Policy Implications Nil Financial Implications The provision of benefits such as transport, accommodation, underwriting of Locums are addressed in the Shire’s budget process. Strategic Implications The recent survey of community expectations listed medical services as a priority. Consultation Dr Rowlands, Manager of Community Services, Community of Norseman. Comment As a regional - remote town it is essential that the Shire ensures that the region is well served with appropriate medical services and that every effort is made to retain such practitioners in the region. It should be noted that Dr Rowlands has certain specialised skills and experience which dictates that the Shire has to share his expertise with others in our region from time to time. Dr Rowlands has undertaken that at all times there will be suitable and appropriate medical assistance available, be it via the hospital, through a locum or himself, either in person or telephonically. Summary That the Council approve the differential rate model for public advertising and subsequent inclusion in the 2017/18 budget. Background Part of determining annual budgets is the setting of rates in the dollar that are then applied to the property valuations as supplied by the Valuer General. Rates in the dollar can be set in two ways. Firstly, they can be standard, resulting in a rate levy (rate in the dollar) within the Gross Rental Valuation and the Unimproved Valuation categories. Alternatively, they can be differential within each of the categories (UV & GRV), meaning different rate levies can be set for different types of property within one rate category. The Local Government Act 1995 determines that differential rates can be set according to:-

the purpose for which the land is zoned;

the predominant purpose for which the land is held or used;

whether or not the land is vacant; and

any prescribed characteristics.

The application of differential rating maintains the status quo in terms of equity in the rating of properties across the Shire, enabling the Council to provide facilities, infrastructure and services to the entire community and visitors.

Statutory Environment Section 6.33 of the Local Government Act 1995 and associated regulations prevail in this matter. Prior to finally adopting differential rates, the proposed rates need to be advertised for three weeks seeking public comment. Following the advertised period the Council is then to consider any responses received before adopting the final rates in the dollar along with the annual budget. The Council is not compelled to adopt the differential rates advertised or compelled to factor in any comments received; only to consider the comments prior to final adoption. Section 6.3 (3) of the Act requires that a differential rate of more than twice the lowest differential rate cannot be set without approval of the Minister (delegated to the Director General). Policy Implications N/A Financial Implications The setting of differential rates is an integral part of setting annual budgets. Rate income represents approximately 40% of the Shire of Dundas revenue. It is the only income stream over which Council has any direct control and it is imperative that for future sustainability rate income has an inflationary offset together with a component for capital replacement and/or expansion.

Strategic Implications For the Shire of Dundas to continue to meet the demands of the community and the increased responsibility to local government from the State, it is important that rates are set each year that allow for the increasing financial pressure upon the organisation. The benchmark that many local governments use to assess the overall increase in the cost of providing municipal services is the Local Government Cost Index (LGCI) as developed by WALGA and the CPI. However, these indices do not take in to consideration isolation factors, freight charges, availability of resources and many more unique for regional local governments. Currently LGCI is 1% and CPI stands at 0.6%. Consideration has been given rating levels of the similar shires (with significant mining activities) in the region in calculating proposed rates for 2017/18. In recent years the Council has made rating decisions that include the need to lessen the burden on the town site ratepayers and (more equitably) transfer the rate burden to the under-rated pastoral and mining sectors. With this trend in place there is a need to increase the rate in the dollar in order for the Shire to maintain its current service standards and achieve its financial viability. GRV – Roadhouses

The proposed rate reflects the cost of providing health inspection services, emergency services and other amenities. Most of these stations are generally located a large distance from the main service centre. However, the Shire has decided to charge the base rate by which properties within the town site are assessed. UV – Pastoral

In comparison to similar shires in the region, pastoral properties are severely underrated. The proposed increase will help the Shire to gradually minimise the large disparity between the Pastoral UV and the Mining UV to ensure fairness across these categories. UV – Mining / Exploration / Prospecting

The proposed rate mainly reflects the ongoing costs (increased cost) involved in maintaining the road network that services these land use as the Shire’s local authority boundaries extend all the way to the WA/SA state boundary.

The mining operations result in the Shire’s road network and infrastructure requiring continual ongoing maintenance and renewal work to service these users. The Shire acknowledges the fact that exploration, prospecting and mining have different levels of impact on the Shire’s road network. However, there remain the need to fund the maintenance and renewal requirement of this vital infrastructure asset for the benefit of all users.

In determining proposed rate in the dollar of these categories, consideration was given to the comparable rate in the dollar of the neighbouring shires (with significant mining operations) which provide similar services for mining activities. Even after this proposed increase in rate in the dollar, the Shire of Dundas remains as one of the shires with lowest UV rates for mining leases. Outstanding Rates

Shire has experienced a significant increase in outstanding rates due to dwindling population coupled with the economic downturn. Many vacant lands and rundown properties can be seen throughout the Norseman town site. Further, given the volatility of the mining sectors, it is difficult to predict the amount of the rates that will not be settled. Approximately, a write-off provision of $ 100,000 need to be considered for 2017/18 excluding the uncertainties around key mining tenements. Valuation Changes

The Shire has experienced a significant reduction in property valuations over the preceding years. The final amount raised from the rates may vary as a result of changes in valuations before rates notices are issued. However, the impact is expected to be minimal at this point of time.

Approval of the Minister

If the rate in the dollar determined by Council within a rating category (ie UV) has a differential of more than 2:1 then the approval of the Minister (delegated to the Director General) needs to be obtained before it can be implemented. This has been the case recent years and if the Council continues the philosophy of restructuring the rate burden as discussed above then it will also apply this year. Background Throughout the year, senior staff have sought comment and direction from the Council with regard to capital projects that could be included in future works programs. Comment was also received during the year from the Community on their needs/expectations of future capital projects.

Grant opportunities have also been examined throughout the year, and where practical, submissions have been forwarded for these projects. The outcome of these applications may not be known until closer to the date that the budget is adopted, but the projects been included within this report for information. When developing works programs, reference is also made to the Shire’s Integrated Planning documents which include the Strategic Community plan, Corporate Business plan and the Asset Management plan. These plans contain information on plant replacement, building maintenance, road construction, road resealing, footpath replacement works and any applicable resolutions of Council throughout the year. Statutory Environment Section 6.2 of the Local Government Act 1995 requires that a local government is to adopt a budget by 31st August unless otherwise extended by the Minister. Policy Implications Nil Financial Implications The budget will formulate the income and expenditure program for the Shire of Dundas for the next twelve months. Strategic Implications The budget that will be presented is consistent with the integrated Planning documents in that there will be a commitment to maintenance of Reserve Funds so as to meet the future demands upon the organisation for capital and infrastructure replacement. Reference to the Integrated Planning documents also encourage better long term financial planning, rather than a focus on an annual budget where only short term goals are considered. Summary To inform the Council of properties within the Shire of Dundas which currently have rates outstanding in excess of three full years and to consider application of the provisions of Section 6.64 of the Local Government Act 1995 to take possession and sell the properties. Background The Shire’s Rates Section every year makes a concerted effort in the collection of outstanding rates, utilising the provisions of the Local Government Act. Council has the authority, under the provisions of section 6.64 of the Local Government Act 1995, to take possession and sell land to recover rates which have been unpaid for a period of at least three years. While some of the ratepayers are excellent and some are making an effort to pay regular or semi-regular instalments, the small minority of ratepayers continue to avoid the issue of unpaid rates, necessitating the continuation of legal action. All of the properties on the schedule have either resisted all efforts by Staff, past and present, for various reasons to collect the outstanding debts or have made very small payments over the years. Most, if not all have proved to be unco-operative, and do not respond to any correspondence, leaving the Council no other alternative but to take the action authorised by the Local Government Act 1995. Summary For the Council of the Shire of Dundas to consider and approve the awarding of a contract to WML Consultants Pty Ltd for overseeing the completion of the construction works on the Norseman Airstrip. Background The Norseman Airstrip has moved into the construction phase and it is appropriate to appointment local expertise who are WALGA approved to see the project through to completion. Statutory Environment Nil Policy Implications The Shire’s purchasing policy is applicable, as the Consultants are based in Kalgoorlie. Financial Implications The project, which includes the fees of WML Consultants Pty Ltd, is fully funded. Strategic Implications

The appointment of WML Consultants Pty Ltd falls within the Shire’s purchasing policy. Consultation Shires of Menzies, Laverton and Leonora. Comment WML are based in Kalgoorlie making them ideally positioned to take the project through to completion. The CEO and DCEO have met with WML management and have followed up on references provided. The firm has worked extensively with Local Government as can be seen from the Consultations above. The added advantage is that both Tony Chisholm and Paul Foley (Senior Civil Engineer and Principal Geotechnical Engineer respectively) have both worked on airport pavements and are familiar with design and construction of pavements over salt lakes. Their proposal is attached. Summary For the Council of the Shire of Dundas to consider and approve or not approve the application for a Home Occupation licence. Background Mr and Mrs Ramsay have applied for a Home Occupation licence and wish to operate a “Tilt and Tow” service from their home in Goodliffe Street. Their intention is to erect a 600mm x 600mm Plate Sign at the southern boundary of the Old Post Office in Prinsep Street. The Shire has been assured that no car wrecks will be deposited at their home or at the Norseman tip. Mr and Mrs Ramsay have advised that such wrecks will only be deposited in designated areas as dictated by industry rules. Statutory Environment Shire of Dundas Town Planning Scheme No 2 Policy Implications Nil Financial Implications Nil Strategic Implications The Shire’s Corporate Development plan encourages the development of new business in Norseman. Consultation Shire President and Deputy President Comment By operating their business from 127 Goodliffe Street the Ramsay family will be complying with the requirements of the Town Planning Scheme No 2. There being no further business the Shire President thanked all those in attendance and declared the meeting closed at 6:30pm.

After the closure of the Council Meeting Darren Alley expressed his opinions to Councillors in relation to his concerns of the medical services provided by Dr Rowlands at the Norseman Hospital.
