Moses D. Wogbeb Sr. and the People of Tecmor Chietuom, DistrictNumber One, Grand Bassa County, hereinafter referred to as Sallouyou. S e c t i o ~represented by Sarah P.     W I T N E S S E T H:

    \VHEREAS, the Authority is statutorily responsible for the sustainable management anduse of all categories of forest resources;

    WHEREAS, the Citizens o f Sallouyou Section, District Number One above described,are legitimate and bonafide owners of an aggregated land mass of 13,437 acres/5,438hectares of forested land by virtue of inheritance through a legitimate pure-hase from theRepublic of Liberia;

    WHEREAS, by virtue of Section 5.6 (d) (i) of the National Forestry Reform Law(NFRL) of 200

    WHEREAS, validation o f the area in keeping with Section 5.6 (d) (il) o f the NFRL andSection 61 of FD A Regulation 102-07 shows that the said tract of land "ISu n - e n ~ m b e r e dand does not overlap with any forestry designated land use. Said validation report ishereto attached and marked Exhibit "D " forming also an integral part of this contract;

    WHEREAS, Sallouyou Section is desirous. of commercializing harvestable tree specieson the said accumulative tract of 13,437 acres! 5,438 hectares o n a n d ~

    \ V H E R E A ~the Authority having examined Sallouyou's application and therequirements o f Section 5,6 o f the NFRL having been met, declares SaliQuyou qualifiedfor the issuance of a Private Use Permit that wiJl aHow It enter into contractual agreementwith any company or CQrporation to carry out said commercial act1"vities; and

    NOW. l l IEREl tORE, for and in consideration of the mutual promises and agreementsherein contained, th e parties do hereby agree a s follows:

    1. Defirutions

    a. Authority: The Forestry Development Authority (FDA) created by an Acto f the Legig!atureon November 1,1976.

    b. Annual Operations Plan: th e plan that guides the annual operations of theHolder

    c. Chain o f Custody: the path o f custodianship followed by logs, Timber andwood products through harvesting, transport, interim storage, prot'eSsing,distribution and export ~ o msource of origin in the forest to end use.

    d. Code of Forest Harvesting Practices: a set of standards forenvironmentally sound forest use prepared by th e Authority

    e. Conservation: th e sustainable management and protection of forestresources to achieve maximum environmental, social, economic an dscientific benefits for present and future generations,

    f Forestry: the science, art and practice of conservation of forest resources

    g. forest Resources License: any legal instrument pursuant to which th e

    Authority allows a person, subject to specified conditions, to extractforest resources or make other productive and sustainable use of forestland. This includes Forest management Contracts, Timber Sale Contracts,Forest Use Permit and Private Use Permit.

    h, Forestland: a tract o f land, including its flora and fauna capable ofproducing furest resources, or land set aside for the purpose of forestry,but not including land in permanent settlements and land that has been inlong term use for non-shifting cultivation of crops or raising livestock.

    L Forest Product: any material or item derived f rom furest resources.

    J. Forest :Management Contract: forestry contract which covers a land area of50,000 - 400,000 hectares,

    k Holder: a person who holds a valid forest resources license

    L Land Owner: a person who owns land by legal title

    m. Operator: a person harvesting or making commercial use of forestresources under a furest resources license, including a person working asan employee, contractor or other agent for a Holder.

    n. Pre-Felling Operations: Jegal requirements of th e Holder before feHing oflogs. They include posting of required performance bond; preparation ofinitial annual operations plan and preparation of environmental impactassessment_

    O. Private Use Permit' a forest resource license jssued by the Government toaUcrw commercial use of the forest resources on private land"

    p_ Public Cse Permit: a forest resource license issued to extract forestresource from an area less than 1000 hectares

    q. Reforestation: the establishment of a tree plantation in a previouslyforested area that has been amcted by cutting. fire, or some other at.'t oftree removal.

    L Societe Generale de SurveiHance {SGS): the institution/companyresponsible to manage the Chain of Custody System.

    s. Timber Sale Contrylct: a short tenn forest resources license issued by theGovernment for a period of three (3) years that allows a person to harvesttimber from a specified tract of forest land.

    4. Contract Objective

    d. To create employment for about 250 locals of the contract area andsurrounding towns and villages.

    5 Contract Duration

    The contract shall be for three (3 ) e a r s ~

    6 Chain of Custody System

    In keeping with Section 135 of the National Forestry Reform Law 0[2006 andsections (1-35) of FDA Regulation 108-07, th e Chain o f Custody System willapply during the life and implementation o f this contract. The system soestablished for the tracking of togs, timber and wood products from forest toprocessing and then 10 domestic or foreign market shaH be managed by SocieteGenerale de Surveillance (SGS) using SGSlHelveta equipment and software asprovided for by section 3.2 (3) of the Chain of Custody System ManagementContract of 2007.

    7. Land Rental & Stumpage Ta x

    Consistent with Section S.7(b) o f th e National Forestry Reform Law of2006, theCompany shall no t be charged to pay land rental tax. However, stumpage shall bepaid consistent with Section 5.7 (c) of th e National Forestry Reform La w and alsoconsistent with Section 22(b) o f Regulation 107-07.

    All other fees and (,JOL Taxes levied on the project shall be consistent with theRevenue La w o f Liberia and FD A RegulatioIl"

    9 Pre-femng Date

    Termination

    This contract shan be tenninated i f the company upon notice of breach of an yterm of this Contract fails to remedy said breach within a period of (60) sixtydays,

    In the event of force majeure, which causes either party from meeting itsobligations herein stated. th e Contract shall be suspended as long as the forcemajeure continues.

    10. Duty of Care

    The Authority shaH ensure that the Company maintains environmental quality ofthe cutting area and comply v,dth an other conditions consistent with the LiberiaCode of Harvesting Practices to include:

    a. Water course protection b, Erosion pre'vention c. Prevention of poHution to rivers, streams and other waterways by disposal of

    wastesd. Prevention of fire disaster

    The operation shaH also be in conformity with international conventions to whichLiberia is a party. They include: th e Convention on Biodiversity, the InternationalTropkal Timber Agreement, the United Nation Framework Convention on ClimateChange, the United Nations Convention to Combat Desertification, the Conventionon International Trade in Endangered Species and the RAMSAR Convention on

    Background

    Predicated on a written communication dated June 13, 2011 from ~ M r s .Sarah Miller,

    requesting the Forestry Development Authority to authenticale, verifY and issue PrivateUse Permit in order to carry out commercial logging in ber private deeded land. A teamof technicians from the FDA, blended with the Contract Administrator was mandated byManaging Director Moses n Wogben, Sf. to visit the area for detail ground truthing aodauthentication of the area for Management' s reaction.

    Field, Patrol

    During the period June 15-21, the jOint team patroned a significant portion of the areaand gathered detail information relating to on going multipJe uses of the area, types ofvegetation and livelihood of community dwellers within the parameters of the forests.

    The GIS officer, Assistant Chief Surveyor and the Contract Administrator handled allTechnical issues rdating to the deed location, boundaries and commencement/startingpoints,

    Findings

    Following an intensive tour by th e three (3) men w e observed and authenticated that:

    "> Indeed th e Sarah Miller's property truly lies within Grand Bassa County.* The area doesn 7 t overlap with any o f the Forest Management Contracts, Protectedand Proposed Protected Areas.

    & Teclmically Sarah MiIler?g property deed description and total land mass is13,437.3 acres.

    v4> Large portion o f all the areas as described in th e deeds consists o f primary forestsand species except those areas near the road side consists of mangrove swamps.*"The area is the borne of some un-protected v.rildlife animals species

    aj) Large portion o f all the areas are suitable for harvesting (commcrciallogging)_>!> Topographically, the entire land mass of deeds submitted to FDA is relatively flat

    with few v.!ater ways,I' The entire community proves that the deed is family deed, and that the

    community has no problem with FDA granting pennisslon to their sister toconduct logging,

    Recommsndation

    In view o f the verification and confmnation o f these documents by the ForestryDevelopment Authority, coupled with our ground truthing (June 15-21), we hereinrecommend that:

    '" That the deed be forwarded to th e Ministry of Lands, Mines & Surveys,especially the Director o f Cartography for authentication. After authenticatingthe deed and found legitimate, the FDA should perform th e below activities

    '" As per National ForeslIy Reform Law (NrRL) of 2006 provision in chapterfive section 5 6, we therefore recommend that FD A Management issue aPrivate Use Permit for Land totaling 5,438 hecto.res to th e people of GrandBassa Coumy, particularly Sallouyou Section in compliance with all relevantrequirements o f this section (particularly section 5.6 c O,ii,iii) and d( i ) i , i i ~ i v , v , v i )respectively.
