In a move that went relativelyunnoticed amidst the furore of the expenses scandal, thegovernment recently publishedproposals to change the waythe private rental sector ismanaged. These proposals,which include plans tointroduce licensing for alllandlords and the regulation of all lettings agents, came inlight of the Rugg review, areport into the private rentalsector undertaken by theCentre for Housing Policy atthe University of York. Somecritics believe the move, which

Cara Bailey, office and accounts manager at City Residential, took a detour fromstudying sports development to discover herflair for property. Cara has been thriving in the city centre office now for five years.

How did you get into property?I was working at a sandwich shop opposite the CityResidential offices whilst finishing off a university coursein sports development. People from the City Residentialoffice came in for lunch. I discovered that there were jobvacancies available. I applied for a job as office junior, butonly did it for a week before I was moved to the lettingsside of the company as a property manager.

How has your role progressed?Six months later I was promoted to lettings advisor, andthen began to do accounts for the lettings department. I now manage accounts for the whole company and have been promoted to office manager. I also run thefurnishings side of the business which includes interiordesign of apartments for sale or let, as we are able toprovide full packs for landlords, investors, first timebuyers or serviced apartments.

What would be on your summer wish list?I would love some air tickets for my boyfriend andI to jet off to Cyprus or Egypt. It would be great to get a tan, enjoy the sun, sea, and sip some strawberry Daiquiricocktails whilst sampling the nightlife!

Q. I own a successful retail business, trading as a limitedcompany, which I am planning to sell in a few years time. Theproperties which the business uses are owned personally by me,and the business pays me rent. I was banking on only paying10% tax when I sold the business and properties but someonehas told me the rules have changed. What is the position?

A. When the Chancellor originally announced the New Entrepreneurs’relief in early 2008, the rules contained a number of importantdifferences from the old ‘Taper Relief’ regime. One of those related toproperty (usually land and buildings, but also occasionally plant andmachinery) held outside the business.

Under the old Taper relief rules, subject to all other conditions beingmet, disposal of these assets would attract tax of only 10% even if theyhad been let to the business throughout the period of ownership at fullmarket rent. Holding assets in this way and charging rent became acommon set-up because it minimised tax through the life of thebusiness and also eventually upon its disposal.

This changed in April 2008, because the new Entrepreneurs’ Reliefregime treats such assets as ‘investments’, i.e. owned personally and letat full market rent by the owner, which means they no longer qualifyfor relief.

Q. Is there anything I can do now to improve my position?

A. Potentially yes. The new rule is that that if a property is let to thebusiness for rent then only the rent paid on or after the 6 April 2008will be taken into account and also the extent to which the rent paidfalls short of the full market rent will also be taken into considerationin the calculations.

In your case, if the property will be sold at the same time as thebusiness and you will not utilise your £1million Entrepreneur’s Relieflimit against the business itself, then you may need to stop chargingrent as soon as possible. You should speak to your accountant or taxadvisor as soon as possible – as always good advice will be critical tooptimise your position.

Q I am a landlord with a residential investment property.

I acquired this with a buy to let mortgage. The property has

tenants occupying it under an assured shorthold tenancy

agreement. I am in arrears with my mortgage and the

mortgage company is threatening to take possession

proceedings. Where do I stand?

A This raises two issues. The first is the possession claim by

the lender. The second is the issue with your tenant.

Dealing with the mortgage company first. There are some

things that you can do if you are in trouble paying your

mortgage. There are various guidelines which have been

produced and the lender is expected to comply with these

guidelines. If the lender does not comply, or is otherwise

unreasonable in pursuing a possession claim then you can

tell the Court about this. In addition, most lenders have

agreed with the government not to bring possession

proceedings unless the mortgage is at least three months in

arrears. However, this does not apply to all mortgages and

does not apply to all lenders.

You should try and negotiate with the lender to come to

an arrangement for the payment of any outstanding arrears

as soon as possible. The lender is under an obligation to

consider all reasonable offers. This includes an offer to pay

the arrears over the whole of the remaining term.

The situation with the tenant is more complicated.

Although there is an assured shorthold tenancy agreement,

the mortgage company can apply to the Court to try and

take possession and sell the property and to remove the

tenants. The judge who would eventually hear the case does

have discretion to evict the tenants although it will depend

on the facts of each case. For example some mortgage

lenders require consent forms to be signed and the

individual facts and evidence on each case will have to be

considered. You would need to take independent legal

advice as soon as possible to deal with both the claim by the

mortgage company and to deal with the tenant.

What attracted you toMontreal Gardens?My sister showed me thehouse. She lives in thedevelopment and she’s reallyhappy here. We’ve been living with Mike’s mum inKensington for the last twoyears but really wanted a placeof our own. It’s nice to be in our own new build.

What do you think of the house?We looked at older propertiesfirst but they needed such a lot of work doing and loads of money spending on them.Everything is pretty much the way we want it here.

How is the ground floor laid out?As you enter through thehallway the kitchen is on theleft and the living room is tothe right hand side. Ahead ofyou is the downstairs WC.

Do you have any outdoorspace?We have patio doors leading to quite a big garden at theback. We’ve got a lot of spaceto work with, so mypartner is goingto put indecking and arockery area. At the frontthere are bark chippings and a small lawn.

Take us into the kitchen...It’s a fully fitted kitchen, with black flooring and work surfaces, wooden unitsand a nice chrome sink.

First time buyers Sam Foley, 22, and Mike Benson, 25, recently moved to a threebedroom end terrace property in the MontrealGardens development in North Huyton. Sam, a hairdresser, and Mike, a council refuseworker, secured the house through GleesonHomes’ shared equity deal – paying 75 percent of the property value up front, with theremainder secured by a 10 year equity loan.

Tell us about the masterbedroom...We have magnolia colouredwalls and cream carpets whichare consistent with the rest ofthe house. There are featuredpictures on one of the walls, my favourite of which is thelandscape of trees we boughtfrom Matalan.

Any plans for the spare rooms?The smaller room is where I do all my ironing so I supposeit’s a sort of utility room! We’re planning to turn it into a nursery when we have kids.The other room is for anyone who stays.

And the bathroom?The bathroom has a stone effect wall and floortiles with lovely white units.There’s a bath, shower, toilet,sink and a black mosaic mirrorwe bought in IKEA.

What would be your dream buy?I’m not too sure about that as I think we have everything weneed! I think a wet room wouldbe nice though.

What’s your theme?Orange and black are the predominant coloursin the living room. We’ve got a large black vasewith big orange flowers on it. On one wall we’vehung a picture of a lake and the other features aphotograph of black and white boats, so it’s gota bit of a waterside theme.

For the majority of those who grew up in the ‘80s, the loud shirts andwacky antics of Timmy Mallett will be entrenched in their minds forever. The ‘Wacaday’ presenter was the main attraction for young viewersduring their summer holidays, and evenmanaged to secure a place at the top of the charts with an infamous songabout a polka dot bikini. Years later he was thrust back into the nationalconsciousness with an appearance on‘I’m a Celebrity...Get Me out of Here!”and now the man with the mallet is inLiverpool to raise funds, and the roof,for the disability charity Children Today.

What brings you to the city?I’ll be up to host ‘It’s aKnockout’ at the RiversdalePolice Club to raise funds forChildren Today. It’s a fun gameif you don’t mind gettingsoaking wet and covered infoam. My role will be thewielder of the mallet. I wasthere last year and I’m thrilledto bits to be doing it again. It’s guaranteed to be a day of good fun.Tell us a little about thecharity...I’ve been involved with themfor 18 months and I’m veryimpressed by their dynamism.What I like about them is thatthey help kids straight awayand they focus on what’sneeded now. The children needany help they can get and it wasgreat that I could raise £20,000for them when I was doing ‘I’m a Celebrity’.Do you like getting out andabout around the country?I love it. Whether it’s doing a show, something for charity,or hosting an art exhibition,

I feel that I’m a very lucky manbecause I get to travel all over.In fact my many trips are where I find the inspiration for my art.You’ve developed a growingreputation as an artist. Howlong have you beenpainting?I’ve always loved art. I used totake the paints on Wacaday butnow I can put a bit more timeand effort into it. That doesn’tmean I’m a bore with it, I canjust give it a bit more focus. Iheld a recent exhibition of myacrylics and water colours inEssex which was reallyenjoyable and I’ve got anotherexhibition coming up inEccleston. People don’t oftenrealise that I’m an artist.Is painting a way to relax?No, I don’t find it relaxing. It’sa lot of hard work and all aboutconcentrating the mind tomake sure you’ve got it right.These things don’t necessarilycome easy.Who’s your inspiration?Rolf Harris and I are good

mates. We speak on an almostdaily basis. In fact, his is thenext call I’ll make today before he goes off to play atGlastonbury.Which entertainers do youadmire at the moment?CBBC have a number of greatshows and I like a lot of thedouble acts such as ‘Dick andDom’ and ‘JK and Joel’. We’vegot a lot of new talent comingthough and we shouldencourage it.What’s been the highlight of your career?I think ‘Itsy Bitsy’ getting tonumber one was pretty amazingand I also love the fact that mypaintings are so warmlyreceived. What’s been your mostmemorable moment intelevision?Bashing Margaret Thatcherwith the mallet has to be upthere. I met her when she wasprime minister and she reachedfor the mallet and asked, “Whatdoes this do?” I just let herhave it.What was the jungleexperience like?I enjoyed it. I love the greatoutdoors. The deprivation isquite entertaining. You do gethungry and tired but that’s theeasy bit. The hardest part isdealing with the other people.It isn’t easy but of course whenyou are watching it’s hilarious.I do like to have a laugh, somoments like Kilroy gettingcovered in gloop keep youentertained.What’s next for you?I’ve become a patron at StDeiniol’s Library in Hawardenthrough a family connection.It’s the only prime ministeriallibrary in the UK and wellrenowned internationally. I’vebecome involved in raisingmoney for a new addition to thelibrary – an Islamic ReadingRoom and Religious ResourceCentre. Our feeling is that inthis day and age we need somesort of understanding with eachother. I think we should all begetting on with each other

because you never know whenit’s going to end.Any plans to do panto this year?I’d like to do panto again thisyear but the family are comingfrom all over the world to enjoya Hogwarts style Christmas ascaretakers at St Deiniol’s. I’ve recently moved, and the bathroom really needs decorating.There are some exposed pipes in one corner, which look really ugly!Do you have any ideas on how to disguise these?

Boxing in is usually the best way to hide exposed pipes. The job is quite simple to do yourself if you are good at and confident inyour DIY skills, but if not I would recommend using a good joiner,as the joints need to be as neat as possible for the new addition to merge as part of the wall. If you’re attempting the job yourself, I would use plywood and be as accurate with the measurements as possible. If you have trouble getting the edges to fit smoothlyagainst the wall, use a good quality filler. Finally I would paint the boxing in the same colour as your walls to disguise those pipes completely!

I’m living in a rented apartment in town. My landlords arefantastic but have said that if I make any changes to theapartment, I would have to make good before I leave in order toreceive my full deposit. The walls in the apartment are paintedwhite, and I would like to add some colour or pattern withoutspending a great deal of money or causing any damage to theproperty. Do you have any ideas?

2009 has seen some really good decorating devices coming ontothe cheaper end of the home decorating market. Colourful,decorative wall stickers could be an ideal solution. The graphicstickers or decals are available to suit every room. They are perfectfor use in rented accommodation as most can be fixed andremoved from the walls without any damage to paint work, but please read the manufacturer’s instructions to check first. I would have a look at companies such as Rockett St George,Brume and B&Q to find your personal favourite.

For a simple arbour design, digthe postholes around 30 inchesdeep in your chosen locationand fill the first few inches withgravel for drainage. Plumb theposts with a level and hold inplace with foundation stakesbefore setting in concrete.When the concrete is dry pullout the foundation stakes andtop the holes with gravel.Attach the beams with stainlesssteel washers and screws and do the same with thecrosspieces, spacing themevenly on top. Make the arbourmore attractive by first cuttingan interesting design into theend of each beam andcrosspiece.

The newly refurbished Swan Innin Aughton has been drawingattention for its interior fit-out,and is also enjoying a warmreception for its fresh, cooked-on-the-premises, locally sourcedproduce, and traditional ales. The drive to Aughton, nearOrmskirk, where I meet MikeBlack of Blacks Estate Agents,offers a welcome rural retreatfrom the city and from Mike’sBootle office, where he’s beenbased for five years now.Covering the area betweenKirkdale, Crosby and Aintree,Blacks sells houses from thelower end of the marketupwards, catering for first timebuyers and expanding families,right up to more expensiveproperties. Sales have beencoming in pretty quickly of late:“Things have been picking up agood deal. Dealing for the mostpart with cheaper properties, mybusiness hasn’t been as badlyaffected as others’, but it isstarting to move more quicklyagain now.” With four staffmembers in the Bootle office andworking in partnership withPlatinum lettings agents, Blacksis the first port of call for sales inthe north Liverpool area, with a

particular appeal for first timebuyers and those requiring a onestop shop, in-house service.

Mike opts for the Thaifishcakes to start, which arrivein a portion of three withchopped fresh peppers and salsa.I choose the Bury black puddingwhich, I’m told, uses the headchef ’s spice mixture in itsrecipe, topped with bacon and a fried egg. We choose to shareand sample the adventurouscombination of cultures as wediscuss Mike’s varied career,which has seen him work inhospitality in Tenerife beforechoosing to get into property.From joining Collertons as atrainee manager, Mike quicklyrose through the ranks tobecome area manager forLiverpool running eightbranches: “When it came tosetting up on my own andconcentrating on just onebranch it was obviously a newbusiness challenge and agamble, but I knew I had theexperience behind me to makeit a success.”

For our main course, I opt for the short crust chicken pie,served with mash and steamedvegetables, while Mike is

tempted by the fresh salmonfillet, served on a bed of puréedmash and fine green beans.Head chef Robbie informs usthat all the vegetables are locallygrown and that everything isprepared on the premises – as all good pub food should be.

Blacks is also part of TheHome Market on Marion Squarein Netherton, which sees estateagents from across the area cometogether in a joint venture tooffer properties, financial andlegal advice, HIPs andconveyancing, under a singleroof. It’s a move which has seenSefton businesses decide to worktogether for mutual benefit. Inhis spare time, Mike likes towrite short stories and poems,and enjoys training for theannual Sefton Triathlon whichhe supports each year. He says:“It’s a brilliant community eventwhich I’m really proud to be partof, and everyone says that afteryou’ve been once to watch ortake part, you can’t help but getthe bug.” He hopes to continuecontributing to the eventsponsorship next year but for now, with the marketpicking up, he’s certainly got plenty on his plate.
