1.1Executive Summary The Ministry of Road, Transport and Highway (MoRT&H), Government of India had entrusted
National Highways Authority of India with the task of implementing of Golden Quadrilateral
project. The National Highway Authority of India is engaged in the development of highways
and as part of this endeavor, the authority has decided to undertake development of six laning
of Delhi-Agra section of NH-2 from km. 20.500 to km. 200.00 through private participation on
built operate and transfer basis.
Delhi-Agra section of National Highway no. 2 is a part of Golden Quadrilateral connecting
cities of Delhi and Kolkata. This portion of NH-2 also provides connectivity to East-West
corridor and North-South corridor of NHDP. This stretch from Delhi to Agra of NH-2 comes
under NHDP Phase- V.
The authority has awarded this project to M/s Reliance Infrastructure Limited on DBFOT
basis. M/s Reliance Infrastructure Limited has since promoted and incorporated the
concessionaire as a limited liability company under the company’s Act 1956 and has
requested the authority to accept the Concessionaire (M/s. DA Toll Road Pvt. Ltd.) as the
entity which shall under take & perform the obligations and exercise the right of the selected
bidder.
The Concessionaire has appointed M/s. Reliance Utility Engineers Pvt. Ltd. as EPC Contractor
The Concessionaire has divided the work of entire project in 2 packages (Haryana Package &
UP Package) and appointed EPC Contractor M/s Reliance Utility Engineers PvtLTd, who in
turn has appointed M/s. L&T Limited as Sub-Contractor and L& T has further engaged M/s
Feedback ventures Pvt Ltd & SAI Consulting Pvt Ltd as their design consultant for UP and Haryana
respectively
This monthly progress report covers project highlights, progress of work and includes the
“Independent Engineers monthly inspection report” on the highway project as per clause 13.2
of Concession Agreement on the works executed in the month of May- 2014
Description of the Project Road
The project road starts from Km 20+500 of NH-2 and ends at Km 200+000 of NH-2, thus
making a total length of 179.5 km. The project road lies in State of Haryana and Uttar Pradesh,
starts from Badarpur Delhi Border (Km 20.500) and passes through Faridabad industrial area,
Ballabgarh, Palwal, Hodal, Kosi, Mathura and ends at Agra (Km.200.00). The project road lies
between latitudes of 28o28’18” and 27o12’22.7” north and longitudes of 77o18’20.65’’ and
78o01’53” east.

1.3 CONSULTANT’S SCOPE OF WORK
1.3.1 Drawings, Documents and Safety Report received by the Independent Engineer for its review and
commenting upon during the Construction Period.
1.3.2 The Independent Engineer shall review the monthly progress report furnished by the
Concessionaire and send its comments thereon to the Authority and the Concessionaire within 7
(seven) days of receipt of such report.
1.3.3 The Independent Engineer shall inspect the Construction Works and the Project Highway once
every month, preferably after receipt of the monthly progress report from the Concessionaire, but
before the 20th (twentieth) day of each month in any case, and make out a report of such
inspection (the “Inspection Report”) setting forth and overview of the status, progress, quality
and safety of construction, including the work methodology adopted, the materials used and their
sources, and conformity of Construction Works with the Scope of the Project and the
Specifications and Standards. In a separate section of the Inspection Report, the Independent
Engineer shall describe in reasonable detail the lapses, defects or deficiencies observed by it in
the construction of Project Highways .The Inspection Report shall also contain a review of the
maintenance of the existing lanes in conformity with the provisions of the Agreement. The
Independent Engineer shall send a copy of its Inspection Report to the Authority and the
Concessionaire within 7 (seven) days of the inspection.
1.3.4 The Independent Engineer may inspect the Project Highway more than once in a month if any
lapses, defects or deficiencies require such inspections.
1.3.5 For determining that the Construction Works conform to Specifications and Standards, the
Independent Engineer shall require the Concessionaire to carry out, or cause to be carried out,
tests on a sample basis, to be specified by the Independent Engineer in accordance with Good
Industry Practice for quality assurance. For purposes of this Paragraph, the tests specified in the
IRC Special Publication-11 (Handbook of Quality Control for Construction of Roads and
Runways) and the Specifications for Road and Bridge Works issued by MoRT&H (the “Quality
Control Manuals”) or any modification/substitution thereof shall be deemed to be tests
conforming to Good Industry Practice for quality assurance. The Independent Engineer shall
issue necessary directions to the Concessionaire for ensuring that the tests are conducted in a fair
and efficient manner, and shall monitor and review the results thereof.
1.3.6 The sample size of the tests, to be specified by the Independent Engineer under Paragraph 1.3.5,
shall comprise 10% (ten per cent) of the quantity or number of tests prescribed for each category
or type of tests in the Quality Control Manuals; provided that the Independent Engineer may, for

reasons to be recorded in writing, increase the aforesaid sample size by up to 10% (ten percent)
for certain categories or types of tests.
1.3.7 The timing of tests referred to in Paragraph 1.3.5, and the criteria for acceptance/ rejection of
their results shall be determined by the Independent Engineer in accordance with the Quality
Control Manuals. The tests shall be undertaken on a random sample basis and shall be in addition
to, and independent of, the tests that may be carried out by the Concessionaire for its own quality
assurance in accordance with Good Industry Practice.
1.3.8 In the event that the Concessionaire carries out any remedial works for removal or rectification of
any defects or deficiencies, the Independent Engineer shall require the Concessionaire to carry
out, or cause to be carried out, tests to determine that such remedial works have brought the
Construction Works into conformity with the Specifications and Standards, and the provisions of
this Paragraph 1.3.5 shall apply to such.
1.3.9 In the event that the Concessionaire fails to achieve any of the Project Milestones, the
Independent Engineer shall undertake a review of the progress of construction and identify
potential delays, if any. If the Independent Engineer shall determine that completion of the
Project Highway is not feasible within the time specified in the Agreement, it shall require the
Concessionaire to indicate within 15 (fifteen) days the steps proposed to be taken to expedite
progress, and the period within which the Project Completion Date shall be achieved. Upon
receipt of a report from the Concessionaire, the Independent Engineer shall review the same and
send its comments to the Authority and the Concessionaire forthwith.
1.3.10 If at any time during the Construction Period, the Independent Engineer determines that the
Concessionaire has not made adequate arrangements for the safety of workers and Users in the
zone of construction or that any work is being carried out in a manner that threatens the safety of
the workers and the Users, it shall make a recommendation to the Authority forthwith,
identifying the whole or part of the Construction Works that should be suspended for ensuring
safety in respect thereof.
1.3.11 In the event that the Concessionaire carries out any remedial measures to secure the safety of
suspended works and Users, it may, by notice in writing, require the Independent Engineer to
inspect such works, and within 3 (three) days of receiving such notice, the Independent Engineer
shall inspect the suspended works and make a report to the Authority forthwith, recommending
whether or not such suspension may be revoked by the Authority.
1.3.12 if suspension of Construction Works is for reasons not attributable to the Concessionaire, the
Independent Engineer shall determine the extension of dates set forth in the Project Completion

Schedule, to which the Concessionaire is reasonably entitled, and shall notify the Authority and
the Concessionaire of the same.
1.3.13 The Independent Engineer shall carry out, or cause to be carried out, all the Tests specified in
Schedule-I and issue a Completion Certificate or Provisional Certificate, as the case may be. For
carrying out its functions under this Paragraph 1.3.13 and all matters incidental thereto, the
Independent Engineer shall act under and in accordance with the provisions of Article 14 and
Schedule-I.
1.3.14 upon reference from the Authority, the Independent Engineer shall make a fair and reasonable
assessment of the costs of providing information, works and services as set forth in Article 16
and certify the reasonableness of such costs for payment by the Authority to the Concessionaire.
1.3.15 The Independent Engineer shall aid and advise the Concessionaire in preparing the Maintenance
Manual.

2.15 Change of Scope (COS) : Seprate Chapter 21 2.16 Project Mile Stones
2.16.1 Project Mile Stone I – The Concessionaire shall commence the construction of
project highway and spend not less than 10% (Ten Percent) of the total contract
cost. This shall occur on the 255th (Two Hundred Fifty Fifth) day from the
appointed date. (From 16-10.2012 to27.06.2013)
First Mile stone has been lapased on 27.06.2013 and progress achivment by
that time was almost NIL. The Project Director NHAI has issused a show cause
notice under clause 12.4.2 of CA vide letter No NHAI/CMU/MTR/6-
laning/2013/D-3
2686 dated 25.06.2013.Subsequently the engineer has recommended to
Authrity vide letter no. dated 15.11.2013 to invoke the prvision in clause
12.4.2 of the Concession Agreement. No decision has yet been taken by the
Authority ion the recommendation of Independent Engineer, however, the
Concessionaire vide his letter dated 27.11.2013 has submitted an EOT
application for extending Mile Stone-I from 27.06.2013 to 25.06.2014, How
Independent Engineer Vide ets letter no. URSSWI/PMG/Highways/N-1852/06
dated 08.01.2014 has recommended the deferment of mile-stone-I up to
26.03.2014, which is under consideration. The Mile stone-I has not been
achieved sofar.
2.16.2 Project Mile Stone II – The Concessionaire shall commence the construction of the
project highway and should not spend less than 35% (Thirty Five percent) of the
total contract cost. This shall occur on the 510th (Five Hundred and Tenth) day
from the appointed date.(From 16-10.2012 to 09.03.2014)
2.16.3 Project Mile Stone III – This shall occur on the date of falling on the 770th (Seven
Hundred and Seventeenth) day from the appointed date. Prior to the occurrence of
the project mile stone III, the Concessionaire shall have commenced and expended
not less than 70% (Seventy Percent) of the total capital cost set forth in the financial
package.(From 16-10.2012 to 24.11.2014)
2.16.4 Concession period 26 years (Including the construction period
of 912 days from the appointed date to completion date 15.04.2015

3.0 Organization
3.1 Authority:-
The terms of the Concession Agreement, Authority is the National Highways Authority of India
(NHAI) established under the National Highways Authority Act, 1988. Corridor Management
Unit, Mathura is headed by Project Director.
3.2 Independent Engineer
The Contract was signed on 08th October 2012 between URS Scott Wilson India Pvt. Ltd. –
Rodic Consultants (JV) and the Authority, to provide Independent Engineer (IE) services of the
projects. The IE Staff has mobilized as per requirement. All key staff members have been
mobilized. Part time / Intermittent staff is visiting site as and when required, apart from
reviewing design, drawing and submittals from main / satellite offices. The organization chart is
enclosed.
3.3 Concessionaire
M/s. DA Toll Road Pvt. Ltd., a Special Purpose Vehicle (SPV) provided by Reliance Infrastructure
has been awarded the Design, Construction, Finance, Operation and Maintenance of six laning
of Delhi – Agra Section of NH-2 starting from Km 20+500 to Km 200+000 in the State of
Haryana and Uttar Pradesh to be executed as per BOT (Toll) on DBFOT Pattern under NHDP
Phase-V.
M/s. DA Toll Road Pvt. Ltd. having its main office at Sector-11B, Faridabad” is responsible for
day to day activities conducted by EPC Contractors and also provides information to IE as and
when necessary.
3.5 EPC Agencies –
The Concessionaire has appointed M/s. Reliance Utility Engineers Pvt. Ltd. as EPC Contractor.
3.5 Sub-Contractor–
The EPC Contractor M/s Reliance Utility Engineers Pvt Ltd has divided the work of entire
project in 2 packages (Haryana Package & UP Package) and appointed M/s. L&T Limited as Sub-
Contractor and L& T has further engaged M/s Feedback ventures Pvt Ltd& SAI Consulting Pvt
Ltd as their design consultantfor UP and Haryana respectively.
3.6 PMC –PMC has not been appointed till date; concessionaire is proposing to do PMC at the own
level (ACTION TO BE TAKEN IF PMC NOT APPOINTED)

Elevated Highway at Sikandara 190+660 to 192+100 4 Lane Viaduct Widening of project highway in place of
construction of elevated corridor at Sikandara.The effect of reduction in the scope of project will be assessed as
per Clause 16.6 of the concession agreement vide NHAI letter no. NHAI/NHDP-V/MC-
II/Concessionaire/04/39678 dated 24.05.2013.
As per Clause no. 2.11 of Concession Agreement (Planing Drawings) but not yet submitted by the Concessionaire. The entire Project depicting all features as specified in schedule-B as well as the project facilities specified in schedule-C, clearly indicating the existing features and proposed improvement plan in accordance to clause 2.11 of Manual of Specification & Standards (schedule-D).

7.1 CONCESSIONARE SCOPE OF WORK
7.1.1 Construction of Six Laning
Construction of Sixlaning, Delhi-Agra section of National Highway no. 2 in the state of Haryana and Uttar
Pradesh from km. 20.500 to km. 200.000 (length 179.500 km) to be executed as BOT (Toll) on DBFOT pattern
under NHDP phase-V as specified in schedule B together with provision of Project Facilities in specified in
Schedule – C and in conformity with the specifications and standards set forth in Manual of specification &
Standards for six laning in Schedule-D.
7.1.2 Scope of works for O&M
As per concessionaire view Clause 12.2 is operative , the concessionaire shall maintain, at its cost, the existing
lane(s) of the project Highway so that the traffic worthiness and safety thereof are at no time materially inferior
as compared to their condition 7(seven) days prior to the date of this agreement, and shall undertake the
necessary repair and maintenance works for this purpose; provided that the concessionaire may, at it cost,
interrupt and divert the flow of traffic if such interruption and diversion is necessary for the efficient progress
of construction works and conforms to good industry practice; provided further that such interruption and
diversion shall be undertaken by the concessionaire only with the prior written approval of the independent
engineer which approval shall not be unreasonably withheld . For the avoidance of doubt, it is agreed that the
concessionaire shall at all times be responsible for ensuring safe operation of the project Highway.
Applicability of Schedule-K (Details in Page No- 58 to 59)
As per view of Project Director & IE that during the construction period of
widening of existing four lane to six lane highway, all the requirement of
schedule-K (annexure-I) except the roughness criteria are applicable.
a. Routine Maintenance of Highway:-
Repair of Local pot holes / patch work, as per MoRT&H Specifications.
Crack Sealing
o Cracks less than 3mm width
o Cracks wider than 3 mm
Road Sign Maintenance. Road Marking, Guard Rail / Crash Barrier Maintenance and replacing it with new
members including fixing. Dismantling of existing damaged fencing and repair/replacement of damaged
fencing including fixing. Cleaning of litter & debris from carriageway and ROW. Maintenance of Earthen
Shoulder & Slopes. Drain Cleaning as per frequencies mentioned in the Quotation Notice. Repairing of the
damaged sections of the drains.Dismantling of Structures & pavement including its replenishment / repair.
Repair to Brick Masonry. Cement Plaster. Cement Concrete of Specified Mix. Painting of the Kerb stones
Supply and fixing of 25mm thick precast cement concrete chequered tiles as per MoRT&H specifications.
Maintenance and repair of damaged road kerbs. Painting / distempering / providing snowcem coat on the
doors & windows, walls of Toll Plaza Buildings.

b. Routine Maintenance of Horticulture :- The concessionaire shall ensure the conservation of all trees, shrubs and similar vegetation, in the median and
the right of way. The concessionaire shall take adequate and appropriate measures, during the various seasons, to
ensure the survival of the vegetation. Grass cutting shall include the cutting of planted or natural grasses by
means of mechanical mowers or by hand, along the main carriageway and in the median. The concessionaire
shall hoe around trees and shrubs within the road reserve before the grass is cut and shall take care not to
damage or disturb the roots of these trees and shrubs during hoeing or grass cutting. Light hoeing shall be done
around designated newly planted and young trees and shrubs to protect them from fire and from being smothered
by weeds.
Maintenance of existing shrubs / plants in medians including watering, supplying and spreading farm yard
manure, trimming, replacement of casualties of similar age, providing and spraying insecticides. Sprinkling of
water in the median, cutting of grass in the median, trimming & cutting of median plants, cleaning of median,
preparation and cleaning of basin for holding water etc. as per detailed specification mentioned in attached
technical specification and terms and conditions for routine maintenance of horticulture under heading Schedule
of Operation as per attached activities required for maintenance of median plantation.
Trimming and cutting of trees in the median and ROW to remove obstructing branches from passengers vision
as directed by the Engineer
Work will be executed as per Horticulture Strategy in addition to the specifications indicated in maintenance
manual.
The concessionaire is required to provide 24 hrs per day route patrols to assist the road users of the highway, to
provide information, feedback and perform functions in relations to incident management. To achieve this, the
Patrol vehicles should be fully equipped as well as the patrol persons should be adequately trained in traffic
management, road safety and primary first aid. The purpose of route patrol is to:
Provide the users of the highway with basic mechanical help for vehicles that break down on the National
Highway Section, and protect other motorists from such vehicles.
Immediately identify traffic hazards of whatever nature, such as unauthorized parking, public transport
vehicles obstructing traffic during passenger loading and unloading, debris, stray animals and the like.
The Contractor shall take the necessary measures to remove such obstructions.
Provide emergency management at accident scenes until such time as the appropriate authorities arrive,
Assist with the removal of damaged or mechanically impaired vehicles from the highway,
Provide road user information and to further the image of the National Highway Section in a professional
and friendly manner.
Maintain daily records of assistance provided to motorists.
Concessionaire will remove dead animals/birds from the project roads and bury them at a suitable location
as directed by the Engineer/Employer within two hour of the incident. It will be treated as incidental to
contractual obligations.
Observe, record and report suspect aspects of the highway, hazards and incidental damage caused by
vehicles, floods, storms, or other random events, such that the highway maintenance records and data base
are continuously improved.

8.4 Central Casting Yard
The concessionaire is to set up a Central Casting Yard at Km-82 (LHS)
8.5 Operation & Maintenance works
The O & M works are not being carried out properly. The riding quality improvement is
pending at many places, especially at the urban areas of Ballabhgarg, Palwal, Kosikalan,
Mathura and Agra.
(Pavement Markings):- There reflectivity is required to maintain and repainting to be done at wear
out locations.
(Traffic Signs):- All the traffic signs such as informative, caution, warning and overhead gantry signs
are not maintained, at present many location Traffic signs are tilted and damaged conditions, There
is required to maintain constantly of traffic signs on routine basis Repairs/ replacement of signs
damaged due to accidents .
(Distance Stones):- KM Stone , 5th Km Stone etcand damaged and tallied condition, it is required to
maintained for Repairs/ replacement of stones damaged due to accidents.
Railing/Fencing/Crash Barrier: -These are the protection measures taken and provided at high
embankments, ROW protection and on culverts & bridges. These are maintained for theft of barbed
wire fencing erected for protection of row Theft of metal crash barrier Railing/ Crash barrier
damaged due to accidents.
Drainage Works: - It consists of drains provided in median, at edge of main carriageway, at ROW
and on side slopes. The special maintenance drive is taken up before and after the monsoon for
maintenance of all drainage works, such as Cleaning side drains provided at ROW and open pitched
drain provided between main road & service road cleaning of sumps & pipe incase of curves Cleaning
of drainage chutes and its inlet in case of high embankments Repairs of drains. These are not
maintained regularly on the basis of frequency as per themaintenance manual.
Patches/Pot holes/Crack: - Existence of patches, pot holes makes the journey uncomfortable and
sometimes makes the road accidents prone.
The Concessionaire’s maintenance programme for the year 2012-13 is still pending.
The toll plaza are to be kept in proper conditions like in cleanliness, illumination etc, at many areas
repairing is required, like the toll booths etc.

Dedicated team to cater the needs of O&M requirements must be re-constituted by the Concessionaire
on top priority basis.
Pavement cleaning work is not carried out properly, only a few labours deployed which are not at all
sufficient, observing the huge amount of garbage and debris seen lying on Ballabhgarh, Palwal,
Kosikalan, Mathura & Agra and at many other locations etc.
Safety issues are not properly attended at the maintenance works.
8.6 SAFETY ISSUES
Ongoing maintenance activities are not fully in compliance with stipulated safety requirements as
discussed in IRC: SP-55 and Schedule L of Concession Agreement. Concessionaire has been advised
that all excavation activities adjacent to the travel lanes shall be protected with effective barricades
and traffic control devices to warn motorists and pedestrians. Also maintenance activities on
carriageway are being conducted in a haphazard way without proper barricading on carriageway, thus
compromising the safety of workers and motorist as well. No night work to be carried out without
Independent Engineer approval.
8.7TOLL PLAZA
There are two toll plazas on the entire project highway.
At km. 74.00 – Srinagar toll plaza
At km. 164.00 – Mahuvan toll plaza
After development to 6-lane, one more toll plaza in KM 46.00 will be constructed and toll plaza in Km
74.00 shall be shifted in Km 94.00.
The Concessionaire had started collecting toll fee from the appointed date as per the Concession
Agreement provision and required staff for collecting toll and guards, marshals to regulate the
traffic/control the leakage and to record the collections and for the management of the toll plazas.
The toll plazas are not being maintained properly. The cleaning and housekeeping is to be improved.
8.8 Independent Engineer Inspections
Monthly Inspection reports are appended under chapter 16. Independent Engineer is conducting
inspection as per Concession Agreement Article 13.2. Independent Engineer issued letter regarding
poor performance of O&M works and other related issues vide
Independent Engineer letter no. URS-RODIC/FBD/DATR/14/418 dated 23.05.2014.

8.9Independent Engineer Final Observations
In spite of so many reminders, the concessionaire has not yet submitted programme of works,
horizontal and vertical profile of works, detailed engineering report & detailed construction
methodology in accordance to Article 12.1 of Concession Agreement.
8.9.1Programme of Works:-
The Concessionaire has started the work at site but the pace of work is very slow details in page no 53
to 55
8.9.2O&M Works:-
The most important activity to take up and complete is shoulder filing & improving the riding quality,
cleaning of rains spouts, cleaning of chutes, debris removal, BC/DBM/over lay on the very rough
surface, PQC repair. The concessionaire must ensure that the MCW and service road surface is
maintained in traffic worthy condition round the clock.
Other O&M activities are being carried out very slowly. Repair of the rutting areas is taken up but the
progress is slow & works are being carried out without following proper methodology and
MoRT&H/IRC guidelines. Metal beam crash barrier are damaged at several locations and become a
safety hazard for the road users as the pedestrians and two wheeler riders are crossing the roads from
these locations. Also, beam sections are missing at some locations eliminating, protecting for bearing
traffic and also allowing pedestrians to cross the roads at limited sight distance Zones putting their
lives in danger. Concessionaire should take remedial steps to repair/replace damaged metal beam
barriers immediately.
Independent Engineer has been informing and reminding Concessionaire about their obligations
regarding O&M activities to be carried out as per Concession Agreement relevant clauses. The
concessionaire needs to accelerate O&M activities.
Toll fee collection work to be supervised properly. All the automation activities are to be expedited.
At both the two plazas, Medical Aid post & Traffic Aid post are set up by the concessionaire but these
are not fully equipped and furnished till now.
Bridge/structures inspection must be carried out and report to be submitted to Independent Engineer
for review.
The route patrol vehicles, ambulances & cranes must be maintained properly and number of these
vehicles to be increased as per Concession Agreement requirements.
8.9.3Toll Plaza:-
The general cleanliness, housekeeping, toilet facilities needs lot of improvement.
Illumination is very poor on toll plazas.
The overall maintenance is very poor.
8.9.4Traffic Aid Post/Medical Aid Post:-
The buildings are not adequately furnished as per Concession Agreement requirements. The
concessionaire needs to upgrade the same for providing proper facilities for the users. The medical aid
post is without proper furniture, the staff deployed is not professionally trained & lacks basic
infrastructure. The medical register is not updated regularly. Many life saving drugs are not there.
The Concessionaire has provided two ambulances at project site which are not adequate as per
Concession Agreement.

Route patrol vehicles are ill equipped and lack many basic items. Independent Engineer is regularly
inspecting. The concessionaire must keep the project highway in traffic worthy conditions and take
steps to improve the riding quality, traffic management; ambulances etc and fulfill the obligations as
per Concession Agreement.
8.10. Maintenance of Project Highway: -
The concessionaire has neglected the maintenance of project highway. Member (Technical), NHAI
during his inspection of the road on 23.02.2014 pointed out that due to excessive patch
work, the riding quality of the road has deteriorated at many locations and it needs
immediate renewal coat or if the Concessionaire so like, he can lay the part of proposed
overlay in the affected reaches. Accordingly, 59.20 Kms were identified by the
Independent Engineer and intimated to the Concessionaire vide this office letter no. 182
dated 10.03.2014. There was no response from Concessionaire, Independent Engineer
has notified vide his letter no. URS-RODIC/FBD/DATR/14/238 dated 27.03.2014 that in
case remedial works are not started by 03.04.2014, the Authority shall get this work
executed at the risk & cost of the Concessionaire as per Clause 17.9 of Concession
Agreement. An estimate amounting to Rs. 29.08 crore was sent to Project Director, CMU-
Mathura for his necessary action. Subsequently the Concessionaire intimated that he is
in the process of identification of affected reaches and will start the overlay work.
However, as on today, over lay has been laid in a length of less than 4 km. Since
the monsoon will be approaching after 1 months, the Concessionaire is advised
either to increase the speed of providing overlay or can carry out normal
periodical maintenance with 40mm BC
Other aspect of maintenance like removal of rain water, drain water from shoulders & MCW, removal
of debris & construction material from shoulders & MCW, removal of Cow dung from median &
shoulders, removal of posters & banners etc are also neglected.
The Concessionaire has not submitted any work-programme for completion of work as per Schedule
G required as per Clause 12.1 of Concession Agreement.

8.11. Applicability of Schedule ‘K’ Maintenance of Project Highway during Construction Period:
COD was given to Concessionaire w.e.f. 16.10.2012.
Due to one reason or the other, the highway is not being maintained by the Concessionaire in spite of
the fact that the regular monthly inspection note, indicating the short comings in the maintenance,
supported with photographs are being issued by Independent Engineer regularly.
The Concessionaire is insisting that he will follow clause 12.2 for the maintenance standard i.e. he is
bound to maintain the road in such a way that they are not materially inferior as compared to the
condition 7 (seven) days prior to the date of the agreement, however, the Concessionaire shall all the
times be responsible for ensuring the safe operation of the project highway.
Concessionaire view is not based on the true spirit of the Concession Agreement and various clauses
as explained below:
(i) The COD has been provided to the Concessionaire for operation of Highway project in terms of
Article 15.1 of Concession Agreement w.e.f. 16.10.2012 together with the appointed date and he has
been allowed to collect user fees at Toll Plaza w.e.f. 00 hrs on 16.10.2012, the appointed date.
(ii) It is pertinent to mention here that the conditions precedent have been waived by NHAI while granting
the COD for which we have not find any reason for allowing the Concessionaire to operate the 4-lane
and collect the toll w.e.f. 16.10.2012.
(iii) As per Article 15 of the Concession Agreement, once the Project Highway entered into the
commercial service on COD, the Concessionaire shall be entitled to demand and collect fee in
accordance with the provision of Article 27.
(iv)Keeping in view the order/sequence of the Articles in the Concession Agreement executed by and
between the Authority and the Concessionaire, we are of the opinion that the Project Highway starts
its operation from the commercial operation date as provided in Article 15 of the Concession
Agreement with respect to 4 lanes which is part 6 lanes of the Project Highway and the same is
required to be maintained for all the items of road.
In view of the submissions made above, we are of the view that during the
construction period of widening of existing four lane to six lane highway, all the
requirement of schedule-K (annexure-I) except the roughness criteria are
applicable.
It is pertinent to mention here that as per provision of the Concession Agreement,
highway patrol vehicles are to be provided with round the clock patrolling so as to
provide assistance to road users in case any need, Ambulance services to be provided in
such a way that response time is not exceeding more than 10 minutes and Crane are to
be provided so that these are available within 1 Hour of an accident to clear the disable
vehicle off the highway.
Concessionaire has provided only Four Route patrol Vehicles, Two Ambulance and Two
Cranes in the entire project of 180 km. length. With this no. of deployed vehicles,
response time for Ambulance will be definitely more thanOne Hour and for Crane it will
be about Four Hours. It is not understood that the Ambulance which are deployed to

attend the road accidents/victims, how the response time can be different whether
the highway is four lane or six lane.
We are of the view that the Authority may direct the Concessionaire to maintain the
road as per article-17 along with schedule-K of the Concession Agreement except the
requirement of roughness parameter.It should made clear to the Concessionaire that in
the event the project highway is not maintained as per maintenance standards given in
schedule-K than the Authority may invoke the clauses 17.8, 17.9 and 17.10 of the
Concession Agreement.
8.12. Independent Engineer views based on various provisions & spirit of Concession
Agreement
Any sub-standard curve existing on the road may be due to limitation of ROW at the
stage of 4-laning of road will have to be improved to the minimum standard prescribed
in IRC.
Required super elevation will have to be provided irrespective of exiting super elevation
at the same is very vital for safety of vehicles driving at designed speed of 100 km/hr.
To affectively drain out of the rains water & to increase the life of pavement proper
cross-fall and vertical gradient should be provided as per provision of the IRC Code.
Vertical gradient of existing road needs to be modified to the extent so that censor paver
can be effectively used for laying DBM/BC.
TCS of project highway shall be developed in accordance with the manual included in
schedule-D and Plan & Profile drawings will be prepared according to TCS.
What to talk of making improvement in the geometries of highway, Concessionaire is not even
ready to give the details of retrofitting and in the absence of which there is nothing for
Independent Engineer to review. Moreover, unless the Concessionaire provide the actual
details of longitudinal profile and cross fall/super elevation, no checking can be done at the site
of work during execution and even the FRL of widening portion of road from 4 lane to 6 lane
will depend upon the designed level of existing highway.
In view of the circumstances explained above, we had requested the Project Director to
look into the matter and intervene to resolve this controversy vide Independent
Engineer letter No. URS-RODIC/FBD/NHAI/13/360 dated 10.10.2013.

9.3 Approval GAD of ROB
This issue was discussed at length and keeping in view the following factors:
As per clause 4.5.5 (ii) of Manual for Six laning it has been mentioned that as widening and also
dismantling of bridges having T-beams for box type super structures is generally difficult and it is
advisable to go for construction of new additional bridge instead of widening the existing bridge.
Even the Railways has pointed out that existing ROBs are about 100 years old, as such putting
extra load on the existing structures which will definitely come in one way or the other is not at
all a sound proposal.
As such a unanimous decision was taken that all together a separate a new three lane ROB on one side or
two lanes ROB on each side should be constructed. Accordingly concessionaire was advised to do the
detailed survey for each ROB for working out the suitability of three lanes ROB or two lanes ROB each side
and prepare the GAD in consultation with Independent Engineer. Subsequently to Railways approval to
the GADs, the concessionaire will work out the detailed design and drawing and will submit the same to
the Authority.
9.4 Forest Clearances
(HARYANA):- Forest clearance is obtained for Haryana only. The tree cutting in Haryana section has been
started since May, 2013.
(UP):
Stage II Clearance letter issued from NHAI office on 27/08/2013. The letter is addressed to Principal
Secretary / Forest Govt. of Uttar Pradesh. The Principal Secretary after taking approval from Ministry has
to issue a Govtorder for Nodal officer and down below to initiate cutting of the trees by Forest
Corporation.
9.5 Taj Trapezoidal Zone (TTZ) Clearances
Highway stretch from km. 115+000 to km. 200.000 the permission of forest clearance within TTZ is
obtained on 13th March 2013 fromHon’ble Supreme Court.

9.6 NOC for SoorSarovar Bird Sanctuary
As per Government order for any construction with in 10 Km of Bird Sanctuary, NOC from National Wild
Life Board of MUEF is to be taken by Client. This sanctuary falls between 179.100 to km. 183.000 on LHS
and runs along NH-2. The Proposal is approved on 01/02/2013 by National Wild Life Board (NBWL) of
MoEF.
9.7 ASI Approval of Elevated Structure in Sikandara (Km 190+660 to Km 192+360)
As per ASI, the permission for construction within 100 m of ASI nominated structures/monument need to
be taken from ASI. Several structures are within 100 m of ROW. The approval is yet to be taken by NHAI.
Since the Competent Authority and ASI does not agree for the construction of Elevated Corridor in front of
the protected Monument at Sikandra, we have to abide by their suggestion otherwise the project will not
get clearance from ASI & subsequently 2nd Stage Forest clearance will not be given by Ministry of
Environment and Forest.
Commissioner Agra Division, Agra (the competent Authority, Monument Authority of India) vide his letter
No. 02/11/11-CA-129 dated 10.04.2013 has forwarded the NOC application of Project Director, CMU
Mathura for conversion of four laningto Six laning NH-2 from Ch. 20.500 to 200.000 to ease traffic
congestion on NH-2 on the report of the Committee recommending the proposal for approval.Widening
of project highway in place of construction of elevated corridor at Sikandara. The effect of
reduction in the scope of project will be assessed as per Clause 16.6 of the concession agreement
vide NHAI letter no. NHAI/NHDP-V/MC-II/Concessionaire/04/39678 dated 24.05.2013.

The Hon’ble Minister, MORT&H has desired to verify the Vehicle tracking systems installed on Incident Management vehicles viz. Ambulance, Route Patrol vehicle and Crane deployed by BOT Concessionaires& O&M Contractors. The Details of VTS for Route Patrol Vehicle, Ambulance & Cranes were requested vide NHAI HQ Letter No 39214 dated 15.05.2013.
Concessionaire has submitted the detail of VTS dated 26th

2013 and it can be traced on website

Route Patrol Vehicles & other Incident Management Vehicles are
not performing the duties as per the norms. – Live tracking facility
of incident management vehicles is not available on web site.
Moreover, the ambulances have not been provided with all
necessary medicines &equipments and are not having
trained/qualified staff.

18. Safety Requirements (As per CA-Schedule –L) 18.1 Introduction: -Road accidents are a matter of great personal tragedy, tremendous social and
economic costs in terms of valuable lives lost, medical treatment, insurance and damage to
public and private property. Although, acknowledgement of the problem has existed for
some time, the attempts to improve road safety have been half hearted and not focused on
the root of the problem.
18.2 Safety Requirements aim at reduction in injuries, loss of life and damage to property
resulting from accidents on the project Highway, irrespective of the person(s) at fault
18.3 Responsibilities of Project Directors/Independent Consultants
To regularly review the relevance and adequacy of Traffic Management and Safety Plane(s)
and Emergence Response plane(s) submitted by the concessionaire in line with the
traders/risks associated with the proposed construction activity and with regard to the
specific site condition where the activity has been proposed.
To ensure that the permission including approval of Request for Inspection (RFI), to
commence an activity/ operation is given only after the Independent consultant is satisfied,
after site verification with the compliance of safety requirements (implemented by the
concessionaire).
Conduct regular site inspections (includes daily, weekly and monthly site inspections/ visits
including some during night) to verify whether the safety measures provided, at the time of
work Initiation, are being maintained property by the Contractor. All major observation of
such visits shall be recorded in the Site Instruction Book.
Issue written warnings / memos, as required (based on site inspections) to inform the
concessionaire about any deficiencies/lapses that need to be rectified within a specified time
limit the IE will also intimate the action that will be taken if the non-compliance persists . A
maximum of three warnings will be issued for any non-compliance that is not life threatening
after which the IE will take appropriate action in line with the contractual provisions. In cases
where non-compliance on part of the Contracture is creating life threatening situation, the IE
shall immediate remedial measures by the Concessionaire.
18.4 It has also been decided that IEs& PDs would give ratings of the Concessionaire as per the
sample criteria enclosed and furnish a safety report on monthly basis to GM (Safety), NHAI,
New Delhi so as to reach NHAI HQ by 5th of the following month (the report should be
prepared after the end of the month end not by 25th or 26th of the month). In case of
unsatisfactory ratings or persistent defaults of the concessionaire, IEs and PDs should
propose appropriate actions on the contractors as per provisions of the contract agreements.
The monthly safety report should cover the following aspects:-
18.5 Details of site visits undertaken by PD to examine worksite safety measures, report of such
visits sent to the Consultant, items/minutes on items in Monthly Review Meeting on worksite
safety.

18.6 Independent Consultants should conform that
The responsibilities of various members of his team were specified on worksite safety.
Traffic management Plan/ Safety Plan/ Emergency response plan of all sites where work is
taken up during the month were reviewed.
Approved RFIs to commence work at all sites during the month only after verifying/
satisfying with safety measures provided by the contractor.
Proper maintenance of safety measures by the contractor was examined and recorded in
“site Instruction book.”
List of letters written to the contractor on deficiency/ lapses on worksite safety and list of
replies of the contractor on each letter of the consultant (only list is to be given, not the
copies of the letters).
18.7 In connection with the life threatening situations mentioned in above paras, the
following examples are given:
Excavations deeper than 1.2metere without proper barricading, warning and night time
safety measures.
Lack of provision of signage and barricading and/or delineation at temporary ‘diversions’.
Non-availability of minimum 5.5 meter width of all weather road surfaces for two way
movement of traffic along with the required passing places as per the length of the work
front.
Formwork of superstructure not provided as per approved design of the temporary
structure.
Lack of safety measures at structure constriction sites. This includes:
(a) Traffic operation near half done structures with protruding steel bars/reinforcement
without safety measures.
(b) Diversion of traffic through the spans of the partly completed structures without
proper safety arrangements.
Working at heights without proper safety measures (such as safe ladder and working
platform) and without use of personal protective Equipment (such as safety belts/harness,
etc. As applicable).
Working around electrical lines without safety precautions.
Improper transportation, storage and use of inflammable materials such as lubricants,
diesel, gas cylinders and other such chemicals/materials.
Note
The specific provisions in the contract shall prevail over the above examples.
The above list intend to provide examples of typical situation operations could lead to life
threatening situation, However, each site may offer specific challenges (could be due to
topography, density of human population, nature of human activities in the surrounding
area, nature and extent of construction activity etc.), which need to be kept in mind when
the IE/PIU assesses the risks and hazards to human life.

The Engineer/Independent Consultant must be proactive and allow opening of work
fronts/operations only after satisfactory safety measures are in place.
The provision of safety devices and measures (both in terms of number and quality) must
to be required specifications that including IRCs SP: 55 (2001).
Visibility of safety signage and other devices needs to be ensured at all work fronts both
during the day and in the night.

21. Change of Scope
21.1 Land Acquisition in Agra City from Km 192+300 To Km 200+000
It has been decided not to acquire the land in Agra city from km 192+300 to 200+000
vide Letter No NHAI/CMU/MTR/6-lanning/2011/D-26044 dated 18.08.2011
Land acquisition in Agra city the competent authority has decided to annul 3A
notification published towards acquisition of land in the city of Agra between the stretch
Km 192+300 to Km 200+000.
21.2Elevated Highway at Sikandara190+660 to 192+100 4 Lane Viaduct
Widening of project highway in place of construction of elevated corridor at Sikandara.
The effect of reduction in the scope of project will be assessed as per Clause 16.6 of the
concession agreement vide NHAI letter no. NHAI/NHDP-V/MC-
II/Concessionaire/04/39678 dated 24.05.2013. (From NHAI/ letter no.32528,
dated06.06.2013).
21.3The Proposal is approved on 1/2/2013 by NATIONAL WILD LIFE BOARD
(NBWL) of MoEFhas approved the proposal as per letter no. NHAI/CMU/MTR/6-
Laning/2013/D-32323 dated 15.05.2013
The Member Secretary informed the Committee that the proposal was for widening and
improvement of 6-laning of Delhi-Agra section of NH-2 from Km. 20.500 to Km.
199.000 by M/s NHAI and that as per the proposal, the portion of NH-2 from Delhi to
Agra is already having 4-lane divided carriageway configuration and that the corridor has
been identified as one of the faster growing economic corridor and therefore, from the
safety point of view and growing traffic requirements, a smooth uninterrupted flow of
traffic through this corridor was left necessary. Accordingly capacity augmentation of the
existing 4-lane divided highway to 6-lane divided highway under DBFO scheme has been
proposed. He also added that as per the project proposal the project road (i.e. NH-2) is an
existing highway with Right of Way (ROW) of 40 to 60 m and the widening is proposed
only within this ROW of 60 m. Therefore, additional 3-4 m of wide side strips will be
required on both sides all along the road.

After discussions, the Committee recommended the proposal subject to the following
conditions as stipulated by the Chief Wildlife Warden, Uttar Pradesh:
i. Construction debris will be disposed off outside the sanctuary area at a safe
distance.
ii. There should be safeguard measures against noise pollution.
iii. Melning, storage and mixing of caoltar should be at a safe distance from the
sanctuary.
iv. Requirement of firewood for labourers shall be met by purchasing it from Forest
Corporation and no firewood shall be collected from the nearby forest area.
v. No work shall be allowed between sunsets to sunrise, near the sanctuary area.
vi. Restriction of speed on vehicles will be put with speed breakers with florescent
paints near the sanctuary.
vii. A7 (seven) ft. high wall should be constructed by thr NHAI along NH-2
between Km. 179 to Km. 183on the side of sanctuary area to prevent accident
related death of the wild animal and as a noise barrier.

Review of Plan & Profile and Typical
Cross
Lot of correspondence has exchanged between Independent Engineer and Concessionaire in regard to submission and review of Plan & Profile and Typical Cross Sections. Somehow or the other, the submission made by Concessionaire do not qualify for review by Independent Engineer in the interest of safety and serviceability of the proposed six lane project and also does not conform to the various provisions of Concession Agreement . In view of the circumstances explained in letter, we request the Project Director to look into the matter and intervene to resolve this controversy.

Maintenance of the
Project Highway
We are of the view that the Authority may direct the Concessionaire to maintain the road as per article-17 along with schedule-K of the Concession Agreement except the requirement of roughness parameter. It should made clear to the Concessionaire that in the event the project highway is not maintained as per maintenance standards given in schedule-K than the Authority may invoke the clauses 17.8, 17.9 and 17.10 of the Concession Agreement.
