Deputation to City of Charles Sturt Asset Management Committee —

3.37 Road Closure — Foot Thoroughfare between Kerr Grove and Allerdice Court, West Lakes

I represent my family, residents of 6 Allerdice Court of whom 2 are present tonight, being my father,

Peter Elberg and brother Damien Elberg. I also represent residents of 11 and 12 Kerr Grove.

The points that I wish to convey to the committee are:

1. With regards to liveability and place issues and the council's commitment to Build Healthy,

functional and attractive neighbourhoods.

a. The Walkway is anything but attractive. It is a weed covered rubbish dumping

ground for fisherpersons and anti-social elements.

b. It provides as a meeting point for unruly elements and a secluded position of

anonymity for reconnaissance of property and planning of escape routes from the

area

I. There have been many instances of stolen property being dumped there

after taking valuables... i.e. handbags, wallets etc.

c. The landscaped area mentioned in recommendation 3 has occupied the land since

building of the dwelling circa 1983 (some 30 years) . Constant dumping of rubbish

also occurs here, particularly at the corners of the property : i.e. Syringes, alcohol

bottles, fishing tackle, fast food waste

d. Whilst providing a shortcut during the day for recreational walkers, the walkway also

provides the same access after dark for less desirable elements using the Lochside

drive bridge as an escape from Delfin Island when conducting antisocial behaviour.

i. From the April 2014 Neighbourhood Watch newsletter, 57% of reported

crime on De[fin Island is in within close proximity to the Lochside Drive

Footbridge

e. The walkway provides unmonitored, covert access to the rear of the adjoining

properties.

2. Comments on the published agenda to tonight's meeting

a. Appendix F — Pedestrian Network

i. I draw to the attention of the members and staff the following points

1. Closure of the laneway in no way impedes the access to services or

public transport for any residents of the area as the most common

route to these is via powell court

2. Although the majority of pedestrian traffic through this area from

the Lochside Drive footbridge to Westfield Centre and associated

services is via Kerr Grove and Powell Court, neither of these streets

has a footpath or pedestrian network

3. Closure of the walkway and the suggested detour around the

proposed closure would be along what is a common pedestrian

route as per point 2

4. Recreational walkers may claim to be affected by the closure. We

pose that they would be in no way adversely affected as they would

merely be walking an extra few metres along an already busy and

accepted pedestrian route to rejoin the lakefront. Is it not the aim of

recreational walking to actually "walk"?

5. The existing pedestrian network is marked as being on Allerdice

Court and Fischer Place, both streets without footpaths on them

b. Appendix H — Consultation Area

i. We draw the members attention to the consultation area being only residents of Delfin Island serviced by Sir John Marks Drive and also reiterate

the points made in reference to Appendix F

3. In closing

a. Designed in a bygone era of social respect and inclusion, the walkway being

discussed is now an eyesore which has the main function of providing cover for

illegal activities which directly impacts the surrounding residents. We have used

various means to protect ourselves from this intrusion including allowing bushes to

overgrow preventing access via the landscaped area, however, council has

requested that we trim these bushes with which we intend to comply. Meanwhile,

however, we have been subjected to anonymous threatening letters from unknown

persons, merely adding to our frustration and apprehension. We ask that the chair

and members please consider our application favourably.

I have decided to retire after 43.5 years in SAPOL and have many a good memory of policing and friends I have met. I hopefully will share some of those memories at my last Watch. Today’s Situation The Laneway is unkept with weeds and large overhanging

trees but wide and very useful to residents walking around

the lake.

When using the laneway there is trouble seeing around the

corner because of the big trees that have been left to grow

over the path. This may have been the cause of people being

able to be secluded and out of sight.

This area is council responsibility as it is classified as foot

thoroughfare in the report by the transport Engineer (page

6/7 in the Executive Summary). The trees planted by the

resident (but not maintained) continue to impinge on the

walkway. This must be rectified.

Today’s Situation There HAVE been major improvements

with the NO FISHING signage and since the complaint in December 2013 and after the upgrade there have been no apparent incidents, therefore there is NO need to close the lane.

Today’s Situation

I would suggest that 95% of fishermen actually park in Fisher Place as this provides the largest area for fishing and the fishermen can at all times see their cars and go back and forth for supplies.

There is no reason for the fishermen to park their car’s out of sight down the laneway on Kerr Grove when they can see it at all times.

In Appendix D there is a letter from Chris Bentick,

Transport Engineer (at the Charles Sturt Council

dated 14.8.12) to the resident.

In this letter the resident was told that his

application to purchase the land was not granted as “it provides an important pedestrian link” and

“maintaining the existing walkway access

arrangements at Kerr Grove cul-de-sac is in the

interests of the wider community”.

What’s changed since this statement? Absolutely

NOTHING! This DECISION should STAND.

Area 1 – (refer 1 & 2 on map) The resident is concerned about

inadequate lighting and 3 pieces of rubbish in the lane. Both these issues can be easily rectified rather than closing a well used laneway.

In Answer to the complaint by the

resident Area 2 – (refer 3-9 on the map)

The issue here is the rubbish left by the fishermen and

in one case trespass on private property.

Council have recently put blue bins in both parks at

the end of Allerdice Court and Fisher Place. This

does help with rubbish control. These photos are

undated but as this complaint is dated December

2013 is definitely before the bins were positioned.

The bin at Allerdice was approximately done 3

months ago and the one at Fisher Place about 1

month ago. The council have also put large yellow NO

FISHING lines in front of this property which clearly

tells the fishermen that they are not allowed to fish

there.

In Answer to the complaint by the

resident Area 2 – (continued) Regarding location 9 of the man who sat

on the steps of the residence. The answer is to call the police and get him moved on.

The complaint also talks about privacy issues on an outdoor dining area. There is no expectation of privacy when you live on a lake irrespective of whether you have private lake frontage or not.

Recommendation 3

Remove all trees on the corner of the laneway and in front of the property or at least cut them back so that walkers can again use the proper path along the lake.

It will also provide no coverage for the

fishermen, although it is now a NO FISHING AREA.

Recommendation 4 This issue is going to public consultation and

I have seen the map of public consultation area. It seems to assume that the closure of the laneway only affects the people who live around the laneway.

You need to realise that many people come from a large area on both sides of the lake.

You have totally discounted these people and I implore you to open up public consultation to these residents also.

Summary

Closing the laneway will only increase the value of the residents house while devaluing the properties behind the lake who now will not have direct access.

This laneway is an important walkway for health conscious walkers. You will need to divert these walkers with dogs and children to walk around on the roads which have no public paths! This will lead to a dangerous situation for walkers.

The fishermen were the problem not the laneway, so don’t disadvantage the many walkers who do the right thing for the few who do not!

I believe that this complaint is all about getting private lake frontage for one resident and less about the laneway issues.

The NO FISHING paintwork has only been installed within the past few months we need to give it some time to allow this approach to work. At the moment it appears to be working well.

Brief

This report seeks a decision by Council to commence the process under the Roads (Opening and Closing) Act 1991 to close a Foot Thoroughfare (walkway) that runs between Kerr Grove to the lake edge and then along the lake edge to the reserve being 7 Allerdice Court in West Lakes and sell it to the Registered Proprietors of 6 Allerdice Court and 11 and 12 Kerr Grove.

Motion

1. That Council note the submission from a Registered Proprietor of 6 Allerdice Court contained in Appendix E, requesting the closure of the Foot Thoroughfare.

2. That Council note the advice of Council’s Land Acquisition Group, summarised in the letter in Appendix D, recommending retention of the Foot Thoroughfare.

3. That Council agree to undertake consultation in relation to the proposal to close and sell the portion of the foot thoroughfare as marked by red hatching in Appendix A.

4. That the consultation area be not less than a 300 metre radius from the site and include a notice in the Weekly Messenger column and signage on site inviting comment.

5. That a site survey be undertaken to ascertain the extent of the encroachment.

6. That a report be brought back to the August meeting of the Asset Management Committee.

Motion

1. That Council note 3-crashes were reported at the intersection of Ryan Avenue and Rosemary Street over the 5-year period to December 2011 and that the 85 percentile speed of vehicles in Ryan Avenue is 52.5km/h, even though the posted speed limit is 40km/h.

2. That Council note resident consultation returned a low 15% response rate, with 63% of all respondents supporting the installation of the roundabout.

3. That Council note that two (50%) of the affected (corner) property owners support the installation and two (50%) oppose installation.

4. That, due to poor road safety conditions and the benefits that will be realised by the local community, the roundabout installation proceeds.

5. That the persons within the consultation area be advised of this decision.
